reconsideration ofthe channel capacity restrictions adopted by the

Reconsideration Order. Video dialtone service is intended to compete with

incumbent monopoly cable services. The allocation ofcapacity for a competitive

service should be guided by market considerations, not arbitrarily established by

government regulation. Any arbitrary limitation on the amount ofcapacity that a video programmer can obtain will put the programmer at a competitive

disadvantage to the incumbent cable operator, thus reducing the effectiveness ofa video dialtone service to accomplish the Commission's goals.

The Commission has recognized that the arbitrary limitation of channel capacity to a programmer is not in the public interest. In particular, the

Commission has recently agreed that permitting capacity to go unused after the initial requests for capacity have been met is economically wasteful and inefficient. Thus, the Commission will permit a customer-programmer's allocation to exceed fifty percent ofcapacity ifthe customer-programmer agrees to relinquish capacity in excess of the fifty percent limit ifnecessary to meet future demand. 2

We urge the Commission to adopt this rule for all video dialtone authorizations.

We also support comments objecting to the imposition ofadditional, unnecessary requirements as part of the video dialtone approval process. 3

2 Requirements such as proposed by the Joint Parties4 should be recognized as an

attempt to create additional barriers to video competition, and should be rejected.

Instead, the Commission should adopt commentors' suggestions that would permit

the expeditious consideration and grant of applications so that the benefits of

video dialtone can actually reach American consumers. Consolidating and

streamlining the various procedures that are now required before a local exchange carrier can provide video dialtone services is the proper direction. Regulatory proceedings can be used to unreasonably prolong the start-up time for video dialtone services. Each additional proceeding and additional information requirements burden both Commission and carrier resources and provides monopoly cable opponents greater opportunity to delay actual competition without commensurate benefit to the decision making process. For example, the proposal that the Commission require carriers to file a tariffreview plan should be
