SOUTH GLOUCESTERSHIRE COUNCIL (OFF STREET PARKING PLACES) (CONSOLIDATION AND VARIATION) ORDER 1998

The District Council of (herein referred to as ‘the Council’) in exercise of its powers under sections 35(1) and (3) of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended (hereinafter referred to as “the Act of 1984” as amended (hereinafter referred to as “the Act of 1984”) and of all other enabling powers, after consultation with the chief officer of police in accordance with Part III of Schedule 9 to the Act of 1984, hereby makes the following order: -

PART I – GENERAL

Commencement and Citation

1. This order shall come into operation on the 14th September 1998 and may be cited as the South Gloucestershire Council (Off Street Parking Places) (Consolidation and Variation) Order 1998.

Interpretation

2. (1) Any reference in this order to a numbered is a reference to the Article bearing that number in this order, and any reference in this order to “the Schedule” is a reference to the Schedule to this order.

(2) “Bank Holiday” has the same meaning as defined in the Banking and Financial Dealings Act 1971;

“charging hours” means any period between the hours of 8.00am and 6.00pm in respect of which a charge is specified in Article 6 and Article 8;

“disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for Motor Vehicles) Regulations 1982 amended by the Disabled Persons (Badges for Motor Vehicles) (Amendment) Regulations 1991;

“disabled person’s vehicle” has the same meaning as in the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England and Wales) Regulations 1986 as amended by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England and Wales) (Amendment) Regulations 1991;

“discounted penalty charge” 0716

“driver” in relation to a vehicle waiting in a parking place, means the person driving the vehicle at the time it was left in the parking place;

“invalid carriage” and “motor cycle” has the same meaning as in section 136 of the Act of 1984;

“motor vehicle” means a mechanically propelled vehicle not being a motor cycle or an invalid carriage which is constructed itself to carry a load or no more than seven passengers exclusive of the driver and their effects, is fitted with tyres of such a type as may be specified in regulations by the Secretary of State and of which the weight laden does not exceed 1525 kilograms;

“notice to owner” 0716 “owner” in relation to a vehicle means the person by whom such a vehicle is kept and used;

Page 1 of 15 “parking attendant” means a person authorised by or behalf of the Council to supervise any parking space specified in column 1 of Schedule 1, column 1 of Schedule 2, column 1 of Schedule 3, column 1 of Schedule 4 to this order in accordance with provisions contained in 0716 section 63A of the Act of 1984;

“parking bay” means any area of a parking place which is provided for the leaving of a vehicle and indicated by markings on the surface of the parking place;

“parking place” means any area of land specified by name in column 1 of Schedule 1, column 1 of Schedule 2, column 1 of Schedule 3, column 1 of Schedule 4 provided by the Council under section 32 or section 33 of the Act of 1984 for use of a parking place;

“passenger carrying vehicle” has the same meaning as in section 121 of the Road Traffic Act 1988;

“pedal cycle” means a bicycle, tricycle or cycle having four or more wheels, not being in any case a motor vehicle;

“penalty charge notice” means a notice issued or served by a parking attendant pursuant to the provisions of section 66 of the Road Traffic Act 1991;

“prescribed” means prescribed by any enactment or any regulation, order, direction or other instrument made hereunder;

“relevant position” has the same meaning as in the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England and Wales) Regulations 1986 as amended by the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England and Wales) (Amendment) Regulations 1991; and

“trailer” means a vehicle drawn by a motor vehicle as defined in section 136 of the Act of 1984.

(3) The Interpretation Act 1978 shall apply to the interpretation of this order as it applies to the interpretation of an Act of Parliament and as if for the purposes of section 16 of that Act this order were an Act of Parliament and the orders revoked by Article of this order were an Act of Parliament thereby repealed.

(4)

(5) Any reference in this order to any enactment shall be construed as amended applied consolidated or re-enacted by or having effect by virtue of any subsequent enactment.

PART II – USE OF PARKING PLACES

3. (1) Each area of land specified by name in specified in column 1 of Schedule 1, column 1 of Schedule 2, column 1 of Schedule 3 and column 1 of Schedule 4 may be used, subject to the following provisions of this order, as a parking place for such classes of vehicles, in such positions on such days and during such hours as are specified in relation to that area in the Schedule.

(2) Where in the Schedule a parking place is described as available for vehicles of a specified class or in a specified position the driver of a vehicle shall not permit it to wait in that parking 0716 place unless it is of the class and in the position so specified.

(3) The driver of a vehicle shall not permit to wait: - 0716

(i) in any parking place specified in column 1 of Schedule 1 for longer than two hours; (ii) in any parking place specified in column 1 of Schedule 2 for longer than twelve hours; (iii) in any parking place specified in column 1 of Schedule 3 for longer than twenty-four hours; (iv) in any parking place specified in column 1 of Schedule 4 for longer than the period specified in column 6 of that Schedule in relation to the parking space.

(4) When a vehicle has left a parking bay in any parking place specified in column 1 of Schedule 1 or column 1 of Schedule 2 or column 1 of Schedule 3 after waiting therein the driver thereof shall not within one after its leaving permit it to wait again in that parking space.

(5) Nothing in paragraph (1) or paragraph (2) or paragraph (3) or paragraph (4) of this Article shall apply to any vehicle which is a vehicle in the service of or employed by the Council and is being used for the purpose of cleaning or carrying out maintenance works in the parking place.

4. (1) Where, within a parking place, there is a sign or surface marking which indicates that a parking space is available only for a disabled person’s vehicle, the driver of a vehicle shall not permit it to wait in that parking bay unless it is a disabled person’s vehicle or an invalid carriage.

(2) Where, within a parking place, an area or a parking bay or parking bays as the case may be are reserved for a specific class of vehicle, no vehicle of any other class shall wait in any such area or parking bay or parking bays unless as required by a parking attendant on duty at the parking place.

(3) Where, within a parking place, an area or a parking bay or parking bays as the case may be are marked as reserved for special functions or otherwise not available for general use, no vehicle shall wait in any such area or parking bay or parking bays unless as may be required bay a parking attendant on duty at the parking place.

(4) In so far as a vehicle is left in a parking place during the charging hours the driver thereof shall pay such charge or charges as are specified in the following provisions of this order.

5. (1) Nothing on this order shall prevent the Council, by notice displayed at the parking place: -

a.) from closing the parking place or any part thereof for any period; or b.) from setting aside for use only by specially authorised vehicles of any part or parts of the parking place on all days or certain days or during certain parts of certain days.

(2) Nothing in this order shall prevent any person specially authorised by the Council from using any parking place or part thereof as may be defined by the Council: -

Provided that any such use is in accordance with any conditions or restrictions contained in any such authorisation and is only for the duration specified therein.

PART III – CHARGING PROVISIONS

Amount of initial charge at parking places

6. (1) This article applies to those parking places specified by name in column 1 of Schedule 4 in relation to which a charge is imposed by column 7 of the said Schedule.

Page 3 of 15 (2) The initial charge for a vehicle left in a parking place during the charging hours shall be set out in relation to that parking place in column 7 of the said Schedule.

(3) The charge referred to in paragraph (2) of this Article shall be payable by the insertion of an appropriate coin or coins into the apparatus or device provided being an apparatus or device approved in accordance with section 35(3) of the Act of 1984 and the provisions of section 47(5) of the Act of 1984 apply in respect of such apparatus.

(4) The owner of a vehicle may on application to the Council purchase a season ticket in respect of that vehicle for a charge ascertained by reference to the charge specified in paragraph (2) of this Article and that season ticket shall be valid in such parking places as are specified thereon during the period for which it is issued.

(5) Any ticket issued on payment of the charge referred to in paragraph (2) of this Article shall be attached in a conspicuous position to the vehicle in respect of which it was issued. A vehicle shall not be left in a parking place if it displays an out of date ticket.

Exemption from charges

7. (1) The driver of a disabled person’s vehicle which displays in the relevant position a disabled persons badge shall be exempt from any payment specified in Article 6.

(2) The driver of a motorcycle without a sidecar or a pedal cycle shall be exempt from any payment specified in Article 6 and Article 8 if he leaves it in a parking place where there is a sign or surface marking which indicates that it is available only for a vehicle of such a class but otherwise shall be liable to the same charges as the driver of any other vehicle.

Amount of excess charge at parking places

8. (1) (a) If a vehicle is left in a parking place during the charging hours for longer than the initial period for which the payment was made or a vehicle is left in a parking place in V0444 contravention of the provisions of this order the initial charge together with an initial amount is hereinafter referred to as the “excess charge”) shall be payable.

(b) The initial charge and the excess charge which would otherwise be payable under sub paragraph (1)(a) of the Article shall not be payable if the driver of a vehicle in respect of which a excess charge may have been incurred within seven days to the Council the sum of fifteen pound.

(2) In the case of a vehicle in respect of which an excess charge may have been incurred it shall be the duty of a parking attendant to attach to the vehicle, unless prevented by doing so by the driver, in a conspicuous position a notice which shall include the following particulars:

(a) the registration mark of the vehicle or, where the vehicle is being used under a trade licence, the number of the trade plate carried by the vehicle;

(b) the time at which he first observed that the initial period for which payment was made by the initial charge had expired;

(c) a statement that the excess charge of thirty pounds is required to be paid; V0444

(d) the manner in which and the time within which the excess charge should be paid;

(e) a statement that the excess charge of thirty pounds is not payable in the circumstances referred to in Article 8(1) (b). V0444

9. (1) The excess charge shall be paid to the Council either by cheque, bankers’ draft or postal order in accordance with the instructions printed on the notice referred to in paragraph (2) of Article 8 no later than 4.00pm on the fourteenth day following the day on which the excess charge was incurred or in cash in person or by messenger at the Council facilities for receiving payment not later than aforesaid: -

Provided that, if the fourteenth day falls upon a Saturday or on a day which the Council facilities for receiving payment are closed, the period for payment of the discounted excess charge shall be extended until 4.00pm on the next full day on which the said facilities are open.

(2) Where payment of the excess charge is received by the Council within a period of seven days following the day on which the excess charge was incurred, a discounted sum of fifteen pounds will be accepted in settlement of the excess charge.

Provided that, if the fourteenth day falls upon a Saturday or on a day which the Council facilities for receiving payment are closed, the period for payment of the discounted excess charge shall be extended until 4.00pm on the next full day on which the said facilities are open.

Period for which a vehicle may be left after an excess charge incurred

10. (1) The period for which a vehicle may be left in a parking place during the charging hours after the excess charge has been incurred shall not exceed two hours.

(2) If a vehicle is left in a parking place during the charging hours for more than two hours after the excess charge has been incurred, it shall be the duty of a parking attendant to attach to the vehicle in a conspicuous position, unless prevented from doing so by the driver, a notice which shall include the following particulars: -

(a) the registration mark of the vehicle or where the vehicle is being used under a trade licence the number of the trade plate carried by the vehicle;

(b) the time at which he first observed that the vehicle had been left in a parking place for more than two hours after the excess charge had been incurred; and

(c) a statement that it is an offence under section 35A of the Act of 1984 for the driver of a vehicle who has left the vehicle therein for longer than two hours after the excess charge has been incurred.

Restriction on removal of notices

11. When a notice has been attached to a vehicle in accordance with any of the foregoing provisions of this order, no person other than a person authorised by the Council in that behalf or the driver or a person authorised by the driver in that behalf shall remove the notice from the vehicle.

PART IV – OTHER PROVISIONS

12. The driver of a vehicle shall not permit that vehicle to wait in a parking place unless the vehicle is licensed in pursuance of the provisions of the Vehicle Excise and Registration Act 1994 and unless there is in relation to use of the vehicle by the driver such a policy of insurance as complied with the requirements of the Road Traffic Act 1988.

Page 5 of 15 13. The driver of a vehicle using a parking place shall stop the engine as soon as the vehicle is in position in the parking place and shall not start the engine except when about to change the position of the vehicle in or to depart from the parking place.

14. (1) No person shall use the vehicle whilst it is in a parking place in connection with a sale of any article to persons in or near the parking place or in connection with the selling or offering for hire of his skill or services.

(2) No person shall use any part of a parking place or any vehicle left in a parking place:

(a) for sleeping or camping purposes

(b) for eating or cooking purposes

(c) for the purpose of servicing or washing any vehicle or part thereof other than it is reasonably necessary to enable that vehicle to depart from the parking place

(d) for any purpose other than the leaving of vehicles in accordance with this order and without prejudice to the generality of the foregoing provisions for such activities as skateboarding.

15. The driver of a vehicle using a parking place shall not sound any horn or other similar instrument except when about to change the position of the vehicle in or to depart safely from the parking place.

16. Where in a parking place signs are erected or surface markings are laid for the purpose of: -

(1) indicating the entrance to or exit from the parking place or

(2) indicating that the vehicle using the parking place shall proceed in the specified direction within the parking place: –

no person shall drive or cause to permit to be driven any vehicle: –

(1) so that it enters the parking place other than by an entrance or leaves the parking place otherwise by an exit so indicated or

(2) in a direction other than that specified.

17. No person shall except with the permission of the person duly authorised by the Council in that behalf, drive or permit to be driven a vehicle of any class or description in a parking place for any purpose other than the purpose of leaving that vehicle in the parking place in accordance with the provisions of the order or for the purpose of departing from the parking place and in particular no person shall abandon or cause to be abandoned any vehicle or leave it unattended for longer than the length of time specified in relation to that parking place in Article 3.

18. A disabled person’s vehicle left in a parking place shall be exempt from any limitation on time specified in paragraph (3) of Article 3 provided it displays in the relevant position a disabled person’s badge.

Page 6 of 15 19. No person shall, in a parking place -

(a) wantonly shout or otherwise make any loud noise to the disturbance or annoyance of users of the parking place or residents of the premises in the neighbourhood;

(b) use any threatening, abusive or insulting language gesture or conduct with intent to put nay person in fear or so as to occasion a breach of the peace or whereby a breach of the peace is likely to be occasioned, or

(c) drive any vehicle without due care and attention or without reasonable consideration for others using the parking place

(d) deposit or leave any article, trailer or anything which forms part or a vehicle or trailer any rubbish, litter or any other thing within a parking place for the purpose of abandoning it there

20. In any parking place, no person shall: -

(1) erect or cause to permit to be erected any tent booth stand building or other structure without the written consent of the Council;

(2) light or permit to be lit any fire, or

(3) leave or cause or permit to be left any wheeled shopping trolley except with the written permission of the Council.

21. No person shall park any vehicle in a parking place for the purpose of or in connection with any trade or business, provided that this restriction shall not prevent a person parking any vehicle for the purpose of calling at any trade or business premises or by virtue of being an employee thereof subject to the period specified in Article 3(3) where applicable and to the payment of any charge payable in Article 6.

22. (1) The driver left in a parking place shall permit it to wait only in such a position as conforms with any notices or markings displayed in a parking place or with any directions given by a parking attendant and shall not leave a vehicle in a position that prevents the ingress or egress of any vehicle.

(2) The driver of a vehicle shall not permit that vehicle to wait in a parking place unless every part of that vehicle is wholly within the limits of a parking bay.

(3) Any trailer attached to a vehicle or articulated vehicle as defined by section 138 of the Act of 1984 shall not be disconnected from the vehicle.

(4) Where there is a sign in a parking bay indicating that the use of that bay is suspended the driver of a vehicle shall not permit that vehicle to wait in the parking bay.

23. No person shall use a parking place as a means of passage proceeding from one road to another road: -

Provided that nothing in this Article shall apply to any vehicle being used for police, fire brigade or ambulance purposes whilst attending an emergency call.

24. The driver of a vehicle shall not bring into a parking bay any vehicle or trailer attached thereto containing any toxic inflammable explosive noxious or dangerous substance other than fuel used either for the propulsion of the vehicle or the drawing vehicle as the case nay be for the driving of any ancillary engine or equipment forming part of the vehicle.

(1) If a vehicle is left in a parking place in a position other than in accordance with the provisions of 0716 Article 3 a person authorised by the Council in that behalf may alter or cause to be altered the position of the vehicle so that its position is in accordance with the said provision.

(2) If a vehicle is left in a parking place in contravention of any of the foregoing provisions of Article 3 of this order, a person authorised by the Council in that behalf may remove the vehicle from 0716 the parking place or arrange for such removal.

(3) For the purpose of meeting the requirements of an emergency, a person authorised in that 0716 behalf by the Council or a police constable in uniform may alter or cause to be altered the position of the vehicle in a parking place or arrange for the removal of a vehicle from a parking place.

(4) Any person altering or causing the alteration of the position of a vehicle by virtue of paragraph (1) of this Article or removing or causing the removal of a vehicle by virtue of paragraph (2) or paragraph (3) of this Article may do so by towing or driving the vehicle or in such other manner as he may think reasonably necessary to enable the position of the vehicle to be altered or the vehicle to be removed.

(5) Any person removing or arranging for the removal of a vehicle by virtue of paragraph (2) or paragraph (3) of this Article shall make such arrangements as he considers being reasonably necessary for the safety of the vehicle in the place to which it is removed.

(6) Neither the Council nor the person authorised to remove or make arrangements to remove vehicles or trailers shall be responsible for any loss or damage to the vehicle or trailer or to anything contained therein or thereon arising from or in consequence of the exercise of the powers contained in this order. Any expenses incurred by the Council in removing a vehicle or trailer within any parking place shall be recoverable by the Council from the driver of the vehicle or vehicle to which the trailer was attached as the case may be summarily as a civil debt.

26. The Council accepts no liability either at common law under the Occupiers Liability Act 1957 or otherwise for loss or damage to vehicles or the property left in any of the Council’s parking places to which this order applies.

PART V – REVOCATION

27. The following orders are hereby revoked:

(1) The Kingswood District (Off-Street parking Places) Order 1985 as varied by the Kingswood District (Off-Street parking Places) (Amendment) Order 1986; the Kingswood Borough (Off-Street parking Places) (Amendment) Order 1988; the Kingswood Borough (Off-Street parking Places) (Amendment) Order 1990; the Kingswood Borough (Off-Street parking Places) (Amendment) Order 1992.

(2) The Northavon (Off-Street Parking Places) Order 1991.
