| 1 A Trusted Resource to Track Key Votes in K-12 Education

The Friends of ASBA, a sister organization of the Arizona School Boards Association and separate 501(c)(4) corporation, is dedicated to leading a more informed public discussion of K-12 education in Arizona and fostering greater understanding and support for our public schools and the more than 1 million students who attend them. Our mission, as a board of directors comprised of current and former school board members from throughout Arizona, is providing a strong, equal-access, issue-focused voice that is unabashedly pro-public education.

The Friends of ASBA is focused on educating the people of Arizona so we, as a state, continue to prioritize a quality public education for all children as both a civic and an economic virtue.

This publication focuses on the impact of the Arizona Legislature, specifically the votes of individual legislators on key bills impacting K-12 education and district public schools. On these pages, we look at voting records of Arizona legislators on 8 significant bills introduced last session that focused on issues of key importance to school districts.

School board members and other school district leaders will be familiar with the color-coded voting records format, which provides at-a-glance insights into the level of support – or lack of support – each Arizona legislator provided for Arizona public school districts and the local school boards who govern them.

This fifth edition of the Friends of ASBA voting record contains updated additional legislative district data that illuminates the populations and constituents served, voter participation and registration from the 2018 election, and indicates whether your state representatives supported advancing a pro K-12 education agenda this session.

The first session after an election is a good opportunity to take stock of where we stand relative to promises made on the campaign trail. It’s important to honor those state representatives who support our work to bolster and better our state’s public schools and hold accountable those who do not.

2 | Using the Voting Records

Arizona’s 90 elected state legislators serve constituents in our state’s 30 legislative districts. Each district has two representatives, who serve in the state House of Representatives, and one senator, who serves in the State Senate. On the following pages, you will find an overview of each legislative district and a record of legislators’ votes to highlight those who support and do not support public education in Arizona.

The information is separated into two pages. The first includes data about the legislative district itself with the names and party affiliation of each elected representative, the partisan split of registered voters, and data regarding voter turnout in the 2018 general election. It also includes the most recently available census data on race/ethnicity of the total population, and the population under age 18 within the district. Also, note the number of school districts within each legislative district and the student enrollment of each.

The second page displays the voting record of each legislator in that district on key K-12 education bills.

Friend of Public Education

For the third time, legislators will be rated on whether their overall record during the session was supportive of public education or not, in the estimation of Friends of ASBA. This rating is based on voting record, but also how helpful (or not) a given legislator was in advancing the ASBA political agenda during the legislative session, and how the legislator acted toward public education in general. A legislator may earn thumbs up, thumbs sideways or thumbs down. This is based in part on the member’s voting record, but also on other issues that may occur behind the scenes, such as helping to get bills heard (or not) in committee, helping to prevent bad bills from advancing, etc. Helpful actions are recognized by “extra credit.” This is intended to help our supporters determine at a glance which legislators have been helpful to the mission Arizona public schools and the 1 million-plus students who attend them. You will note that the closer partisan split has had something of a moderating influence on this Legislature, though there are still many clear distinctions. Last year, legislators who received thumbs up for both 2017 and 2018 were labeled “champions of public education with a special trophy icon.” This is a new Legislature, so those icons are not included. They will return next year in advance of the 2020 general election.

The Fifty-Fourth Legislature, First Regular Session adjourned sine die at 12:58 a.m. on Tuesday, May 28, 2019 after 134 days. The general effective date for non-emergency bills is August 27, 2019. Appropriation bills and bills with an emergency clause are effective immediately upon the signature of the governor.

We want to thank everyone who assisted Friends of ASBA in its advocacy efforts this year. Without you, our mission to ensure the success of all students would not be possible. This interim, we encourage you to use this guide to engage with others to educate them on how their representatives act over time. The following bill summaries represent significant pieces of legislation that impact K-12 public education. For a detailed summary of these bills and more, please consult the Comprehensive Legislative Wrap Up Brief published by ASBA.

| 5 Key Bills

SB 1014/HB 2184 English language learners; instruction; budgeting (Boyer & Udall) This bill reduces the required amount of time an English Learner student must spend in Structured English Immersion (SEI) from four hours each day to 360 hours per school year in grades K-5, and 300 hours per school year in grades 6-12. ASBA Supported; Laws 2019, Chapter 3

SB 1256 school districts; procurement practices; auditors (Gray) This bill repealed the requirement that school districts use the “lowest qualified bidder” for materials, services, goods, construction or construction services procured by the district. It also eliminated the requirement that districts rotate auditors every three years. ASBA Supported; Laws 2019, Chapter 85.

HB 2693 misconduct involving weapons; school grounds (Petersen) This bill would have allowed a person to possess a loaded firearm carried within a vehicle that is under the control of an adult on school grounds. ASBA Opposed; Failed third reading in the Senate.

SB 1346 schools; assessments; instruction; reporting (S. Allen) This bill provided the State Board of Education flexibility in implementing the “menu of assessments” for high school in future years, and delayed implementation of a menu in K-8. It also repealed discriminatory provisions of the state’s statute on HIV/AIDS instruction. ASBA Supported; Laws 2019, Chapter 86.

SB 1071 school districts; personnel evaluations (Boyer) This bill repealed the statewide educator evaluation framework and returned evaluation instrument development to local district governing boards. It also lowered the amount of data required to be considered in an evaluation from 33-50% to 20-33%. ASBA Supported; Laws 2019, Chapter 191.

HB 2015/HB 2032 school employees; statements; employer discipline (Townsend) These bills would have imposed penalties on teachers and school districts directly for teachers engaging in certain conduct determined to be partisan, sectarian, or any sort of “propaganda” after investigation by the attorney general or county attorney. ASBA Opposed; both bills died awaiting floor action in each house.

SB 1395 empowerment scholarship accounts; program revisions (S. Allen) This bill made numerous changes to the state’s ESA voucher program, including expanding the age range for eligibility for kindergarten. Also made numerous changes to the administration functions of the program. ASBA Opposed; Died awaiting floor action in the Senate.

SB 1485 school tuition organization; inflator (Mesnard) This bill imposes a cap on the corporate tax credit for contributions to a private school tuition organization (STO). The growth rate gradually decreases from 20% annually to the greater of 2% or inflation, beginning in FY2024. ASBA Supported; Laws 2019, Chapter 281.

| 7 What the Timeline for Census 2020 Looks Like

Preparing for Census 2020 begins long before Census Day and work continues until the counts are delivered to the president. The U.S. Constitution requires a count – or census – of the ’ population each decade. These census results determine the number of seats for each state in the U.S. House of Representatives and the distribution of more than $675 billion in federal funds each year that impact public schools and communities. For example, public schools receive federal funds based on census counts for the National School Lunch Program, special education (IDEA) grants, Head Start/Early Head Start, Title I grants to local education agencies and health center programs as well as child care and development entitlement funds. It’s important to remember that your census responses and personal information are protected by law and remain confidential. Census responses may only be used by the U.S. Census Bureau to produce statistics. Census responses cannot be shared with immigration or law enforcement or be used to determine a person’s eligibility for government benefits.

Here is a timeline for some of the key dates for Census 2020.
