Concern is expressed over Criteria “b)” and “c)” and their insertion to Policy 4.4, as follows :

Criteria “b)” : – Whilst the rationale for its inclusion is recognised, concern is expressed over an intensification of “agricultural operations” on the “neighbouring farm” prior to residential development coming forward. As such, insertion of the word ‘existing’ is recommended between “of” and “agricultural”.

Criteria “c)” : - The necessity for this Criterion is questioned. No reference is made in the supporting text/reasoned justification for the insertion. What makes a Local Plan “sound”?

Positively prepared - the plan should be prepared in a way that meets the need for housing and other development, including infrastructure and business development. Justified – the plan should be based on evidence, and be the most appropriate strategy for the borough when considered against other reasonable alternatives. Effective – the plan should be deliverable; the housing and other development should be capable of being carried out.

Consistent with national policy – the plan should enable sustainable development and be consistent with the policies in the National Planning Policy Framework (NPPF).

Representations must be received by 5pm on Friday 5 July 2019. Representations received after this time will not be considered duly made. 5. If you consider the proposed Modification is UNSOUND, do you consider this to be because it is NOT: (please tick all that apply)

Positively Prepared / Justified /

Effective / Consistent with national policy /

6. Please give reasons for your answer to Questions 4(1), 4(2), 4(3) and 5, where applicable. You can attach additional information but please make sure it is securely attached and clearly referenced.

Concern is expressed over the proposed amendments to Policy 32 and Paragraphs 11.1 and 11.3 of the supporting text/reasoned justification which do not provide the necessary clarity and certainty, in terms of application and use. Indeed, the Policy as currently drafted is capable of being misinterpreted, misapplied and misused. References to “identified local deficiencies” imply new residential development should remedy existing deficiencies through new (recreational) provision.

Representations must be received by 5pm on Friday 5 July 2019. Representations received after this time will not be considered duly made. (Please continue on a separate sheet if necessary)

7. Please set out what further change(s) you consider necessary to make the proposed Modification legally compliant or sound, having regard to your responses to Questions 5 and 6. You will need to say why this change will make the Local Plan Part 2 legally compliant or sound. It will be helpful if you could put forward your suggested revised wording of any policy or text. Please be as precise as possible.

(If you are suggesting that the Local Plan Part 2 is legally compliant or sound please write “Not applicable”).

All references to “identified local deficiencies” should be deleted from the Policy and supporting text/reasoned justification. The circumstances under which new recreational provision will be sought on a site by site basis ie directly arising from new residential development should be spelt out clearly.

Representations must be received by 5pm on Friday 5 July 2019. Representations received after this time will not be considered duly made. (Please continue on a separate sheet if necessary)

Concern is expressed over the proposed amendments to Policy 39 and Paragraphs 13.0 and 13.1 of the supporting text/reasoned justification which is now targeted at all “development proposals”. Part 2, as amended, ‘reflects’ the content of Paragraph 13.1 which, itself, repeats the same material.

(If you are suggesting that the Local Plan Part 2 is legally compliant or sound please write “Not applicable”).

Part 2 of Policy 39, as amended, should be deleted and Paragraph 13.1 should be further amended with the first two sentences being deleted thereby removing (internal) repetition.
