INTRODUCTION In 2009, a group of researchers from University of California, Los Angeles released the fi ndings of a study of low-wage workers in New York, Chicago, and Los Angeles, aimed at assessing the prevalence of workplace violations in the nation’s three largest cities.1 The result was eye-opening for lawmakers: federal and state employment laws are not providing adequate protections to the most critical, and indeed the most vulnerable, members of the United States (“U.S.”) workforce—immigrant workers. Among the report’s fi ndings, the fact that two-thirds of the workers surveyed suffered pay violations, losing roughly $2,600 in annual wages, which is about fi fteen percent of their yearly salaries, is especially alarming.2 This report, along with others, indicates the need for immigration reform has reached critical levels. Regrettably, the political discourse over immigration reform is entangled in America’s culture wars.3 Anti-immigrant activists maintain that immigrants come to the United States to take advantage of social welfare programs, health care services, and birthright citizenship. However, this anti-immigrant rhetoric does not adequately explain why people actually pack up and leave their home countries to come to the United States.

NOTE Organizing in the Shadows: Limits on Union Organization of Undocumented Day Laborers Paige Coomer* ABSTRACT This Note illustrates how the current US labor scheme acts as an impediment to union organization of undocumented day laborers. While the market for these contingent workers grows, so too does the need for worker protection from abuses. However, unions face legal and structural barriers that prevent them from effectively organizing day laborers. Ultimately, these legal and structural barriers show that the US labor scheme as a whole is incapable of effectively responding to the needs of day laborers, and by extension, to the needs of a globalized, migrant workforce. My Note argues that by failing to adapt to changes brought on by globalization, our labor law cannot be harnessed to protect vulnerable day laborers.

    Dear Legislator: We, the undersigned organizations, would like to express our support for the DREAM Act of 2009 (H.R. 1751/S.729). We hope that Congress acts quickly to enact this piece of legislation. Each year, approximately 65,000 undocumented students graduate from U.S. high schools. These students, raised as Americans, deserve a chance to become legal residents of the country where they grew up. The DREAM Act will provide a path to legal status for individuals brought to the U.S. as children. Under the DREAM Act, most students with good moral character who came to the U.S. at age 15 or younger and have lived in the U.S. for at least five years before the date of the bill’s enactment would qualify for conditional permanent resident status upon acceptance to college, graduation from a U.S. high school, or being awarded a GED in the U.S. The conditional status will be lifted if the student completes at least two years of college or serves in the military. We urge your support for this important legislation. Regards, Peter -------------------------------------------------------------------------------- The Denver Post Sunday, February 29, 2004 - States forced to deal with migrant issue Sides entrenched as debate reverberates across country By Michael Riley Denver Post Staff Writer ANNAPOLIS, Md. - Outside, men with calloused hands and mud-covered boots sheltered themselves from the icy Maryland wind with signs shouting "We are a nation of immigrants." Inside the red-brick statehouse, a debate over a slew of bills that would affect many of those newcomers provided more heat than most of the button-down lawmakers bargained for. Conservatives supporting a bill to require local police to enforce federal immigration laws rattled off crime statistics and warned of the growing threat of the Russian mafia and Middle East terrorists. Advocates for immigrants [illegal aliens] countered with stories of the newcomers' hard work and success - and lobbied for in-state tuition for undocumented immigrants [illegal aliens]. Six hours and more than 50 witnesses later, state Assemblyman Ted Sophocleus, a Democrat from Linthicum, was clearly frustrated. "We'd love to leave this up to the federal government, but this is starting to affect local jurisdictions," Sophocleus said of the 11 immigration-related bills Maryland lawmakers will consider this session. "Are we going to resolve all the problems of illegal immigrants? Of course not. But we can't sit here and do nothing." Maryland's heated debate over immigration two weeks ago in many ways typifies a battle that is moving from Washington to state legislatures nationwide.
