inclusive shall not be applicable to an amount not exceeding one hun- dred million dollars ($100,000,000) of obligations to be issued by the State and Bridge Authority within fiscal year 1968-1969, as previously authorized by section 2 of the act of December 15, 1965 (P. L. 1069), amending the act of April 18, 1949 (P. L. 604), known as the “ and Bridge Authority Act.” Section 18. Constitutional Construction.—The provisions of this act shall be severable and, if any of the provisions thereof shall be held unconstitutional, such decisions shall not affect the validity of any of the remaining provisions of this act. It is hereby declared as the legislative intent that this act would have been adopted had such unconstitutional provisions not been included therein. Section 19. Termination.—No Commonwealth debt shall be in- curred, except by the issue of obligations as defined in this act, and no debt shall be incurred pursuant to the provisions of this act sub- sequent to February 28, 1969. Implementing the provisions of clause (4) of subsection (a) of section 7 of Article VIII of the Constitution of Pennsylvania by providing for the capital budget fur the fiscal year 1968—1969 as required therein. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

Section 1. Short Title.—This act shall be known and may be cited as the “Capital Budget Act for the 1968-1969 Fiscal Year.” Section 2. Required Statement.—This act is enacted pursuant to the provisions of the act of July 20, 1968 (Act No. 217), known as the “Capital Facilities Debt Enabling Act of 1968.” All terms used herein which are defined in such act are used herein as therein defined. Section 3. Over-all Limitations on Debt to be Incurred in Fiscal Year for Capital Projects without Approval of the Electors.—The capital projects to he financed by the proceeds of debt to be incurred during the fiscal year 1968-1969, the aggregate amounts of debt to be incurred during such fiscal year pursuant to clause (4) of subsection (a) of section 7 of Article VIII of the Constitution of Pennsylvania and the fund to be charged with the repayment of such debt are as follows: (1) Such highway projects as are specifically itemized in subsec- tion (b) of section 3 of this act, or as may be specifically itemized in acts supplemental hereto or hereafter enacted. The debt to be incurred for providing funds for and towards the payment of the financial cost of such capital projects by additional bonds of the State Highway and Bridge Authority shall not exceed, in principal amount of bonds to be issued, the sum of one hundred million dollars ($100,- 000,000). Further debt to be incurred for providing funds for and towards the payment of the financial cost of such projects shall not exceed, in principal amount of bonds to be issued, the sum of one hundred seventy-five million dollars ($175,000,000). Repayment of all such obligations whether through lease rentals or otherwise, shall be from the Motor License Fund. (2) Such public improvement projects as are specifically itemized in subsection (a) of section 3 of this act, or as may be specifically itemized in amendments to the act of March 31, 1949 (P. L. 872) known as “The General State Authority Act of one thousand nine hundred forty-nine,” hereafter enacted. The debt to be incurred for providing funds for and towards the payment of the financial cost of such capital projects shall not exceed, in prfncipai amount of bonds to be issued, the sum of two hundred million dollars ($200,000,000). Repayment of all such obligations, whether through lease rentals or otherwise, shall be from the General Fund. (3) Such community college projects as are specifically itemized 650 Act No. 218-219 LAWS OF PENNSYLVANIA, in subsection (e) of section 3 of this act, or as may be specifically itemized in acts supplemental hereto or hereafter enacted. The debt to be incurred for providing funds for and towards the payment of the financial cost of such capital projects shall be incurred pursuant to the provisions of the act of July 5, 1947. (P. L. 1217), known as the “State Public School Building Authority Act,” and shall not ex- ceed, in principal amount of bonds to be issued, the sum of six million dollars (~6,OOO,OOO).Repayment of all such obligations through lease rentals or otherwise, shall be from the General Fund. (4) Such transportation assistance projects as may be specifically itemized in acts supplemental hereto or hereafter enacted. The debt to be incurred for providing funds for and towards the payment of the financial cost of such capital projects shaH not exceed in principal amount of bonds to be issued, the sum of thirty million dollars ($30,- 000,000). Repayment of all such obligations shall be from the General Fund. (5) Other capital projects as may be specifically itemized in acts supplemental hereto or hereafter enacted. The debt to be incurred for providing funds for and towards the payment of the financial cost of such capital projects shall not exceed in principal amount of bonds to be issued, the sum of fifteen million dollars ($15,000,000). Pay- ment of all such obligations shall be from the General Fund. Section 5. Constitutional Construction—The provisions of this act shall be severable and, if any of the provisions thereof shall be held unconstitutional, such decision shall not affect the validity of any of the remaining provisions of this act. It is hereby declared as the legislative intent that this act would have been adopted had such unconstitutional provisions not been included herein. Section 6. Effective ?Date.__This act shall take effect immediately.
