The Committee on Education, General and Omnibus Affairs convened a public hearing on Friday, May 23, 2008 at 2:00 p.m. to receive testimony on among other measures Bill No. 282 (EC) An act to amend §13104 of Chapter 13 OF Title 3, Guam Code Annotated and to add a new §1126 in Chapter 1 of Title 2, Guam Code Annotated; relative to vacancies in I Liheslaturan Guahan:

II. Summary of Testimonies

Senator B.J. Cruz the author of the legislation was afforded the opportunity to explain the bill. Senator Cruz stated before and after the special election in which he was elected to fill in the vacant seat that there was much discussion about the cost of the special election. Senator Cruz pointed out during a public hearing that was held earlier with the Guam Election Commission that the acting administrator Stephanie Chargualaf testified that the special election cost One Hundred fifty thousand dollars. Senator Cruz believes that this is a considerable amount of money. He furthered elaborated that the bill provides four options appointment by the governor, appointment by the mayors council, and appointment by the Guam Legislature or the sixteenth place finisher.

Mrs. Rita T. Franquez testified as a private citizen in support of Bill No. 282. She believes that the options offered by Senator Cruz's bill, she endorses the option of the candidate who places number sixteenth on the general election results. This option is more representative and less contentious.

Mr. Romeo Carlos testified as a private citizen in support of Bill No. 282. He believes that the people will more than likely support the candidate who places number sixteenth to fill in the vacant seat, but that body should consider giving the authority to the mayors' council. Mr. Carlos elaborated that this will afford the Mayors to be more involved and they are closely with the process. Mr. Carlos ended by stating that there is no doubt that the option of the candidate coming in number sixteenth is the most plausible.

Ms. Pilar C. Lujam, former Senator and Chairwoman of the Democratic Party of Guam, submitted written testimony in support of Bill No. 282. Further, she elaborated that in the event a vacancy occurs, the party with the vacancy selects and submits the names of three individuals to the Governor. The Governor would then select and appoint one of the individuals to fill the vacancy. Ill. Findings and Recommendations

2 Section 1. Legislative Findings and Intent. I Liheslaturan

3 Gutihan finds that the October 2007 passing of one of Guam's

4 statesmen, former Speaker Antonio R. Unpingco, led to a special

5 election on January 2008 to fill the vacancy of his unexpired term in I

6 Mina Bente Nuebi na Liheslaturan Gudhan.

7 The intent of this Act is to present alternatives to filling

8 vacancies in I Liheslatura in a manner that is streamlined and less

9 costly. The special election held on January 5, 2008 cost Guam

10 taxpayers about $125,000. This Act presents several new sections to

I I the existing statutes of Title 2 of the Guam Code Annotated. However, only one out of the four that receives the most favorable

2 testimony by the People of Guam will prevail based on public input

3 during the public hearing. It will be included in the final version of

4 the bill prior to its introduction on the legislative floor.

5 Section 2. § 13104 of Chapter 13 of Title 3, Guam Code

6 Annotated is hereby amended to read:

9 The Guam Election Commission shall call for a special

1o election on a Saturday on or about sixty (60) days of the

11 vacancy to fill vacancies in the Guam Legislature '\Nhenever one

12 (1) or more vacancies occur therein prior to eight (8) months

13 before the date of the next general election of members of the

14 Guam Legislature. Candidates must file their candidacies no

15 later than thirty (30) days prior to the special election date.

16 There shall be no primary election. The highest vote getter or

17 vote getters if there is more than one (1) vacancy, shall be

18 certified by the Guam Election Commission as elected and shall

19 be administered the oath of office immediately to fill the

20 unexpired ,.fracancy."

21 Section 3. A new§ 1126. in Chapter 1 of Title 2, Guam Code

22 Annotated is hereby created to read:

2 1 11§ 1126. Vacancies. In the case of a vacancy occurring in I

2 Liheslaturan Guahan because a member can no longer qualify to

3 serve in the seat for which he was elected, the vacancy shall be

4 filled by appointment of I Maga'lahen Guahan with the advise

5 and consent of I Liheslaturan Guahan. The appointment shall

6 take place within thirty (30) days of the vacancy occurring. The

7 person appointed to fill the vacancy shall serve for the

8 remainder of the term of the position vacated.";

9 11§ 1126. Vacancies. In the case of a vacancy occurring in I

1o Liheslaturan Guahan because a member can no longer qualify to

11 serve in the seat for which he was elected, the vacancy shall be

12 filled by appointment by a majority vote from among the

13 members of the Mayors' Council of Guam. The appointment

14 shall take place within thirty (30) days of the vacancy occurring.

15 The person appointed to fill the vacancy shall serve for the

16 remainder of the term of the position vacated.";

17 11§ 1126. Vacancies. In the case of a vacancy occurring in I

18 Liheslaturan Guahan because a member can no longer qualify to

19 serve in the seat for which he was elected, the vacancy shall be

20 filled by appointment by a majority vote from among the

21 members of I Liheslaturan Gudhan. The appointment shall take

22 place within thirty (30) days of the vacancy occurring. The

2 remainder of the term of the position vacated."; or

4 Gulihan, the sixteenth (16th) place finisher in the general election

5 for which the vacancy was initially filled shall be appointed to

8 appointed, the next highest ranking finisher in votes in that

9 general election shall be appointed. If such finisher is ineligible

On behalf of the Democratic Party of Guam, I am pleased to offer testimony on Bill No. 282(EC) introduced by Democrat Senator BJ Cruz regarding the filling of vacancies in the Guam Legislature. As we all know from our past, there have been instances where unfortunately, a member of this esteemed body has passed away leaving a vacancy in the membership of the legislature. Presently, our laws provide for a special election in the event a vacancy occurs; an election that ultimately costs additional taxpayer money, time, and effort. While this bill seeks to resolve some of these issues, please consider this proposal as a means to resolve any future vacancies.

Presently, the Guam Legislature has a membership of fifteen senators and with this odd number, there will always be a majority of either 8-7, 9-6, l 0-5 and so on. If a vacancy occurs in either the majority or minority side of the legislature, it is safe to assume that the party that has lost that member would want to replace the vacancy with another member of that same party. Given this, we suggest that in the event a vacancy occurs, the party with the vacancy selects and submits the names of three individuals to the Governor. Assuming also, that these same three individuals meet all the requirements for any other individual running for a seat in the legislature, the Governor would then select and appoint one of the individuals to fill the vacancy in the legislature.

Using this method, both parties maintain their majority/minority status within the legislature, the number of majority/minority senators remains the same, no additional taxpayer funds are spent, and the business of the legislature continues without any major disruption. I trust I have been able to communicate our position clearly and I hope this assists the legislature in addressing this issue. Thank you for your time and attention to this matter.
