Dear Mr. Wheeler (and Ms. Dortch),

I am a flea in a football field, but there are those who know my exact location. Since at least October 2015 I have been subjected to on-going electronic surveillance. For what? Does someone fear that this little flea holds incriminating and/or damaging information?

While Mr. Rutledge and Ms. Bohigian have twice met with yourself and Mr. Sallet, I have been experiencing such an onslaught of planes at various sizes, as well as helicopters, flying over practically wherever I’m located in the morning, afternoon and evening that it has become surreal.

It has now been six months of daily flights over my locations at times day and night. And who has paid for such an operation? Who ordered such an operation? And who has that authority?

I present to you proof that this is not a hoax, and the complicity involves AT&T, Microsoft, John Malone and Greg Maffei-backed SiriusXM, likely TruePosition/Skyhook Wireless, Charter Communications to the level of board of directors and likely others.

Beginning on page 31 of my November 12, 2015 Reply to Responses/Oppositions and page 23 of my December 27, 2015 Supplemental Reply I detailed how Microsoft was a potential silent partner in allowing my files to be secretly shared by unknown third parties.

At the time of writing my November Reply I had to change the network and sharing settings for my Windows 7 laptop each time I turned on the device. At the time of writing my December Reply the settings regarding file sharing remained saved after the device was turned off. However, I hadn’t looked at the settings again until last week when I noticed that I can no longer change the settings whatsoever. The following is a portion of the Windows 7 settings screen on my laptop:

When I click on “Turn off network discovery” and/or “Turn off file and printer sharing” the software automatically rejects the change and reverts back to “Turn on....” The next page shows a similar screen for the ‘Public’ versus the ‘Home or Work’ settings. Neither screen allows changes to turn network discovery or file and printer sharing off as it did in the past.

That is only a small part of the picture. What is far more critical is that the proposed merger will fundamentally empower Liberty Broadband’s subsidiary TruePosition with Skyhook Wireless technologies, capabilities and clients through a broader intertwining base in which John Malone and company hold directorship. I plan to provide comment for WC Docket No. 16-106,1 but this letter is to emphasize that I am a prime example of what is taking place before the proposed merger and what could become irreversible if a new Charter becomes a reality without isolating conditions.

When I was at the local library earlier today, using free Wi-Fi service, a plane flew over and put a file on my laptop (which was quickly deleted). This is the screenshot showing how I knew:

I mentioned this same type of event on page 14 of my January 19, 2016 Additional Reply to Responses/Oppositions. So how was it known that I was at the library? Easy. Microsoft and/or Dell have caused Windows 7 to search for Wi-Fi upon startup without permission, and without a setting to stop it from happening. But that alone is useless. That’s where a company like Skyhook Wireless—acquired by TruePosition last year—and perhaps solely that company has instant access to the unwanted search no matter my location. Here’s what my laptop startup screen looks like:

At startup there is a forced brief swirling circle overlapping a Wi-Fi signal bar icon, even though my Wi-Fi card is set as disabled among other disabled system settings.

Though my Wi-Fi card is disabled it still initially searches always making my location known. After the swirling for a few seconds the icon changes to my setting, which is ‘disabled’.

The correct icon appears only after a forced Wi-Fi search.

Obviously you are unaware of those who facilitate the E9-1-1 Mandate, but I am an example of misused joint technologies that could become commonplace. I again mention that the website for TruePosition’s Skyhook Wireless clearly conveyed:

Skyhook’s massive global network powers billions of location requests in all of the places that they happen. Our customers include giants like Apple, Samsung, and Mapquest. Our coverage is monumental and constantly growing.

In addition to TruePosition likely tracking me, SiriusXM has most definitely been utilized to track my mother’s car from place to place without laptop, iPad or a smartphone in the car. My proof are the planes that fly practically over every location in which I turn on my iPad and/or laptop and/or where my mother’s car goes (SiriusXM equipped without a subscription).

My mother and I recently moved to a new apartment about two miles from the previous, and I purposely did not make any address changes of any kind. However, the overhead flights moved with us. The following is a photo taken yesterday about fifteen minutes after I turned my laptop on in my bedroom without any connection to the Internet. This is only one of many flights.

You could think that planes are unrelated if not for the fact that this has been occurring for months and that happened at our new location without me providing my new address to anyone. Here are other photos taken this past weekend. The second was while it was raining.

The following photo was taken a few days ago at my mom’s new apartment porch, though I had not provided anyone my new address. The jet was larger than a normal private jet, and it circled around my location completing a 180-degree turn. On this same day a friend was visiting my mom and a low-flying military jet circled twice, but it was so alarming that a photo wasn’t made.

One of many helicopters over the past six months that have flown either separately or about the same time as a plane flying nearby. This particular photo was taken early this morning. A yellow helicopter flew overhead later at the same time as a plane from a different direction.

The following are photos I took today with my mom’s camera that focused on the tree. This plane flew over downtown Turlock, where I live, practically directly over my residence. This is not a hoax. If you are wondering why the sky looks so different across the photos, it’s because we regularly have crystal clear skies but this weekend there was an overcast and rain.

Again, the camera I used focused on the tree, but this is by no means the first time planes of this size have flown over my location after turning on my laptop, iPad or being traced via SiriusXM. Planes of the size shown below have flown over my sister’s house in another part of Turlock several times, but this plane was the first I noticed with blue engines. Normally, they have been solid white.

The following is a plane above FedEx Office the day of our move. Planes were flying almost ceaselessly during the day a U-haul truck was parked in front of my mom’s apartment.

Here is one of the twin-engine planes that has flown over me more times than I could possibly count. This photo was taken at my old residence, and for months I didn’t take a single photo because I either didn’t fully believe the planes pertained to me or I just didn’t think anyone would believe such a story. The twin-engine planes have often flown too fast for me to take a photo.

Here is a photo of a plane doing a very familiar maneuver of flying by and briefly tilting so that the belly of the plane faces my direction while remaining in a straight path.

Last week I went with my mother to my sister’s house and a plane was soon flying over the house. I stood in the driveway and turned on my iPad which happened to automatically connect to my sister’s Charter Internet. Within one minute the plane that had just flown directly over the house turned 180 degrees and flew over the house again. By then I had already turned my Wi-Fi only iPad off and the plane left. A minute or so later another plane flew over from a different direction. That also has been a very familiar tactic, for one plane to fly over while another is flying higher or comes from a different direction right after the other. And many times three planes have been involved.

Charter executives have not been notified of approval for the joint Applications, and they have not been notified of any filed class action relating to my still open, valid comprehensive billing dispute. Those are the only two reasons why I personally would be under surveillance.

I have found myself in a situation where I can not turn on my laptop without soon hearing a plane fly overhead or nearby, and it leaves me wondering what the future holds if the FCC does not

12 create a barrier between broadband service providers and those who use the E9-1-1 Mandate as a constant shield for unsolicited, intrusive activities against innocent people.

If the Commission intends to approve the Applications, there will be an irreversible mistake if the approval does not come with conditions that directly involve joint ventures, partnerships and affiliations pertaining to multi-faceted connections to track devices of targeted innocent people. And you must know that Liberty-related companies present a unique situation regarding a new Charter.

Chairman Wheeler, if you have read this far, I present one other point related to recent filings. I have mentioned in detail that comments related to One America News Network (“OANN”) have not been genuine, and tens of thousands of comments regarding OANN flooded the FCC’s system.2 Before beginning this letter I randomly clicked on comments from the past week and the following is the first viewed:

I enjoy OANH, not Liz Wheeler Tipping Point, what a racist/uninformed young woman . Don’t I don’t believe she ever take a breath. I was asked to watch her for 2 weeks.... She lose! 3

I urge you to introduce new guidelines regarding future comment processes to ensure that paid individuals can’t just sit at computers using database lists filing tens of thousands of non- genuine comments which bog down the process and drown out genuine filings.
