The subject project is located in southern Escambia County and Santa Rosa County, the City of Pensacola and the City of Gulf Breeze, Florida, respectively, and addresses the approaches to the Pensacola Bay Bridge along U.S. Highway 98, specifically South Pensacola and North Gulf Breeze. The Central East and Central West are the two alternatives being considered for this conceptual stage relocation plan.

As stated in the Environmental Assessment Document (EA), both alternatives are consistent with the City of Gulf Breeze Future Land Use Map and the Vision 2020 and provide an improved quality of life, adequate levels of service, efficient use of facilities and protection of natural resources.

Pursuant to the EA document, the City of Pensacola refers to the approaches to the Pensacola Bay Bridge as a “Redevelopment District.” The City’s main concern is to redevelop the southern gateway to the City and portions of the Pensacola Bay waterfront in an orderly manner with the goal to enhance visual appearances, preserve unique shoreline vistas, provide public shoreline access and improve traffic safety.

This Conceptual Stage Relocation Plan (the Plan) was prepared on behalf of District 3 Florida Department of Transportation and RS&H as PD&E Consultant. The Plan is submitted in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, Federal Regulations 49 CFR, Part 24 and Chapter 339.09, Florida Statutes.

1. Sources of Data: Environmental Assessment Document, Census Tract Data, Multiple Listing Services (MLS), LoopNet, Commercial property realtors, and demographic data obtained from non-profit city/non-profit resources, as well as field inspections, discussions with other Realtors, and secondary resources (individuals on site) and primary resources (affected worker(s)).

Proposed Central East Alternative:

The Central East Alternative requires permanent right of way acquisition from 5 parcels for a total of 4.97 acres. The Pensacola approach, the Central East Alternative, requires a total of 0.62 acres from the Florida Fish and Wildlife Conservation Commission parcel and 2.24 acres from Pensacola Wayside Park. Additionally, temporary construction easement of 2.95 acres is estimated to facilitate the construction of the new northbound bridge and approach which is considered Section 4(f) impact and is adequately addressed in the EA document Section 1.1.3.3-4. There are no residential parcels affected and those commercial properties where permanent right of way is required will likely only be relegated to potential business damage(s) only from 8 businesses due to adjacent parking arrangements that are undisclosed at this point. Because the Central East Alternative is shifted eastward, only a single commercial parcel requires a permanent Right of Way acquisition.

Proposed Central West Alternative:

The Central West Alternative requires permanent right of way acquisition from 6 parcels for a total of 2.74 acres. The Pensacola approach, the Central West Alternative, requires a total of 0.62 acres from the Florida Fish and Wildlife Conservation Commission parcel. No permanent right of way acquisition from Pensacola Wayside Park is proposed. There are 2 publically owned parcels that have 4(f) implications that are adequately addressed in the EA Section 1.1.3.3-4. There are no residential parcels affected. There are 4 commercial parcels that are affected in this alternative. It is estimated 28 – 34 parking spaces and 3 potential business tenants may be considered eligible for relocation/move cost reimbursement. Additionally, there is the possibility for business damage claims from 9 businesses. On the West side of the roadway, the Central West Alternative impacts a vacant commercial parcel used as overflow parking where arrangements are yet undisclosed at this point.

Since there were identified publicly owned lands, the proposed acquisition will be conducted in accordance with the FDOT Right of Way Manual, Section 7.10, Acquisition of Rights of Way from Governmental Agencies, and pursuant to 23 C.F.R. 710 in case of the potential for functional replacement.

The Central West Alternative comprises the majority if not all of the relocation impacts on this project of which they are minimal. These impacts are located in the City of Gulf Breeze at the west side Gulf Breeze Parkway bridge approach. It appears that the 4 privately owned parcels will lose some parking but may be able to recover some parking lost through proper land planning and potential variances.

3. (A) Households to be Displaced:

There are no improved residential use properties within the project limits. The project study area according to the City of Gulf Breeze Future Land Use Map designates the east and west approach as park land. Commercial designation has been assigned to the existing properties on the western approach, south of the boat launch area. The properties south of Gulf Breeze Wayside Park East on the eastern approach to the bridge remain designated as residential land use with commercial properties abutting SR 30 (US 98) near Baybridge Drive.

There are no residential minority displacements identified within the Pensacola Bay Bridge project limits. Population statistics for Santa Rosa County and Escambia Counties are attached.

(2) Estimate of the Income Range (In Dollars) of the Affected Neighborhoods or Communities:

The project’s census tract number for the City of Gulf Breeze approach is 010900. Estimated residential income for this neighborhood is $76,226 annually. Income statistics for Santa Rosa County census tracts are attached.

The project’s census tract number for the City of Pensacola approach is 010800-1. Estimated residential income for this neighborhood is $34,500 annually. Income statistics for Escambia County census tracts are attached.

(3) Estimate of the Tenure or Age of the Structures which are being Displaced:

No residential structures are being displaced. Public records indicate that structures in the City of Gulf Breeze area range in age from current (new) to 60 years of age. Housing Statistics for Santa Rosa County are attached.

Neither Central East Alternative nor Central West Alternative will have an impact on any residential properties or properties with special relocation needs.

We contacted Craig S. Carmichael, Community Services Director at the City of Gulf Breeze to identify any condemnation relief ordinances that may be in place as we reviewed the online ordinances and found none.

We understand the PD&E Consultant has had significant discussions with City, County and State officials regarding the project which is thoroughly documented in the EA document.

Since there are no residential relocations, no discussions with local officials, other social agencies or groups such as the elderly, handicapped, non-driver, transit-dependent or minorities regarding relocation impacts have occurred.

Special advisory services:

Relocation advisory services are of great importance in achieving relocation objectives. As previously noted, there are no special relocation needs for residential occupants nor does there appear to be need for special advisory services.

7. (D) Replacement housing remedy:

No residential properties or residential occupants are impacted by the Central East and Central West Alternatives. Sufficient housing will not be an issue on this project.

8. (E) Businesses to be Displaced (Number, Type, Size, Characteristics and Clientele):

The Central East Alternative

This alternative is shifted eastward. There is only one single commercial parcel that requires permanent right of way acquisition. This vacant commercial parcel is owned by Northern Horizons, LLC, although the Managing Member is Wayne Wheatley, who in turn owns the adjacent two parcels which have businesses located thereupon. This acquisition requires .40 acres to locate an access road to Gulf Breeze Wayside Park West. There appears to be some remainder parking available in the “after situation.” After our field inspections, in this alternative there is potential for business damages only in the event that this vacant piece of land is leased by the adjacent commercial property for parking. There is no relocation identified in this alternative.

9. The Central West Alternative

After conducting our field inspections, we have determined that there are potentially 28 - 34 parking spaces and 3 potential business owners and/or tenants that may be eligible for relocation/move cost reimbursement. This alternative impacts a vacant commercial parcel, which serves as overflow parking and is owned by Northern Horizons, LLC, whose Managing Member is Wayne Wheatley. This has been confirmed by a local maintenance man and through the Secretary of State’s Office of Corporations. There are 3 improved commercial parcels currently occupied with several existing businesses which are identified below. It appears this alignment does not strike any main building structures, which is a significant determinate for business relocation. Acquisition appears to affect parking, signage and minor site improvements only. There is the potential for a business damage claim from each of the noted businesses below, but several appear to be recent occupants. For business damage claims, there is a five year occupancy provision at the time of acquisition in order to qualify, pursuant to Florida Statute.

The parcel numbering system used below and throughout this Plan corresponds to the Environmental Assessment document which is used to index the owner/parcel tax ID and size.

Parcel No. 7, which is owned by Wayne and Denise Wheatley, is improved with two concrete/masonry and frame structures that are each two story buildings. The north building is approximately 3769 SF and the south building is approximately 5254 SF more or less. The northern most building, which accommodates The Bridge Bar, Coastal Paddle Company and Flowers by Yoko, appears to be the most impacted by loss of parking due to the assumption that the adjacent vacant commercial lot may be leased and/or used by patrons for these businesses. The southernmost building on this parcel is occupied by Thai 54 (restaurant), Bote/Stand Up Paddle Boards and the Pier 1 Marina (also owned by Mr. & Mrs. Wheatley according to secondary information). Parcel 6, the vacant parking lot adjacent north, Parcel 7 and Parcel 8 (Bay Breeze Dive Center, occupant) all appear to be owned by or controlled by the Wheatleys. Each of the parcels appears to utilize and enjoy cross parcel access and parking with one another. The public parking areas for Wayside Park located adjacent north and across the street, US 98, appear to be utilized as overflow parking, although when observed, there was little utilized north of the subject properties. If this alternative is selected, an appraisal with land planning considerations for reconfiguration of parking, the local zoning code, variances and/or condemnation relief may recapture some of the

10. parking which appears to be lost and may mitigate damages and relocation. There have been observed 3 signs that are affected by the acquisition in this alternative; all 3 are located on Mr. Wheatley’s properties, Parcels 7 and 8, which advertise the businesses occupying the buildings located on those properties.

The businesses are general in nature and do not reflect any specialized clientele or cultural orientation, other than the Marina and Paddle Companies which are businesses with water access orientation and cater to some of the surrounding hotel/motel patrons among others. These businesses rely on the access to water for a good majority of their income. The businesses in general are considered small and regional in nature.

12. The acquisition on this parcel is a minor strip acquisition of green space. Parking appears unaffected. This will result in no relocation. A possible nuisance business damage claim may occur. There appears to be plenty of parking for the Quality Inn & Suites. The Unique Café and La Brisa Restaurants appear to be part of the Quality Inn and operate together. There will be no relocation from this property.

We have identified the estimated number of employees and businesses above and have concluded that this dislocation shall not impact the local economy. As stated above, there are estimated 3 business displacees and 3 on-premise signs affected, and of those 3 businesses an estimated 18 employees may be displaced.

While in the field we observed a plethora of available retail, restaurant and other commercial space, both for lease and sale. In our research on-line, in the field, and discussions with local real estate persons, Granger Properties and casual observers, we have found it to be a renter’s/purchaser’s market. We have identified earlier that a majority of the relocation impact on businesses is in the Central West Alternative.

There are 3 businesses we have identified that are restaurant, retail or service related. There is attached a sampling of the available replacement resources and/or listings herein.

Less than a mile away there was observed both free standing vacant buildings and retail centers within blocks of one another directly fronting US 98 (Gulf Breeze Parkway). The picture bellow represents leasing for the Publix shopping center and the vacant building on the west side of US 98.

In assessing the impact this transportation project will have on the local community, it is anticipated that acquisition of the needed right of way for the Central West Alternative will have minimal disruption of the surrounding commercial and residential neighborhoods. Additionally, no major employment centers, shopping centers, hospitals, schools, or other related community establishments will be impacted or displaced, which further minimizes community disruption. The remaining businesses should enjoy the increased traffic flow and ease of parking in the adjacent Wayside Park.

The small number of displacees will be able to relocate in close proximity to the project due to the types of businesses displaced.

(F) Discussion Results with Local Governments Regarding Potential Business Displacements:

Neither the Central East Alternative nor Central West Alternative will have an impact on any residential properties or properties with special relocation needs. Since the West Central Alternative has the most significant impact on private businesses at the City of Gulf Breeze southern approach to the bridge, our concentration below is such.

We contacted Mr. Craig Shane Carmichael, Community Services Director at the City of Gulf Breeze, to discuss the Gulf Breeze US 98 Redevelopment Overlay District in an attempt to identify any condemnation relief ordinances that may be in place, as we reviewed the online ordinances and found none. Mr. Carmichael was very accommodating but made it clear that the current ordinances do not address the issue of condemnation relief and that the issues of loss of parking due to a public use or condemnation and non-conformity would have to be reviewed by the City attorney and come before the City Council to be reviewed and who in turn would instruct staff how to apply the ruling.

We understand the PD&E Consultant has had significant discussions with City, County and State officials regarding the project which is thoroughly documented in the EA document.

Santa Rosa County Household Hazardous Waste Center -

The Santa Rosa County Environmental Department is offering a new service that will provide citizens an environmentally safe way to dispose of hazardous household waste. The center is located at the entrance of the Central Landfill at 6337 Da Lisa Road in Milton. Residents of Santa Rosa County can bring in items such as: household cleaners, motor oils, gasoline, car batteries, propane tanks, pool chemicals, pesticides, and much more to be properly disposed or recycled. This service is provided Monday-Saturday 7 a.m. to 5 p.m . and is free of charge. (G) Statement that Relocation Resources are Available to all Relocatees Without Discrimination:

The proposed Acquisition and Relocation Program will be conducted in accordance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended.

Relocation resources are available to all residential and business displacees without discrimination.

18. (H) Potential Hazardous Waste Concerns:

The EA document prepared for this project thoroughly identifies hazardous waste concerns. Pursuant to Section 4.10.4 Contamination, page 4-79, there are no environmental hazardous waste concerns on those properties affected with the exception of Parcel 8, which is the Baybreeze Dive Center, property owner Wayne and Denise Wheatley.

According to the EA, “The site previously held a BP gas station which had a discharge report filed in March 1990. Cleanup action was required. A Site Rehabilitation Completion Order was issued by the FDEP to the property owner in June 2008, releasing the owner of any further obligation to conduct site rehabilitation.”

Based on our field inspections, there are no properties on the project that present a particular unusual hazardous waste concern or pose an obvious problem. All businesses within the project limits appear to comply with occupational standards. No postings or warning signs were evident.

To our knowledge, hazardous waste should not be an issue for this project.

19. (I) Publicly Owned Lands:

The EA document has done a thorough job documenting and addressing 4(f) for Publicly Owned Lands in Section 3.2.4 Comparison of Permanent and Temporary 4(f) Impacts. Additionally, as of the date of this report, Appendix D of the EA also identifies the specific parcel issues and numerous discussions and public meetings that have occurred to-date to mitigate impacts to all publicly owned property.

It appears that there will be sufficient excess State and/or Municipal owned lands to adequately accommodate each design alternative where relocation and/or function replacement will not be necessary.

The FDOT and its Consultants have had significant discussion with all agencies and stakeholders affected, including private property owners, both in public meetings and private correspondence and/or meetings.

Those properties/agencies directly affected by the project are listed below:

Central East Alternative TIITF / Law Enforcement City of Pensacola City of Gulf Breeze Escambia County

Central West Alternative TIITF / Law Enforcement City of Gulf Breeze

Since there were identified publicly owned lands, the proposed acquisition will be conducted in accordance with the FDOT Right of Way Manual, Section 7.10, Acquisition of Rights of Way from Governmental Agencies, and pursuant to 23 C.F.R. 710 in case of the potential for functional replacement.

20. Conclusion:

Based on our research it does not appear that the Pensacola Bay Bridge project will create negative impacts on the general neighborhood and the community. Since the Pensacola Bay Bridge is a major approach to both, the City of Gulf Breeze and the City of Pensacola, and that this proposed project will increase the level of traffic service, it is anticipated that this project will have a positive influence on the general neighborhood and regional communities.

Improved traffic flow combined with design safety criteria will have a positive effect in this area.
