2. Crosstrees LLC: Informational Review and Discussion - Stephen Mohr: (see attached documents) Pamela and Bern Murphy are the clients (Crosstrees LLC). They asked for the Stephen Mohr’s Landscape firm to check out the property. They requested the following as priorities for the plan: a dock for a 62’ boat, swimming pool and tennis court. The architect is from Washington D.C. All the waterfront buildings need some degree of repair. Bath House add toilet,

Boathouse - needs footings redone

Hope cottage in the flood plain lift the building up 21 inches, needs FEMA compliant foundation, three footings are in intertidal zone, and according to MDEP the building can be lifted but it can’t be set back down without completing a full permit (Can’t use Permit by Rule).

Back House needs to be lifted (Permit by Rule) adding 8’4”x10’10.5” addition Need to replace lift station Need to file a FEMA flood hazard permit Already submitted self verification to the Army Corp of Engineers. Need to ask The (CEO) about expanding the Back House since it is non-conforming.

Pending Issues: Notice of Zoning Violation and Order of Required Compliance Edward Lamont, Jr. & Ann Lamont. They removed the easements that were in place when they purchased property from Ann Kiley. That removal of easement created a land locked property, making it an illegal lot.

UPDATE: Tammy has heard from Ann Kiley and Ned Lamont. Ned Lamont is taking steps to correct the easement issue. He has engaged Ed Collins to assist with correcting the issue at hand. He is also covering the cost of the taxes for the acreage that was sold to him but still assessed to Ann Kiley.

5. Chapter 1000: New Shoreland Zoning Rule: We will ask the consultant if she can review our draft Shoreland Zoning Ordinance.

6. Attorney Response re Draft Subdivision Ordinance Proposal: Paul Gibbons called today and will get back to us with his suggestions. He has not reviewed it yet.

7. Land Use Fee Schedule Proposal Update: According to the Town attorney, the Select Board can bring forward temporary fees that need to be approved at Town meeting. Once we are on the agenda, Planning Board members expressed interest in attending the Select Board meeting. 8. Legal Bills: 2016 and 2017 year to date: We will ask Joette to provide another document for our review.

9. Other Business: The Planning Board Secretary will reach out to consultant Beth Della Valle to see if she is available and affordable. Moved by Doug and seconded by Jamien to establish contact with Beth to work on the Shoreland Zoning Ordinance and the Draft Land Use Ordinance, approved 4-0.

In accordance with the Town of North Haven Land Use Ordinance revised through 02/16/2010 and on behalf of applicants, Mr. & Mrs. Byrne Murphy doing business as Cross Trees LLC, Mohr & Seredin Landscape Architects, hereby submits an Application for Land Use Permit, attachments and $350.00 fee for review of the proposed building and site improvements within the Shoreland Zone at their 17.10-acre property at 19 Crosstrees Road.

The applicant proposes a number of building and site improvements and repairs to the Bath House, Boat House, Hope and Back Cottages. The proposed improvements presented in this application are primarily associated with the maintenance and upkeep of the existing circa 1910 buildings; utilities and waterfront grounds at a family compound near Iron Point, the exception being the proposed addition to the Back Cottage. The property is 17.10-acres in size, of which 10.2-acres are located within the 250’ Shoreland Zone as shown on North Haven Tax Assessor Map 4, Lot 6. The site is partially located in the Town of North Haven overlay Shoreland Protection (250’ from Normal High Water) and Rural Zones, with the balance of the acreage located inland from the Shoreland Zone.

The property includes open fields and wooded areas with a series of existing buildings and structures including a Bath House, Boat House, Hope Cottage, Back Cottage, Main/Custom House, a storage building, pier, ramp and float. Per our discussion with the Assistant CEO we understand that the Town of North Haven Planning Board’s jurisdictional review includes the maintenance, repair and replacement activities proposed at the Boat House, Hope Cottage and Back Cottage. Other activities that will be reviewed and approved by the Code Enforcement Officer and Local Plumbing Inspector include the Bath House repairs and toilet, the proposed new swimming pool and the work at the Main and Custom Houses. The activities requiring a permit from the Planning Board are listed from south to north as follows:

Boat House The existing ±40’ x 40’ boat house is built in a classic coastal style and includes an existing wood railway system extending from the Thorofare to the waterside barn doors. The owner intends to

18 Pleasant Street, Portland, Maine 04101 (207) 871-0003 replace the granite cribs under the structure and repair and reset the upland support posts/blocks to improve the structural support conditions. The Boat House will remain in place while the cribs will be replaced in the identical size and location footprints. There will also be isolated repair, replacement and reinforcement of wood sill plates and other deteriorated or damaged wood components as existing conditions are exposed. The applicant will reinforce the roof over the boat storage bay by sistering existing rafters and providing new collar ties. The roof work also includes new blocking along the ridge at the mid-span of the sistered rafters. The building maintenance and structural fixes in conjunction with the exterior work of reshingling will provide longevity to the building for continued and historical boat house use at Crosstrees.

Other work adjacent to the Boat House also includes site disturbance for trenching for the extension, upgrade and replacement of essential utilities including electrical and water. The proposed service upgrades are common to all of the waterfront buildings (Bath, Boat, Hope and Back). The accessory buildings on the island are in immediate need of attention due to deferred maintenance.

Back Cottage The existing 20’-9 ¼” x 18’-8” 2-bedroom Back Cottage (388 SF floor area, 488 SF w/roof overhang) with a FFE 14.2 (NAV 88) is located within the 75’-resource/building setback and is partially within the FEMA Flood Zone (AE, El. 12). Per our review of the Town of North Haven Zoning Ordinance, we understand that a substantial expansion is defined as an increase of more than 33% of the floor area of a structure. Due to the location of the Back Cottage in the Shoreland Zone expansion is limited to 30% (146 SF) per the provisions of the Shoreland Zone expansion area including the roof overhangs. As designed, the proposed addition for the bedroom expansion at the Back Cottage is ±10’-10 1/2” x 8’-4” (92 SF floor area, 110 SF w/roof overhang) which is within the allowable expansion limits. The proposed addition is not located closer to the shore/high water and maintains the existing 42’distance from the highest annual tide location. The owner proposes to replace the existing building supports under the cottage in order to elevate the entire structure approximately 6” intending to raise the structure’s lowest framing member 1’ above the flood elevation.

As proposed the addition is being made to the north rather than to the west due to the higher grades, ledge and mature vegetation on that side the building. No trees or shrubs will be removed for the construction of the addition as proposed.

The Back Cottage project also includes soil disturbance and trenching within the setback to accommodate the support replacement, addition and updates to the electrical, water, septic pump tank and septic service line. Maintenance and repair at the cottage includes shingle and trim replacement while the interior renovation includes space rearrangement to accommodate slightly enlarged bedrooms and bathroom upgrades. The new supporting pilings for the building will conform to the FEMA requirements.

Hope Cottage The existing Hope Cottage is an irregularly shaped structure approximately 45’ x 45’ in size with an overall footprint area of 2,476 SF that includes the roof overhang, a covered porch, concrete patio and steps. The cottage has a FFE of 12.6 (NAV 88) and the entire structure is located within the 75’- resource/structure setback and is within the FEMA Flood Zone (AE, E. 12). The northerly-most corner of the cottage extends over the resource by ±3 feet. As with the Back Cottage, the applicant/owner intends to repair and reinforce the two granite cribs in the resource under the

The utility service upgrades includes installation, relocation and updates to the service lines which requires soil disturbance inland from Highest Annual Tide (HAT). As with the other buildings at the shoreline, maintenance shingle replacement, interior renovation and utility systems upgrades.

The applicant intends to temporarily lift the cottage to repair and rebuild the supports as noted in the Maine DEP NRPA Permit by Rule Notification (copy attached). Future DEP review for the Hope Cottage includes an application for the permanent vertical lifting of the Hope Cottage approximately 24”to raise the building above the FEMA Flood Zone. The aforementioned NRPA Tier Application is being prepared concurrently with the local application. We make note that lifting the cottage for the support replacement and reinforcement is allowed by the DEP PBR that is currently under review. The building will not be reset until the Tier (full) application has been reviewed and approved by the Maine DEP. The Hope Cottage foundation piers will be constructed in compliance with the FEMA regulations and the Town Flood Hazard Development Permit (FHDP). The FHDP will be submitted to the CEO under separate cover.

Other work at the cottage includes replacement of the concrete patio at the easterly face of the building and the stone steps that are compromised. The patio and porch area will not be enlarged. The projects will commence upon receipt of all applicable permit approvals with completion of these permitted activities by early summer, 2018.

Vegetation Removal, Plantings and Erosion Controls The projects noted above have been designed to eliminate the need for tree removal within the 75- foot zone adjacent to HAT. Understory vegetation removal will be limited to existing lawn or wood duff the width of trenches associated with the utility service runs. The services trenches will be backfilled and mulched immediately following installation in order to limit the possibility of sediment migration to the resource. Additional native plantings will be installed adjacent to the Hope and Back Cottages to improve aesthetics and enhance the buffer between the buildings and the resource.

Potential impacts to the buffers and natural resources have been reduced by careful planning regarding the sequence of activities, limiting the understory vegetation removal and avoiding tree removal. Work will be expedited to limit potential for resource impacts and the temporary erosion control consists of the installation of Filtrexx Siltsoxx™ downhill of all proposed work prior to the start of any soil disturbance. The SiltSoxx location is shown on the enclosed Site Plan.

Other Proposed Site and Building Activities Other activities proposed for approval by the Code Enforcement Department include the installation of a new swimming pool, steps and a stone patio adjacent to the Main/Custom House over 100 feet inland from the 75’-resource setback but within the Shoreland Zone. The applicant also proposes interior and exterior maintenance, repair and space reorganization at the Main/Custom House similar to the shorefront buildings. The activities at the Main/Custom House not requiring Planning Board review will be reviewed through Code Enforcement and the Local Plumbing Inspector in advance of work commencement. The details of the proposed inland work have not been finalized to date.

The owners propose exterior and interior improvements to the Bath House (9’-4” x 15’-4”, 168 SF w/roof overhang) as part of necessary maintenance and repair. The work includes updating exterior finishes, roofing and shingle repairs, updating the electrical, water and plumbing and the installation

18 Pleasant Street, Portland, Maine 04101 (207) 871-0003 of a toilet. The Planning Board’s review for the Bath House includes temporary soil disturbance and trenching adjacent to the resource. FEMA A formal submittal for a Flood Permit Application is required for the building elevation changes proposed at the Hope Cottage and Back Cottages. The completed application will be submitted directly to Code Enforcement for review and approval prior to commencement of the proposed structural elevation changes. Raising the buildings is an important element to the overall site improvements planned at Crosstrees by reducing the long-term risk for flood damage to structures. A full relocation of the buildings to an area outside of the flood zone is not practicable due to the wooded site, adjacent slopes, ledge and accessibility issues. Elevation certificates for the residential buildings will be prepared for insurance purposes when the buildings are reset on the new foundations.

Disturbance within the resource setback will be minimized. The following steps will be taken to prevent erosion of soil or fill material from the disturbed areas associated with the Maine DEP NRPA Permit by Rule Notification:

1. Filtrexx Siltsoxx will be installed down gradient at the perimeter of the work areas between the activity and the resource before the activity begins; 2. Siltsoxx will be maintained until the disturbed area is permanently stabilized; 3. Within 7 calendar days following the completion of any soil disturbance, and prior to any storm event, mulch must be spread on any exposed soils; 4. All disturbed soils will be permanently stabilized, and 5. Within 30 days of final stabilization of the site, all temporary erosion control measures will be removed and properly disposed of off-site; 6. All DEP NRPA PBR work is limited to the location and extent depicted on the plan or plans submitted.

This written plan for controlling sedimentation and erosion is based on conservation practices found in the Maine Erosion & Sediment Control BMPS Manual, by the Maine Department of Environmental Protection (DEP), October 2016, or latest edition. The contractor who implements this plan shall be familiar with the aforementioned BMPS publication and the Maine DEP Maine Erosion and Sedimentation Control Practices Field Guide for Contractors, 2014 revision, or latest edition. The contractor will adhere to the publications and the practices presented therein.
