Sub: VUDA- Allotment Wing - Allotment of odd bits – Applications invited through online in two spells - Perusal – Reg. *** AGENDA NOTE:

VUDA Board VIDE Resolution No 77 dated: 8-5-2012 resolved that “the Board discussed the matter and resolved and delegated the powers to the Vice Chairman, VUDA for allotment of odd and irregular bits which cannot be sold in public auction to the adjacent plot owners by collecting average auction rate of the nearest VUDA developed layout. Such rate is applicable only if the auction for plots in the said layout was held within two years from the date allotment and such auction is nearby to the irregular odd bits. All other cases which cannot fit in this norm may be placed before the VUDA Board for approval”. The Vice Chairman, VUDA vide orders dated 24.05.2012 had ordered to return all amounts taken by VUDA which do not confirm to the Board Resolution No 77 dated 8-5-2012 and cancelled the old allotments which are not registered with a direction that if the applicant wants allotment, they can apply afresh as per norms. Accordingly the following allotments were cancelled.

It is to submit that Smt.J.Sudha Rani, I.A.S., Retd., has returned the cheques and submitted representation to that effect stating that having retained the amount of Rs.26,19,000/- for eleven months, the principal

168 amounts is retuned ignoring the loss of interest caused to her. She is also requesting for allotment of the subject odd bit adjacent to her Plot No.17 of Marripalem Layout. Hence, in the arrival of decision on the odd-bits, following issues have to be sorted out. 1. Whether the land vests with VUDA 2. The extent has to be arrived at duly leaving the area already disposed by VUDA 3. The allotment particulars have to be verified.

Hence, it is proposed before the board that

a. A Committee of EO, CUP & Secretary with the latter as Convener has to be formed, which will visit all such representations pending in various layouts developed by VUDA and submit the recommendations to process as per the procedure already resolved by the Board. b. It is mandatory for the committee to freeze and account for the availability of the odd-bits for each lay-out c. The odd-bits which are eligible to be disposed as a separate plot can be disposed accordingly. d. The updation of approved lay-out plan can also be carried out by processing as per the procedure available. e. If required, with a cutoff date, representations may be received from the public on the availability of odd bits in VUDA’s layouts.

The Board in its Resolution No.35, dt.20.07.2013 has agreed the proposals cited above placed before the VUDA Board.

Accordingly, VUDA has invited applications for allotment of odd bits in VUDA developed layouts through online from 01.09.2013 to 30.09.2013 and 30.01.2014 to 05.03.2014 under regular procedure and also to comply with the directions of the Hon’ble High Court in W.P No.35886/2013, dt.10.12.2013. The applications received in the 1st spell are 72 odd bits in 23 layouts and in the 2nd spell, are 72 applications for 24 layouts. A Committee of Estate Officer, VUDA, Chief Urban Planner, VUDA & Secretary, VUDA with the latter as convener has been formed, to visit all such representations and submit the

169 recommendations to process as per the procedure already resolved by the Board. The Committee is yet to give in findings since 1.10.2013 i.e. for the past six months. I am an NRE, working in Mozambique, at the time of the application submission for bidding the Adibhatla nagar plot. I was told to sign the application in person. Since I was in residing in Mozambique. I had my wife sign the application and submitted. She then participated in the auction and successfully bid for the plot on 20'h October 2013 (Plot no A-22)

I would now like to request that I be allowed to have the registration of the plot in my name. the reason being:

1) I have paid the whc,le amount from my NRE account (SBl, Gopalapatnam branch)

2) From the legal stand point I would like to own it.
