Public Authority: The Public Information Officer, Tahsildar, Taluk Office, Uthamapalayam, District. ==== The petitioner had aked for information on action taken on an application for assistance for the handicapped under RTI on 4.4.2008 and not getting anywhere approached the Commission on 6.11.2009 which was sent by the Commission in case No.38442 and 38444/08/09, dated 29.06.2009 directing the Public Information Officer, Tahsildar, Uthamapalayam to supply the informaion to the petitioner before 24.07.09 and send a report and if not appear before the Commission on 31.07.09 with the explanation why.

2. Neither the report was received nor the information seems to have been given not did the Public Information Officer appear. Since the petitioner again complained that he has not received the information in his letter 13.8.09 the case was taken up in case No.19566/ O-8/09 summoning the Public Information Officer to

(a) immediately supply the information

(b) to appear in person before the Commission with details of the action taken on the above case with his explanation for not having supplied the information.

The Public Information Officer appeared before the Commission and claimed to have sent a reply to the petitioner in June, 2009 and again on 13.02.2010 but he has not got the acknowledgement of the petitioner nor could he show the despatch register for verification and the explanation for not supplying the information justifies how the application for assistance is not sustainable under the rules and why it has been turned down but he has nothing to say about non-supply of information.

3. The District Collector, Theni is therefore directed to

(a) file before the Commission the acknowledgement of the petitioner for having received the information and

(b) the personal explanation of the PA / PIO for having violated the provisions of the RTI Act and directions of the Commission. The petitioner's complaint that the Public Authority's statement that information must be obtained from the Collector's Office is contrary to Section 6(3)(ii) as the Public Authority himself should have transferred the petition and that the appellate authority has not sent a reply are both upheld as correct.
