For making a Railway from Leeds by Dewshury to , all in the West Riding of the County of York, and for improving the Com­ munication by Railway between the Towns of Leeds and Huddersfield and the Town of Man­ chester. [Royal Assent, 30th June, 1845.]

~ J!1.UBUR~ the making of a Railway from Leeds Preamble. ~ by Dewsbury to Huddersfield, in the West Riding of the County of York, would be of great public advantage, and would improve the communication by Railway between the towns of Leeds and Huddersfield, and the town of Man­ chester: And whereas the persons hereinafter named are willing at their own expense to carry such Undertaking into execu­ tion, but the same cannot be effected without the authority of Parliament :

May it therefore please Your MAJESTY, That it may be enacted ; RnlJ llt tt UttacttlJ, by the QUEEN'S Most Excellent :MAJESTY, by and with the advice and consent of the Lords Spritual and Temporal, and Com­ mons, in this present Parliament assembled, and by the Authority of the same, That the several Acts following, that 1. is to say, the Companies Clauses Consolidation Act, 1845, :.ncorrcr the Lands Clauses Consolidation Act, 1845, and the Railways r':.0Acts.e 11e­ Clauses Consolidation Act, 1845, shall be incorporated with and [ 4 J and form part of this Act, and shall, ·with the same, be con­ strued as one Act. !. Short title. And be it enacted, That in citing this Act in other Acts of Parliament and in legal instruments, it shall be sufficient to use the expression, " The Leeds, Dews bury, and Man­ chester Railway Act, 1845." 3. ~ubscribers And be it enacted, That John Allison, Joseph Armitage, incorporated. And whereas the estimated expense of making the said Capitat Railway is six hundred and forty thousand pounds, be it en­ acted, '"fhat the capital of the Company shall be six hundred and fifty thousand pounds : Provided nevertheless, that if, under the provisions hereinafter contained, the Company shall not execute so much of the Railway hereby authorized, as lies between the To"'-n of Huddersfield and the Junction thereof with the Manchester and Leeds Railway, then the capital of the Company shall be only five hundred thousand pounds. 5. And be it enacted, That the number of shares into which Number and the capital shall be divided shall be thirteen thousand if the :.:~:~t of Company shall raise the whole sum of six hundred and fifty thousand pounds, and ten thousand if the Company shall only raise the sum of five hundred thousand pounds, and the amount of each share shall be fifty pounds.

And be it enacted, That five pounds per share shall be Calls. G. the greatest amount of any one call which the Company may make on the shareholders, and twenty pounds of the amount of a share shall be the utmost aggregate amount of calls that may be made in any one year upon any share, and three months at the least shall be the interval between successive calls. 1. And be it enacted, That it shall be lawful for the Com- Power to pany to borrow on mortgage or bond any sums not exceeding t~~:; in the whole the sum of one hundred and sixty-six thousand · pounds, but no part of such sum shall be borrowed until the whole of the said capital or sum of five hundred thousand 18 B pounds [ 6 ] pounds shall have been subscribed for, and three hundred and twenty-five thousand pounds shall have been actually paid up. 8. Numberand And be it enacted, That the number of Directors shall ~u~':~~:. be nine, and the qualification of a Director shall be the pos­ session in his own right of twenty shares in the Undertaking. 9. And be it enacted, That the quorum of a meeting of Directors shall be three. 12. Committee And be it enacted, That the number of Directors, of ot Directors. which committees appointed by the Directors shall consist, shall be not less than· three nor more than five, and the quorum of such committee shall be two. l& . Power to And whereas plans and sections of the Railway, showing make Rail­ the line and levels thereof, and also books of reference, way accord­ ing to De­ containing the names of the· owners, lessees and occupiers, posited or reputed owners, lessees and occupiers, of the lands Plans. through which the same is intended to pass, have been de­ posited with the clerk of the peace of the West Riding of the county of York ; be it therefore enacted, That, subject to the provisions in this and the said Acts contained, it shall be lawful for the said Company to make and maintain the said Railway and Works in the line and upon the lands delineated on the said plans, and described in the said books of reference, and to enter upon, take and use such of the said lands as shall be necessary for such purpose. And [ 7 ] . lL And be it enacted, That the said Railway shall com- Line of Rail­ mence in the township of Holbeck, in the parish of Leeds, way. there forming a junction with the Leeds and Bradford Rail- way, and shall pass through or into the several places fol- lowing, or some of them ; that is to say, Leeds, Holbeck, Wortley, Beeston, Churwell, West Ardsley otherwise Wood- church, Morley, , Soothill, Batley Car, Dews bury, , Kirkheaton and Huddersfield, all in the West Riding of the county of York; and shall (subject to the pro- visions hereinafter mentioned respecting the execution of the works of such Railway between the town of Huddersfield and the junction of the said Railway with the Line of the Man- chester and Leeds Railway) terminate at or near the town of Huddersfield, in the township and parish of Hudders- field, and also by a junction with the Manchester and Leeds Railway, in the township and parish of Kirkheaton afore- said: And one of such Branch Railways shall be made within the township and parish· of Kirkheaton aforesaid, and shall form a junction with the said Manchester and Leeds Railway : And another of such Branch Railways shall be made within the township and parish of Mirfield aforesaid, and shall also form a junction with the Manchester and Leeds Railway : And another of such Branch Railways shall com- mence in the township and parish of Batley, and shall pass through or into the several townships of Batley, Birstal and Gomersal, or some of them, all in the said West Riding, and shall terminate at or near the town of Birstal, in the township of Gomersal and parish of Birstal aforesaid : And another of such Branch Railways shall commence in the· township of Wortley, in the parish of Leeds aforesaid, and shall pass through or into the several townships of Wortley, Holbeck and Leeds, and shall terminate in the township and parish of Leeds aforesaid. 16. Not t~8inter- Provided always, and be it enacted, Th~t this Act shall fe~e withcer- not, nor shall anything herein contained, enable the said :::i:.ro- Leeds, Dewsbury and Manchester Railway Company to enter upon nor to take for the purposes of the said Railway, nor for any purposes whatsoever, any part of the house, warehouses, buildings, lands or hereditaments whereof, in the schedule to this Act, Alexander Henry, William J Scholefield, George Wilders, William Firth, William R Johnson and Thomas Barton, or some or one of them, are described as the owners or reputed owners, nor to stop up nor divert any part of the cross street leading from Aire Street to Wellington Street, nor any part of Aire Street lying to the eastward of the centre of the said ·cross street, without the previous consent in writing of the owner or owners for the time being of the said house-, warehouses, buildings, lands and hereditaments. 19. Period for And be it enacted, That the Railway shall be completed Completion of Works. within seven years from the passing of this Act, and on the expiration of such period the powers by this Act or the said Acts granted to the Company for executing the Railway, or othenvise in relation thereto, shall cease to be exercised, except as to so much of the Railway as shall then be com­ pleted. 20. Power to . And whereas the Line of the said Railway, or of the it'°~ certam Branches thereof, or some of them, is proposed to be carried 1e:=1.1 on a across the several highways following; that is to say, a public highway called Holbeck Lane, near Copley Hill, in the township of Wortley, a public highway in the township and parish of Mirfield, numbered SS on the said Plans deposited with the Clerk of the Peace, and a public highway in the township and parish of Batley, numbered 87 on the same Plans, and it is expedient that th~ said Railway should cross the said highways on a level : Be it therefore enacted, That the said Company may make the said Railway across the said highways on a level. And whereas the said Railway is intended to. be carried For :~tec­ over the Canal Navigation from Leeds to Liverpool, at or tiod tLeeds near a certain place called Monkpitts Bridge, in the township ;!01 c::~i. of Holbeck, in the West Riding of the county of York, and it is expedient to provide against obstructions being occa- sioned therel>y to the free navigation of the said canal, be it therefore enacted, That, in carrying the said Railway over the said canal, the said Company of Proprietors hereby incorporated shall, and they ~re hereby required, at their own expense, to make a good and substantial bridge of brick, stone or iron, over the said canal and the towing path thereof, with proper approaches thereto, and with perpendicular foundation walls to such bridge, the underside of the opening at the keystone of the arch of such bridge not being less than eleven feet in height above the top water level of the said canal upon which bridge the said Railway shall be made, and the opening or span of the arch of the said bridge shall not 'be less than forty feet wide, so as to extend over and include the entire width of the said canal and of the towing path, without the consent of the engineer of the said Company of Pro- prietors of the said Canal Navigation; and the space between the piers of the arch of such bridge ( except so much thereof respectively as shall be occupied by the towing path of such canal) shall, after the said bridge shall have been completed, from time to time, and at all times thereafter, except during the necessary repairs of the said bridge, or the erection of any future bridge in lieu thereof, be left and preserved an open uninterrupted navigable waterway. Provided always and be it enacted, That the said Com- Com;;~Y pany hereby incorporated shall and are hereby required during not to ohb- th e progress of construe tmg. th e sa1'd bn 'd ge, or of t he necessary structNaviuation t e repairs thereof, or of the erection of any future bridge in lieu 0 ~ L~ds and thereof, from time to time ·and at all times to leave an open ~~:~~':!on­ uninterrupted navigable waterway in the said canal of. not stru~ti_ng or · less t~an thirty-f~ur ~eet in width ?ur.ing the !ime .of con- ~~:i~1 8~~ es. structmg and puttmg m the foundation of the said bridge, up ~ · to two feet above the water level of the said canal, which time. shall not exceed six weeks, nor less than forty feet during the remainder of the period of constructing the said bridge ; and in case by reason or in execution of any of the works bv this act authorized, or by reason of the bad state of repair of the said bridge, .the said cana] shall be so obstructed as that boats, barges and other ves!?els navigating or using the same · 13 c shall ( 10 J shall not be able to pass along the same, or in case the navigable waterway hereinbefore required to be preserved during the progress of the works shall at any time be con­ tracted to a less width than hereinbefore prescribed, then the said Company of Proprietors hereby incorporated shall pay to the said Company of Proprietors of the sail Canal N avi­ gation, as or by way of ascertained damages, the sum of fifty pounds for every day not exceeding fourteen days, and. so in proportion for any less time than one day, during which such obstruction or contraction shall continue on the said canal ; and in default of payment of the said sum, on demand made of the treasurer or principal clerk of the said Company hereby incorporated, any two or more of her Majesty's justices of the peace for the West Riding of the said county of York are hereby empowered, on application to them made by the said Company of Proprietors of the said Canal Navigation, or by any person or persons by them authorized by warrant under their hands and seals, to cause the amount of such sum or sums of money to be levied by distress and sale of any goods and chattels vested in the said Company of Proprietors hereby incorporated by virtue of this Act, and to be paid to the said Company of Proprietors of the said Canal Navigation, or to their treasurer or clerk for the time being, rendering the overplus, if any, upon demand, after deducting the reasonable charges of making such distress and sale, and the costs and expenses of hearing and determining the matter in dispute, to the treasurer of the said Company of Proprietors hereby incorporated for the use of such Company, otherwise the said Company of Proprietors of the said Canal Navigation may sue for and recover the same, together with costs of suit, against the said Company of Proprietors hereby incorporated, by action of debt or on the case, in any of her Majesty's Courts of Record in Westminster. 28. Company to . Provided always and be it enacted, That unless and maintain until the said Railway, where it cros~es the said canal, shall Bridge. at any time be abandoned by the said Company, the said Company shall and they are hereby required at their own expense to maintain the said bridge and arch in perfect repair, and if that part of the said Railway shall at any time be abandoned by the said Company, the said Company shall at their own expense remove the said bridge if they shall be re­ quired so to do by the Company of Proprietors of the Canal ~ aviga.tion from Leeds to Liverpool. · And ( 11 ] 24. . And be it enacted, That in carrying· the said Railway Prea;Ji,ing over the canal, banks and towing path. of the said Com- manner 0! pany of Proprietors of the Calder and Hebble Navigation, n:itl::sc~r in the township of Mirfield, in the said West Riding, the iuts ijfe r · said Railway Company shall, and they are hereby required, Mirli:id.P 0 at their own costs and expenses, to make, and at all times for ever thereafter maintain and keep in perfect repair, a good and substantial bridge over the said Navigation, and the towing path thereof ; and the soflit of the arch of such bridge shall be constructed at the greatest height, and the arch of the greatest span not being less than fifty feet, mea- sured at rignt angles with the canal, which the level of the said Railway will admit of; and · the said bridge shall be constructed in such manner as shall be agreed by the engineer of the said Railway Company, and the engineer of the said Calder and· Hebble Navigation Company, and in case they should differ respecting the same, in such manner as an umpire (being a civil engineer) to be appointed· by them shall appoint · and direct : Provided always~ that the soffi.t of the arch of such bridge over the said canal in the township of Mirfield aforesaid shall not be less than fourteen feet above the ordi- nary top water level of such canal.

And be it enacted, That in ~arrying the said Railway Pres;Jbing over the navigable part of the River Calder, in the respective mannero! townships of Mirfield and Kirkheaton, in the said West Riding, Brhl::sc=:, and over the towing Lath adjoining to such river, the said Rail~ the River way Company shal , and they are hereby required, at their t~r:i:: !d own cost and expense, to make, and at all times for ever J!eb~Ie Na- thereafter vigation. [ 12 ] thereafter maintain and keep in perfect .repair a good and sub­ stantial bridge over the said Navigation, and the towing path thereof; and such bridge shall be constructed in such manner as shall be agreed by the engineer of the said Railway Com­ pany, and the engineer of the said Calder and Hebble N avi­ gation ; and in case they should differ respecting the same, in such manner as an umpire (being a civil engineer) to be ap­ pointed by them shall order and direct : Provided always, that in no case shall the soffit of the arch of such bridge be less than eighteen feet above the water level of the crown of the first dam immediately below the said bridge, nor the arch of such bridge over the said Navigation be of less span than will be sufficient to leave under it a navigable waterway in the most navigable part of the said river, and a continuous and unin­ terrupted towing path adjoining thereto, and unseparated therefrom, of fifty feet together, measured at right angles with the said river; and if by the c-0nstruction of such briclge the present towing path shall be separated by any pier or otherwise from the most navigable part of such river, then and in such case the said Railway Company shall, and they are hereby required, at their own costs and expenses, to pro­ vide and make a good and sufficient towing path under the direction of such engineers or umpire as aforesaid, and fence .in the same and make the necessary communication and approaches thereto, so as to secure along the said Navigation an uninterrupted and continuous towing path adjoining to the most navigable part of the said river in the place of the one so separated as aforesaid. Noo:!';..uc- And be it enacted, That, during the erection of the tioa to be said several bridges, or during the execution of any work c.i!i:::!~e authorized or required to be made by the said Railway Com­ f!eb~Ie Na- pany for the said Calder and Hebble Navigation Company, •agataon, &c. or which may interfere '1\'ith the said Navigation, and at.all future times during any repairs thereof, no obstruction shall be occasioned to the said Navigation, or to the boats or barges passing along the same, or to the towing horses drawing such boats or barges; but that at all times during such erection or repairs a navigable waterway of not less than thirty feet, a towing path adjoining to and unseparated therefrom of not less than six feet, and a clear height sufficient for boats to pass along, shall be left in the main line of the said Navigation and towing path, and that the said bridges and other works · and ( 13 ] and repairs shall be constructed and made to the satisfaction of such engineers or umpire as aforesaid. · 28. · And be it enacted, That if by reason and in execu- Penalty for tion of any of the works by this Act authorized or required 0;!r1ca1der to be made, or by reason of the bad state of repair of any :nd Hebble such works or of any of the said bridges, or if by any act Navigation. or omission of the said Railway Company, or any of their agents, servants or workmen, the said Calder and Hebble Navigation, or the towing paths thereof, shall be so obstructed as that boats, barges, or other vessels navigating o~sing the same cannot pass, or shall be impeded in the passage along the same, or in case the space under the said bridges shall be at any time contracted, so as to be less in width or height than is hereinbefore prescribed, then and in any of the said cases the said Railway Company shall pay to the said Com- pany of Proprietors of the Calder and Hebble N avig~tion, as or by way of ascertained damages, the sum of fifty pounds for every day not exceeding fourteen days, and so in proportion for any less time than one day during which the said obstruc- tion shall continue on the said navigation ; and in default of payment of such respective sum, or such proportion thereof as shall become due, on demand made of the treasurer of the said Railway Company, the said Company of Proprietors of the Calder and Hebble Navigation may sue for and recover the same, together with full costs of suit, against the said ' Railway Company, by action of debt or on the case, in any of her Majesty's courts of record at Westminster; and in case the said bridges over the said Calder and Hebble N aviga- tion, or any part thereof, or over the said canal, or the ap­ proaches, slides, slopes, or banks of the said Railway next to the said canal or_ river navigation, or any such bridges; approaches, slides, slopes or banks, or any part thereof respec- tively, shall not be kept in good and substantial repair, and if the said Railway Company shall not, within three days after notice in writing of such want of repairs given to their clerk by the clerk or principal engineer of the said Company of Proprietors af the Calder and Hebble Navigation, proceed to make and complete with all reasonable despatch the repairs so required, or in case of any pressing emergency, then it shall be lawful for the- said Company of Proprietors of the said Calder and Hebble Navigation to do the needful repairs, and to recover the amount of the expenses from the said Railway Company, by action of debt or on the case, with full 18 D costs [ 14 ] costs of suit, in any of her Majesty's courts of record at West­ minster : Provided .also, that nothing herein contained shall extend to prevent the said Company of Proprietors of the said Calder and Hebble Navigation from recovering against the . said Railway Company· any special damage that may be sus­ tained by them on account of such penalty or penalties, and they are hereby authorized to sue for and recover such special damages accordingly ; but in every case where the penalty or penalties hereinbefore imposed shall have been paid by the said Railkvay Company, and any action for special damages shall be ~rought as above mentioned, then the penalty or penalties so paid shall be deemed and consiµered as payments on account of such special damages, a~d credit shall b~ given by the court before whom such act10n shall be tried for any sum or sums of money so paid by the said Railway Com­ pany, and the same shall be deducted from the amount of damages to be recovered by the said Company of Proprietors of the Calder and Hebble Navigation ; and in case the amount of damages recovered shall not exceed the sum or sums . so paid, then and in such case judgment shall be given for the said Railway Company ; and no action shall be maintained by the said Company of Proprietors of the Calder and Hebble Navigation against the said Railway Company for the reco­ very of any penalty or penalties, after judgment shall have been obtained by them for any special damage in respect of the said act or acts for which such penalty or penalties would have been recoverable. !9. And be it enacted, That ·in case it shall be found neces- Leed!!nd sary to carry the Railway by this Act authorized across the tudford Leeds and Bradford Railway, it shall not be lawful to carry to ~;~~o::d the, same across such Railway upon the level, but the same on the Level. shall be carried across such Railway by means of a bridge, of such dimensions as shall be approved of by the engineer for the time being of the said Leeds and Bradford Railway Com- pany : Provided always, that the dimensions of such bridge shall not exceed the clear width of thirty feet between the abutment walls, and the clear height of fifteen feet from the surface of the rails of the said Leeds and Bradford Railway, to the soffit of the arch of such bridge, and such clear height to extend across the whole width of the said last mentioned Railway. 33. Tolls. And be it enacted, That it shall be lawful for the Com­ pany to demand any tolls for the use of the Railway not Tonnage on exceeding the following ; that is to say : In respect of the Articles of Merchan­ tonnage of all articles conveyed upon the Railway or any dize. part thereof, as follows : For all dung, compost, and all sorts of manure, lime and limestone, and all undressed materials for the repair of public roads or highways, per ton per mile not exceedin8 one penny ; and if conveyed by car­ riages belongmg. to the Company, an additional sum per ton per mile not exceeding one halfpenny ; For all coals, coke, culm,. charcoal and cinders; all stones for building, pitching and paving; all bri~ks, tiles, slates, clay, sand, ironstone and iron ore, pig iron, bar iron, rod iron, hoop iron, and all other similar descriptions of wrought iron, and iron castings, not manufactured into utensils or other articles of mer­ chandize, per ton per mile not exceeding one penny halfpenny ; and if conveyed in carriages belonging to the Company, an additional sum per ton per mile not exceeding one halfpenny ; For all sugar, grain, corn, flour, hides, dyewoods, earthen­ ware, 'timber, stones and deals, metals ( except iron), nails, anvils, vices and chains, per ton per mile two pence ; and if conveyed in carriages belonging to the Company, an additional sum per ton per mile not exceeding three farthings ; For all cotton and other , drugs, manufactured goods, [ 17 ] goods, and all other wares, merchandize, fish, articles, matters or things, per ton per mile not exceeding three pence ; and if conveyed in carriages belonging to the Company, an additional sum per ton per mile not exceeding one penny ; And for every carriage, of whatever description, not being a carriage adapted and used for travelling on a Railway, and not weighing more than one ton, carried or conveyed on a truck or platform not belonging to the Company, per mile not exceeding six pence ; And a sum of two pence per mile for every additional quarter of a ton, or fractional part of a quarter of a ton, which any such carriage may weigh ; and if any such carriage be conveyed on a truck or platform belonging to the Company, an additional sum per mile not exceeding two pence ; · In respect of passengers and animals conveyed in carriages Tolls for upon the Railway, as follows : Pc:t,er• For any person conveyed in or upon any such carriage, or a • per mil~ not exceeding two pence ; and if conveyed in or upon any ca1Tiage belonging to the Company, an additional sum not exceeding one penny ; For every horse, mule, ass, or other beast of draught or burden, and for every ox, cow, bull, or neat cattle, conveyed in or upon any such carriage, per mile not exceeding three pence ; and if conveyed in or upon any carriage belonging to the Company, an additional sum not exceedi~g one penny ; For every calf or pig, sheep, lamb, or other small animal conveyed in or upon any such carriage, per mile not exceeding one penny; and if conveyed in or upon any carriage belonging to the Company, an additional sum not exceeding one farthing. Tollss:~r And with respect to small packages and single articles small Parcels of great weight, be it enacted, that notwithstanding the rate w!i:~=-t of tolls prescribed by this Act, the Company may lawfully demand the tolls following; (that is to say,)- For the carriage of small parcels (that is to say, parcels not exceeding five hundred pounds weight each), the Company may demand any sum which they think fit : Provided always, that articles sent in large aggre­ gate quantities, although made up of separate parcels, such as bags of sugar, coffee, meal, and the like, shall not [ 19 ] not be deemed small parcels, but such term shall apply only to single parcels in separate packages ; For the carriage of any one boiler, cylinder, or single piece of machinery, or single piece of timber or stone, or other single article, the weight of which, including the carriage, shall exceed four tons, but shall not ex­ ceed six tons, the Company may demand such sum as they think fit, not exceeding six pence per ton per mile ; For the carriage of any single piece of timber, stone, machinery, or other single article, the weight of which with the carriage shall exceed six tons, tlie Company may demand such sum as they think fit. Provided always, That with respect to cattle and sheep, when a waggon for the carriage of cattle or sheep shall be engaged by one party the charge for any such waggon, capable of con­ taining six cattle or thirty sheep, shall not exceed one shilling and three pence per mile. 41. " into one Undertaking the said proposed Railway and the " Huddersfield Canal Navigation ;" and the line of the Rail- way and one of the Branches thereof hereby respectively authorized to be made, and the line of the intended Railway of the Company proposed to be incorporated by the last recited Bill, under the name of the Huddersfield and Man- chester Railway and Canal Company, follow the same course between the town of Huddersfield and the Man- chester and Leeds Railway, being a distance of about four miles, and it is expedient that provision should be made, and that an arrangement should be effected under the· autho- rity of Parliament between the two -Companies with respect to the construction of the said portion of Railway and the said Bran~h, and it has accordingly· been agreed between the said two Companies that the Company hereby incor- porated shall suspend the making of so much of their pro- posed Railway and Branch as lies between Huddersfield aforesaid and the said Manchester and Leeds Railway, and that the said last-mentioned portion of the said Railway and the said Branch shall be made by the said Huddersfield and IS F Manchester [ 22 ] Manchester Railway and Canal Company ; be it therefore enacted, That none of the powers and authorities by this Act given to and vested in the Company hereby incorpo­ rated shall be or shall be capable of being put into force or executed by the said Company hereby incorporated, in respect of the making of that portion of the said Railway and the said Branch which lies between Huddersfield aforesaid and the said l\tlanchester and Leeds Railway, for the space of eighteen months after the passing of this Act ; and if the said Huddersfield and Manchester Railway and Canal Company shall, before the expiration of the said eighteen months, have commenced and proceeded bona. fide in the execution of that part of the said Railway and Branch, then and in such case all and every the powers and authorities vested in the said Com­ pany hereby incorporated, so far as respects the making of that portion of the said Railway and Branch, and also all liabilities of the said last mentioned Company in respect of such portion and Branch, shall absolutely cease and be at an end. 4-5.
