RESOURCE CONSERVATION AND RECOVERY ACT PART B PERMIT APPLICATION NOTICE OF ADMINISTRATIVE COMPLETENESS AND NOTICE OF DRAFT HAZARDOUS WASTE MANAGEMENT PERMIT

The Arkansas Department of Environmental Quality (ADEQ), Hazardous Waste Division, received a U.S. Resource Conservation and Recovery Act (RCRA) Part B Permit Renewal Application from U. S. Army, Pine Bluff Arsenal (Applicant) dated January 10, 2006, revised February 3, 2006. ADEQ determined the application to be administrative complete on February 3, 2006.

ADEQ is also providing for notice their tentative decision to issue a Hazardous Waste Management Permit to the Applicant located in Jefferson County, Arkansas. The proposed Permit is based on the Permit application for a miscellaneous treatment unit. The Permit application is for operation of a White Phosphorus Treatment Unit (WPTU) with a treatment capacity of 800 pounds per hour. Both an Open Burn and an Open Detonation (OB/OD) unit (operating under RCRA Interim Status) were originally part of this Permit application, but the Applicant has withdrawn these units from the application (letter dated February 2, 2006) and these units will be undergoing closure under Interim Status standards [Regulation No. 23 §265 Subsection G]. The Permit is to be issued under the authority of the Arkansas Hazardous Waste Management Act (AHWMA), Arkansas Code Annotated Section 8-7-201 et seq., and the U.S. Resource Conservation and Recovery Act of 1976, as amended (Title 42 United States Code, Section 6901 et seq.).

Persons may review the Part B application, the draft Permit, and the administrative record at the ADEQ Records Management Section at the Arkansas State Police Headquarters, One State Police Plaza, Little Rock, Arkansas, or at the Watson Memorial Library, University of Arkansas at Pine Bluff, 1200 N. University Drive, Pine Bluff, Arkansas.

The Pine Bluff Arsenal (PBA) is a ammunition manufacturing and storage facility. PBA is located eight miles northwest of the City of Pine Bluff. PBA produces conventional ammunition products and munitions containing payloads for smoke, incendiary, illumination and infrared generation. Smoke pay-load capabilities include white phosphorous (WP) and red phosphorous (RP).

This Notice satisfies the requirements of Arkansas Code Annotated Section 8-4-203(b), and of the Resource Conservation and Recovery Act (RCRA), as amended, 40 U.S.C. 6901, et seq., 40 CFR 124.10 et seq., and Arkansas Pollution Control & Ecology Commission (APC&EC) Regulation No. 23 (Regulation No. 23). The final Permit, if issued by ADEQ, will implement the requirements of the Hazardous and Solid Waste Amendments of 1984 (HSWA), amending the Federal Solid Waste Disposal Act, as amended, as well as the requirements of the AHWMA. The United States Environmental Protection Agency (EPA) has authorized ADEQ to implement the federal hazardous waste program in Arkansas, including all hazardous waste management regulations applicable to the facility. The RCRA Permit, if issued, will only be signed by the authorized person of ADEQ.

ADEQ will, in response to written requests, hold a public hearing whenever the ADEQ Director determines such a hearing might clarify issues concerning the Permit application and/or Permit. Any request for a hearing must include the requester’s name and address, and shall state the nature of the issues to be raised in a hearing. ADEQ will issue a public notice of a hearing at least 30 days prior to the scheduled hearing.

Should ADEQ determine a hearing is necessary; the Department will schedule a public hearing and will notify the Applicant, and all other persons who have submitted comments, of the date, time and place of the public hearing. The Department, following consideration of all comments received, will make a final decision regarding the Permit Application.

ADEQ maintains a list of interested individuals who are mailed copies of a Fact Sheet on or near the day of publication of a public notice relating to the proposed actions.

Any individuals, including the Applicant, who wish to comment, request a public hearing, or add their names to the mailing list concerning ADEQ decisions relating to the Permit issuance must do so by delivering, mailing, or e-mailing written comments, along with their mailing address to:

All comments and requests for a public hearing must be received by 4:30 p.m. on May 5, 2006. Only comments regarding the Permit will be considered.

Submitting written comments to ADEQ or making oral statements on the record at a public hearing on the Permit provides individuals with legal standing to appeal a final Department decision. Comments supporting or opposing the tentative decision will provide legal standing. Only parties with legal standing may appeal the decision.
