OFFICE OF THE CITY MANAGER DECLARATION OF CITY OF TSHWANE METROPOLITAN MUNICIPALITY’S 2016 LOCAL GOVERNMENT ELECTION RESULTS 1. PURPOSE The purpose of this report is to inform the Council about the outcome of the 2016 Local Government election results within the City of Tshwane as declared by the Independent Electoral Commission. 2. STRATEGIC OBJECTIVE This report aligns with Tshwane Vision 2055 Outcome 6, “South Africa’s Capital with an activist citizenry that is engaging, aware of their rights and presents themselves as partners in tackling societal challenges” as well as strategic objective 4, “Promote Good Governance and Active Citizenry.” 3. BACKROUND The office of the Municipal Electoral Officer officiated the 2016 Local Government election process in line with the election time table as prescribed by the provisions of the Local Government Municipal Electoral Act, No 27 of 2000, the Electoral Commission Act No. 51 of 1996 and Regulations thereunder as amended. Section 64 (1) of the Local Government Municipal Electoral Act No 27 of 2000, provides that the Commission must on receipt of all the results of the count in respect of ballots conducted at the voting stations within the Municipality or wards, determine the results of elections in the municipality or ward and record the results in public. The City of Tshwane’s Local Government Election Results for 2016 were declared in public, as accurate, free and fair by the Commission in terms of the Local Government Election Legislation. 4. DISCUSSION: a. ELECTION RESULTS AND ALLOCATION OF SEATS PER PARTY. The reports mentioned below are submitted to council for cognisance following the declaration of the results by the Commission: 4 • The seat allocation summary report provides information regarding valid votes received, seats won, the percentage seats won and candidates elected into councillor position per party and is attached as Annexure A. • The Leading Party Report summarises seats won by a party and percentage support is attached as annexure B. • Ward Seats won per Party Report details the number of ward seats won and the party representing those wards is attached as annexure C. No independent candidate has won a ward seat in the City of Tshwane. A list of Elected Councillor was gazetted in terms of Electoral Commission Notice 483 of 2016 dated 10 August 2016, attached as annexure D. The mentioned gazette marks the culmination of the candidate nomination process and triggers the application of the Local Government Municipal Structures Act, No. 117 of 1998, schedule 1 item 20, as amended, providing for the Electoral System for Metro and Local Councils. b. THE ELECTORAL SYSTEM FOR METRO AND LOCAL COUNCILS The Local Government Municipal Structures Act, 1998, Schedule 1 (20) provides that a party may supplement, change or increase its list at any time, provided that if a councillor elected according to a party list, ceases to hold office, the party concerned may supplement , change or increase its list by not later than 21 days after the councillor has ceased to hold office. The vacancy must be filled as soon as the party in question has supplemented, changed, or increased its list, but not later than 14 days after expiry of 21 days period (Sub Item 1 substituted by section 26 of Act 51 of 2002). The Act further provides that if a party supplements, changes or increases its list in terms of sub Item (1), it must provide the chief electoral Officer with an amended list. The process requires that a notice be given to the City Manager (Chief Electoral Officer) by the authorized party representative that a vacancy is declared, that a person who is currently not on the list completes acceptance of nomination, attach a copy of identity document and that a party submits an amended list. There is no cut time for this activity, and it is dependent on the party concerned. The Parties are advised to submit the requests to declare vacancies to the Chief Electoral Officer on time to enable the Commission to process the submission in case they wish to effect changes before the inaugural meeting of council. 5 5 COMMENTS OF STAKEHOLDER DEPARTMENTS a. COMMENTS OF STRATEGIC EXECUTIVE DIRECTOR GROUP LEGAL SERVICES DEPARTMENT (Unaltered) The purpose of this report is to inform the Council about the outcome of the Local Government election results within the City of Tshwane as declared by the Independent Electoral Commission. This is an informative report aimed at the Council and to take cognisance thereof. Group Legal Department takes cognizance of the reports and notes the recommendations therein and comment further that same are legally in order. b. COMMENTS OF THE ACTING GROUP CHIEF FINANCIAL OFFICER (Unaltered) Cognisance is taken of the contents of the report. There are no financial implications emanating as a result of this report for the City of Tshwane as the purpose of the report is to inform the Council about the 2016 local government elections results within the City of Tshwane as declared by the Independent Electoral Commission. 6 IMPLICATIONS a. Human Resources There are no human resources implications related to this report. b. Finances There are no financial implications related to this report. c. Constitution and Legal There are no constitutional and/or legal implications related to this report. d. Communication The public will be notified of the names of the elected Councillors after the inaugural council meeting. 7 CONCLUSION The commission has declared the City of Tshwane Local Government Elections Results for 2016 free and fair. This report is tabled for council to note the election results as declared by the commission. 6 ANNEXURES A.
