This Writ Petition is filed under Articles 226 & 227 of the Constitution of , praying to issue a writ in the nature of mandamus, directing the respondents to consider the representation of the petitioner filed under Annexure-G dated 20.12.2011 and select the petitioner for the post of Principal for Morarji Desai or Kittur Rani Channamma Schools run by respondents.

This Writ Petition coming on for preliminary hearing this day, the Court made the following:

ORDER

Petitioner has sought for direction to consider his representation Annexure-‘G’ dated 20.12.2011. He has also sought for his selection to the post of Principal of 3

Morarji Desai or Kittur Rani Channamma Schools run by the respondents.

2. Petitioner has served as Assistant Teacher in

Government Higher Primary School. According to him, now he is not serving in any institution. However, it seems he has applied for the post of Principal of Morarji

Desai or Kittur Rani Channamma Schools run by the respondents. Since his application is not considered, this writ petition is filed.

3. Learned Government Pleader submits that the selection list is already issued and the name of the petitioner does not find place in the selection list. If the petitioner is aggrieved by the order of appointments to be issued, it is open for him to question the same in accordance with law.

Be that as it may, at this stage this Court cannot issue direction to the respondents to consider the 4

application of the petitioner for the post of Principal, since the selection is already made.

Petition fails and the same stands dismissed .
