1.0 Background

1.1. Paragraph 74 of the National Planning Policy Framework (NPPF) requires Councils to:

“identify and update annually a supply of specific deliverable sites sufficient to provide a minimum of five years’ worth of housing against their housing requirement set out in adopted strategic policies, or against their local housing need where the strategic policies are more than five years old. The supply of specific deliverable sites should in addition include a buffer (moved forward from later in the plan period) of:

a) 5% to ensure choice and competition in the market for land; or b) 10% where the local planning authority wishes to demonstrate a five year supply of deliverable sites through an annual position statement or recently adopted plan, to account for any fluctuations in the market during that year; or c) 20% where there has been significant under delivery of housing over the previous three years, to improve the prospect of achieving the planned supply”

1.2. This report sets out South Holland District’s 5-year housing land supply position in accordance with the NPPF.

2.0 South Holland District’s 5-year housing requirement

2.1. Planning Practice Guidance (PPG) indicates that:

“housing requirement figures identified in adopted strategic housing policies should be used for calculating the 5 year housing land supply figure where: - The plan was adopted in the last 5 years, or - The strategic housing policies have been reviewed within the last 5 years and found not to need updating.”

2.2. In the context of the above, the South East Local Plan (The Plan or SELLP) was adopted on 8 March 2019. The document provides the strategic planning policies, including those relating to housing delivery, for both South Holland District Council and Boston Borough Council. The Plan (Policy 10) identifies a requirement for 11,681 new homes to be built between 2011 and 2036 (an average of 467 per annum) in South Holland. This is based on evidence in the Peterborough Sub-Regional Strategic Housing Market Assessment Update which was published in March 2017, as well as a 5% uplift for affordable housing agreed at the Local Plan Examination hearing session on 28th November 2017.

2.3. However, account must be taken of housing completions between 1st April 2011 and 31st March 2021, as well as any under or over-supply during that period. Table 2 shows that a total of 3717 homes were completed over that period. In total, it represents an undersupply of 953 homes when compared against the basic requirement.

2.4. It is important to note that whilst the Council’s monitoring system and the National House Building Council housing returns provide a good data source, in 2017/18 and 2018/19, 374 units have only been identified as being completed through physical site by site surveys in April to May. Furthermore, an additional 49 dwellings have been identified as being completed by the Strategic Housing department at the Council. This has had a significant impact on the figures recently reported.

UNDERSUPPLY TO DATE

2.5. The undersupply to date stands at 947 dwellings. There are two well-established approaches for dealing with past shortfalls, which are known as the ‘Sedgefield’ and ‘Liverpool’ methods. The ‘Sedgefield’ method seeks to meet any shortfall over the following five years, whereas the ‘Liverpool’ method spreads the shortfall equally over all the remaining years of the plan period (16 in this instance).

2.6. There is nothing in the NPPF to suggest that one method is preferable to the other, but the PPG appears to favour the ‘Sedgefield’ method. The different methods are used by various authorities and quoted in various appeal decisions.

2.7. Crucially at the Local Plan examination, the Inspector determined that South Holland should consider its 5-year housing land supply under the Liverpool method and this is confirmed in the Inspector’s Decision letter which states:

Para 75: Whilst such shortfalls would usually be added to the five year supply figure (Sedgefield method), the authorities have demonstrated that, due mainly to long SUE lead-in times it is justified to spread the shortfall over the full Plan period (Liverpool method).

Para 76: “Account must be taken of the under delivery of housing in both the Boston and South Holland areas in the recent past. Consequently, to calculate the five year housing land supply, a 20% buffer has been moved forward from later in the Plan period to enhance the prospect of achieving the planned supply and to ensure choice and competition. This buffer has been applied to the sum of the requirement and the proportion of the shortfall that has been added to the five year supply under the Liverpool method. This methodology is justified under the circumstances.”

2.8. This approach is followed through in the Plan and specifically in the supporting text of Policy 10 at paragraph 5.2.6, which states:

“The Local Plan’s housing provisions (both commitments and allocations) rely heavily on Sustainable Urban Extensions, which will help to deliver important new infrastructure. As a consequence of their scale and complexity, these Sustainable Urban Extensions are not expected to deliver new dwellings until later in the Local Plan period. Thus, the provisions of the Local Plan are significantly ‘back-loaded’ and the shortfalls from the Local Plan’s first six years will therefore be met over all the remaining years of the Plan period (i.e. the ‘Liverpool’ method will be used).”

2.9. Therefore, to accord with Development Plan, the ‘Liverpool’ method must be used to calculate the shortfall that needs to be added to the basic requirement to identify the annual housing requirement for the purposes of considering the Council’s 5 year supply. The calculations are shown in Table 4.

THE BUFFER

2.10. Once the 5-year requirement has been calculated, the NPPF (Para 74) requires local authorities to identify a buffer, as set out above, to ensure choice and 3

competition in the market, and where there has been a record of persistent under- delivery of housing, this should be increased to 20%.

2.11. South Holland passed the Governments Housing Delivery Test this year with 116%, and therefore faced none of the three consequences associated with failing the test including having to apply a 20% buffer. See https://www.gov.uk/government/publications/housing-delivery-test-2019- measurement

2.12. However, considering the historic under delivery of sites within South Holland, and the fact that there remains a substantial shortfall, despite rates improving, it is considered that the Council should apply a 20% buffer to the requirement.

2.13. It is made clear in the NPPF that this additional requirement is moved from further in the plan period and is not an additional requirement for more housing. In essence, it is intended to identify sites that could come forward sooner if there is sufficient demand.

2.14. It is therefore clear that this ‘buffer’ is not actually required to be built as part of the supply, unlike the basic annual requirement or the undersupply to date. Therefore, whilst the buffer makes up part of the question as to whether we have a 5 year supply or not, it should not be used in the calculation of how many years of supply actually exist.

2.15. Therefore there are two steps:

1. We have a 5 year supply where the deliverable supply is greater than Basic requirement x 5 + (Undersupply/15 x 5) + 20% 2. The years of supply that we have is: Supply divided by (Basic requirement + Undersupply/15)

3.0 What is South Holland District’s deliverable housing supply?

3.1. The Glossary of the NPPF (2021) indicates that,

“To be considered deliverable, sites for housing should be available now, offer a suitable location for development now, and be achievable with a realistic prospect that housing will be delivered on the site within five years. In particular: a) sites which do not involve major development and have planning permission, and all sites with detailed planning permission, should be considered deliverable until permission expires, unless there is clear evidence that homes will not be delivered within five years (for example because they are no longer viable, there is no longer a demand for the type of units or sites have long term phasing plans). b) where a site has outline planning permission for major development, has been allocated in a development plan, has a grant of permission in principle, or is identified on a brownfield register, it should only be considered deliverable where there is clear evidence that housing completions will begin on site within five years”.

3.2. Taking the above definition into account, South Holland District Council considers that the following types of sites contribute to deliverable supply: 4

• Large sites (greater than 10 dwellings) with full planning permission or an outline permission with a reserved matters. Outline permissions with no reserved matters are also considered deliverable where the developer / agent has provided delivery information, or towards the rear part of the 5 year period; • Small sites with full planning permission, outline permission (with or without reserved matters) and housing development granted by other means (e.g. prior notification); • Sites which are allocated in the SELLP (March 2019) and there are indications that it will start to deliver within 5 years.

3.3. South Holland District’s Brownfield Land Register identifies 28 brownfield sites that the council considers appropriate for housing-led development. However, a large proportion of these sites already have some form of planning permission or are allocated in the Local Plan. These are therefore already included in the deliverable supply under the categories above. There are 6 sites identified on the Brownfield Land Register that are not permissioned or allocated for housing development, but it is not considered that there is clear evidence that these sites would be capable of delivering housing completions within the next 5 years. These sites have therefore not been included within the deliverable supply set out in the Appendix to this report.

Approach to Windfalls

3.4. Paragraph 71 of the NPPF (2021) indicates that:

“Where an allowance is to be made for windfall sites as part of anticipated supply, there should be compelling evidence that they will provide a reliable source of supply. Any allowance should be realistic having regard to the strategic housing land availability assessment, historic windfall delivery rates and expected future trends”.

3.5. The Inspectors who conducted the Examination of the South East Lincolnshire Local Plan concluded (in paragraph 79 of their report (dated 29th January 2019)) that “sites of fewer than 10 dwellings have not been allocated in the SELLP, although the evidence suggests that historically such sites have made a significant contribution to housing supply (over 20% on average). Although some of these sites have been on residential gardens, which national policy now discourages, a proportionate windfall contribution is still justified, having made an appropriate discount”.

3.6. The Inspectors therefore sought the modification of the Local Plan (Main Modification 036) to include a windfall allowance of 53 dwellings per annum in South Holland District. The windfall allowance was not, however, included in the first three years of the Local Plan’s housing trajectory because “it is assumed that over the next three years all ‘windfall’ completions will come from the stock of commitments”.

3.7. It is therefore considered that the same approach should be taken in this Assessment, and that a windfall allowance should not be applied for the next three years. Thus, windfall sites can be expected to contribute a total of 106 dwellings up to 31st March 2026 (53 x 2 = 106). 5

OVERALL SUPPLY

3.8. Paragraph 31 of the PPG indicates that “local planning authorities will need to provide robust, up to date evidence to support the deliverability of sites, ensuring that their judgements on deliverability are clearly and transparently set out.” The Appendix to this report identifies all the sites that the District Council considers contribute to deliverable supply and identifies how many new homes the Council expects each site to deliver up to 31st March 2026.

LAPSE RATES

3.9. It should be noted that lapse rates of either 10% have been applied to certain sites, depending on the permission type.

3.10. No lapse rate has been applied to extant planning permissions (i.e. those that have been implemented in some manner). Sites allocated in the Local Plan have also been totally discounted where delivery information has not been provided and there is no justification for inclusion.

4.0 South Holland District - 5-Year Land Supply Position for 1st April 2021 – 31st March 2026

4.1. Based on the above information and approach, we can set out the current situation in regard to the Council’s 5-year housing land supply. The figures used are all justified in relation to the detailed tables of sites set out in the appendices.

4.2. This table has been updated from last years after an evaluation of all new dwellings that have been completed over the last year, new planning permissions that have come forward and any sites where the planning permission has now lapsed. Table 3 below looks at the various forms of supply as shown in the appendix tables.

4.3. This shows an overall deliverable supply of 4514 dwellings, which could come forward within the next 5 years.

4.4. The table below looks at the requirement as set out in section 2 above.

4.5. Therefore, the Council clearly have in excess of a 5 year land supply and could currently provide for nine years of housing being brought forward within the next 5 years.

5.0 Recent trends

5.1. The table below shows recent trends in South Holland District’s 5-year supply position (using the agreed ‘Liverpool’ approach). As can be seen, the picture has gradually improved since December 2016, with a steady increase in the supply.

6.0 Conclusion

6.1. In accordance with the Local Plan, the Council calculate the 5-year housing land supply under the Liverpool method, and on that basis have a housing land supply of 8.5 years.

6.2. This is a reasonable assessment of the sites that could come forward within the next 5 years. It is about the availability of land with a reasonable prospect of development. It is not an economic forecast of the sites that be required by the market or the level of demand that there will be for housing within that period.

6.3. As outlined above, Para 73 of the NPPF requires Councils to, “identify and update annually a supply of specific deliverable sites sufficient to provide a minimum of five years’ worth of housing against their housing requirements”. Within this report, those requirements have been met.

6.4. At present, due to the impact of Covid-19 and with the uncertainties around Brexit, it is very difficult to forecast future development rates or how or when we will emerge from the current constraints. However, this work shows that at any such time, there is a significant and justifiable supply of deliverable sites.
