By this Memorandum Opinion and Order, the Commission considers four Applications for Review that challenge the dismissal by the Media Bureau (“Bureau”) of four applications for new low power FM (“LPFM”) construction permits filed in the 2013 LPFM filing window.1 All four applications were dismissed for violating the spacing requirements of Section 73.807 of the Commission’s Rules (“Rules”) and the applicants were not permitted to file curative amendments pursuant to Section 73.870(c) of the Rules.2 2.     EXHIBIT A Engineering Statement On Behalf of Mercer Island School District MOO Calculation of Interfering Signal Contour We have been asked by station KMIH, Mercer Island School District #400, Mercer Island, WA to provide an alternative analysis of the interference caused the station by KAFE, Bellingham, WA. a class C station. For the purpose of this examination we used the KMIH construction permit parameters, (see BMPED 2002051 7ABD) which amends the station's licensed coordinates by four longitudinal seconds. First, we determined if this situation called for the use of an alternative prediction method from the Commission's standard. The Cornmission has set a policy that it will not entertain alternative showings unless the terrain can be shown to range widely from the expect norm under which the F(50-IO) and F(50-50) tables were developed. The norm ranges from a delta h of under 20 meters (flat) to one over 100 meters (rugged). This provided Covington with a first local service and resulted in a net gain of service to 802,176 persons. As a result of this action, Station KMIH would cause interference to Station KMCQ and, as a Class D secondary station, would be required to suspend operation.
