MINUTES of the meeting of the Planning & Environment Committee, held on Thursday 3rd September 2020 at 7.30 pm via Microsoft Teams video conferencing.

P&E20/21.027 Apologies for absence: Due to the Coronavirus the meeting was not held in person. Apologies for absence were received and accepted by Seth Jee, Martin Machan (Chairman) Peter Griffiths, Bob Sampson, Michael Avery. Due to the absence of the Chairman, the Vice-Chair took the role.

P&E20/21.028 Declarations of Interest; the following declarations were received: There were no declarations of interest.

P&E20/21.029 Minutes of the Planning Committee meeting held on 6th August 2020: Due to the Coronavirus the minutes will be signed by the Chairman at the next available opportunity.

P&E20/21.030 Matters arising from the meeting of the Planning Committee held on 6th August 2020: The committee were asked to note the following responses from MSDC: a) 145 High Street Hurstpierpoint - As I understand the situation, work was required to be completed by the 17th June 2020 In respect of the matters approved under application DM/19/5209 and other outstanding matters associated with the Enforcement Notice that is currently in place. Obviously the pandemic will have had an impact on their ability to complete the works and before considering what further formal action may be appropriate, it would appear to me that it would be reasonable to agree a revised date for any outstanding works to be completed. I have asked that a visit to the site is arranged, to establish the current position and make contact with the owner to establish their intentions and to agree a revised date for completion. b) Alders Farm. Road - It is correct that the temporary permission granted under DM/16/4199 has expired and the dwelling does not currently benefit from planning permission. While application DM/20/0585 was withdrawn by the applicants following concerns raised by the Council’s Agricultural Advisor, a new revised application has been submitted and is being considered under reference DM/20/2704. This application is currently being consulted upon and comments on the proposal from the Council’s Agricultural Advisor are awaited. These comments appear key in this case and the Council are unlikely to pursue formal enforcement proceedings while the outcome of the current application is unknown. The planning case officer and enforcement officers are working closely on this matter to resolve the current breach of planning control.

P&E20/21.031 Adjournment for questions from the public: Members considered whether to adjourn the meeting in order to receive questions from members of the public in attendance. One member of the public present and by agreement spoke later re item (1) 7.1.

P&E20/21.033 Planning applications - Committee decision: The Committee considered the following and made RECOMMENDATIONS to the Planning authority:

Conversion of temporary residential dwelling to permanent residential dwelling with associated external alterations. One member of the public spoke in support. RECOMMENDATION: Unable to make an informed recommendation as MSDC are still awaiting a report from their Agricultural Advisor.

(2) 142 Western Road Hurstpierpoint Hassocks West Sussex BN6 9TB. DM/20/2833. T1 Cherry - Reduce crown by 1m. T2 Hawthorn - Reduce crown by 1.5m. RECOMMENDATION: Permission is granted

(3) 137 College Lane Hurstpierpoint Hassocks West Sussex BN6 9AF. DM/20/2847.Proposed first floor extension to form additional bedroom and en-suite. RECOMMENDATION: Permission is granted

(5) Barn Southwest Of Pakyns House Bullfinch Lane Hurstpierpoint West Sussex. DM/20/2941. Application for determination as to whether prior approval is required for the change of use from agricultural barn to a single unit 2-bed dwelling house (Use Class C3) and associated building operations under Class Q(b). RECOMMENDATION: A full application is required due to possible conflict with the Neighbourhood & District Plans.

(12) Buff Cottage Reeds Lane Sayers Common Hassocks West Sussex BN6 9JG. DM/20/2846. Removal of condition No: 5 of Planning Permission DM/18/1193 to allow the ancillary building to become a independent dwelling (Retrospective) RECOMMENDATION: Refusal – Contrary to the condition applied in DM/18/1193 since when nothing has changed to mitigate the reasons for this condition. Over intensive use of the site, not in accordance with planning policy DP26.

(13) 94 College Lane Hurstpierpoint Hassocks West Sussex BN6 9AJ. DM/20/2647. Two storey rear extension with dormer and roof windows, removal of front bay windows with remodelling of front elevation. RECOMMENDATION: Permission is granted

(14) Kingsland Laines Reeds Lane Sayers Common Hassocks West Sussex BN6 9JG. DM/20/2937. Full planning application to revise the approved permission (DM/19/1148) to provide for 13 additional dwellings including 30% affordable units with associated landscaping, road layout, access and parking. RECOMMENDATION: Refusal – The Parish Council strongly objects. There is still no indication of the outline plans for phase 2. The impact of the additional dwellings on the surface water run-off has not been commented on, only the foul water. These additional dwellings represent a 50% increase within this block, on the original plan for phase 1, which was already totally disproportionate to this small settlement and its available amenities. It represents a further abuse of the numbers as set out in the Hurstpierpoint & Sayers Common Parish Council Neighbourhood plan.

(15) Naldretts Farm Pookbourne Lane Sayers Common Hassocks West Sussex BN6 9HD. DM/20/3040. Demolition of existing fire damaged building and erection of replacement dwelling. Repair and re-build of Piggeries and Barn. Re-build barn to form garage/workshop/store. RECOMMENDATION: Permission is granted, with conditions in place which ensure robust control of construction traffic, to protect neighbours and surrounding environment.

(16) Pond Lye Barn Cuckfield Road Ansty West Sussex RH17 5AL. DM/20/2963. To revise fenestration details from those approved under DM/20/0879. Removal of 3 ground floor windows, removal of north elevation first floor window, and addition of a second conservation roof light to the east elevation on the proposed carport. RECOMMENDATION: Permission is granted

(17) 7 Hassocks Road Hurstpierpoint Hassocks West Sussex BN6 9QH. DM/20/3056. Removal of fireplace, internal wall and associated chimney breast and supporting of retained structure above. Fixing shut of door and lining over with associated removal of architrave and removal of door furniture to be retained for possible future reinstatement.

P&E20/21.036 - The committee noted the following:The Parish Council have been made aware that construction at the Kingsland Laines site in Sayers Common is continuing beyond the agreed daily hours. This is a breach of planning conditions. The Council will contact MSDC Planning Office to raise this concern.
