Foreword - Cllr Ruffell, Cabinet Member for Planning, Infrastructure and Natural Environment I am pleased to support the recommendations made in this report. The allocation of S106 contributions to open space and play projects have been identified through appropriate discussions and agreement with Councils, and are supported by ward members. The identified schemes will improve our residents’ quality of life in those areas affected, as part of a rolling programme of additional open space and play enhancements across the borough.

Background, corporate objectives and priorities

The Council’s policies regarding obtaining and allocating S106 contributions are set out in the Local Plan. S106 contributions are secured where it is considered that the provision of required facilities is not feasible within the development site. Contributions are then made to provide new or enhance existing facilities in order to mitigate the impacts of additional residents in areas likely to be used by the additional population. The allocation of S106 funds is sought through discussion with ward members, parish councils and local organisations.

This report accords with the council’s Budget and Policy framework and directly supports the Council Plan priority of improving residents’ quality of life, as a result of enhancing local play and open space facilities, as well as the natural environment.

Main considerations

1 Executive Summary

1.1 The purpose of this report is to gain approval to release Section 106 developers’ contributions secured for improvements to open space and equipped play facilities.

1.2 The council has a legal and accounting obligation to allocate funds collected in accordance with the requirements of Section 106 Agreements, and as part of this process ward members and parish councils are consulted on how best to allocate the available funding.

2 The Proposal

2.1 It is proposed that the Portfolio Holder considers the information in this report and approves the proposed allocation of S106 contributions as set out below.

2.2 The recommendations are based on the basis that the schemes will deliver the greatest benefits or meet the priority needs for the area to which the funds are to be allocated. The S106 contribution is sometimes only part of a collaborative funding approach for a particular scheme.

2.3 Details of each contribution and the schemes they are proposed to be allocated to are outlined below:

1. Proposed Project: The Lime Pits Open Space, Basing Ward Total Project Costs: £60,000 Contribution required: £ 9,000

Description: The Lime Pits is a large open space site between and the village of Old Basing, and forms part of the strategic network of parks and open spaces around the centre of Basingstoke town centre. An improvement scheme has been identified, with the support of Old Basing Parish Council and local members, to improve the site with the provision of automatic access gates, bins and picnic tables. This scheme has received Local Infrastructure Funding, subject to the use of S106 funding to match fund. Subject to further future funding, this work will form the first phase of a series of enhancements to this open space. Revenue Implications: The Lime Pits is owned and managed by the council. The provision of open space improvements will have a small revenue implication, however it is felt that this can be accommodated within existing council budgets due to the improvements being made, which will also reduce the impacts of some antisocial behaviour issues currently being experienced.

3 of 16 Recommendation: To release the contribution set out below to contribute towards the implementation of an improvement scheme at The Lime Pits open space, to support the ongoing use of the site. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

14/00343/FUL Site/Developer: Kelvin Engineering, Old Basing, Basingstoke / Michael David William Purt and Simon Thomas Tubbs and Flavia Estates Limited Contribution Sum: £8,637.70 Contribution type: Public Open Space Purpose of developer contribution as set out in the S106 Agreement: A contribution to the enhancement of open space within the vicinity of the development.

2. Proposed Project: Old Basing Recreation Ground Total Project Costs: £13,680.00 Contribution required: £ 9,968.45

Description: Old Basing Recreation Ground is the main strategic open space within the village of Old Basing, Basing Ward. Old Basing and Lychpit Parish Council have identified a project to provide an additional inclusive roundabout to enhance the play areas on the site, benefitting local residents. The S106 contributions below will contribute to the cost of the provision of this item of equipment. Revenue Implications: This site is owned and managed by Old Basing and Lychpit Parish Council. The provision of additional new facilities will have a small revenue implication for them which will be accommodated within their budgets. Recommendation: To release the contributions set out below to contribute towards the delivery of a new inclusive roundabout at Old Basing Recreation Ground, to support the ongoing use of the site. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

3. Proposed Project: Lower Brook Street Pocket Park, Brookvale and Kings Furlong Ward Total Project Costs: £23,198.42 Contribution required: £23,198.42

Description: Lower Brook Street Pocket Park is a valued local open space within the Brookvale and Kings Furlong ward of Basingstoke. The sum above has been paid to the council for improvements to this open space. Working with local members and liaising with the community, a scheme is proposed to enhance the pocket park for local residents. Revenue Implications: Lower Brook Street Pocket Park is owned and managed by the council. The provision of open space improvements will have a small revenue implication,

5 of 16 however it is felt that this can be accommodated within existing budgets through designing out current problems and rationalising the layout. Recommendation: To release the contribution set out below to implement an improvement scheme at Brookvale Pocket Park, to support the ongoing use of the site. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

15/04189/FUL Site/Developer: Garage Forecourt, May Street, Basingstoke / Sovereign Housing Association Ltd Contribution Sum: £23,198.42 Contribution type: Public Open Space Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the Council’s costs in enhancing, improving and maintaining open space at Lower Brook Street Pocket Park.

4. Proposed Project: Hanmore Road Play Area, Chineham Ward Total Project Costs: £128,151.40 Contribution required: £ 43,151.40

Description: As part of the ongoing Community Audit work for Chineham, £85,000 was released from BDB/44271 and BDB/59787 for the installation of a new play area at the Hanmore Road site in a report approved in November 2018. As this scheme has progressed, due to unforeseen technical issues on the site it has become necessary to release additional S106 to be able to complete the project. Revenue Implications: Hanmore Road Play Area as well as Toll House Meadow are owned and managed by the council. The provision of additional new facilities would have a small revenue implication, however it is felt they can be accommodated within existing budgets, offset by the removal of outdated equipment and overgrown vegetation, improving ongoing site management implications. Recommendation: To release the contributions set out below to allow the completion of the Hanmore Road Play Area project. Subject to the approval of this funding, it is expected that this project will be delivered during 2019/20.

BDB/44271 Site/Developer: North Binfields Development Area, Pyotts Hill / County Council Contribution Sum: £43,151.40 Contribution type: Community Facilities (Community Audit) Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the Council’s costs in providing, running and maintaining community facilities (including but without prejudice to the generality of the foregoing sports barns, outdoor kickabout areas and all weather ballcourts) upon the site or within the northern sector of the Basingstoke Town Area and its environs).

5. Proposed Project: War Memorial Park, Eastrop Ward Total Project Costs: £26,461.46 Contribution required: £26,461.46

Description: War Memorial Park is one of two Green Flag Parks within Basingstoke town centre. As part of ongoing work following the aims and objectives of the Management Plan for the park, proposals have been put together, supported by ward members, to install new information signs at key entrances. Revenue Implications: War Memorial Park is owned and managed by the council. The provision of the identified improvements will have a revenue implication, however it is felt that this can be accommodated within existing budgets. Recommendation: To release the contributions set out below to provide additional signage and interpretation at War Memorial Park. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

15/01309/FUL Site/Developer: Sun Alliance House / SR Developers Ltd Contribution Sum: £26,461.46 Contribution type: Open Space Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the cost of enhancements to War Memorial Park as per the War Memorial Park management plan.

6. Proposed Project: Glebe Gardens, Eastrop Ward Total Project Costs: £7,274.15 Contribution required: £7,274.15

Description: Glebe Gardens is a key civic open space within Basingstoke Town Centre, well used for recreation and relaxation by town centre dwellers as well as those visiting. It is proposed to install new interpretation signage within the site to improve site navigation and information for visitors, and this is supported by ward members. Revenue Implications: Glebe Gardens is owned and managed by the council. The provision of the identified improvements will have a revenue implication, however it is felt that this can be accommodated within existing budgets. Recommendation: To release the contributions set out below to provide additional signage and interpretation at Glebe Gardens. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

7. Proposed Project: Beggarwood Park, Hatch Warren and Beggarwood Ward Total Project Costs: £257,640.00 Contribution required: £257,640.00

Description: Beggarwood Park is a large community park within the Hatch Warren and Beggarwood Ward. With the support of ward members, it is proposed to develop a scheme of improvements during the 2019/20 financial year, including the extension of the play area to provide additional equipment and fencing, and wider park improvements, including signage, seating, additional gym equipment and kickabout area enhancements. Revenue Implications: Beggarwood Park is owned and managed by the council. The provision of the identified improvements will have a revenue implication, however it is felt that this can be accommodated within existing budgets. Recommendation: To release the contributions set out below to provide additional play equipment and open space enhancements at Beggarwood Park. Subject to the approval of this funding, it is expected that this work will be undertaken during the second half of 2019/20.

8. Proposed Project: Recreation Ground Play Area, Kingsclere Total Project Costs: £1,553.70 Contribution required: £1,553.70

Description: Kingsclere Parish Council have identified an improvement project at the play area within the village Recreation Ground. This includes the installation of 3 new items of equipment comprising 2 springies and a spinner, as well as safety mats. This additional equipment will extend the play area, and its capacity for use. Quotes are currently being sought for the installation of the equipment, to be submitted at a later date. Revenue Implications: This site is owned and managed by Kingsclere Parish Council. The provision of these additional new play facilities will have a small revenue implication for them which will be accommodated within their budgets. Recommendation: To release the contributions set out below to contribute towards the costs of providing new seating areas at Chute Recreation Ground. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

BDB/70105, BDB/70996 Site/Developer: Store, 42 Swan Street, Kingsclere / TBC Developments (Kingsclere) Ltd Contribution Sum: £996.00 Contribution Type: Equipped Play Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the cost of providing, running and maintaining equipped play provision in the locality of the site.

BDB/76382 Site/Developer: Barton House, 40 George Street, Kingsclere / Elizabeth Jean Stobart and Harold Rayner Thrower and Martyn Frank White Contribution Sum: £557.70 Contribution Type: Equipped Play Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the cost of providing, running and maintaining equipped play provision in the locality of the site.

9. Proposed Project: The Malthouse Open Space, Kingsclere Total Project Costs: £152.50 Contribution required : £152.50

9 of 16 Description: Kingsclere Parish Council have identified an improvement project at the Malthouse public open space, within the village. This is for the planting of 1000 bluebells, for the enhancement and improvement of the space for users. Revenue Implications: This site is owned and managed by Kingsclere Parish Council. The provision of these wild flowers will have a neutral revenue implication for them. Any future effects will be managed within their budgets. Recommendation: To release the contributions set out below to provide open space enhancements to the Malthouse Open Space. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

BDB/76382 Site/Developer: Barton House, 40 George Street, Kingsclere / Elizabeth Jean Stobart and Harold Rayner Thrower and Martyn Frank White Contribution Sum: £152.50 Contribution Type: Open Space Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the provision of open space in the locality of the site.

10. Proposed Project: Dummer Play Area Total Project Costs: £31,000.00 Contribution required: £ 2,886.20

Description: Dummer Parish Council have developed proposals to upgrade the play area within Dummer village, an important local facility. This project has been successful in obtaining a LIF grant, with the addition of the S106 contributions below, as well as Parish funds to be used as match funding. Revenue Implications: This site is owned and managed by Dummer Parish Council. The provision of this additional and upgraded play equipment will have a small revenue implication for them which will be managed within their budgets. Recommendation: To release the contributions set out below to provide enhancements to Dummer Play Area. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

11. Proposed Project: Cuckoo Meadow, North Waltham Total Project Costs: £6,105.00 Contribution required: £2,657.00

Description: Cuckoo Meadow is a well-used, popular open space serving the village of North Waltham. The site is managed by North Waltham Village Trust, who have developed proposals, with the support of the local Parish and also members, for the development of a sympathetic overflow car park to increase the capacity of the site for the numerous events that take place there. Revenue Implications: This site is owned and managed by North Waltham Village Trust. The provision of this additional open space facility will have a small revenue implication for them which will be managed within their budgets. Recommendation: To release the contributions set out below to provide open space enhancements Cuckoo Meadow. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

15/03790/OUT Site/Developer: Land South of St Michaels Close, North Waltham / Clive Wallace Fletcher and Carol Jane Fletcher and Ian Charles Jones Contribution Sum: £2,657.00 Contribution Type: Open Space Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the Council’s costs in providing additional seating and to increase capacity through improvements to access, and enhancements to planting at Cuckoo Meadow Sports Ground.

12. Proposed Project: Popley Community Park, Popley West Ward Total Project Costs: £406,134.00 Contribution required: £406,134.00

Description: Popley Community Park is a well used strategic neighbourhood park serving a wide population. It is proposed, with the support of local members, to use the developer contributions below to develop a scheme of enhancements to the park, through consultation with the local community. This will include improvements and additions to the play area, as well as open

11 of 16 space improvements including boundary treatments, seating, footpaths and signage. Revenue Implications: Popey Community Park is owned and managed by the council. The provision of the identified improvements will have a revenue implication, however it is felt that this can be accommodated within existing budgets. Recommendation: To release the contributions set out below to provide play and open space enhancements within Popley Community Park. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

BDB/73174 Site/Developer: Land At OS Parcel 4630 1540 North of Popley Way and adjacent to A340, Basingstoke / Hampshire County Council Contribution Sum: £167,685.00 Contribution Type: Equipped Play Purpose of developer contribution as set out in the S106 Agreement: Sum to be used towards the provision of a NEAP at the Aldermaston Road open space adjacent to the site.

16/00614/FUL Site/Developer: Land at Priestly Road and Aldermaston Road, Basingstoke / Hampshire County Council and Bovis Homes Contribution Sum: £238,449.00 Contribution Type: Open Space Purpose of developer contribution as set out in the S106 Agreement: Towards the cost of providing the balance of multi-functional green space to meet the total Green Space Standard.

13. Proposed Project: Stratfield Saye Recreation Ground Total Project Costs: £2,343.00 Contribution required: £2,343.00

Description: The Recreation Ground is the main open space facility for the village of Stratfield Saye. The Parish Council have developed proposals to upgrade the site with picnic benches and a play sculpture, in order to increase the capacity of the site for recreation, and to offer opportunities for informal play. Revenue Implications: Stratfield Saye Recreation Ground is owned and managed by Stratfield Saye Parish Council. The provision of the identified improvements will have a small revenue implication for them which they will manage within their budgets. Recommendation: To release the contributions set out below to provide play and open space enhancements within Stratfield Saye Recreation Ground. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

12 of 16 15/03324/FUL Site/Developer: Berrydown Green Lane, Stratfield Saye / Giles Patrick Denton Toosey and Charlotte Elizabeth Nona Toosey Contribution Sum: £1,733.00 (Open Space) £610.00 (Equipped Play) Contribution Type: Open Space / Equipped Play Purpose of developer contribution as set out in the S106 Agreement: A contribution towards additional seating at Stratfield Saye Recreation Ground, and a contribution towards the cost of toddler and junior age range items of play equipment at Stratfield Saye Recreation Ground.

14. Proposed Project: Alliston Way Play Area, Whitchurch Total Project Costs: £44,317 Contribution required: £44,317

Description: Alliston Way Play Area is a well used facility serving the village of Whitchurch. Whitchurch Town Council, with the support of local members, have plans to deliver a project to enhance the play area, extending teenage provision and improving the range of inclusive facilities to allow use by a wider range of users. Revenue Implications: Alliston Way Play Area is owned and managed by Whitchurch Town Council. The provision of additional play facilities will have small revenue implication for them, which they will meet from within their own budgets. Recommendation: To release the contributions set out below to provide play enhancements within Alliston Way Play Area. Subject to the approval of this funding, it is expected that this work will be undertaken during 2019/20.

15/03693/OUT Site/Developer: Land between Winchester Road and Micheldever Road, Whitchurch / Hampshire County Council and Lilybell Limited and BDW Trading Limited Contribution Sum: £44,317.00 Contribution Type: Equipped Play Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the council’s costs in providing enhanced equipped play provision at Alliston Way and Daniel Park.

3 Key issues for consideration

3.1 This report seeks to allocate a number of developer contributions to projects that will improve public open spaces and play areas owned by Borough Council, as well as Parish Councils and Trusts.

3.2 Failing to allocate secured S106 contributions to appropriate and relevant projects could in many instances result in the contribution having to be handed back to the developer and a community missing out on identified infrastructure improvements. Hence, the purpose of this report is to ensure that funding is allocated to schemes that have been identified by parish councils, ward members and their communities.

13 of 16 4 Options Analysis

4.1 There are two options that could be taken, as follows:

a. Not to allocate funding to the open space and equipped play enhancement schemes. This has been rejected, as it would mean that the council would not be meeting its obligations with regard to obtaining and allocating developer contributions. b. To allocate the contributions referred to in this report to the schemes proposed. This is the preferred option as it will allow the council to meet its obligations and provide improved facilities for borough residents.

5 Legal Implications

5.1 The S106 contributions should be allocated and spent for the purpose they were collected as set out in the S106 agreements.

6 Financial implications

SUMMARY FINANCIAL IMPACTS This report proposes expenditure of £836,737.28 to undertake a number of different schemes, which if approved, can be met from S106 developer contributions included in the current approved capital programme as follows;

Replacement/refurbishment of Community Facilities £ 43,151.40

Total S106 developer contributions £836,737.28

The revenue implications of these schemes are expected to be minor and will be met from within current parks and open spaces budgets.

7 Risk management 7.1 A risk assessment has been completed in accordance with the council’s risk management process and has identified no significant (Red or Amber) residual risks that cannot be fully minimised by existing or planned controls or additional procedures.

8 Equalities implications

8.1 Developer’s contributions are sought for local community infrastructure provision needed as a result of new development. When taking into account the Public Sector Equality Duty and the requirements of the Equality Act 2010,

14 of 16 the projects funded through these contributions are positive for all protected characteristic groups particularly in relation to building good relations between different groups.

9 Consultation and communication

9.1 All relevant parish councils and ward members have been part of the process to identify proposals for open space and equipped play facilities within their areas.

10 HR implications

10.1 There are no direct HR issues arising from this report.

Conclusion

11 Summary and reason for the decision

11.1 The projects set out in this report meet the purpose for which S106 contributions have been collected in the relevant wards and . They have been assessed as being deliverable and have local support. It is recommended that the funds therefore be released to enable the projects to progress.

12 The options considered and rejected

12.1 The option considered and rejected was not to allocate any of the S106 developer contributions to projects. This was rejected as it would mean that the council would not be meeting its obligations with regard to obtaining and allocating developer contributions.
