b) Councillor McCue declared a pecuniary interest pertaining to the Quinte Museum of Natural History delegation given one of the Principals is a customer of his. He refrained from discussion and voting.

c) Councillor Kuntze declared a pecuniary interest pertaining to the Minutes of the Planning Advisory Committee Meeting held on December 17,2020 as per his disclosure at that meeting. He refrained from discussion and voting.

d) Councillor Kuypers declared a pecuniary interest pertaining to the Quinte Waste Solutions delegation given he is a member of the Board. He refrained from any voting.

10.1 Delegations

a) Ms. Marilyn Lawrie, Executive Director, Quinte Humane Society (QHS), Donna Endicott, QHS Board Chair, and J-C D'Amours, QHS Capital Campaign Manager, addressed Mayor Harrison and Council and presented their progress on the fundraising project for the new build. Given they were not successful in receiving grant funding they have scaled back their project. They are anticipating to commence construction in the spring 2021 with an opening of fall 2022.

Council questioned the representation from Quinte West on the Quinte Humane Society Board and Ms. Lawrie advised that there was a vacancy on the Board for a City of Quinte West representative.

Legislation:

Per Section 25 (2) (j) of the Occupational Health and Safety Act:

"An employer shall prepare and review at least annually a written Occupational Health and Safety Policy and develop and maintain a program to implement that policy."

Comments/Analysis:

I feel confident that the reviewed policies meet the goals and legislative requirements of the City of Quinte West as it relates to the Occupational Health and Safety Act.

Once the City of Quinte West’s 2021Health and Safety Policy, 2021 Harassment and Sexual Harassment Policy Statement, and 2021 Workplace Violence Policy Statement have been approved and signed, I will distribute and communicate the policies as per legislative requirements.

HEALTH & SAFETY POLICY 2021

The Corporation of the City of Quinte West has a responsibility to create and maintain a healthy workplace by fostering a culture that puts the health, safety and wellness of its employees first, above all other considerations.

As the governing body of the City of Quinte West, the Mayor and Members of City Council will provide leadership and support for the Health and Safety program. We believe that an effective Health and Safety program is important not only to keep our employees safe and healthy and to meet legislative requirements, but also to reduce the costs associated with accidental injuries and property damage. To this end, we are committed to being active participants in the program and providing the necessary resources to ensure its continued effectiveness.

We believe that a vast majority of injuries are both “Predictable and Preventable”, they are not just accidents. By generating a sound approach to the development and sustainability of a healthy workplace, transformation of thinking and behaviour at all levels will be required. This can only be achieved through the support of senior management with commitment to reinforce and allow changes necessary for improvement.

All Management staff, from the Chief Administrative Officer to the supervisor on the job, is responsible for ensuring that employees are given the necessary instruction, information and supervision to enable them to perform their work safely. It is essential that senior management staff promote safe work practices by their own example and by their participation in the development and implementation of the Health and Safety program. The supervisors at each worksite play a very important role in making their workers aware of known health and safety hazards and putting procedures in place to control those hazards. All management staff must be continually aware of their duty to take every precaution reasonable in the circumstances for the protection of City of Quinte West workers, including those who perform work for the City under contract.

Workers play a major role in the Health and Safety program by their participation on Safety Committees, reporting of hazards and the use of proper safety equipment when required. City of Quinte West employees at every level of the organization are expected to work in compliance with accepted trade safety standards, City safety rules and the Occupational Health and Safety Act and its regulations. Failure to do so will result in appropriate disciplinary action.

We believe that regardless of the type of job or service being performed, the Health, Safety and Wellness of the employee must always be the primary consideration.

City of Quinte West Harassment & Sexual Harassment Policy

The City of Quinte West is committed to providing a work environment in which all individuals are treated with respect and dignity.

Workplace harassment will not be tolerated from any person in the workplace. Everyone in the workplace must be dedicated to preventing workplace harassment. Members of Council, managers, supervisors, and workers are expected to uphold this policy, and will be held accountable by the Corporation.

Workplace harassment means engaging in a course of vexatious comment or conduct against a worker, in a workplace, that is known or ought reasonably to be known to be unwelcome. Harassment may also relate to a form of discrimination as set out in the Ontario Human Rights Code.

This policy is not intended to limit or constrain the reasonable exercise of management functions in the workplace such as:

 Appropriate direction, evaluation or discipline by a manager or supervisor  Stressful events associated with the performance of legitimate job duties  Good natured jesting and bantering which is mutually acceptable

Workers are encouraged to report any incidents of workplace harassment. Management will investigate and deal with all concerns, complaints, or incidents of workplace harassment in a timely and fair manner while respecting workers' privacy, to the extent possible. Nothing in this policy prevents or discourages a worker from filing an application with the Ontario Human Rights Tribunal on a matter related to the Ontario Human Rights Code within one year of the last alleged incident. A worker also retains the right to exercise any other legal avenues available.

City of Quinte West Workplace Violence Policy

The City of Quinte West is committed to the prevention of workplace violence and is ultimately responsible for worker health and safety. We will take whatever steps are reasonable to protect our workers from workplace violence from all sources.

Violent behaviour in the workplace is unacceptable from anyone. This policy applies to all City of Quinte West municipal employees, visitors, contractors, vendors and delivery persons. Everyone is expected to uphold this policy and to work together to prevent workplace violence.

There is a workplace violence program that implements this policy. It includes measures and procedures to protect workers from workplace violence, a means of summoning immediate assistance and a process for workers to report incidents, or raise concerns. The City of Quinte West as the employer will ensure this policy and the supporting program are implemented and maintained and that all workers and supervisors have the appropriate information and instruction to protect them from violence in the workplace.

City of Quinte West Management will adhere to this policy and the supporting program. Supervisors and Managers will be responsible for ensuring that measures and procedures are followed by workers and that workers have the information they need to protect themselves.

Every worker must work in compliance with this policy and the supporting program. All workers are encouraged to raise any concerns about workplace violence and to report any violent incidents or threats.

City of Quinte West Management pledges to investigate and deal with all incidents and complaints of workplace violence in a fair and timely manner, respecting the privacy of all concerned as much as possible.

Recommendation

That Council directs Staff to continue to conduct background research and bring forward further information at a later date with possible options of a Land Acknowledgement Statement for Council's consideration. OR That Stafl Report 21-005CFS regarding lndigenous Land Acknowledgement - Status Update be received and filed.

Background:

At a previous meeting of Council it was requested that Staff prepare a report on options to recognize Indigenous ancestors that lived in the area. Staff continue to research this request and the purpose of this report is to provide Council with a status update.

To date, Staff have consulted with Hastings and Prince Edward Public Health (HPEPH), AMO website, Province of Ontario website as well as the County of Prince Edward in an effort to obtain some background information and possible samples related to the request. àq,fum At the time of consulting with HPEPH they advised they were still in the process of formalizing a Land Acknowledgement for their organization but provided valuable information for consideration.

Valuable information was obtained from the AMO website including Tips for creating your municipality's Land Acknowledgement Statement as outlined below: r Research the history of the land within and in proximity to your municipal boundaries, including treaties, active land claim litigation and lndigenous histories. This information will be useful in helping you craft a statement. r Some of the history of specific areas may be complex and different sources could be contradictory. ln these instances, it may be better to opt for a more general statement rather than trying to be specific' . lf your municipality has an lndigenous Relations or Reconciliation committee or if you have an lndigenous Advisory Council, you may find it useful to have this body help you create your municipal government's land acknowledgement statement. o Municipal governments do not have to craft a land acknowledgement statement on their own. Engage and work with local First Nations, Métis, lndigenous organizations and community champions in your area. Advice from these groups may be useful in helping you develop a land acknowledgement protocol for your municipal government. Some may have also developed template acknowledgement statements for external use. o Focus on your current neighbours and lndigenous residents with an eye towards acknowledging past usage and occupants. Remember that in some cases, First Nations communities may not be located on their traditional lands. o Once your statement has been drafted, remember that it may be viewed as political. Some may critique the acknowledgement protocol your municipal government has created. While you may find it useful to consider their input and view the statement as a living document, do your best and remember that your municipality may not be able to make everyone happy. o Some municipal governments with existing land acknowledgement protocols have implemented a trial period (e.g. 6 months) for their statement to allow lndigenous community members an opportunity to provide feedback. e Determine which type of meetings and events you might wish to begin using your land acknowledgement statement to make sure it continues to be meaningful. You may also wish to consider whether you want to have a traditional land acknowledgement statement on your municipality's website. o To avoid traditional land acknowledgement statements being used superficially and without an appreciation for their cultural meaning, some municipal governments have provided municipal elected representatives and staff with cultural awareness training before implementing the use of a statement. r Some municipalities invite lndigenous Elders or leaders to participate in introduction protocols at civic celebrations or official events to bring greetings on behalf of the local lndigenous community. Sometimes this approach is used instead of a land acknowledgement statement' 2 It was found on the Province of Ontario website that in 2016 the provincial government passed legislation declaring the first week of November as "Treaties Recognition Week". This honours the importance of treaties and helps residents of Ontario learn more about treaty rights and relationships. The County of Prince Edward has shared their Land Acknowledgement Statement and Staff have compiled additional samples which were available on the AMO website. From the above, two possible ways to recognize lndigenous ancestors that lived in the area could be to 1) establish an lndigenous Land Acknowledgement Statement for the municipality andlor 2) proclaim the first week in November as "Treaties Recognition Week" in the City of Quinte West. Should Council desire to proceed, Council could direct Staff to continue to conduct background research and bring forward further information at a later date with possible options of a Land Acknowledgement Statement for Council's consideration. Prior to any approval it would be recommended by Staff, that given the political context of such a Statement, that collaboration occur between City Council representatives and the Leaders of the lndigenous groups within our area to obtain their input and approval in establishing a substantial Land Acknowledgement Statement for the City of Quinte West.

Recommendation:

That Council approves the waiving of municipal parking fees and charges until the conclusion of the current Provincial lockdown. ______

1. Background

City of Quinte West Council, at their meeting of January 11th, 2021 approved the waiving of parking fees until January 23rd being the end date of the Provincial lockdown imposed in late December. With the more recent extension of the lockdown period, and in anticipation of potential future extensions, staff is recommending a corresponding extension to the waiving of parking fees.

During the similar lockdown restrictions that were in place during the spring and early summer of 2020, Council eliminated parking fees in recognition of the impacts on local businesses and residents.

2. Proposal to Waive Fees

Under the recommendation, parking charges at City parking lots and on-street meters would be waived until such time as the current Provincial lockdown is removed.

During this period, illegal or dangerous parking will still be enforced and ticketed in compliance with City By-laws.

3. Financial Impact

The City would forgo an estimated $9,000.00 in parking revenue per month, for the duration of the lockdown.

4. Summary Analysis

If approved, all City parking fees would be waived until the end of the current Provincial lockdown, and parking enforcement would be limited to situations of illegal or dangerous parking within the municipality.

That Council direct Staff to proceed with the process for the discharge of the restrictive covenants registered as lnstrument HT203389 on February 15,2017.

Background:

The City of Quinte West received a request'from S&S Tennier Holdings lnc. at 75 Huff Avenue, Trenton for the removal of the restrictive covenants registered as lnstrument HT203389 on February 1 5,2017.

ln regards to the specific covenants, the substantial completion of the building(s) on thè subject property as contemplated in Section 1 and 2 of the restrictive covenants has been completed to the satisfaction of the City and is no longer applicable. ln addition, City Staff are recommending to Council the discharge of the restrictive covenants in their entirety. All of the conditions remaining are covered through authorities that the City retains through site plan control, easements, and the rezoning process. Therefore, staff are favourable to the request by S&S Tennier Holdings to release all remaining restrictive'covenants as part of the original land sale agreement. ln addition, a By-law will be presented to Council for their consideration at this meeting.

Background:

As council may be aware, $185,000 has been earmarked for a new sidewalk machine in the 2021 capital budget. Just recently, Joe Johnson Equipment contacted us and advised that they have a new (classed as a demo) 2021 Trackless MT7 articulating all season tractor. ​

I am advised that this unit comes in well under today’s cost of the same setup. The breakdown of the attached equipment and costs are as follows

● 2021 Demo Trackless MT7 $111,153 ● Broom $7,650 ● Snowblower c/w chute $17,450 ● 5’ angle plow $6,300 ● Rear salter/sander $8,725

● Autogreaser $2400

Total $153,678 plus HST = $173,656 Net HST $156,382.73 < budget of $185,000

As Council may recall, in late 2018, we purchased a trackless sidewalk machine from Joe Johnson for $165,035 plus taxes with lesser equipment/attachments on it.

Existing Policy/By-law:

The City’s Purchasing Policy requires 3 written quotes for purchases between $5,000.00 and $40,000.00, and for purchases greater, a formal Tender submission. The Purchasing Policy includes a provision for single and sole sourcing where there is compelling rationale and City Council/Committee approval is granted.

Financial Impact:

Council has set aside $185,000 in the 2021 capital plan for a new sidewalk machine and this fully equipment demo unit comes in roughly $30,000 net HST under budget and we can have it within 3 weeks.

That Council approves the purchase of a new (demo) 2020 John Deere JD 6110M all season tractor from Colvoy Equipment for $255,415.58 plus taxes. ______

Background:

As council may be aware, $300,000 has been earmarked for a new tractor in the 2021 capital budget. Just recently, Colvoy Equipment contacted us and advised that they have a new (classed as a demo) 2020 John Deere 6110M all season tractor with +-20 hours on it. This tractor is identical to the one we currently have.

I am advised that this unit comes in well under today’s cost of the same setup. The breakdown of the attached equipment and costs are as follows:

● 2020 demo Tractor $120,000 ● Blade $23,535 ● Mower $85,000.58 ● Sweeper $26,880

Total $255,415.58 plus HST Net HST $259,910.89 < budget of $300,000

Mr. Rick Searle spoke to Staff Report 20-058 Parkview Heights Speed Limit Reduction Proposal. Mr. Searle would like the speed limit reduced to 40km/h as this is a speed and safety issue. This is the second year in a row for a proposed speed reduction. Residents are 84% in support of the reduction and have set a clear mandate. Mr. Searle provided a photo from earlier in the day showing two vehicles parked on either side. He also drove the street at both 40km/h and 50km/h and there was a big difference between the speeds on this roadway. Mr. Searle thanked the Committee for letting him speak.

Jessica Smylie asked about the boat launch and dredging progress. Director Angelo advised that there has been some complications but Staff are moving ahead and work will begin shortly.

Jessica Smylie is not in support of the Parkview Heights motion but the rest of Committee supported and moved the motion.

Councillor McCue asked if the contractors are going to start to tie their barges to shore and Matt Tracey advised that they will be removed soon.

Councillor McCue asked when the bike lanes will be painted on County Road 64. Tim Colasante advised that the contractor needs 5 degree weather held for a couple days in order to paint the lines.

Wayne Scaletta asked when Telephone Road, between Tate Road and Fraser Road will be repaired. Director Angelo said it is part of the 2022 budget.

Councillor Reid thanked staff for hanging the banners and lighting the two trees. Councillor Reid asked if staff can fill the hole at the Frankford Tourist Park in front of the playground area.

Councillor Reid requested that the holiday garbage and recycling information be posted to the electronic sign in Frankford since that is the area directly affected this year.

Chuck Naphan said he is happy to witness and be a part of such big water and wastewater changes in the City of Quinte West, we are seeing milestones created.

Councillor Kuypers asked if the two white fuel tanks are staying in Compass Court. Director Angelo confirmed yes they are but Staff will find ways to shield them.

Chair DeWitt would like Public Works Staff to be sent a reminder to not just drive by waste in the ditch, stop and pick it up. Dumping has become a major issue and the 'no dumping' video and information should be posted weekly to social media.

WHEREAS, citizens of Quinte West face various challenges in their lives and 2-1-1 is there to connect them to the program or service they need;

Being A By-Law To Provide For An Interim Tax Levy And To Provide For The Payment Of Taxes By Installment.

Whereas Section 317 (1) of The Municipal Act, Chapter M45, RSO 2001, as amended, provides that the Council of a local municipality, before the adoption of the estimate for the year, may pass a by-law levying a separate tax rate on the assessment in each property class in the local municipality rateable for local municipal purposes;

And Whereas it is deemed necessary and advisable to provide for an interim tax levy and to fix the date upon which such interim tax levy shall become due and payable in 2021;

Now Therefore Be It Enacted By The Council For The Corporation Of The City Of Quinte West As Follows:

1. That this By-law shall be entitled the “2021 Interim Tax Levy By-law.”

2. An interim tax levy is hereby imposed and levied in order to provide money for general purposes of the Corporation prior to the adoption of the estimates for 2021. There shall be levied by the Corporation, sums equal to that which would be produced by applying the maximum rates set out in subsection 317(3), or as set by regulation pursuant to Section 371, to the whole of the assessment for all realty tax classes according to the last revised assessment rolls of the Corporation.

3. Realty Taxes levied in accordance with Section 2 hereof shall be based on 50% of the 2020 total taxes.

4. The said interim levy shall become due and payable in two installments as follows: one half of the interim tax levy shall become due and payable on the 29th day of March, 2021 and the balance of the interim levy shall become due and payable on the 27th day of May, 2021 and non-payment of the amount on the dates stated in accordance with this section shall constitute default.

5. If any installments or portion thereof remains unpaid after the due date, penalty and interest in accordance with the Corporation of the City of Quinte West By-law No. 98-164 will be charged until payment is made.

6. Penalties and interest added on all taxes of the interim tax levy in default shall become due and payable and shall be collected forthwith as if the same has originally been imposed and formed part of such unpaid interim tax levy.

7. The collector may mail or cause the same to be mailed to the address of such person(s) indicated on the last revised assessment roll, a written or printed notice specifying the amount of taxes payable.

8. This by-law shall take effect upon final passing hereof.

Whereas the City of Quinte West sold land to S&S Tennier Holdings Inc registered by Instrument Number HT203426 on February 15, 2017;

And Whereas certain restrictive covenants were registered in connection with the transaction as Instrument Number HT203389;

And Whereas it is deemed appropriate and advisable to formally release all covenants in Instrument Number HT203389 on the basis of satisfactory compliance by S&S Tennier Holdings Inc;

Now Therefore Be It Enacted By The Council For The Corporation Of The City Of Quinte West As Follows:

1. That this By-law shall be entitled the “Release of Covenant – S&S Tennier Holdings Inc By-Law.”

2. That the Mayor and Clerk, or designates, shall be and are hereby authorized and instructed to execute on behalf of the City a Release of All Covenants in Instrument Number HT203389 from the Corporation of the City of Quinte West to S&S Tennier Holdings Inc.

3. A copy of the said Consent is attached hereto, marked as Schedule “A” and forms part of this By-law.

MEMORANDUM TO: Municipal Chief Administrative Officers and Clerks

SUBJECT: Updates Related to the Revised Rules for Areas in Stage 1 under the Reopening Ontario Act, the Emergency Management and Civil Protection Act, including the Set Fine Amounts under the Provincial Offences Act, and Reporting Enforcement Data

In my memorandum of January 14, 2021, I provided an update on the coordinated provincial enforcement effort and I wanted to thank you again for your work in limiting the spread of COVID-19 infection and managing the impact of the pandemic on your communities. Your actions are having a positive impact on compliance and data reporting across the province.

Today, I am writing to provide a further update on the revised rules for areas in Stage 1 under the Reopening Ontario (A Flexible Response to COVID-19) Act, 2020 (ROA), and the establishment of set fine amounts under the Provincial Offences Act for individuals and corporations to be ticketed for failure to comply with an order or for the obstruct offences under the Emergency Management and Civil Protection Act (EMCPA) and ROA.

Specifically, Ontario Regulation 14/21 revised the Stage 1 Order, effective January 15, 2021 at 12:01 a.m., to permit construction projects that are funded in whole or in part by Canada or Ontario, or agencies of either, or by municipalities.

Additionally, the Chief Justice of the Ontario Court of Justice has established the set fine amounts under the Provincial Offences Act. These set fine amounts are effective January 14, 2021, and apply to individuals and corporations that fail to comply with an order made during a declared emergency and for obstructing any person exercising a power or performing a duty in accordance with an order made during a declared emergency. These set fine amounts apply to orders under both the EMCPA and ROA.

To help support municipal enforcement activities, I am attaching information the Ministry of the Solicitor General has shared with Chiefs of Police explaining, in more detail, the

updates to the Emergency Management and Civil Protection Act, including the set fine amounts and the revised rules for areas in Stage 1 under the Reopening Ontario Act.

Lastly, the Ministry of the Solicitor General has updated the COVID-19 enforcement data reporting template and developed detailed instructions on the use of this template to reflect new EMPCA orders. The updated enforcement data template for municipalities is attached. In addition, the weekly reporting is now requested each Monday at 4 pm. This new time will allow the information you provide to inform analysis and decisions in a more timely way. I have mentioned this reporting template in past communications. I am pleased to hear that many municipalities are contacting the Ministry of Solicitor General in this regard.

Background:

At a meeting of the Corporate and Financial Services Committee held on October T,2O2O, Committee considered the attached report and recommended to Council that Council livestream recordings be retained and made available to the public for a period of one year and that Committee livestream recordings be retained and made available to the public for a period of three months. As a result, Council passed By-law 20-103 on November 2,2020 (attached) to approve the same in accordance with the City's Records Retention By-law.

Councillor Cassidy has asked for a report on the cost of storing Council and Committee meeting livestreamings indefinitely. There is no cost for storing Council and Committee meetings on Youtube regardless of how many videos we store. The Committee recommends that the City's Records Retention By{aw be amended to include livestream recordings;

And further that Council livestream recordings be retained and made available to the public for a period of one Year;

And further that Committee livestream recordings be retained and made available to the public for a period of three months.

Background:

The City has instituted and has been livestreaming Council meetings for the past while. Currently, each meeting is livestreamed for public viewing and remains available for public viewing at any time.

As a result of Covid-19, the Gity commenced livestreaming Committee meetings given the fact that individuals could not attend in person. Currently, these meetings continue to be livestreamed but are not made available to the public afier thã meeting. The Gity has been in receipt of requests from the public that

Whereas Section 1 16 (1 Xb) of the Municipal Act (RSO 1 990, Chapter M45 as amended) provides that a municipality or a local board thereof, as defined in the MunicipalAffairs Act, shall not destroy any of its receipts, vouchers, instruments, rolls or other documents, records and papers, except in accordance with a ByJaw passed by the Municipality and approved by the Auditor of the Municipality establishing schedules of retention periods during which the receipts, vouchers, instruments, rolls or other documents, records, and papers must be kept by the Municipality or local board;

And Whereas the Council of the Corporation of the City of Quinte West deems it necessary and expodient to amend Schedule "4" of By-law 09-71 to incorporate Livestream Recordings of Council and Livestream Recordings of Committee Meetings;

Good morning,

We all know how important the Golden hour is when we are dealing with serious trauma at an MVC. Yesterday we had 3 critically injured people who needed to be extricated from two separate vehicles. Within 15-20 minutes of the first truck on scene, all three people were extricated and in care of paramedics. Although one was deceased, another was transported to KGH. That we were able to remove them in such a short time is directly attributable to the extra set of E- Draulic extrication tools the City approved with the purchase of our new rescue truck (232).

I think it is important to pass on our team mates on council that because they made the decision to support us by approving another set of extrication tools for stn 2, they had a direct positive influence on what was the best outcome under the circumstances,

We have the best equipment and training because we have the best support from our senior managers and council and that is the difference between success and failure.

Staff stated that both project have started and are in progress. In addition, it was mentioned that staff are impressed with the site visit at McLeod Dam with the consultant.

Staff answered that the projects are due in March but we should receive a preliminary report in January.

14. National Disaster Mitigation Program (Motion to Receive)

Staff explained report.

Board Member asked about shoreline mapping costs.

Staff answered that Quinte Conservation is still scooping the project.

Staff added that the scope would have to be reduced for the grant application. The grant would fund 50% and Quinte Conservation would work with the municipalities to fund the other 50%.

Board Member asked why the project is limited to one year.

Staff answered that we do not know but the decision was made at a federal level.

Staff added that when the grant application is due we would have a more accurate budget.

Board Member asked about support letters from municipalities.

Staff answered that response has been good.

16. Lands Committee – Conservation Areas Priority Upgrades (Motion to Receive)

Staff explained that we are creating a conceptual plan for Quinte Conservation’s major conservation areas. This will give staff direction moving forward and reduce operating cost by focusing on conservation areas that are most visited and should be highest priority.

Board Member asked about Little Bluff Conservation Area improvements.

Staff answered that with our “park and pay” money we are updating the railing along the bluff and the trails will get new signs. Staff added these things need to be addressed before it opens.

Staff explained report and mentioned the meeting that happened early in the week.

Staff added when further update is available a lands committee meeting will be called to discuss and then brought to the Executive Board.

Board Member asked if Quinte Conservation met with a potential buyer at the meeting early in the week.

Staff answered yes.

19. Impacts of Bill 229 on Regulations and Planning (Motion to Receive)

Staff explained that the planning and regulations department is most concerned with the proposed appeal process. Staff then explained the current process versus the proposed process and what the changes mean.

Staff showed diagram of the current process versus the proposed process to the Executive Board.

Board Member asked for the diagram to be sent to all Executive Board members.

Board Member asked if the appeal goes to the Ministry of Environment would the homeowner go to the Ministry of Natural Resources for technical help.

Staff answered that we do not know.

Tom Livingston left the meeting at this time.

Board Member asked if there is a group that is putting pressure on the province to make these changes.

Staff answered that we do not know but Conservation Ontario continues to provide us with information.

Board Member stated that these changes are a threat to municipalities.

Staff stated that board members are supportive and in general, we have a good relationship with our member municipalities.

Board Member agreed but stated that may not be the case for other Conservation Authorities.

Staff asked municipalities to raise their voice about the proposed changes.

Board Member stated that municipalities could not afford to administer what is proposed.

Staff said the province does not give the same amount of financial support to Conservation Authorities in comparison to municipalities. In addition, staff stated that Conservation Ontario is lobbying with local municipalities and groups to request repeal of Schedule 6.

Staff asked if municipalities to send letter to the Province stating they do not agree with the proposed changes.

Board Member stated the Minister of Municipal Affairs and Housing should be carbon copied on the letter.

20. Impacts of Bill 229 on the Conservation Authorities Act (Motion to Receive)

Board Member stated that he remembers in the past some neighbouring municipalities were not supportive of Conservation Authorities.

Staff stated there are certain pockets throughout the province that are unsupportive.

The Media asked if staff if anything in Bill 229 would give Quinte Conservation relief of cost or provide revenue.

Staff answered not that we are aware of and there is nothing specifically in the bill about it.

Board Member stated that it is important to get council support, senior staff support, and planning department staff support from the municipalities.

Board Member asked if the link to Ontario Nature is on our social media pages.

Staff answered that is it on our website and the link to the website was put in the media release.

Board Member stated that it is not good to make changes without public consultation.

RE: MOTION REGARDING - Insurance

The following resolution was passed by the Council for the Municipality of Charlton and Dack on December 18th, 2020:

WHEREAS the cost of municipal insurance in the Province of Ontario has continued to increase – with especially large increases going into 2021.

AND WHEREAS Joint and Several Liability continues to ask property taxpayers to carry the lion’s share of a damage award when a municipality is found at minimum fault;

AND WHEREAS these increases are unsustainable and unfair and eat at critical municipal services;

AND WHEREAS the Association of Municipalities of Ontario outlined seven recommendations to address insurance issues including:

1. The provincial government adopt a model of full proportionate liability to replace joint and several liability. 2. Implement enhancements to the existing limitations period including the continued applicability of the existing 10 day rule on slip and fall cases given recent judicial interpretations and whether a 1 year limitation period may be beneficial. 3. Implement a cap for economic loss awards. 4. Increase the catastrophic impairment default benefit limit to $2 million and increase the third party liability coverage to $2 million in government regulated automobile insurance plans. 5. Assess and implement additional measures which would support lower premiums or alternatives to the provision of insurance services by other entities such as non profit insurance reciprocals. 6. Compel the insurance industry to supply all necessary financial evidence including premiums, claims and deductible limit changes which support its

and municipal arguments as to the fiscal impact of joint and several liability. 7. Establish a provincial and municipal working group to consider the above and put forward recommendations to the Attorney General.

THEREFORE BE IT RESOLVED THAT the Council for the Municipality of Charlton and Dack call on the Province of Ontario to immediately review these recommendations and to investigate the unethical practice of preferred vendors who are paid substantial amounts over industry standards, despite COVID 19 delays, as insurance premiums will soon be out of reach for many communities.

AND FURTHER BE IT RESOLVED THAT this motion be provided to the Honourable Doug Ford, Premier of Ontario, the Honourable Rod Phillips, Minister of Finance, the Honourable Doug Downey, Attorney General of Ontario, the Honourable John Vanthof, MPP for Timiskaming- Cochrane, and all Ontario municipalities.

RE: Item for Discussion – Infrastructure Funding

At its meeting of January 20, 2021, the Council of the Corporation of the Town of Bracebridge ratified motion 21-GC-024, regarding Infrastructure Funding, as follows:

“WHEREAS the Association of Municipalities of Ontario (AMO) has reported that municipal governments own more of Ontario’s infrastructure than any other order of government, and most of it is essential to economic prosperity and quality of life;

AND WHEREAS municipalities deliver many of the services that are critical to residents in every community, and these services rely on well-planned, well-built and well-maintained infrastructure;

AND WHEREAS the Ontario Provincial Government has stated that universal asset management will be the foundation of its municipal infrastructure strategy because effective asset management planning helps ensure that investments are made at the right time to minimize future repair and rehabilitation costs and maintain assets;

AND WHEREAS Federal and Provincial infrastructure funding models now contain requirements for recipients to demonstrate that comprehensive asset management planning principles are applied when making decisions regarding infrastructure investment;

AND WHEREAS infrastructure funding limits need to be large enough to support significant projects that have a lasting community impact over multiple generations;

AND WHEREAS targeted funding for critical infrastructure is inconsistent with the principle foundation of an asset management strategy which prioritizes needs over wants and has resulted in underfunding of the wide range of infrastructure that municipalities are responsible for maintaining, such as arenas and libraries;

AND WHEREAS the Community, Culture and Recreation Stream of the Investing in Canada Infrastructure Program received demand of almost $10 billion for a $1 billion funding envelope;

AND WHEREAS broad eligibility for funding is more appropriate as municipalities best understand their infrastructure needs together with the needs of their community;

AND WHEREAS no and/or insufficient funding programs currently exist to fund the demonstrated need for the building, restoration and enhancement of community, culture and recreation assets;

AND WHEREAS funding the replacement of these needed capital assets is beyond the financial capacity of most communities;

AND WHEREAS the age of the Town of Bracebridge arena is greater than 70 years old, and the Library greater than 110 years old, requiring immediate replacement;

AND WHEREAS the Town of Bracebridge was recently denied any funding under the Community, Culture and Recreation stream of the Investing in Canada Infrastructure Program, despite clearly meeting the tests of proper asset management and identifying needs over wants;

AND WHEREAS the economy of Ontario has been negatively impacted by the ongoing measures implemented to reduce the spread of COVID-19;

NOW THEREFORE the Council of The Corporation of the Town of Bracebridge resolves as follows:

1. THAT the Federal and Provincial Governments provide immediate broad and substantial municipal funding opportunities for well-planned, shovel-ready projects already prioritized under municipal asset management plans to provide immediate stimulus to the local, provincial and the federal economies in order to rebound from the impact of the COVID-19 pandemic.

2. AND THAT this resolution be forwarded to the Right Honourable Prime Minister of Canada; the Federal Minister of Infrastructure and Communities; the Honourable Premier of Ontario; the Ontario Minister of the Finance; the Ontario Minister of Infrastructure; the Ontario Minister of Municipal Affairs and Housing; the Association of Municipalities of Ontario (AMO); the Federation of Canadian Municipalities (FCM); the Local Member of Parliament (MP); the Local Member of Provincial Parliament (MPP); and all Municipalities in Ontario.

And Whereas subsection 3 of Section 5 of the Municipal Act (S.O. 2001, c.25) provides that except where otherwise provided, the jurisdiction of every council is confined to the municipality that it represents and its powers shall be exercised by by-law;
