PRELIMINARY. 1, This Act may be cited as " The Constitution Further aaort title. Amendment Act, 1913."

2. This Act is incorporated and shall be read as one Act with Incorpmstion rith A"E. The Constitution Act" and a The Electoral Code, 1908," and all Acts amending those Acts or either of them.

PART I. The Constitution Further Amendmernt Act.-1913.

I nkwpretation. 4. In this Act- " Assembly " means the House of Assembly :

" Assembly District " means District for the purpose of electing Members of the House of Assembly:

" Council " means the Legislative Council : Council District " means District for the purpose of electing Members of the Legislative Council: The State " means the State of South Australia.

Bepeal. 6. (1) The Acts mentioned in the First Schedule to this Act are hereby repealed to the extent mentioned in that Schedule. (2) Such repeal shall not- (a) affect the operation prior to the passing of this Act of any enactment so repealed ; (b) alter, except so far (if at all) as may be necessary for giving effect to this Act, the effect of anything done or suffered, or of the omission of anything before the passing of this Act ; (C) affect any right, duty, or liability acquired, accrued, or incurred under any enactment so repealed ; or (d) affect any legal or other proceedings already commenced, or hereafter to be commenced, with respect to any of such matters or things. (3) All such matters and things are hereby preserved and con- tinued and declared to be of the same force and effect as if the said enactment8 were still in force,

Legisktivecouncil. 7, (1) Until the day of the general election of the House of cf.AC~ ob9,l908.~.4~ Assembly held next after the passing of this Act, the Legislative Council shall consiat, as at present, of eighteen Members, (2) On the day of the said next general election, sufficient Members shall be elected to the Council to increase the number of the Members thereof to twenty, such Members being elected in accordance with section 9 of this Act ; and thereafter the Council shall consist of twenty Members. 8. 8. (1) Until the day of the said next general election the House HOW of A.-~IJ. of Assembly shall consist, as at present, of forty Members. cf. ibid., 0. b. (2) At the said next general election forty-six Members shall be elected to the Assembly, such Members being elected in accordance with subsection (2) of section 10 of this Act ; and thereafter the Assembly shall consist of forty-six Members.

Central District No. 1 shall comprise the present Assembly Districts of Adelaide and Port Adelaide, and Central District No. 2 shall comprise the preaent Assembly District of Torrens ; and

(2) For the purpose of electing Members of the Assembly at the said next general election, and thereafter for the purpose of electing such Members, the State shall be divided into nineteen electoral Districts, which shall respectively- (a) be distinguished by the names, and (b) return the number of Members, and (c) comprise the portions of the State, set forth in the Third Schedule to this Act. 11. (1) Within one month from the coming into operation of assigning the sitting Membm to Centd this Act, the Members of the Council who have been elected to Dhti+c%NW- l and20 represent the Central District (as constituted before the passing of this Act) shall decide amongst themselves the question which three of them shall represent Central District No. 1, and shall, by writing signed by all of them, certify their decision to the President of the Council. (2) I subsection (1) of this section is not fully complied with within the said period of one month, the President shall decide the said question by lot. (3) Notice of t.he decision of the said Members or of the President (as the case may be) shall be published by the President in the Govermnent Gazette. (4) The notice so published shall be conclusive evidence as to the matters therein stated, and as to the validity thereof. (5) From the date of the publication of the notice under sub- section (3) of this section, the three Members therein specified shall be Members representing Central District No. 1 in the Council, and the other three Members of the Council who have been elected to represent the Central District (as constituted before the passing of this Act) shall be Members representing Central District No. 2 in the Council.

Amendment of 13. Section 11 of L' The Constitution Amendment Act, 1908," section 11 of Act 969 of 1908. is hereby amended by substituting the words " two for any Council Periodical retirement District " for the words " three for the Central District and two of Counoillom. for each of the other Districts " in the third and fourth lines thereof.

Amendment of 14. Section 12 of The Constitution Amendment Act, 1908," is mien969 of 1908. In calculating, for the purposes of sections 10, 11, and 12 Methodof txlouhtin~ of a The Constitution Amendment Act, 1908," the time during which a Member of the Council, who, under eection 12 of this Act, becomes a Member representing Central District No. 1 or Central District No. 2, has qccupied his seat, or has represented the District, the time during which he has represented the Central District (ss constituted before the passing of this Act) since he was last elected shall be added to the time during which he has represented Central District No. 1 or Central District No. 2, as the case may be.

16. (2) The Returning Officer for the State may, as occasion may require, make such alterations in the Second Schedule to The Electoral Code, 1908," as appear to him to be necessary to carry NO. 971 of 1908. this Act into effect ; and upon such alterations being approved by the Governor and published in the Government Gazette, the said Schedule shall be deemed to be amended by this Act in accordance with such alterations, and such alterations shall be as valid as if hereby enacted.

PART 111. FRANCHISE FOR THE LEGISLATIVE COUNCIL, AND QUALIFICATION OF ELECTORS FOR THE HOUSE OF ASSEMBLY. 17. 18. Notwithstanding anything in section 17 of this Act, no ~otentitled to vote unleaa repiatered and person shall be entitled to vote at an election for a Member or qdsea. (a) is at the time of the election registered on the electoral roll for the Council District in which such election is held, and (b) has been so registered for a period of at least one month immediately before the day of the issue of the writ for such election.

19. (1 ) Sections 17 and 18 of this Act shall not apply to any New qualifications not to apply before election held before a date to be fixed by the Governor by procltt- date to be mation, which proclamation shall be published in the Government proclsimed. (2) For the purposes of any election held before the date so fixed, and of the registration and rolls of electors to vote at such an election, the enactments repealed by this Act shall be deemed to be still in force. (3) For the purposes of elections to be held on or after the date so fixed, electors to vote for Members of the Council shall, as well before as on and after that date, be registered in accordance with the provisions of section 17 of this Act, and not otherwise. (Q) The Returning Officer of the State shall make such arrange- ments for keeping separate records of registrations ss he deems necessary for giving effect to the provisions of this section.

20, Section 4 of " The Electoral Laws Amendment Act, 1904," Amendment of seotion is amended by substituting the following provision for subsection (1) 4 of Act No. 876 of thereof, namely :-- (1) Subject to the disqualifications set out in subsection (2) Qdifiration ot eleotom for House of hereof, every person who- ~memblyeleotions. 11. has been so' registered for a period of at least one month immediately before the day of the issue of the writ for such election.

PART IV. MONEY BILLS. Interpretation. 21, (1) In this Part, the expressions “revenue," "public Imp. Parlt. Act, 1911, 8. 1 (2). money," taxation," and " loan " respectively do not include any revenue, money, taxation, or loan raised by local authorities or bodies for local purposes.
