HB 13 – Distracted Driver Amendments House Filed – Not Carol Support - https://le.utah.gov/~2019/bills/hbillint/HB0013.pdf Passed Spackman UASD This bill: 1) defines terms related to the operation Moss Amended of handheld wireless communication devices; 2) prohibits certain uses of a handheld wireless communication device while operating a motor vehicle on a roadway; 3) provides limited exceptions to the prohibition on the use of a handheld wireless communication device while operating a motor vehicle on a roadway.

HB 24 – Property Tax Exemptions, Deferrals, and Governor Signed Tracking Abatements Amendments https://le.utah.gov/~2019/bills/hbillint/HB0024.pdf This bill: 1) defines terms; 2) repeals outdated provisions related to property tax exemptions, deferrals, and abatements; 3) reorganizes, redrafts, and updates existing provisions related to property tax exemptions, deferrals, and abatements; 4) broadens the appeal right for a person who is dissatisfied with a tax relief decision; 5) allows an armed forces property tax exemption regardless of when the claimant had ownership of the property during the year the exemption is claimed; and 6) makes technical and conforming changes.

HB 30 - Utah Retirement Systems Amendments Governor Signed Adam Support - https://le.utah.gov/~2019/bills/hbillint/HB0030.pdf Robertson UASD This bill: 1) increases the number of members Amended serving on the Membership Council; 2) amends the powers and duties of the Utah Retirement Systems' executive director; 3) modifies provisions allowing the calculation and payment of benefits pending settlement of a dispute; 4) clarifies the availability of certain retirement allowance payment options; 5) amends how the service status of certain justice court judges is established; 6) specifies additional names for the Tier II retirement systems and plans.

HB 31 – Water Supply and Surplus Water Governor Signed Support Amendments https://le.utah.gov/~2019/bills/hbillint/HB0031.pdf This bill: 1) defines terms; 2) describes the process by which a municipality may provide water to customers outside the municipality's political boundary; 3) states that a municipality may not sell the municipality's waterworks, in whole or in part, except as provided in statute; 4) creates reporting requirements; and 5) makes technical changes.

HB 32, 1st Substitute – Rulemaking Fiscal Governor Signed Support Accountability Amendments https://le.utah.gov/~2019/bills/hbillint/HB0032S01.pdf This bill: 1) provides for review and Legislative approval of certain Water Quality Board rules or standards; 2) requires an agency to submit certain proposed rules to an appropriations subcommittee and interim committee for review before the agency enacts the rules; 3) requires certain notification to the Administrative Rules Review Committee regarding the review of a rule in certain circumstances; 4) amends the duties of the Administrative Rules Review Committee.

HB 34 – Campaign Finance Amendments House Filed – Not Tracking https://le.utah.gov/~2019/bills/hbillint/HB0034.pdf Passed This bill: 1) clarifies and modifies financial reporting requirements for a political action committee; 2) enacts penalties for failure to comply with political action committee financial reporting requirements; and 3) requires a corporation to make financial disclosures for certain donations made to

the corporation with the knowledge or intent that the donated money will be used by the corporation for political purposes.

HB 37, 2nd Substitute – Reauthorization of Hospital Governor Signed Tracking Provider Assessment Act https://le.utah.gov/~2019/bills/hbillint/HB0037S02.pdf This bill: 1) repeals and reenacts the Hospital Provider Assessment Act with a retrospective effective date; 2) amends provisions relating to the calculation of hospital provider assessment rates; and 3) extends the sunset date for the Hospital Provider Assessment Act for five years.

HB 54 – Fire Code Amendments Governor Signed James Support https://le.utah.gov/~2019/bills/hbillint/HB0054.pdf Dunnigan This bill: 1) adopts the 2018 edition of the International Fire Code, with amendments; 2) adopts the 2016 edition of the National Fire Alarm and Signaling Code, with amendments; and 3) adopts the National Fire Protection Association's 2016 edition for the Installation of Sprinkler Systems.

HB 56 – Employers’ Reinsurance Fund Governor Signed James Tracking Amendments Dunnigan https://le.utah.gov/~2019/bills/hbillint/HB0056.pdf This bill provides that after the state pays all liabilities to be paid from the Employers' Reinsurance Fund, the Division of Finance shall transfer any remaining assets to the Uninsured Employers' Fund.

HB 57, 5th Substitute – Electronic Information or Data Governor Signed Craig Hall Tracking Privacy https://le.utah.gov/~2019/bills/hbillint/HB0057S05.pdf This bill: 1) defines terms; 2) requires issuance of a search warrant to obtain certain electronic information or data; 3) addresses notification that electronic information or data was obtained; 4) provides for transmission of electronic information or data to a remote computing service, including restrictions on government entities; 5) provides that the individual who transmits electronic information or data is the presumed owner of the electronic information or data; 6) provides for the exclusion of electronic information or data obtained without a warrant.

HB 59 – Government Enterprise Amendments House Filed – Not Adam Oppose https://le.utah.gov/~2019/bills/hbillint/HB0059.pdf Passed Robertson This bill: 1) requires a city or a county, before authorizing a competitive activity involving recreation or entertainment, to: a) conduct a market study; b) notify private entities that the competitive activity impacts; and c) present the results of the study at a public hearing.

HB 61 – State Databases Amendments Governor Signed Support https://le.utah.gov/~2019/bills/hbillint/HB0061.pdf This bill: 1) encourages counties and municipalities to receive a recommendation from the public safety answering point before approving a plat; 2) requires counties and municipalities to submit, to the Automated Geographic Reference Center, information for inclusion in the unified statewide 911 emergency service database; 3) requires the State Geographic Information Database to contain certain information regarding each public highway in the state; 4) requires conformity to the Utah Coordinate System by a specified date.

HB 62 – Correctional and Peace Officer Governor Signed Paul Ray Support Amendments https://le.utah.gov/~2019/bills/hbillint/HB0062.pdf This bill: 1) increases the penalty for assault committed by a prisoner against an officer, or an employee or volunteer, including a health care provider, when the prisoner propels a substance or

HB 63 – Local Government Financial Amendments Governor Signed Stephen Support - https://le.utah.gov/~2019/bills/hbillint/HB0063.pdf Handy UASD Bill This bill: 1) encourages a local district with a certain budget to obtain liability insurance; 2) modifies the balance a local district may accumulate in the district's general fund.

HB 64, 3rd Substitute – Lobbyist Expenditures Governor Signed Michael McKell Tracking Amendments - UASD https://le.utah.gov/~2019/bills/hbillint/HB0064S03.pdf Amended This bill: 1) defines terms; 2) modifies provisions relating to an approved activity; 3) requires a lobbyist to file certain reports related to the lobbyist's expenditure on a local official or education official; 4) establishes limits for a lobbyist's expenditures on a local official or education official; 5) establishes provisions for the disposal of a publication that qualifies as an expenditure; 6) establishes criminal and civil penalties; 7) grants rulemaking authority to the director of elections within the Office of the Lieutenant Governor; and 8) makes most of the provisions of the Lobbyist Disclosure and Regulation Act applicable to expenditures for a local official or an education official by incorporating those provisions into a Local Government and Board of Education Lobbyist Disclosure and Regulation Act.

notices; and 4) makes technical and conforming changes.

HB 70 – Community Reinvestment Agency House Filed – Not Kim Coleman Tracking Modifications Passed https://le.utah.gov/~2019/bills/hbillint/HB0070.pdf This bill: 1) removes provisions that prevented the creation of an economic development project area after 2016; 2) allows an economic development project area to receive tax increment through an interlocal agreement between a taxing entity and the agency; 3) addresses measurement of the project area funds collection period; 4) requires a community that creates an agency having a housing allocation from tax increment to create an affordable housing plan; 5) allows an agency to use the agency's housing allocation to implement the affordable housing plan; 6) requires a description of how an agency used the agency's housing allocation in the agency's annual budget report; 7) imposes certain requirements on jobs that will be created for post-performance distribution; 8) for urban renewal project areas, removes the option to reduce the agency's housing allocation; 9) requires an agency to start distributing the agency's housing allocation held from project areas created in the past.

HB 72, 1st Substitute – Local District Board Governor Signed Stephen Support – Amendments Handy UASD Bill https://le.utah.gov/~2019/bills/hbillint/HB0072S01.pdf This bill: 1) amends provisions related to a county legislative body appointing one of the body's own members to the board of trustees of a local district in certain circumstances; 2) establishes the procedure for filling open board member positions when the number of board members increases; 3) addresses when the term begins for a board member who joins a board because the number of board members increases; 4) requires adjusting the lengths of terms of new board members who join a board because the number of board members increases to ensure that term expiration occurs biannually; 5) clarifies a provision related to a county or municipal legislative body that serves as the local district board of trustees; 6) addresses the entity that appoints members to a mosquito Page 7 of 55 UASD Legislative Update

abatement board of trustees; 7) requires certain notice in the event of a vacancy on a local district board of trustees.

HB 74, 2nd Substitute – Open Meetings Amendments House Filed – Not Support - https://le.utah.gov/~2019/bills/hbillint/HB0074S02.pdf Passed UASD This bill modifies the purposes for which a closed Bill meeting may be held to include the purpose of discussing a protected audit report that requires the public body's signed response.

HB 78, 3rd Substitute – Federal Designations Governor Signed Carl Albrecht Tracking https://le.utah.gov/~2019/bills/hbillint/HB0078S03.pdf This bill: 1) defines terms; 2) requires a governmental entity that is advocating for a federal designation within the state to bring the proposal to the Natural Resources, Agriculture, and Environment Interim Committee for review.

HB 79 – Interlocal Provision of Law Enforcement Governor Signed Tracking Service https://le.utah.gov/~2019/bills/hbillint/HB0079.pdf This bill requires that an interlocal agreement between a county and one or more municipalities to provide law enforcement service requires or appoints a certain individual to provide or direct law enforcement service, depending on the county classification.

HB 85 - Political Subdivision Boundary Shift Governor Signed Jeffrey Tracking Amendments Stenquist https://le.utah.gov/~2019/bills/hbillint/HB0085.pdf This bill requires a county that proposes a minor adjustment to the county's boundaries to provide certain notification to certain political subdivisions.

HB 86 – Service Area Board of Trustees Governor Signed Steve Waldrip Support Amendments https://le.utah.gov/~2019/bills/hbillint/HB0086.pdf This bill: 1) allows a municipal governing body to petition to appoint a member of a service area board of trustees in certain circumstances; 2) provides for the appointment and term of a municipal governing body appointee on a service area board of trustees; 3) allows a service area

board of trustees to rescind the board's approval of a municipal petition to appoint a member of the board.

HB 91, 1st Substitute – Agricultural Land House Filed – Not Tracking Amendments Passed https://le.utah.gov/~2019/bills/hbillamd/HB0091S01.pdf This bill directs the Department of Agriculture and Food to conduct a study identifying and classifying private agricultural land.

HB 94 – Weapons Restrictions Amendments Governor Signed Norman Tracking https://le.utah.gov/~2019/bills/hbillint/HB0094.pdf Thurston This bill: 1) eliminates the current exemption that allows a peace officer to carry a dangerous weapon while intoxicated; 2) clarifies that carrying a dangerous weapon that is securely encased or not readily available is not prohibited; 3) modifies the law to respect an individual's constitutional right to self defense; and 4) provides an exception for an individual who carries a dangerous weapon on private property with the consent of the owner.

HB 96, 4th Substitute – Nighttime Highway Governor Signed Kay Tracking Construction Noise Amendments Christofferson https://le.utah.gov/~2019/bills/hbillint/HB0096S04.pdf This bill: 1) modifies definitions related to nighttime highway construction; 2) allows a local jurisdiction to request mitigation for unreasonable noise disturbances caused by nighttime highway construction; and 3) makes technical changes.

HB 99, 2nd Substitute – Catastrophic Wildfire and Governor Signed Ken Ivory Support Other Public Nuisance Revisions after https://le.utah.gov/~2019/bills/hbillint/HB0099S02.pdf Amended This bill: 1) expands notification requirements; and 2) provides that, under certain circumstances, the state shall indemnify, defend, and hold a chief executive officer or county sheriff harmless from any claims or damages, including court costs and

attorney fees that are assessed as a result of the chief executive officer's or county sheriff's action in abating a catastrophic public nuisance subject to a cap.

HB 100, 3rd Substitute – Sexual Violence Protective Governor Signed Lowry Snow Tracking Orders https://le.utah.gov/~2019/bills/hbillint/HB0100S03.pdf This bill: 1) defines terms and modifies definitions; 2) creates a sexual violence protective order and an ex parte sexual violence protective order; 3) establishes procedures for the application, modification, and enforcement of a sexual violence protective order and an ex parte sexual violence protective order; and 4) requires that a sexual violence protective order and a dating violence protective order be placed on the statewide warrant system.

HB 119, 4th Substitute – Initiatives, Referenda, and Governor Signed Tracking – Other Political Activities UASD https://le.utah.gov/~2019/bills/hbillint/HB0119S04.pdf Amended This bill: 1) defines terms; 2) provides for the publication of a proposition information pamphlet to inform voters of arguments for and against proposed and pending local initiatives and referenda; 3) amends provisions relating to a local voter information pamphlet; 4) enacts provisions for holding a public hearing to discuss and present arguments relating to a proposed or pending local initiative or referendum; 5) requires the lieutenant governor to create instructional materials regarding local initiatives and referenda; 6) modifies requirements relating to local initiatives and referenda, including: a) petition, petition circulation, and petition signature requirements; b) timelines; and c) appeals and other challenges; 7) enacts provisions relating to determining whether a proposed initiative or referendum is legally referable to voters; 8) amends provisions regarding the use of email, and the expenditure of public funds, for political purposes relating to proposed and pending initiatives and referenda; 9) requires certain municipalities to establish voter participation areas; 10) modifies signature requirements for a local initiative or referendum; 11) establishes procedures and requirements relating to a referendum for a local land Page 10 of 55 UASD Legislative Update

use law; 12) modifies a referendum petition and signature sheets for a local referendum; 13) amends provisions relating to unlawful verification of a local referendum packet; 14) modifies signature submission requirements, and signature removal procedures and requirements, relating to a local referendum; 15) amends provisions regarding the use of email, and the expenditure of public funds, for political purposes relating to proposed and pending local initiatives and referenda; 16) regulates the dissemination of information regarding a proposed or pending initiative or referendum by a county or municipality.

HB 120, 6th Substitute – Student and School Safety Governor Signed Raymond Tracking Assessment Ward https://le.utah.gov/~2019/bills/hbillint/HB0120S06.pdf This bill: 1) amends provisions of the International Fire Code related to routine emergency evacuation drills; 2) directs the Department of Public Safety to employ a public safety liaison; 3) directs the State Board of Education (Board) to establish policies and procedures for student resource officers; 4) creates the Student Safety and Support Program; 5) requires the Board to develop model policies and procedures for student safety and support; 6) directs the Division of Substance Abuse and Mental Health to employ a school-based mental health specialist.

HB 122 – Property Rights Ombudsman Advisory Governor Signed Calvin Support Opinion Amendments Musselman https://le.utah.gov/~2019/bills/hbillint/HB0122.pdf This bill: 1) amends a provision regarding the award of fees and costs when an issue in an advisory opinion of the Property Rights Ombudsman is subsequently litigated; 2) amends a provision regarding a refund of an impact fee at issue in both litigation and an advisory opinion of the Property Rights Ombudsman.

HB 125 – Quantity Impairment Modifications Governor Signed Carl Albrecht Support https://le.utah.gov/~2019/bills/hbillint/HB0125.pdf This bill states that there is a rebuttable presumption of quantity impairment to the extent that, for a period of at least seven consecutive years, a portion of the right identified in a change application has not been: a) diverted from the approved point of diversion; or b) beneficially used at the approved place of use.

HB 127 – Sales Tax Exemption Revisions House Filed – Not Tracking https://le.utah.gov/~2019/bills/hbillint/HB0127.pdf Passed This bill: 1) defines electric energy storage asset; 2) creates a sales and use tax exemption for an electric energy storage asset used for residential, commercial, or industrial purposes.

HB 135, 1st Substitute – Wildfire Preparedness Governor Signed Support Amendments https://le.utah.gov/~2019/bills/hbillint/HB0135S01.pdf This bill: 1) creates the Wildland Fire Preparedness Grants Fund, including sources of money; 2) directs the state forester to make one or more grants to fire departments or volunteer fire departments to assist in the suppression of wildland fire; 3) requires the Division of Forestry, Fire, and State Lands to make rules establishing criteria for receiving a grant from the Wildland Fire Preparedness Grants Fund.

HB 150, 2nd Substitute – Trampoline Park Safety Governor Signed Norman Tracking Standards Thurston https://le.utah.gov/~2019/bills/hbillint/HB0150S02.pdf This bill: 1) defines terms; 2) requires the operator of a trampoline park to obtain a business license to operate the trampoline park; 3) provides for a local regulating authority to suspend or revoke a trampoline park operator's business license for noncompliance; 4) identifies industry standards with which a trampoline park must comply; 5) describes specific notification, training, supervision, injury reporting, and emergency response standards with which a trampoline park must comply; 6) requires an annual inspection; 7) requires a trampoline park operator to annually provide a local regulating authority certain certificates of compliance; 8) requires a trampoline park to carry certain insurance; and 9) insulates a trampoline park from liability claims due to certain inherent risks related to the use of a trampoline park.
