JUSTIFICATION FOR GRANTING CONSENT

The broad land use principle of the replacement dwelling is considered acceptable under the provisions of HDLP Policy H20.. The revised dwelling is marginally larger than the former dwelling. In this respect the dwelling is contrary to HDLP Policy H20. Regard has to be taken however of the landscape impact of the development. In this respect, whilst the site occupies a prominent and sensitive location, the development would have no greater impact upon the landscape setting than either the former property or the approved replacement structure granted consent under 6.78.47.I.FUL. Due to differing land levels the dwelling would be seen against the backdrop of existing substantial built development. Subject to a controlling condition to secure the removal of permitted development rights, it is considered that approval of the application can be supported.

The approved access arrangements and turning space shall be provided before the development is first brought into use. Once created these areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

7 The dwelling shall not be occupied until parking spaces of a size not less than 4.8 metres x 2.4 metres, including one garage or a car parking space capable of accommodating a garage, have been provided within the cartilage of the dwelling, in accordance with standards set out in the North Yorkshire County Council Parking Design Guide. 9 Prior to the commencement of the development hereby approved a site plan shall be submitted for the prior approval of the Local Planning Authority in consultation with the Highway Authority showing visibility splays providing clear visibility of 2m x 65m in a northerly direction and 2m x 70m in a southerly direction measured down the centre line of the access road and the nearside channel line of the major road shall be provided at the junction any access road with the county highway at a maximum height of 1 metre above the level of the adjacent carriageway. Once created, these visibility areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

10 Prior to the commencement of any other part of the development hereby permitted, the access or accesses to the site shall be laid out and constructed in accordance with the following requirements:-

1c the crossing of the highway verge and or footpath shall be constructed in accordance with the approved details and or Standard Detail number E7e and the Specification of the Local Highway Authority,

2 any gates, barriers or other means of enclosure shall be erected a minimum distance of 13 metres back from the carriageway of the existing highway and shall open into the site,

3 that part of the access or accesses extending 13 metres into the site from the carriageway of the existing highway shall be at a gradient not exceeding 1 in 10,

4 that part of the access or accesses extending 13 metres into the site from the carriageway of the existing highway shall be made up and surfaced in accordance with the approved details and or Standard Details number E7e and the Specification of the Local Highway Authority,

5 provision shall be made to prevent surface water from the site or plot discharging onto the existing or proposed highway in accordance with the approved details and or Standard Detail number E7e and the Specification of the Local Highway Authority.

NOTE You are advised that a separate licence will be required from the Local Highway Authority in order to allow any works in the adopted highway to be carried out. The local office of the Local Highway Authority will also be pleased to provide the detailed constructional specification referred to in this condition.

11 The development shall not be commenced until full details of the proposed vehicular access, parking and turning arrangements have been submitted to and been approved in writing by the Local Planning Authority in consultation with the Local Highway Authority. Those arrangements shall be constructed in accordance with the specification so approved before the development is first brought into use unless otherwise approved by the Local Planning Authority. Once created these areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

12 The industrial unit hereby approved shall be restricted to Class B1 of the Town and Country Planning (Use Classes) Order 2006 (or any order revoking and re-enacting that Order with or without modification).

13 Prior to the commencement of development a Phase I ground contamination assessment shall be carried out to involve a desktop study of any previous uses of the site and site walkover. The Phase I survey shall be submitted to the Local Planning Authority, and only if a previous contaminative use is identified will a Phase II report be necessary.

A phase II assessment should be undertaken by a suitably qualified Environmental Consultant (in consultation with the local planning authority) and will take account of the condition of the land and outline the extent of any ground contamination on the above named site and on any land adjacent to the site. The investigation methods including sampling and analytical strategy shall be in accordance with best practise or current guidance.

Thereafter a remediation scheme shall be agreed with the local planning authority to leave the site in a condition suitable for its proposed end use.

Any remediation work should be undertaken prior to the commencement of the development and a validation report submitted on completion of the work.

14 Prior to the commencement of the development hereby approved an assessment of the noise levels in accordance with BS4142 to determine the rating level of the business use in relation to the neighbouring dwellings is required for the prior approval of the Local Planning Authority in consultation with the Environmental Health Section. The rating level can be determined including proposed attenuation measures. During normal daytime hours, 07.00 to 23.00 hours, the BS4142 rating level, measured over 1 hour, should be no greater than the background level (LA90). During the night time period, 23.00 to 07.00 hours, the BS4142 rating level, measured over 5 minutes, should be 5dB below background level (LA90).

15 The use hereby approved shall not be carried out other than between the hours of 08.00 and 18.00, Monday to Fridays and 08.00 and 13.00 on Saturdays and shall not be carried on at all on Sundays and Public Bank Holidays.

It is recognised that a flexible approach may be required in certain circumstances where the need is justified. The following minimum standards may be accepted notwithstanding the rating level:-

* NR 25 in bedrooms (23.00 to 07.00) * NR 30 in all habitable rooms (07.00 to 23.00) * If there is a distinguishable tone the NR curves should be reduced to NR 20 and NR 25 respectively. * Noise Rating curves should be measured as a 15 minute linear Leq at the octave band centre frequencies 31.5 Hz to 8 kHz. * For outdoor areas a BS4142 rating of up to +5 dB higher than the background level (LA90) may be accepted. * In addition the levels specified in Appendix 1 of the Noise Advice Design Guide should not be exceeded. * All indoor levels shall be taken with windows opens or with alternatively provided acoustic ventilation over and above 'background' ventilation.

PPG24 recommends that wherever practicable noise sensitive developments should be separated from major sources of noise. PPG24 also refers to the use of BS4142: 1997 (where appropriate) to consider noise from industrial and commercial developments. This standard assesses the likelihood of complaints in relation to noise.

Noise Rating (NR) curves are another way of setting acceptable levels in noise sensitive premises where industrial/commercial noise may be an issue. From experience of statutory nuisance investigation work, the setting of broad band A weighted noise level limits on their own are not appropriate for industrial noise.

JUSTIFICATION FOR GRANTING CONSENT

With the existing constraints on site, the visibility from the access and the proximity to Wayside Cottage, it is considered that the demolition of part of the industrial building to provide a smaller unit will ensure the retention of an existing business use on the site. In addition the removal of the tie between the industrial building, workshop / outbuilding and Wayside Cottage will be helpful in securing a business tenant for the premises if the applicant should wish to cease his current business. 2 The materials to be used in the construction of the external surfaces of the extension hereby permitted shall match those used in the existing building.

3 The first floor windows in the side elevation of the extension hereby approved shall be obscure glazed in strict accordance with the submitted drawings and shall thereafter be maintained and retained as such.

4 Notwithstanding the provisions of The Town and Country Planning General Permitted Development Order 1995 (or any order revoking and re-enacting that Order with or without modification), no further windows shall be inserted in the side (first floor) elevations of the extension hereby approved, without the prior written approval of the Local Planning Authority.

5 Prior to the development hereby permitted being first brought into use, the access to the site shall be laid out and constructed in accordance with the following requirements:

(i) the crossing of the highway verge and/ or footpath shall be constructed in accordance with the approved details and/ or Standard Detail number E6a and the Specification of the Local Highway Authority.

(ii) any gates, barriers or other means of enclosure shall be erected a minimum distance of 4.5metres back from the carriageway of the existing highway and shall open into the site

(iii) that part of the access extending 4.5metres into the site from the carriageway of the existing highway shall be made up and surfaced in accordance with the approved details to the Specification of the Local Highway Authority.

NOTE: You are advised that a separate licence will be required from the Local Highway Authority in order to allow any works in the adopted highway to be carried out. The local office of the Local Highway Authority will also be pleased to provide the detailed constructional specification referred to in this condition.

6 Prior to the commencement of the development hereby permitted, details of the bridge widening and safety fencing shall be submitted to and approved in writing by the Local Planning Authority in consultation with the Local Highway Authority using the North Yorkshire County Council Technical approval procedures for Developer's structures. Thereafter the bridge widening and safety fencing shall be constructed in strict accordance with such details prior to the development hereby permitted being first brought into use.
