Bills for consideration and passing

$ I. SHRI HUSAIN DALWAI SHRI SITARAM YECHURY to move the following Motion:—

“That this House resolves in pursuance of Section 28 of the University Grants Commission Act, 1956, the University Grants Commission (Minimum Standards and Procedure for Award of M. Phil/Ph.D. Degrees) Regulations, published in the Gazette of dated 5th July, 2016 vide Notification No.F.1-2/2009(EC/PS)V(I)Vol.II and laid on the Table of the House on the 11th August, 2016, be annulled; and

That this House recommends to Lok Sabha that Lok Sabha do concur in this Motion”

$ II. SHRI SITARAM YECHURY SHRI RITABRATA BANERJEE to move the following Motion:—

“That this House resolves in pursuance of Section 28 of the University Grants Commission Act, 1956, the University Grants Commission (Minimum Standards and Procedure for Award of M. Phil/Ph.D. Degrees) Regulations, 2016 published in the Gazette of India dated 5th July, 2016 vide Notification No.F.1-2/2009(EC/PS) V(I).Vol.II and laid on the Table of the House on the 11th August, 2016, be modified as follows:—

1. That in regulation 1.2 at page 7, after the word “under Section 3 of UGC Act, 1956”, the words “in harmony with the law on reservation and adopted in accordance with the relevant University’s Act. Provided that nothing in this regulation will contravene the Central Educational Institutions (Reservation in Admissions) Act, 2006, where applicable, nor will any such amendment be applied with retrospective effect.” be added; 2. That in regulation 5.2.1 at page 8,line 2, after the word “admitted” insert “in accordance with the University’s Act”;

3. That in regulation 5.2.1 at page 8, at line 3, substitute the word “available” with “sanctioned faculty strength”

4. That in regulation 5.2.1 at page 8, delete the following “'keeping in mind the norms regarding the scholar teacher ratio (as indicated in Para 6.5) laboratory, library and such other facilities”;

5. That in the regulation 5.2.3 at page 8 after the word “adhere to the national/State-level reservation policy, as applicable” insert the following “Provided that nothing in this regulation will contravene the Central Educational Institutions (Reservation in Admissions) Act, 2006”;

6. That in regulation 5.3 at page 8, after the words “statutory bodies concerned” the words “in accordance with the Act of the concerned University” be inserted;

7. That in regulation 5.3, at page 8, at the end insert the following: “Provided that nothing in this regulation will contravene the Central Educational Institutions (Reservation in Admissions) Act, 2006 where applicable, nor will any such amendment be applied with retrospective effect”; 8. That in regulation 5.4.1 at page 8, substitute the following: “'with qualifying marks as 50%. The syllabus of the Entrance Test shall consist of 50% of research methodology and 50% shall be subject specific” with “and shall test research aptitude and subject knowledge. The weightage of written examination to viva voce shall be determined in accordance with the Acts and statutes of the concerned university and law of the land”

9. That after regulation 5.4.2, at page 9, insert the following: “5.4.3 Relevant statutory bodies of the concerned university shall adopt a criterion of reasonableness and non-arbitrariness to determine the relative weightage of written entrance exam and interview/viva voce.

5.4.4 The combined aggregate marks scored by the candidate in the written entrance exam and the interview will determine the merit list for admission to the programme. Reservation will be applied at each stage of the admission”

10. That in regulation 6.1, at page 9, at lines 2, 4 and 5, delete the word “referred”.

11. Substitute regulation 6.5, at page 9, with the following: "A Research Supervisor/Co-supervisor, at any given point of time, may supervise a minimum of one and a maximum of three M.Phil; and, a minimum of six and a maximum of twelve Ph.D. Scholars, adopted in accordance with the concerned University's Act. Provided that nothing in this regulation will contravene the Central Educational Institutions (Reservation in Admissions) Act, 2006, where applicable, nor will any such amendment be applied with retrospective effect."; and

That this House recommends to Lok Sabha that Lok Sabha do concur in this Motion”. ———— CLARIFICATIONS ON THE STATEMENT BY MINISTER
