Through the Office for Dispute Resolution, the Pennsylvania Department of Education (PDE) fulfills its statutory mandate to maintain a special education due process system. PDE contracts with the Central Susquehanna Intermediate Unit to provide fiscal and certain management support for that office, without becoming involved in substantive operations.

Introduction The Office for Dispute Resolution (ODR) provides the resources for parents and local educational agencies (LEAs) to resolve educational disputes involving children served by the early intervention system, students with disabilities (or thought to have disabilities) and students who are gifted (or thought to be gifted). Pennsylvania’s recognition as an “exemplar state” by the Office for Special Education Programs (OSEP) and the Center for Appropriate Dispute Resolution in Special Education (CADRE) is an acknowledgement of the array of quality services offered by ODR.

ODR Stakeholder Council The ODR Stakeholder Council (SC) brings together representatives from a broad array of stakeholders to provide functional input and recommendations on the special education dispute resolution system. The membership consists of four parent advocates; a representative from the Parent Training Information Center; three attorneys (parent, school district, and ODR counsel); a school district representative; and one representative each from the following stakeholder groups: mental health, gifted, and higher education. The Council is self-sustaining, i.e., the members themselves, not ODR staff, choose their replacements.

During FY 2014-2015, the SC provided insight and feedback about a myriad of issues involving the dispute resolution system, including ODR pilots on the use of electronic exhibits at hearing, and virtual hearings. One of the most critical roles of the SC is to interview prospective hearing officers and make selection recommendations. The Council was called upon to assist in finding a hearing officer to replace a retiring hearing officer during this reporting period.

Presentations Stakeholder education continues to be a priority initiative. The Director, staff, and hearing officers participated in a variety of presentations within the state, such as the Special Education Leadership Academy; the National Autism Conference; various early intervention programs; Eastern Pennsylvania Special Education Administrators (EPASEA) annual conference; Special Education Fellows program; and the Lehigh University’s Special Education Law conference, as well as with parent groups and school districts. In addition, as part of professional reciprocity with other states, staff and hearing officers on occasion assisted other states with their dispute resolution development.

Hearing Officer Training The hearing officers engage in rigorous professional development each year, both in house and through highly regarded professional associations. They are members of the National Association of Hearing Officials (NAHO), and participate in the certification process. Hearing

officers regularly attend either the NAHO conference, and/or the Academy for Hearing Officers and Administrative Law Judges at Seattle University School of Law.

ODR Pilot Projects

Hearing Officer Settlement Conferences ODR is in the process of transforming Evaluative Conciliation Conferences (ECC) into the more streamlined “Hearing Officer Settlement Conference”. Both the Stakeholder Council and members of the parent and school bar have provided input on these changes. Detailed information about Hearing Officer Settlement Conferences will be posted on the ODR website.

Virtual Hearings Pilot Two of the hearing officers have been working to finalize the framework for the second phase of the Virtual Hearing Pilot. This phase will focus on the needs of the court reporters in producing an accurate record, as well as various scenarios for the location of all participants using combinations of virtual and physical presence of the parties, counsel, court reporter, and hearing officer. The Pilot leaders also continue to consider appropriate uses of initializing virtual technology on a limited but regular basis in actual hearings. They are coordinating with ODR regarding if/how virtual hearings might impact contracts with these agencies going forward.

Electronic Exhibits Pilot The Electronic Exhibit Pilot is a system that will allow parties to submit exhibits electronically. In phase one, limited tests were conducted internally and with the assistance of the bar. In phase two, volunteers have participated in the pilot. The next steps for this pilot are to continue to gather data and draw experience as cases convene, and based upon results, discuss expansion of the pilot beyond one hearing officer.

ConsultLine The Special Education ConsultLine is a toll-free information helpline for parents and advocates who have questions or concerns about special education for school-age children. ConsultLine is staffed by three Specialists who provide information about special education, gifted education, and Section 504 of the Rehabilitation Act of 1973. Specialists assess the nature of the caller’s inquiry or concern and respond to them with clear explanations about:

 Processes involved in having a child evaluated, identified, and provided with special education, accommodations, and related services;  Parent’s rights and procedural safeguards, including explanations of related regulations;  Information, assistance and access to the state complaint process managed by the Department of Education’s Bureau of Special Education (BSE);  Dispute resolution services and options for resolving disagreements about their child’s special education program; and  Other resources, publications, websites and disability-related organizations.

Call Activity To the greatest extent possible, Specialists provide equitable service by responding to calls in the order in which they are received and, in accordance with contact instructions provided by the caller, i.e., date and times when the caller expects to be available. During FY 2014-2015, ConsultLine received 3,373 calls, and provided service to 3,052 constituents. In 32 instances, the caller was provided service in Spanish and in two instances the caller was provided service in Russian. The difference between the number of calls received, and the number of callers served, is due to unavailability of the caller despite attempts to reach the caller at least three times over the course of three business days.

Caller Demographics The following data is not inclusive of all callers served; it is limited to statistics which were volunteered by 1,161 of the 3,052 callers served during FY 2014-2015. Based on information provided by callers, the following statistics provide a general impression of call activity across the state.

ConsultLine received the highest volume of calls (more than 100 calls) from the following Intermediate Unit areas: Philadelphia Intermediate Unit 26; Capital Area Intermediate Unit 15; Montgomery County Intermediate Unit 23; and Allegheny Intermediate Unit 3.

Types of Inquiries ConsultLine Specialists document the special education-related topics associated with a caller’s question(s). During FY 2014-2015, the most frequently reported inquiries pertained to multidisciplinary evaluation; IEP content; IEP implementation; educational placement; and

mediation. Specialists provided publications, forms, web resources and other materials related to special education to 1,489 callers; the majority of this information was delivered electronically.

Call Resolution Process and Provision of BSE Complaint Packets ConsultLine’s Call Resolution Process (CRP) is an effective dispute resolution tool for compliance-related concerns for IDEA-related issues and certain types of concerns related to Section 504 of the Rehabilitation Act of 1973. During CRP, the Specialist acts as a conduit of information between the parent (as defined in 34 CFR 300.30) and the school; the Specialist does not serve as an advocate, decision-maker, mediator, or compliance advisor.

The format and process includes an emailed summary of the parent’s compliance-related concerns, and to the extent known, the parent’s proposed resolution. The email is prepared by the Specialist in consultation with the parent so that the message accurately reflects the nature of the issue. Once the message is drafted and reviewed with the parent, the parent provides verbal permission to send the message to the following recipients: LEA administrator responsible for special education; BSE division chief; and the regional BSE advisor. Once the email has been sent, the Specialist’s involvement in CRP has concluded. During FY 2014- 2015, CRP was offered to 320 callers, and provided in 171 instances, which is a significant increase over the past few years.

Information about the BSE complaint process and the state complaint form is sent to the parent every time CRP is utilized, but also when otherwise requested by a caller. During FY 2014-2015, Specialists sent out 229 state complaint forms and information packets.

Gifted Education ConsultLine Specialists assist callers who have questions or concerns about Chapter 16/Gifted Education. Some of these callers allege compliance violations. When this occurs, the Specialist provides the caller with information about the procedural safeguards for gifted education including the option to file a written complaint. Callers are also referred to the BSE advisor designated for management of Chapter 16 compliance issues. During FY 2014-2015, ConsultLine Specialists served 61 callers whose questions or concerns were specifically related to gifted education.

Evaluation Surveys When callers provide contact information, Specialists conclude service by mailing or emailing an evaluation survey to the caller. The survey is brief and it can be completed and returned anonymously. Survey participants are asked to provide comments and to answer several satisfaction-based questions.

During FY 2014-2015, constituents submitted 90 evaluation surveys. Consistent with past years, survey results indicate very high levels of satisfaction with the services provided by ConsultLine Specialists. The following is a sampling of typical comments provided during FY 2014-2015:

 I am absolutely thrilled with the quick response time from the ConsultLine as well as the incredible understanding the Consultant showed. It shows that the people who work the line care and know their jobs. THANK YOU

 I appreciate the services of the Special Education ConsultLine. Their staff assists me to find hard to find regulations or nuances of the law. Thank you!

 The Consultant was excellent! She gave me exactly what I needed and sent hard copies to back it up. The material she mailed was most useful. I was able to move forward with an appropriate plan for my child.

ConsultLine staff continue to expand the scope of their assistance to parents. ConsultLine staff assist parents in completing the online IEP/ECC/Mediation request form where needed, and, at the request of BSE, they assist with the parent surveys.

IEP/IFSP/GIEP Facilitation ODR has been offering IEP Facilitation since the early 2000s, long before most states developed such a program. Since the commencement of this service, IEP Facilitation theory and practice has become more refined, as more states continue to explore its use. A subcommittee of the SC was formed to assist in examining the configuration of ODR’s model, to assess its viability, and areas for refinement and improvement. In addition, ODR facilitators received training from Trisha Bergin-Lytton, an experienced facilitator from New Mexico, with the goal being to institute a more uniform process of facilitation. Facilitators were required to participate in the two-day training, and receive a certificate from the trainer. SC members and a BSE representative attended the training to learn more about the format, as well as to provide feedback to the mediators and ODR staff. Several SC members were videotaped discussing IEP Facilitation, for use in a video currently in production.

During FY 2014-2015, there were 68 requests for IEP Facilitation, divided among age groups and exceptionalities as follows:

Birth – 3 None.

3 – 5 There were two requests, and both resulted in an IEP.

School Age There were 65 requests for IEP Facilitation for this age group. In three instances the non-requesting party declined to utilize an IEP Facilitator. In 10 instances, the request for facilitation was later withdrawn. For those meetings that did include a facilitator, the results were as follows:

Gifted There was one request for GIEP Facilitation which resulted in an IEP.

Evaluations Twenty-five (25) post-IEP facilitation meeting evaluations were returned during FY 2014-2015. Examples of comments on the evaluation form include:

• My IEP Facilitator was excellent. Facilitator did not really have the opportunity to intervene or assist because we got right to work. However, the presence alone was key to the successful meeting. Facilitator did a great job and I am satisfied with the outcome.

• [Name redacted], being an objective participant helped the tone in the room. It was by far more relaxed than previous meetings.

• [The facilitator] made sure that both parties understood each other and no information was lost in translation.

• I was very fortunate to have [name redacted] come to my IEP meeting. As soon as I saw him, I knew he was experienced and well-spoken. He helped to diffuse some tempers in the room, and the conclusion of the meeting was better than I could have hoped for. Just his presence made everyone cooperate, but [name redacted] often interjected, asking me if I understood what was being explained, etc. He was invaluable to my outcome.

• Having an impartial participant provided an environment of calm. It helped keep all participants more positive and congenial.

Mediation IDEA requires each state to offer mediation services to parents and educational agencies. In FY 2014-2015, ODR contracted with 21 independent contractors to provide mediation services to parents and educators. ODR received 428 requests for mediation during the reporting period, with the highest request rates coming from Montgomery County IU (54); Allegheny IU (50); Delaware County IU (45); and Chester County IU (44). Detailed information about mediation results can be found in Exhibit 1, Mediation Results by Intermediate Unit and School District.

Of the 428 mediation requests received by ODR, there were 391 IDEA cases. The difference in number of requests versus number of sessions held was due to withdrawal of the request after it was made, almost always due to settlement, or in 75 instances, the non-requesting

party declined to participate in mediation or there was no response from the non-requesting party. At the end of the reporting period, there were 61 cases that remained active.

Evaluations Sixty-two (62) post-mediation evaluations were returned during FY 2014-2015. Examples of comments on the evaluation form include:

• Mediator set a high professional positive tone. Mediator gave a comprehensive explanation of the process and individual roles of each participant. Mediator was excellent and tried to establish a cordial relationship with all parties. As a result of the mediator's efforts, no anger was expressed. Although the concerns of the parents were well defined before the meeting, I believe the mediator assisted us in a reasonable compromise.

• Everything was explained beautifully so I was prepared for the meeting. Mediator was very good and patient with the explanation. Mediator stopped and went over all points a few times to make sure we were all in agreement. We were able to keep the meeting calm and professional. When we needed, mediator stepped out with the other party to help reach a compromise.

• Mediator was clear with her role and the role of each party. Mediator obviously comes with a great deal of experience and listened to everyone's input. Mediator encouraged both parties to continue the discussion and work towards a solution until it became apparent that we were on point. Mediator attempted to help us find different solutions but when it became apparent that there was not a solution she did quickly move on. I feel that mediation was helpful to further discussion and explain the evaluation. Once we got to the point that there was no common ground we could meet at the mediator did a fantastic job of pulling the session to a close.

• The mediator was thorough and clear. The mediator gave each party time to speak and we had several opportunities to talk about issues, concerns and our opinions. She kept the conversations positive and organized. The mediator gave each party

time to meet and discuss what had been discussed and we felt as though we were not rushed with making a decision. The mediator rephrased each solution and guided us into figuring out as a team what would be in the best interest of the student. Meeting was held and it went very well. There was a sense of open communication once again, a level of comfort for everyone.

Due Process Requests For FY 2014-2015, ODR received 829 requests for due process. The total number of requests are broken down into the following categories:

Due Process Issues The most frequently occurring issues at due process were compensatory education; IEP disputes; placement; and evaluation. Detailed information about due process requests/issues can be found in Exhibit 2, Due Process Requests/Issues by Intermediate Unit and School District. The 829 due process requests were resolved as follows:

Hearing Officer Decisions The hearing officers wrote 72 decisions on FY 2014-2015 requests with the following results:

3 - 5 One decision was written and the hearing officer found in favor of the LEA.

School Age Sixty-four (64) decisions were written. The hearing officer found in favor of parents in 30 instances, and in favor of LEAs in 17 instances. In eight instances, the hearing officer found partially in favor of the parent, and partially in favor of the LEA. In addition, five decisions favored the parent with modification; three favored the LEA and one hearing officer dismissal.

Protected Handicapped/504 Students Two decisions were written. The hearing officer found in favor of the parent in one instance and in favor of LEA in one instance.

Gifted Five decisions were written. The hearing officer found in favor of the parent in two instances; in favor of the LEA in two instances; and favored the LEA with modification in one instance.

Timelines In 68% of the fully-adjudicated cases, the parties requested an extension of the decision due date pursuant to 34 CFR §300.515(c). The balance of decisions were written during the statutory period without extensions granted.

Appeals to State and Federal Court During FY 2014-2015, there were 20 appeals to state or federal court; only three of these appeals pertained to 2014-2015 requests for hearing, with the balance pre-dating the reporting period. All appeals were brought under the Individuals with Disabilities Education Act (IDEA). The appellant chose federal court in 95% of the appeals. Parents accounted for 65% of the total number of appeals received. As of the close of the reporting period, 12 cases were still in progress; four were dismissed, voluntary or otherwise.

A judge ruled on the substantive aspect of the case in only four instances, upholding the hearing officer in three cases. The judge vacated the hearing officer decision and remanded the case for further proceedings in the remaining case.

Costs IEP Facilitators billed a total of $22,060 for services rendered during the fiscal year.

Resolution Meeting Facilitators billed a total of $6,050 for services rendered during the fiscal year.

Mediators billed a total of $95,163 for services rendered during the fiscal year.

Court Reporting fees totaled $402,642 with one-third billed to the respective LEA ($134,214).

Conclusion A copy of this Annual Report will be posted on the ODR website, www.odr-pa.org, as well as distributed to the Special Education Advisory Panel (SEAP) and the ODR Stakeholder Council.
