in criminal misconduct, such misdemeanour on their part is
not to be treated as an act in discharge of their official duties

The “Allahabad High Court” on Friday 18-JUNE-2021 said that the
permission of the government is not necessary to prosecute a public
servant for offences like criminal conspiracy, misconduct or taking
undue advantage. The court said that the trial can go on without
permission.
The division bench of Justices Surya Prakash Kesarwani and Ravi Nath
Tilhari clarified that the protection of section 197 of CrPC is available to
the public servant only for the offences committed while performing
the duty. The permission for prosecution is not necessary if the offence
is committed other than on duty.
The court stated that, an accused public servant who claims protection
under Section 197 of the CrPC, has to show that there is a reasonable
connection between the act on which the complaint is made and the
discharge of official duty. An official act can be performed in discharge
of official duty as well as in dereliction of it. The act of the accused

the discharge of official duty. But where there is no reasonable
connection between the act complained (about) of and the
performance of official duties, no sanction under Section 197, CrPC
would be required. In order to come to the conclusion whether the
claim of the accused that the act which he did was in the course of
performance of his duty was a reasonable one and neither pretended
nor fanciful, can be examined during the course of trial by giving
opportunity to the defense to establish it.
Again, it has consistently been laid down that the protection under
Section 197 of the Code is available to the public servants ONLY ……
AND ….. ONLY ….. when an offence is said to have been committed
‘ while acting or purporting to act “BONAFIDE” in discharge of
their official “ PUBLIC DUTY “,
But where the acts are performed using the office as a mere cloak

The statements of law in some of the earlier decisions were culled out
by this Court in Inspector of Police and another vs. Battenapatla
Venkata Ratnam and another as under :-
No doubt, while the respondents indulged in the alleged criminal
conduct, they had been working as public servants. The question is not
whether they were in service or on duty or not but whether the alleged
offences have been committed by them “while acting or purporting to
act in discharge of their official duty”. That question is no more res
integra. In Shambhoo Nath Misra v. State of U.P.10, at para 5, this
Court held that: (SCC p. 328)
The principle of immunity protects all acts which the public servant has
to perform in the exercise of the functions of the Government. The
purpose for which they are performed protects these acts from criminal
prosecution.
However, there is an exception. Where a criminal act is performed
under the Colour of authority but which in reality is for the public

The question relating to the need of sanction under Section 197 of the
Code is not necessarily to be considered as soon as the complaint is
lodged and on the allegations contained therein. This question may
arise at any stage of the proceeding. The question whether sanction is
necessary or not may have to be determined from stage to stage.”
Even while discharging his official duties, if a public servant enters
into a criminal conspiracy or indulges in criminal misconduct, such
misdemeanour on his part is not to be treated as an act in discharge of
his official duties and, therefore, provisions of Section 197 of the Code
will not be attracted.”

Housing Societies General bodies at AGM - SGM or Managing
Committee have no authority to bypass the statutes , Court Rulings ,
Government Resolutions , Notifications , Other Legislations -
Enactments , Court Rulings and Mandatory rules VIZ ; MOFA ,
MAHARERA made therein under Maharashtra Coop Society act.
Any Housing Societies Management has to be framed within the
Act Or DDR or courts as it is Mandatory . Even illegal decisions
under disguise of Majority are “ NULL AND VOID “ Cannot be
enforceable or binding on either Flat Owners or any interested
parties . It is Mandatory to strike down Housing Societies
Committee Arbitrary decisions And Unconstitutional resolutions
struck also individual office bearers are responsible jointly as well
as severally to indemnify the society.

Nowadays most of the General bodies and managing committee's are
passing illegal resolutions in the name of majority by making their
own Arbitrary laws ( Bypassing Mandatory Laws of the state )
against the members who raise the voice against the Committee for
their illegal acts. When the aggrieved member approach the Deputy
Registrar, the Deputy illegally Directs the aggrieved members/
complainants member to approach Cooperative Court to file
complaints against the Resolution passed by the General Body of the
society and he has no power to pass any order against resolution of the
General Body which is the Supreme Body to take the decisions
concerned to the working of the society.
It’s not true because Deputy Registrars – DDR – Joint Registrars
have wide powers to dismiss such Committee And initiate criminal
proceedings by issuing Suo Motu show cause notices for blatant
violation of Constitutional & or Statutory Laws, Bye Laws & Case Laws

If knowledgeable members Initiate proceedings Against Committee
(And their Supporters at Housing Society – Who have acted as
proposers & Endorsers of illegal resolutions ) , Deputy Registrar ,
DDR , Joint Registrar with Anti-corruption Bureau , CID Crime
Investigation Cell , And Judiciary then All Law offenders Connivance
will be Exposed. So in Ultimate Analysis Managing Committee
Members along with their supporters ( Proposing – Endorsing
illegal society administration ) are liable for prosecution and
indemnify housing society for total damages incurred by housing
society.
Society Bye Laws are not Laws in itself , have no Legal Bearing .
Byelaws are to be interpreted in conjunction with other mandatory
laws framed by the Government . So If the Byelaws rob you of your

It may please be noted that The Government Auditor Complaint reports with

vigilance authorities . The Managing Committee has failed to circulate the
Mandatory Government Auditors reports amongst 208 Society Members .
So I Request , Appeal And Caution to not to use Defamatory , Abusive , Insulting
And threatening language against me , otherwise it will also be reported to
Courts And Appropriate Vigilance Authorities . The prime reason for making the
remark is , I was defamed , insulted by respondents in the recent past --The

If Society Members ( who are Owners of 208 Residential Flats ) do not be Vigilant to
initiate immediate timely initiative then it would be detrimental to the interest of Our
Housing Society as a whole . Show Cause Notice u/s 79(3) is also served for large

Two Attached Auditors Reports were sent to Managing Committee Members on 30-MAY-
2021 , which is Mandatory to be Circulated Amongst 208 Flat Owners by Committee as
Society Mandatory Official Documents submitted by Statutory Auditor . But the
Committee has not circulated Mandatory official documents to all members so far for
18 days for strange reasons known to them. But Concealing Auditors reports from
208 Members is a serious offence .
Further Committee has Concealed all the serious matters from Society Statutory
Auditors . Furnishing false information to a government auditor , is it a crime ? Yes
if true information is not provided by the committee then it amounts to false

other higher authorities of the cooperative housing society.
It is apparent from the Auditors report And Deputy Registrar’s Notice Under
Section 79 (3) about Blatant illegalities perpetrated by the Managing Committee
. Appointment of Managing Committee And Office Bearers are Null And Void
since August , 2019 because legitimate election procedure was deliberately
not followed by Committee Despite my Continuous Email Warnings in July /
August 2019 , Society Auditor is Aware about all illegalities , Hence Any of
decisions taken by Committee Since August , 2019 are Null And Void not
binding to Housing Society .
Managing Committee has also Held Back From Society Members NOTICE
UNDER SECTION 79(3) ISSUED BY DEPUTY REGISTRAR TO MANAGING COMMITTEE
MEMBERS DATED 09-APRIL-2021 . The Notice is served because of Blatant
Illegalities , Violations etc .

We have finally got a PMC water connection to our Society. Supply of Water from the PMC
pipeline has been started for the last 5 days.
There has been a great amount of efforts carried out for the past 1 year which includes
rigorous follow up with local politicians and Water/PMC officials which was undertaken by our
society Secretary Mr. Kewal Prakash. Special thanks and appreciation to Mr. Sayed Uncle who
with this political network was able to take the task to the next level in order to get it
completed on priority.
Special Mention about our Society Manager Mr. Yuvraj who completed all documentation and
continued follow up concern official, his hard work and dedication to serve our society is
commendable.
Our Chairman Mr. Rohit Phutane with his strong convincing skills and rapport was able to get
the builder agreed to execute the pipeline work from main gate to our underground tank along
with installation of motor with all the cost borne by builder itself which is amounting to more
than 5 LAC. Overall our society had to only spend little sum towards Storage tank and other
miscellaneous costs towards installation.

Under MAHARERA Any installation Costs of Pipe Line Work , Installation of Motor
, Underground Tank Or even any faulty work it is Legal Responsibility of
Builder . It is nothing extraordinary . But any such amount cannot be spent
by the Housing Society . It is Mandatory Under MAHARERA to Spend Any
amount by Builder . Society cannot bear any such unlawful costs . It is
mentioned in the Managing Committee Circular that some costs are paid from
society accounts . I Strongly Oppose unlawful costs paid from 208 Flat Owners
pocket . Either it is to be paid by the builder or to be recovered from the
Managing Committee. I Remember Last July , 2020 I had objected to
spending of approximately INR 3,00,000/- by Society whereas it was Legal
Accountability of Builder Under MAHARERA . I Have mentioned this illegality in
my complaint and RTI Application to Co-operation Department , The Said RTI
Application is also attached with this email .
Further it is nothing Special to get a Corpus Fund with interest from Builder .
It is Mandatory requirement under MAHARERA to credit Corpus Fund to
Society Accounts On Formation . We are delaying receipt of the Corpus Fund by
at least two plus Years . I Have scrupulously followed up by email for more
than 24 Months . My RTI Application Reply to the Housing Department will
disclose the facts regarding how the resolutions are achieved .
