You´ve found the ideal property on the Costa del Sol and have decided that you wish to move forward with the purchase, the next step would be for Right Casa Estates to draw up a “Reservation Contract”
What Is A Reservation Contract?
A Reservation contract takes the property off the market, whilst due dilligence is processed. It sets out the basic terms of sale, and is signed by the buyer and the vendor.
Usually, a 6000€ deposit is enough to reserve a property, whilst due dilligence is carried out, a potential mortgage finalised, and a date for exchange of private contracts is agreed on. This REFUNDABLE deposit can be held in our escrow account, or with a lawyer of your choice.
Your lawyer will then do due diligence, which includes determining the legal owner of the property; checking the property is registered at the correct property registry, checking the property is free from charges and debts, & checking the property has the correct building permits.
Once the lawyer is satisfied everything is up to date, a private purchase contract is drawn up that suits all parties.
Once these checks have been made, the sale can go ahead, and this deposit deducted from the final price.
6 Completion At The Notary
On the agreed completion date, the buyer and vendor (or their authorised representatives) will sign the title deeds (Escritura de Compraventa) at the public notary, whilst the final payment is made to the vendor´s legal representative. The notary checks all the required documents, and legally rubber stamps everything. The notary does not check terms as such, but certifies that both parties have agreed to the terms stated (the notary is in place to only witness both parties’ signatures).
The property is now yours, and your lawyer is required to fax the details of the title deed to the local land registry, confirming you as the new owner. The lawyer will also arrange payment of the taxes and fees.
Registration Of Title Deeds
You can use the copia simple to do most things, such as set up utility contracts and pay taxes.
A few days later your lawyer will be able to collect the original deeds signed by the notary (copia autorizada), which are needed to inscribe your title in the property register. In the meantime the notary should have faxed notification of your purchase to the property registry immediately after the sale, thus blocking the register for 10 days and preventing anyone else from inscribing a claim to the same property during this period.
Mortgages
If you raise finances in Spain, there will be a cost of around 2-3% of the purchase price. This cost is made up of the additional notary and land registry fees for registering the Mortgage + Mortgage arrangement fee.
Try to obtain an a decision in principle before embarking on the buying process, paying deposits etc. If you have prior knowledge of issues, then you are in a better position to solve them
Mortgage lenders will generally obtain a valuation from a trusted independent valuer, or ´Tasador´

Legal Fees
There are two types of legal fees – those from your solicitor and those that are external and include the notary fees.
The notary witnesses the signing of some essential documents. He/ she is a professional who legalises agreements and contracts and will witness the signing of the Title Deed. The amount that notaries charge is prescribed by law and starts around €800. The Title Deed is inscribed at the Spanish Land Registry and the fee for this usually starts at around €400.
You will also have your own solicitor to pay. It pays to ask for recommendations, and to do your research, as solicitors fees can vary significantly. A good solicitor helps you avoid pitfalls of buying, and can end up saving you a huge amount of money! So don´t cut corners, or hire a solicitor purely because they are cheap.
Taxes
• 8% IVA/transfer tax on the purchase price for properties up to €400,000.
• 9% IVA/transfer tax on the purchase price for properties from €400,001 to €700,000.
• 10% IVA/transfer tax on the purchase price for properties from €700,001+.
These figures are solely for resale properties - this rate increases to 16% if you are purchasing plots of land, commercial premises, or garage spaces.
Once these checks have been made, the sale can go ahead, and this deposit deducted from the final price. 8 Additional Costs
Surveyor Fees - Even if you are not purchasing with mortgage funds you may obtain comfort from obtaining a Surveyor’s Report on your chosen property.
Chartered surveyors are covered by a professional indemnity, so in the case of an error, compensation may be available. On average Surveyor’s fees are between €1,000 and €2,000.
Insurance - It is compulsory to have fire insurance when you have a mortgage, indeed few lenders will release the funds to complete your purchase without evidence that you have an insurance policy in place with their interests noted on it.
Annual Fees
Community Charges
These charges will be rendered if you buy a property on an Urbanisation. The “community” will maintain the gardens and swimming pools. The costs of their work and staff will be covered by these charges. In large formal Urbanisations these charges may be quite high but they may also include the provision of water to your property.
Impuesto Sobre Bienes Inmuebles (IBI)
A local Town Hall charge and effectively an annual real estate or council tax. IBI’s are similar to “Rates” in the UK. Your lawyer should obtain copies of previous bills from the seller of a resale or second hand property.
Basura - Rubbish Collection Tax
This annual tax is payable by all property owners to the local Town Hall.

Fuengirola is still one of the most popular towns on the Costa Del Sol. One of the main reasons for this, is the excellent location - which is accessible directly by Road,Rail,and Bus.
Fuengirola has been well maintained since it became popular in the 1960´s, and has steadily grown into the bustling, all year round town that we find today. It´s paseo is sprawling and beautiful, and contains many popular ´Chiringuitos´ which serve traditional Spanish fried fish.
You really have it all in Fuengirola - large, clean beaches, and a busy town, made up of narrow, pedestrian streets leading to interesting boutiques, and a mix of international restaurants. An Ideal tourist spot, but also a authentic Spanish, working town, which brims with culture and energy all year round. Sierrezuela La Sierrezuela is a popular, Secure urbanisation, between Mijas and Fuengirola. It is a well maintained area, and includes many large, typically Andalucian style villas. It´s close to all amenities, with 2 highly recommended schools a short drive away. There are also several popular bars and restaurants within walking distance in the area. It´s become a popular area, due to it´s natural beauty, and the fact you are close to the bustling tourist areas & beaches of Fuengirola & Mijas Costa, but also retain a sense of all year round community & tranquility.
The area is particularly popular with Scandinavians, but there is a good mix of nationalities throughout the urbanisation. The proximity to the airport, and the popular areas of Fuengirola and Mijas, make Sierrezuela a great choice for people looking for their dream villa, without the expense of some other nearby areas. 10 Los Boliches Los Boliches is a particualrly popular area of Fuengirola. Over the years, it has maintained it´s popularity - particularly with the British - as a family friendly area, with a very popular beach. If central Fuengirola is the area for young people enjoying the party scene, Los Boliches is probably more for people who enjoy the Spanish relaxed pace of life.
Apartments in this area are always in high demand, and are worth considering as a great investment, and personal holiday apartment.
Paseo Maritimo Fuengirola´s Paseo Maritimo stretches 7km from East to West. It´s particularly popular for walkers, because it is completely flat throughout. There are several popular beaches, with popular ´Chiringuitos´ serving traditional Spanish fried fish. There are also many international bars and restaurants, both on the paseo, and in the popular ´Fish Alley´ (Calle Moncayo) which is becoming a more and more popular place for modern gastronomy.
Fuengirola is up and coming again, and was one of the most popular destinations amongst tourists on the Costa del Sol last year. This means property is going up in price, and you should act quickly to find a bargain.
It´s a great area to find an investment, with guaranteed rental income, or to live permanently, amongst a vibrant Andalucian community.
11 Mijas
The municipal district of Mijas, has become one of the most popular areas for Ex-pats to move to. This is because it balances the traditional Spanish lifestyle, with the culturally diverse amenities it´s international community requires. This beautiful district is made up of 3 distinct areas: Mijas Pueblo - a stunning white mountainside village; Mijas Costa - a popular stretch of beautiful coastline which includes several very popular towns such as La Cala and Calahonda; and Las Lagunas - a popular residential and commercial area. There are properties for every taste in Mijas - from traditional to ultra modern; modern penthouses, to rustic villas. Mijas Pueblo Mijas Pueblo is one of the most charming villages in Andalucia. Typically Andalucian, it attracts a mix of tourists, whilst at the same time being a beautiful place to live on a permanent basis. At 428 metres above sea level, you have the most spectacular views the coast has to offer.
It´s easy to appreciate why this preety town has become so popular with tourists. It´s traditionally cobbled whitewashed streets lead you through a mix of popular restaurants, and interesting craft shops - which are indicative of the many artists and writers who live in the area. The mix of tourists and locals give the town a quiet buzz, whilst still retaining a strong sense of Andalucian living.
Many residents also appreciate living here, because you can have the benefits of the excellent all year round climate, and slower paced way of village living; but with easy access to the more commercial areas of the coast. La Cala La Cala has become the central point of Mijas Costa. This is because although it has grown larger and larger - from it´s origins as a small fishing village - La Cala has still managed to maintain it´s Andalucian charm. You have the best of both worlds with traditional Spanish life, mixed with modern facilities and infrastructure which includes International Schools; Health Centre; Public Library; Post Office; Quality Shops; World Class Golf Courses and famous Bars and Restaurants. 12 July and August are truly special in La Cala, as the promenade becomes host to Classical music, and Flamenco dancing. It´s impossible to not soak up this very special atmosphere, as you dine in one of the famous seaside restaurants. The season of Noches de Luna y Playa (nights of Moon and Beach) is a truly magical experience that keeps many people coming back to La Cala again and again. The sense of community and fun in La Cala is perhaps unrivalled along the coast, with popular street markets on Wednesday and Saturday that offer fresh Fruit & Vegetables, Assorted Crafts, Flowers and Plants, and much more.
Calahonda The attraction of property in Calahonda, is that unlike many areas on the coast, it has been properly planned for the long-term, rather than simply building for the sake of building. It´s founder was keen on green areas, and disliked the sight of multiple large apartment blocks, so it´s development has been an organic, natural one. This means the area feels like a real town, instead of a holiday urbanisation.

Marbella Town The famous ´Plaza de Los Naranjos´ is the central attraction to the Old Town, and still exhudes the traditional, relaxed Spanish culture we all love. Built in 1485, this square provides the beating heart of the Old Town, where the City Hall, Marbella Tourist Office, and the oldest church in town (Ermita de Santiago) can be found. The night time is when the square really comes alive, with the colourful scenes of various performers, including authentic Flamenco performances.
The ´Old Town´ or ´Casco Antiguo´ still retains it´s classic charm, despite the influx of tourists over the years. You can´t help but take in the Spanish vibe as you wander through the cobbled streets, lined with beautiful, well maintained flower baskets. You will find some great places
to eat and drink, as well as many eclectic art and craft boutiques. The main highstreet provides all the top names you would expect in any modern city.
Property wise, you will mainly find traditional, whitewashed townhouses and apartments - great for those looking to experience a truly authentic Spanish lifestyle. Elvira Elviria is approximately a 15 min drive from the centre of Marbella / Puerto Banus, and around 40 mins from Málaga airport.Elviria is known for it´s clean beaches with clean waters, and you find several beautiful properties within walking distance of the famous beach clubs - Nikki Beach and the Beach House.
