1. PURPOSE OF REPORT

1.1 This report is to inform Members of the main and additional minor Modifications required to the Minerals Plan following Submission to Secretary of State and the Hearing Sessions held during February 2012. It seeks full Council approval for the Main Modifications to the Plan to be made available for public consultation during August and September 2012.

2. RECOMMENDATIONS

2.1 It is recommended that the Council:

1. Approve the Main Modifications to the Joint Minerals Development Plan Document and subsequent period of public consultation; and 2. Note the additional minor modifications.

2.2 The Cabinet recommend the above actions to Council.

2.3 The Overview and Scrutiny Committee consider and support the above actions.

3 MAIN TEXT INCLUDING ALTERNATIVES CONSIDERED/ CONSULTATION CARRIED OUT

3.1 In November 2009 the ten Greater Manchester Authorities agreed to produce a joint Development Plan Document (DPD) covering minerals issues in Greater Manchester (the Minerals Plan). Since then the document has undergone a series of consultations to identify locations for future minerals development and to develop a suite of minerals planning policies. The Minerals Plan was approved by Rochdale Council in 2011 for Publication and Submission to Secretary of State.

3.2 Once adopted, the Minerals Plan will provide a planning framework covering land-use planning matters in relation to minerals development for the Greater Manchester area. The Plan will set out the policy approach to each mineral found here: construction aggregates; brick clay; natural building stone; coal; unconventional gas resources; and . It will also include a set of development management polices which will assist in the consideration of planning applications relating to the working and winning of minerals. In addition, the Minerals Plan will identify Areas of Search for future mineral development. These are broad areas within which there may be particular sites that could meet any shortfall in future minerals supply. It also sets out how Greater Manchester’s mineral resources will be protected from sterilisation through Mineral Safeguarding Areas. The Areas of Search and Minerals Safeguarding Areas will also need to be added to each District’s Local Development Framework Proposals Map.

3.3 The Plan was published between 22 nd July until the 2 nd September 2011 then submitted to the Secretary of State on the 11 th November 2011 for its Public Examination before an independent Inspector. The purpose of this examination was to assess the soundness of the plan and whether its preparation has complied with legal processes. Hearing sessions commenced on Wednesday 22nd February 2012 and have been adjourned following the close of the session on Thursday 23 rd February. During the hearing sessions three changes were proposed which the Inspector has indicated constitute Main Modifications to the Plan and, as such, approval for these changes is required from each of the Full Councils in Greater Manchester; as well as this, an additional two changes are proposed as a result of the publication of the National Planning Policy Framework (NPPF).

3.4 It is essential to note that these ‘Main Modifications’ address matters that the Inspector considers raise soundness issues with the Plan. Without these changes there is a real risk that the Inspector will be unable to recommend that the Plan is sound and authorities will not be able to adopt the plan.

3.5 The Main Modifications proposed (listed in Appendix 1) relate to Policies 2, 7 and 12 of the Submitted plan, the removal of the Peat Minerals Safeguarding Area, and the inclusion of a new Policy on the presumption in favour of Sustainable Development. It is important to note that the modifications proposed do not alter the purpose of the Plan and will have no impact on the way the Plan is to be used in guiding minerals development in future.

3.6 The most significant change is to Policy 7 Mineral Safeguarding Areas - this change has been introduced in response to concerns from objectors to the Plan that the non-identification of MSAs within the urban area could lead to the unnecessary sterilisation of minerals and missed opportunities for the extraction of important resources. The change therefore sets out a policy approach outside identified MSAs (i.e. for the urban area) that would support the prior extraction of minerals where the potential for prior

The acceptability of prior extraction would of course need to comply fully with the key planning and environmental criteria in the plan. This change is necessary to ensure that areas suitable for extraction of mineral resources prior to non minerals development outside the current MSA receive support within the Plan in line with the requirements of National Planning Policy.

3.7 The change proposed to Policy 2 ensures that the reference to the ‘at least landbank period’ for Sand and Gravel and Crushed Rock is included within the policy text, in addition to the supporting text, to demonstrate the GM Authorities commitment to delivering the landbank in line with National Planning Policy.

3.8 The change to Policy 12 sees the removal the third bullet point on financial provision which was incorrectly included in this policy. The change is essential to ensure the Plan conforms with national policy, which does not allow us to request financial guarantees for site restoration.

3.9 The removal of the Peat Minerals Safeguarding Area is in response to the publication of the National Planning Policy Framework (NPPF), which discourages peat extraction. The addition of text relating to a presumption in favour of sustainable development is also a response to the NPPF, and a request from the Planning Inspectorate that this change is necessary in order for compliance with NPPF.

3.10 It is proposed that following approval from each of the Full Councils of the ten Authorities, consultation on the Main Modifications will take place during August and September 2012 for a period of 6 weeks. At the end of the consultation period any representations received on the modifications will be provided to the Inspector. Should the Inspector decide that an additional hearing is required to examine the representations a further hearing session will be held on 3 rd October 2012.

3.11 Following the close of the hearing sessions in October, the Inspector’s report into soundness will be received during November 2012. Provided the Minerals Plan is found sound, the Plan will then need to be adopted by each of the ten Authorities. This process is likely to commence from December 2012 with a common adoption date of 1 st April 2013.

Alternatives considered

3.10 The alternative is to not make the proposed modifications; however, this would leave the Plan open to the challenge of being unsound and would mean that it would not reflect the changes agreed during the Preferred Options consultation. In particular, it would not take into account concerns about the sterilization of coal reserves. (see para 3.5).

Consultation proposed/undertaken

3.11 Commencement of production of the Minerals Plan took place in November 2009. There have been a number of stages in its development:

• An initial exercise identifying where minerals resources are located in Greater Manchester. • An Issues and Options stage, which looked at the current situation in respect of minerals extraction, the issues relating to different

Greater Manchester Minerals Plan Main Changes March 2012 3 types of minerals (e.g. demand, environmental issues), and the different policy options for each mineral as well as options for Development Management approaches. • A ‘Preferred Approach’ stage, which outlined ‘Areas of Search’ for different minerals, ‘Minerals Safeguarding Areas’, and a very limited number of specific extensions to existing quarry sites. • The Publication stage, which develops the Preferred Approach and is essentially the final document which the Joint Committee would like to see published (this is the current stage).

Each stage has been subject to consultation, including the document being available at all libraries and information points, press notices and public events.

All Councillors were informed about the proposed modifications by e-mail on 27 th March and have been given the opportunity to comment.

4. FINANCIAL IMPLICATIONS

4.1 The costs of the creation of the Plan have already been covered by an AGMA grant and other sources including Planning Delivery Grant (PDG), and there will be no additional costs to the Authority as a result of the proposed modifications. Once the Plan is adopted, it will be available electronically and it is not intended to produce paper copies as a general rule (the few that may occasionally be required will be covered by existing printing budgets). The Head of Finance has been consulted and has no further comments.

5. LEGAL IMPLICATIONS

5.1 Legal Services have been consulted and have expressed their agreement with the report and in particular have re-iterated that the modifications address matters that the Inspector considered raise soundness issues, and failure to adopt these changes would leave the Plan open to the challenge of being unsound and the authorities would subsequently not be able to adopt the Plan.

6. PERSONNEL IMPLICATIONS

6.1 There are no personnel implications relating to this report. The head of Human Resources has been consulted and have no comments.

1. Introduction

1.1 This document has been produced to include any main modifications which have arisen throughout the examination stage of the Greater Manchester Joint Minerals Development Plan Document (the Minerals Plan).

1.2 These changes are being suggested to update the Minerals Plan prior to adoption to reflect the results of the public examination, factual amendments and errata.

2. Proposed changes

2.1 The following table lists all the main modifications to the main body of the Submission version of the Minerals Plan.

All non-mineral development proposals within the Mineral Safeguarding Area (see maps 4, 5, 6, 7 & 8) should extract any viable mineral resources present in advance of construction. Proposals for prior extraction of minerals will be permitted provided the proposal is in accordance with Policy 1 'Key Planning and Environmental Criteria'.

Proposals for non-mineral development within the Mineral Safeguarding Areas which that do not allow for the prior extraction of minerals will only be permitted where:

1. The need for the development outweighs the need to extract the mineral; or 2. It can be clearly demonstrated that it is not environmentally acceptable or economically viable to extract the mineral prior to non- mineral development taking place; or; 3. It can be clearly demonstrated that the mineral is either not present or of no economic value or too deep to extract in relation to the proposed development; or; 4. The development is limited (10) or temporary and would not prevent minerals extraction taking place in the future.

Exemptions

This policy does not apply to the following: i. Applications for Householder development ii. Applications for extension to commercial developments similar in scale to householder developments iii. Applications for Conservation Area Consent

Peat has been used for the past forty years as a growing medium enhancer for horticulture and gardening. In recent years substitute products have been developed which are proving increasingly attractive to the amateur and commercial grower.

MPG 13 ‘Guidelines for Peat Provision in England’ proposed a target of reducing peat use such that 40% of growing media and soil improvers would not contain peat by 2005. The latest 2009 data indicates that 58% has been achieved.

More recently Defra published a ‘Consultation on reducing the horticultural use of peat in England’ in December 2010. This continued the policy trend of seeking to reduce peat use. It recognised both the important commercial role peat has to play within the horticultural industry and its environmental role as an important ecosystem for wildlife and carbon sink. With both these considerations in mind the consultation paper sought views on the elimination of peat from the amateur horticultural market by 2020 and the feasibility of phasing out peat from the commercial sector by 2030. It argued that no planning permissions be granted for new peat workings. Following this consultation Defra set out plans for reduction in peat use and confirmed the 2030 ambition for zero peat use in the Natural Environment White Paper.

The White Paper also announced the creation of a peat task force to explore how to overcome barriers to further reducing peat use in horticulture. This has broadened its remit to that of putting the horticultural sector on a long-term

To reflect this change of emphasis, it is now operating under the working title of the Sustainable Growing Media Task Force.

The 2007 Panel Report for the North West Regional Spatial Strategy indicates that there are sufficient peat workings with planning permission to meet existing and future demand and no planning permissions need be granted for new peat workings.

The National Planning Policy Framework does not identify peat as a ‘mineral resource of local and national importance’ and requires that Local Planning Authorities do not identify new sites or extensions to existing sites for peat extraction.

The main local issue relates to the need to re store areas of degraded lowland arising from previous peat working.

There are two main local issues relating to peat resources in Greater Manchester:

Firstly the need to restore areas of degraded lowland bog arising from previous peat working. With this issue in mind the Greater Manchester Minerals Plan complements the developing National Planning Policy Framework and the strategic background both of which point to the

Secondly, there are areas of peat resources in Tameside and Trafford, which have either already been built upon, are the subject of valid planning permissions for non-minerals development or are the subject of future non- minerals development aspirations supported by the Local Planning Authority. These areas are not the focus of Policy 6 as future development at these locations is not considered as mineral working nor is it likely to impact upon peat resources which could be restored to lowland bog habitat as supported by the EU Habitats Directive.

Peat is also considered by Policy 7 ‘Mineral Safeguarding Areas’. This Policy safeguards known peat depos its in Greater Manchester from s terilisation by n on minerals develop0ment as required by MPS1.

In line with the requirements of the National Planning Policy Framework the Minerals Plan does not include a Mineral Safeguarding Area for peat resources.
