THE SECRETARY OF STATE:

1. has on 19 October 2018 received a report from Portsmouth Water Ltd (the “Company”) dated 19 October 2019 (the “Report”) which states that there is or has been a significant risk of supplying water from multiple sites that could be unwholesome.

2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:  Hydrocarbons

Requirements Date until/by which requirements must be maintained/ satisfied (as appropriate) (a) to maintain the following measures for the period specified:

i. Enhanced routine sampling for hydrocarbons Ongoing for the duration at appropriate locations. of the Notice ii. Monitor and investigate consumer contacts related to hydrocarbon taste and odour. iii. Continuation of initiatives to reduce the risks from domestic oil tanks. iv. Review and respond appropriately to mitigate the risk from hydrocarbons from pollution incidents, including those reported through the ’s alerts.

(b) to review, revise and/or make operational the following measures, by the date specified below:

i. Install and commission Volatile Organic 31 December 2022 Carbon (VOC’s) online monitors at the Water Treatment Works listed in this Notice. These monitors must be: a) Linked to appropriate alarms and integrated failsafe shutdown mechanisms that have been tested; and b) Positioned at appropriate locations to protect Company assets from hydrocarbon contamination. ii. Design and operate a system of verification 31 December 2022 and maintenance for the VOC monitors installed under measure (b)i. iii. Update the site operating manuals and 31 December 2022 procedures, as appropriate, following the

installation of the VOC monitors under measure (b)i. iv. Ensure all relevant staff are trained 31 December 2022 appropriately in the operation of the VOC monitors installed under measure (b)i.

(c) to audit whether the measures have been effective by the following means:

i. Define an audit strategy to monitor the 31 December 2019 effectiveness of the above measures.

ii. Implement and keep under continuous For the duration of the review the audit strategy defined in (c)i. Notice above.

(d) not to supply water for regulation 4(1) purposes from the sites covered by this Notice, unless the conditions specified below are satisfied:

i. n/a (e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

i. Provide a progress report annually by 31 January and against the following milestones:

a) Report to confirm details of the 31 January 2020 strategy for auditing the effectiveness

of the measures as specified in

measure (c)i.

ii. Review the risk assessment for the sites covered by this Notice as required by From time to time and by regulation 27(3) and subsequently submit a 21 February 2023 revised regulation 28(1) report accompanied by a signed board level declaration.

iii. Submit a satisfactory completion report 28 February 2023

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act.
