Elections P.E.I. has been established to manage and oversee all aspects of the electoral process in Prince Edward Island with fairness and impartiality. It is to conduct provincial elections, by-elections, municipal and school trustee elections and plebiscites. Elections P.E.I. also promotes public awareness of the electoral process. The principal mandate of Elections P.E.I. is to inform and enable all qualified electors and candidates to exercise their democratic right and ensure their constitutional entitlement in elections as entrenched in the Canadian Charter of Rights and Freedoms.

Background:

In addition to the above, the Elections P.E.I. office has been involved in the designing of the electoral districts and the electoral wards on Prince Edward Island since 1994. Specifically, since 2003 the Elections P.E.I. office has provided support staff and mapping support in designing boundaries for the following independent electoral boundaries commission for the city of Charlottetown, the city of Summerside, the town of Stratford and most recently the Prince Edward Island Electoral Boundaries Commission for the province of Prince Edward Island.

Rational:

In preparing our work for this report we respected the guidelines for designing electoral boundaries from the Electoral Boundaries Act and Recommendation No. 12 from The Special Committee of the Prince Edward Island’s Electoral Boundaries First Report of the Third Session Sixty-second General Assembly on Proposed Provincial Electoral Boundaries and Fixed Provincial Election Dates, dated 4 May 2006, which outlines the following:

(a) the Canadian Charter of Rights and Freedoms (b) data from the Register of Electors (c) polling divisions from the most recent general election (d) geographical features (e) information pertaining to population (f) community of interest (g) municipal boundaries (h) public input (i) guidelines or criteria proposed for the consideration of the Commission by resolution of the Legislative Assembly (j) such other factors as it regards as relevant

This office gave prominence to the first two recommendations within The Special Committee’s Report, in which it was suggested that we seek to balance considerations of community of interest, or community of identity in, or the historical pattern of an electoral district with the democratic rights of the individual, as guaranteed in the Canadian Charter of Rights and Freedoms. Conclusion and Summary

To say the least is to say that our task has been challenging. However, we would like to emphasis that, in addition to our acquired knowledge and practical involvement on this subject, complemented with the electoral database which contains the Register of Electors and allows us to accumulate precise data on behalf of the Elections P.E.I. office, our objective was to strike a balance in accordance with the recommendations found within The Special Committee’s Report as well as respecting voter parity as guaranteed within the Canadian Charter of Rights and Freedoms.

Here is a brief summary of the reasoning behind the drafting of the boundaries for the proposed 27 electoral districts as presented in this report:

1. The number of electors across Prince Edward Island was gathered from the data collected for the provincial general election of 29 September 2003. The total number of electors across the province, at that time, was 99,252.

2. The Special Committee Report, Recommendation No. 2, states “that the deviation in absolute parity in the number of electors in each of the 27 electoral districts be limited to plus or minus 15% as compared to the electoral quotient (that is, the total number of electors in the province divided by 27), with the exception of the district of Evangeline - where the deviation is permitted to be greater to accommodate the cultural diversity of that area.”

No. 2 above provides the use of the district variance to be within a plus or minus (+)15% (with the exception of district of Evangeline - Miscouche which was approved at a -18.82 % variance). We have prepared the following chart, using several levels of variances, to further explain the + variance and how it relates to the number of electors within an electoral district.

VARIANCE EXAMPLE TABLE

District parity at 0% (the ideal) is 3,676 electors per electoral district

+ 1% range, added to (+) or subtracted from (-) the ideal gives a + range of 37 electors or from a maximum of 3,713 to a minimum of 3,639 electors within an electoral district

+ 5% range, added to (+) or subtracted from (-) the ideal gives a + range of 184 electors or from a maximum of 3,860 to a minimum of 3,492 electors within an electoral district

+10% range, added to (+) or subtracted from (-) the ideal gives a + range of 367 electors or from a maximum of 4,043 to a minimum of 3,309 electors within an electoral district

+15% range, added to (+) or subtracted from (-) the ideal gives a + range of 551 electors or from a maximum of 4,227 to a minimum of 3,125 electors within an electoral district

As a “real” example of a variance range affecting an electoral district, the community of O’Leary contains approximately 650 electors or gives a +18% variance, depending on whether it’s being added to an electoral district or taken out of an electoral district. 3. The eastern area of the province was designed using district variances ranging from between - 6.07% to -12.38%. Our objective was to meet the criteria set out in the allowable variance of +15%, while respecting the guidelines for designing electoral boundaries from the Electoral Boundaries Act and Recommendation No. 12.

4. The western area of the province was designed in respect to maintaining the current District 24 Evangeline - Miscouche, which had been pre-established as a district boundary as designed by the 5 October 2004 Electoral Boundaries Commission and later as approved by the 4 May 2006 Special Committee Report on Electoral Boundaries. This western area, which is west of District 24 Evangeline - Miscouche, contains an estimated 11,357 electors. Consequently, this western area was divided into three electoral districts. Attempts in dividing this area west of Evangeline-Miscouche into four districts resulted with each of the four having an average variance of - 23% which was considered to be well outside The Special Committee’s allowable limit of +15%. This area, ultimately, had to be divided into three districts with the following variances: No. 25 O’Leary - Grand River +5.98%, No. 26 Alberton - West Point +0.71% and No. 27 Tignish - Alma +2.26%.

5. Within the central area, and attempting to keep within the limits of The Special Committee’s recommendations, the cities and towns within each of the electoral districts were designed to share urban and rural electors. This has been an electoral boundaries mapping precedence since 1994.

6. The major growth areas of Stratford and West Royalty were designed with minus variances to accommodate expected population growth in these areas.

The maps are designed as a general index of the proposed electoral districts and are not intended to be used for measurements or for legal purposes. Should there be any discrepancy between the description and the map, the map shall prevail. Whenever a body of water such as river or stream forms part of a proposed electoral boundary, the actual boundary proposed will follow the middle of such body of water.
