Sri Mohammed Aleemuddin, Hyderabad has filed 2nd appeal dated 12-04-2018 which was received by this Commission on 12-04-2018 for not getting the information sought by him from the PIO / 1. The Deputy Tahsildar, Asif Nagar Mandal, Hyderabad District, PIO / 2. O/o. the Chief Executive Officer, Telangana State Waqf Board, Razzack Manzil, Opp. Public Gardens, Nampally, Hyderabad and 1st Appellate Authority / The Revenue Divisional Officer, Hyderabad Division, Hyderabad District.

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 01-02-2018 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: TSIC

The Public Information Officer / The Deputy Tahsildar, Asif Nagar Mandal, Hyderabad District, has Transferred the 6(1) application on 05-05-2018, U/s 6(3) to the PIO / the Chief Executive Officer, Telangana State Waqf Board, Razzack Manzil, Opp. Public Gardens, Nampally, Hyderabad, to furnish the information to the Applicant.

Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 05-03-2018 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005.

The 1st Appellate Authority / The Revenue Divisional Officer, Hyderabad Division, Hyderabad District, issued notice on 31-05-2018 calling the PIO to appear for hearing on dated 16-10-2017.

As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005.

On 20-2-2019 the case is called. The appellant is absent. The Public Information Officers, Naib Tahsildar, Asifnagar Mandal and Executive Officer, Telangana State Wakf Board are present. Naib Tahsildar, O/o the RDO, Hyderabad is present on behalf of the First Appellate Authority.

The appellant filed affidavit stating that he did not receive the sought information from the Public Information Office, O/o the Tahsildar, Asifnagar and the information furnished by the PIO, Wakf Board is incomplete and not authenticated.

The Public Information Officer, Naib Tahsildar, Asifnagar submitted that information was furnished to the appellant through letter dated 10.11.2018.

The Public Information Officer, Wakf Board submitted that a letter dated 25.05.2018 was sent to the appellant informing him to pay Rs.40/- and after receipt of requisite amount information was furnished to the appellant on 20.06.2018.

The Naib Tahsildar appearing on behalf of the First Appellate Authority submitted that the application dated 23.10.2018 received from the O/o the District Collector, Hyderabad was transferred U/s 6(3) to the Naib Tahsildar, Asif Nagar for necessary action through letter dated 02.01.2019.

Heard the parties and perused the records.

The Commission observed that there is no co.ordination in the submissions made by the respondents. As per the records, the appellant filed 6(1) application dated 01.02.2018 before the Public Information Officer, O/o the Tahsildar, Asifnagar Mandal requesting information on four points and as he did not get information filed 1st appeal dated 05.03.2018 before the O/o the Tahsildar, Asifnagar Mandal and against filed 1st appeal dated 03.05.2018 before the RDO, Hyderabad Division. The record reveals that the PIO, Dy. Tahsildar, Asifnagar Mandal through Endorsement dated 12.04.2018 informed the appellant that the sought information is not available. The First Appellate Authority & RDO, Hyderabad through intimation dated 25.05.2018 informed the appellant to appear before him for hearing on 31.05.2018.

The Commission noticed that the Public Information Officer, Naib Tahsildar, Asifnagar is not aware of the application dated 01.02.2018 and the subsequent reply of the then Public Information Officer dated 12.04.2018 and he made submission before the Commission with regard to another application dated 23.10.2018 filed by the appellant herein, the subject matter of which is different. The representative of the First Appellate Authority could not inform about the happenings after the 1st appeal hearing on 31.05.2018. The Public Information Officer, Wakf Board did not file copies of the letters dated 25.05.2018 and 20.06.2018.

The case was adjourned.

On 29-4-2019 the case is called. The appellant is absent. The Public Information Officers (1) Dy. Tahsildar, AsifTSIC Nagar Mandal and (2) Executive Officer, Telangana State Wakf Board are present.

The Public Information Officer, Dy. Tahsildar submitted that the 6(1) application dated 01.02.2018 filed by the appellant was transferred U/s 6(3) to the Public Information Officer, Wakf Board on 05.05.2018.

The Public Information Officer, Wakf Board submitted that the sought information was furnished to the appellant on 25.08.2018. The Public Information Officer further submitted that some land has been encroached.

Since information is furnished, the appeal is closed.
