O’Donovan, Division Director OFFICIAL LIST OF PUBLIC WATERS Published Pursuant to RSA 271:20 II (effective June 26, 1990) IMPORTANT NOTE: Do not use this list for determining water bodies that are subject to the Comprehensive Shoreland Protection Act (CSPA). The CSPA list is available on the NHDES website. Public waters in New Hampshire are prescribed by common law as great ponds (natural waterbodies of 10 acres or more in size), public rivers and streams, and tidal waters. These common law public waters are held by the State in trust for the people of New Hampshire. The State holds the land underlying great ponds and tidal waters (including tidal rivers) in trust for the people of New Hampshire. Generally, but with some exceptions, private property owners hold title to the land underlying freshwater rivers and streams, and the State has an easement over this land for public purposes. Several New Hampshire statutes further define public waters as including artificial impoundments 10 acres or more in size, solely for the purpose of applying specific statutes. Most artificial impoundments were created by the construction of a dam, but some were created by actions such as dredging or as a result of urbanization (usually due to the effect of road crossings obstructing flow and increased runoff from the surrounding area). -

Chambers Creek – Clover Creek Drainage Basin - Section 3.1 Puyallup River Drainage Basin – Section 3.2 Nisqually River Drainage Basin – Section 3.4 Kitsap Drainage Basin – Section 3.5 3.1 Chambers Creek – Clover Creek Drainage Basin The Chambers Creek - Clover Creek Drainage Basin (Basin) is located in central Pierce County, between Puget Sound on the west and the ridge above the Puyallup River Valley on the east. Point Defiance and the southwest shore of Commencement Bay serve as the basin’s northern boundary, and the City of DuPont lies on the southern boundary. The basin encompasses approximately 104,258 acres (117 square miles) of land including the Cities of DuPont, including Northwest Landing, University Place, Lakewood, and Northwest Tacoma, Fircrest, the Towns of Ruston, and Steilacoom, as well as portions of Fort Lewis and McChord Military Reservations, and the unincorporated communities of South Hill, Frederickson, Mid County, Graham, Parkland, and Spanaway. 3.1.1 Topography Lowland topography is generally flat to gently rolling. -

Rulemaking under 10 V.S.A. §I424 - General The Vermont Water Resources Board (Board) was given the authority by the Legislature to adopt rules regulating the use of public waters under 10 V.S.A. §I424 which is entitled "Use of Public Waterst1 (see Attachment A) in 1969. In the past 25 years the Board has corlsidered 80 rulings under this authority. Occasionally, these rulings have been by the Hoard's own initiative, but more often they have been in response to petitions filed by the legislative bcdy of a municipal.ity or by Vermont citizens. As a result of these 80 proceedings, the Board has adopted rules on 48 occasions, although often adopting less restrictive rules than initia1l.y requested. The Board has not adopted any rules in response to 25 of the petitions. In recent years the number of petitions filed with the Board has increased dramatically. In the past ten years alone 46 petitions (nearly 58% of the total over 25 years) have been filed ; a record seven petitions were filed in the past year alone. This trend reflects the increased demand being placed on Vermont's public waters for recreational and other uses as a result of growth in population, tourism and in the number and intrusiveness of recreational uses. -

Franklin County NRCD Natural Resources Assessment
Franklin County NRCD Natural Resources Assessment Written by Jeannie Bartlett, District Manager Submitted March 15, 2017 Summary Every year each District in Vermont submits a Natural Resources Assessment to the Natural Resources Conservation Council. This report describes the natural features and resources of the District, how they have changed over time, and their current status. This year the District Manager has significantly updated and expanded the Franklin District’s Natural Resources Assessment. This Assessment includes information from the Tactical Basin Plans for the three major watersheds in Franklin County. Further research and interpersonal knowledge of the District will lead to updates and improvements in the coming years. This Assessment begins by laying out the legal and organizational definitions and context for the Franklin County NRCD. We then give the basic geospatial definition of the District, and a basic outline of the watersheds included. A couple of maps help illustrate the watersheds in the District. The next section tells the early history of the landbase, from the most recent glaciation up to European arrival. Future Assessments may add content covering European settlement and industrialization up through the present, as the history of land use provides important context for our use of it today. Next we give an assessment of the District’s natural resources in a few categories: soil, water, air, animals, wetlands, and hydrology. The next major section summarizes priority actions to improve the state of our natural resources identified through the 2015 Local Working Group and the District’s relevant Tactical Basin Plans. Finally, we give a brief overview of the District’s current projects and programs Mission The mission of the Franklin County NRCD is to assist farmers, landowners, and the community of Franklin County, VT with resource conservation projects and public education. -

Impacts to Stream Habitat and Wild Trout Populations in Vermont Following Tropical Storm Irene Vermont Fish and Wildlife Department Annual Report State: Vermont Project No.: F-36-R-14 Grant Title: Inland Waters Fisheries and Habitat Management Study No. IX Study Title: Aquatic Habitat Conservation and Restoration Period Covered: July 1, 2011 to June 30, 2012 Summary: Damage suffered from Tropical Storm Irene required immediate and in some cases extensive stream channel alteration to protect life and property and rebuild critical transportation infrastructure. However, a significant amount of instream activity was also conducted without proper consultation and oversight or for reasons beyond necessary flood recovery. These activities continued for several months after the flood event and covered a wide area of the central and southern portion of the state. Post-flood activities which were detrimental to aquatic habitat quality and diversity included large scale removal of streambed material and natural wood, berming of streambed materials to raise streambank elevations and the straightening of stream channels. These activities resulted in homogeneous, overwidened stream channels comprised of small substrates and lacking the diversity of habitats, flows and depths necessary to support robust aquatic populations. As fish population recovery and fisheries management options will be dependant on aquatic habitat quality and complexity, the Vermont Department of Fish and Wildlife conducted an assessment of post-flood aquatic habitats in selected watersheds. This partial assessment estimated a total of 77 miles of stream with major degradation of aquatic habitat resulting from post-flood stream channel alteration activities. Long-term monitoring studies in Vermont indicate that, in the absence of post-flood channel alterations, wild trout populations generally recover within 2-4 years.
