A MEETING of the PLANNING COMMITTEE was held at the MANSION HOUSE, DONCASTER on TUESDAY, 9TH JUNE, 2009, at 2.00 p.m.

116. MINUTES OF THE MEETING HELD ON 12TH MAY, 2009 AT 2.00 PM

RESOLVED that the minutes of the meeting held on 12th May, 2009, be approved as a correct record and signed by the Chair.

117. DEFINITIVE MAP MODIFICATION ORDER (EAST BANK OF THE STAINFORTH AND KEADBY CANAL FROM WEST STREET TO WIKE WELL BRIDGE, THORNE)

The Committee received a report presented by George Diprose, Public Rights of Way Officer, which reported on a direction made by the Secretary of State for Environment, Food and Rural Affairs to Doncaster Council to make a Definitive Map Modification Order for a claimed public footpath on the east bank of the Stainforth and Keadby Canal.

RESOLVED that

i) a Definitive Map Modification Order adding a public footpath between West Street and Wikewell Bridge in Thorne to the Definitive Map and Statement, be made,

ii) a neutral stance at any subsequent Public Inquiry or Hearing that may be required, be taken, and,

iii) if there are no objections made to the order, or if all objections received are withdrawn, then authority to permit confirmation of that order, be given. 118. THE APPLICATION OF NATIONAL AND REGIONAL FLOOD POLICY WITHIN DONCASTER

The Committee received a presentation from Steve Butler, Spatial Planning Manager, which provided Members with information regarding a Planning Guidance Note clarifying Doncaster’s interpretation of the of the following National, Regional and Local Flood Policies:

 Planning Policy Statement 25 (Flooding)  Planning Policy Statement 3 (Housing)  Regional Spatial Strategy  Local Development Framework  Unitary Development Plan

Members were informed that this guidance note had been endorsed by the Environment Agency and had already been used to successfully defend the Council at several recent appeals. This guidance would eventually be formalised as a Supplementary Planning Document (SPD).

The Spatial Planning Manager explained that all proposals for housing developments within the borough would be required to meet the SPD, which could help to identify sites at a lower risk of flooding if possible and will require developers to apply the Sequential and Exceptions Tests to assess flood risk. Richard Purcell, Head of Development Management, explained that the Committee’s views were sought as to the most appropriate approach to be taken with regards to applying these tests to infill developments.

Members were of the opinion that requiring all infill developments to undergo a sequential test could have a negative impact on infill developments in the Borough and therefore agreed that Approach 2, ‘Infill Developments within the Main Urban Area and RSS Principal Towns (Thorne and ) are deemed to have automatically passed the Sequential Test, Infill developments elsewhere are required to undergo the Sequential Test,’ was the most appropriate approach.

One Member held the view that Flood Risk Assessments should demonstrate a neutral impact on local flooding including the use of Sustainable Drainage Systems before planning permission is granted.

RESOLVED that

i) the proposal to produce a Supplementary Planning Document, based on the Flood Guidance, be endorsed,

ii) that ‘Approach 2’ to infill developments, be considered to be the most appropriate, and,

iii) a requirement for new developments to demonstrate a neutral impact on local flooding, including the use of Sustainable Urban Drainage Systems be included in the Supplementary Planning Document. 119. PLANNING AND OTHER APPLICATIONS

RESOLVED that upon consideration of a Schedule of Planning and Other Applications received, together with the recommendations in respect thereof, the recommendations be approved in accordance with the Schedule hereto and marked Appendix ‘A’.

The proposed development would prevent a significant detrimental effect to the character and appearance of the local area and the siting of the dwellings respects the privacy of neighbouring occupiers. Lastly, subject to conditions, the access serving the development would not create Highway safety problems.

(Receipt of additional representation in opposition to the application, on grounds similar to other objectors, was reported at the meeting).

The existing use along with the proposed extension, which is currently open to members of the public in a sustainable location. The proposed development is considered to be of an appropriate layout and appearance, which will not be harmful to the character of the surrounding area. The development will provide enhanced shopping facility whilst causing no significant impact on neighbouring residential properties, highway safety or the character of the area.
