1. Introduction and Project Background A Framework Financing Agreement (FFA) was signed on 8 July 2011 between the Indian Government (India) and the Asian Development Bank (ADB) for the implementation, through the Ministry of Railways (MOR), of the Railway Sector Investment Program (RSIP) using the Multitranche Financing Facility (MFF) loan modality.Railway improvement component of RSIP consist of doubling of about 840 km rail routes of comprising of (a) Daund-Gulbarga (224 KM); (b) Sambalpur-Titlagarh section (182 km); (c) Raipur-Titlagarh section (203 km); and (d) Hospet-Tinaighat section (229 km) and electrification of the Pune-Wadi-Guntakal section (641 km). The scope of projects is to provide a second line along the existing single line by constructing the roadbed and either extending or constructing new bridges, provision of facilities for passenger and staff, providing and laying track, signalling and telecommunications and general electrical works. The scope of the electrification project is to provide overhead Railway electrification in the Pune- Wadi-Guntakal double line section. Further, all the projects under the Railway Sector investment program have been categorized as category A seeing its significant resettlement impacts, in accordance with ADB’s Safeguard Policy Statement (2009).

Rail Vikas Nigam Limited (RVNL) is a Special Purpose Vehicle created to undertake project development, mobilization of financial resources and implement railway projects. It is a wholly owned Government company under the provisions of Section 617 of Companies Act. RVNL is acting as Implementing Agency (IA) for the above doubling and electrification projects.

Out of five projects only two, namely Sambalpur-Titlagarh and Hospet-Tinaighat doubling projects require land acquisition. The other two doubling projects (Daund-Gulbarga and Raipur-Titlagarh) involve resettlement of Non-Title Holders only. In Pune-Guntakal electrification project, there is no land acquisition or resettlement of Title holders (TH) and Non-Title Holders (NTH). All the resettlement planning documents related to above projects were disclosed in September 2011.

The land acquisition will impact nearly 1330 Title Holders in Hospet-Tinaighat and Sambalpur-Titlagarh doubling projects. The both project will require about 108.048 acres of private land for completion of doubling work. On completion of the detailed engineering designs, Resettlement Plans report has been prepared based on a census of the Displaced Persons (DPs) and socio economic survey of major impacted DPs. Social Impact Assessment (SIA) of the displaced persons has been undertaken so as to determine the magnitude of displacement and prospective losses, identify vulnerable groups for targeting, ascertain costs of resettlement.

The monitoring for the land acquisition and resettlement activities at field level is done by the consultants hired by RVNL in both the projects after demobilization of NGO in the year 2016. To meet the challenge of tedious and lengthy land acquisition process in the country, well experienced and qualified consultants have been hired to assist RVNL for monitoring involuntary resettlement and land acquisition.

One of the main reason for delay of the Hospet-Tinaighat and Sambalpur-Titlagarh doubling projects is because of cumbersome and lengthy process of acquisition of land in the country. In Sambalpur-Titlagarh project, land acquisition and Resettlement is on critical path and causing severe delay. The Odisha and Government should speed up land acquisition process to avoid further delay of RVNL railway projects in the state, seeing the land acquisition is the ultimate responsibility of the state Governments.

Egis Rail – Egis India R&R Implementation Status No. 14 March 2020 arrangements under Schedule 5 of Loan agreement between ADB and RVNL The main objective of this report is to highlight the major activities related to Land Acquisition and resettlement under taken across various projects during the reporting period. As a key part of its Social and Safeguards Contract Scope of works, the General Consultant is required to submit a quarterly and Semi Annual report for the task carried out during the project Implementation.

The projects which are financed by the present ADB loan, are located in the states of Chhattisgarh, Odisha, Maharashtra, Karnataka and Andhra Pradesh. These projects are shown in red and blue in the map here under figure 1.

2. Legal and Policy Frame Work In Sambalpur-Titlagarh project, Odisha Government is acquiring land under new act RFCTLARR, 2013 effective from 01/01/2014. In this regard, a notification was issued by Odisha Revenue and Disaster Management on 07/02/2014 clarifying award in LA cases initiated prior to 31/12/2013. According to above notification, LA proceedings initiated under the LA act 1894 in which 4(1) notification and 6(1) declaration have been issued but where no award has been passed as on 31/12/2013, the provision of the new act in relation to determination of compensation and award shall apply. A notification issued by Odisha Revenue and Disaster Management Department on 7th February 2015 for the new Land Acquisition Amendment Bill also has been in force for land acquisition for Sambalpur-Titlagarh project by Revenue Authority. In Hospet-Tinaighat project, Karnataka Government has partly acquired land under Land Acquisition Act 1894 for declaration 6(1) issued before enforcement of act RFCTLARR, 2013. To speed up the progress of land acquisition, State Government has notified new act to go for direct purchase from land owners under section 107/108 of RFCTLARR, 2013 by providing higher compensation and rehabilitation than stipulated in act. The new LA act (Karnataka) has come into force from 17/10/2015. Government of Karnataka has issued an order under new LA Direct Purchase Act letter no. 54/2014 under which government has permitted to direct purchase of the land for the following works, i.e for the construction of houses, Grave - yard, multiple – village water supply, electrical grid, under – drainage, road construction or widening of roads, construction of over bridge/under bridge, construction of Railway tracks, Airport. And for all their needful –public-works,

the required land is limited to 100 Acres and can be purchased directly from the land owners.

3. Institutional arrangement and implementation mechanism 3.1 Rail Vikas Nigam

Rail Vikas Nigam Limited (RVNL) is acting as Implementing Agency (IA) for execution of various doubling and electrification project including the resettlement and land acquisition activities under RSIP. The RVNL organisation has been fully set up for taking up RSIP programme. Five project implementation units (PIUs) have been established for managing a doubling or electrification work. Each PIU is headed by a CPM. The headquarters of CPMs are based in Mumbai, Waltair, Raipur, Bangalore and Pune. Further, under CPM there is a Project Director for each package. Project management consultants (PMCs) have been engaged to support IA for construction supervision as the Engineer. One of the Project Director from each PIU has been entrusted with additional charge for land acquisition and implementation of R&R activities in all packages of a subproject. PIU nominated officers responsible for implementation of land acquisition and involuntary resettlement at following projects are as below:

Sambalpur-Titlagarh  Mr. P.K. Dash, AGM/RVNL: Oversee and coordinate with State Government for implementation of LA and R&R activities.  Mr. Tushar Kanta Bhoi, Site Engineer from RVNL assisting to Mr. P.K. Dash regarding land acquisition and R&R on daily basis.

Hospet-Tinaighat

 Mr. A.G. Patil, AGM/RVNL and R&R Nodal Officer: Oversee and coordinate with State Government for implementation of LA and R&R activities.  Mr. Suneel, Site Engineer/RVNL assisting to Mr. A.G. Patil on land acquisition and R&R activities.

PIUs under CPM are overall in charge for land acquisition and rehabilitation and resettlement in their respective project area. In addition to the responsibilities of LA and R&R activities, PIUs ensure:

 Availability of budget for LA and R&R activities;  Laison with district administration for land acquisition, R&R, implementation of training and income generation for PAPs.  Monitor progress of land acquisition and R&R activities.

3.2 Land Commissioner–Revenue Department

The State Government of Odisha has designated a Special Land Acquisition Officer (SLAO) for Sambalpur- Titlagarh project stationed at Sambalpur for execution of land acquisition compensation and rehabilitation activities as per the RFCTLAR act 2013. SLAO at Sambalpur reports to Secretary, Commerce and Transport Department, Government of Odisha and co-ordinate with District Administration Revenue Department.

Also, for Hospet-Tinaighat project the Government of Karnataka has designated Assistant Commissioner (Revenue) at each district as a special land acquisition officer to look after compensation and rehabilitation activities with respect to land acquisition. District level Committee under the chairmanship of Assistant Commissioner to fix the amount of compensation of the land to be acquired by Direct Purchase as per

In case the sale deed between District level committee and a land owner on direct purchase fails to be executed, Assistant Commissioner can pass order to acquire the land following the provisions of RFCTLARR ACT 2013.

3.3 General Consultant RVNL has engaged General Consultancy Services to assist them in implementation of doubling and electrification project under RSIP. General Consultant’s Resettlement expert is responsible for monitoring progress of implementation of Resettlement Plan for each project and provide necessary guidance for improvement wherever required.

Dr. Sudesh Kaul was mobilized as a Resettlement expert in June 2013 and since supporting the RVNL (IA) in monitoring the progress related to Resettlement and Rehabilitation activities across the projects under RSIP. 3.4 RP Implementing NGO

M/S Sugam International Sansthan (NGO) based in Lucknow was appointed in 2011 to assist RVNL in land acquisition, resettlement and rehabilitation activities in doubling projects of Daund-Gulbarga, Hospet- Tinaighat, Sambalpur-Titlagarh and Raipur-Titlagarh project. The services of above NGO awarded with work of implementation of Resettlement Plan (RP) have not been extended after August 2016 in any of the project. There is no work of land acquisition involved in Daund–Gulbarga and Raipur-Titlagarh projects and NGO has completed all the required resettlement activities related to NTHs at above projects. Now, RVNL is directly monitoring balance land acquisition and resettlement activities by Revenue Department at Sambalpur-Titlagarh and Hospet-Tinaighat projects and has hired individual Consultants to support the PIU staff dealing with R&R.

3.5 The Asian Development Bank

The ADB is monitoring the social and environmental safeguards through its Head quarter mission. One mission including safeguards specialists is usually conducted every year. Last ADB review mission was held at Hospet-Tinaighat project in November 2019.

4. Grievance Redress Mechanism Committee Grievance Redress Committee (GRC) has been formed under chairmanship of District collector /Assistant commissioner in each District of the sub projects where land acquisition and Resettlement activities are involved. The other member of GRC includes Special Land Acquisition officer of district level, representatives of RVNL and PAPs. The objective of formation of GRC is to achieve and facilitate the resolution of DP’s any concerns, complaints or grievances related to compensation and rehabilitation or any issue related to social safeguard. The other functions of the GRC are to (i) record, categorize and prioritize the grievances; (ii) settle the grievances in consultation with complaints and other stakeholders; (iii) informed the aggrieved parties about the solutions; and (iv) forward the unresolved cases to higher authorities. A register has been maintained at District Collector office for recording the grievances related to social issues and the Resettlement Officer/Representative from RVNL records and handle the complaints received from the aggrieved party. No written Grievances have been received during the reporting period.

5.2 Important events related to LA and R&R from October 2019 to March 2020

Sambalpur-Titlagarh (ST)

 Private land acquisition in 26 villages of Bargarh District

o Declaration under section 19(1) of land acquisition act for all 26 villages (3 nos. of villages during the reporting period) by District Collector, Bargarh on receipt of sanction from commerce & Transport department, Odisha Government. o Payment has been done towards Land acquisition to 156 nos THs in 10 villages of Bargarh district (5 nos. of villages during the reporting period) for 11.03 acres. Out of which, 9.52 acres possession taken in seven villages and the payment in 14 villages for 9.42 acres is in progress. The details awaited from concern Revenue Department. o During this reporting period in District Bargarh, INR 11,181,518 was compensated to 156 THs and possession of about 49% of total private land has been achieved in the district(refer table 6,page 14).

 Private land acquisition in 32 villages of Balangir District

o Declaration under section 19(1) of land acquisition act for 27 villages (3 nos. of villages during the reporting quarter) by District Collector, Balangir on receipt of sanction from commerce & Transport department, Odisha Government. o Payment has been done towards Land acquisition to 146 nos THs in 11 villages of Bolangir district (4 nos. of villages during the reporting period) for 9.24 acres and possession taken. The payment in 14 villages for 12.62 acres is in progress. The details awaited from concern Revenue Department. o During this reporting period in District Bolangir, INR 8,552,524 was compensated to 146 THs and possession of around 22 % of total private land has been achieved in the district(refer table 6,page 14).

 Government Land

The possession for total 31.952 acres of government land has been taken up to March 2020, accounting around 83 % of the scope.  Forest Land

o For diversion proposal of forest land, site inspection report has been uploaded online by respective DFO’s and forwarded to Regional Chief Conservator Forest (RCCF) and further forwarded to the Principal Chief Conservator of Forest (PCCF)/Bhubaneswar (BBS) on 01/10/2019. o The diversion proposal has been put up with State Government on 18/12/2019 for Stage-1 clearance and State Government forwarded the Forest Diversion Proposal to ADG/Forest/Central on 21/01/2020 for Stage-1 Clearance. o Observation raised by ADG/Forest/Central in REC meeting held on 24/02/2020 and compliance under process.

Hospet-Tinaighat (HT)

The total scope of land acquisition has now been revised to 30.200 acres. Out of which, possession has been taken over 18.512 acres and in process for 11.688 acres. Out of the land taken over with possession, 1.025 acres of land pertains to Government and 17.487 pertain to private land. Possession of balance private land of 5.275 is in process under relevant LA act and 6.413 acres of land is in process under direct purchase.

Title Holders of 71 numbers are identified for the total proposed acquisition of private land of 29.175 acres and no NTH were found in this project. The total PAPs identified in this project are 43 Nos. out of which, 18 PAPs have been eliminated from PAPS list, since the corresponding land of these PAPs has been proposed for acquisition under direct purchase act. Hence, the micro plan for resettlement allowance for the eligible remaining PAPs of 25 Nos has been approved and disbursed with 3,70,000 INR in three stages.

Contract for resettlement monitoring by deployment of local experts was initially given to M/s Shree Manjunatha Enterprises for a period of six months starting from 16/06/2016. Thereafter, this contract agreement for resettlement monitoring has been accorded with multiple extensions and active till the end of the reporting period. Two local experts are working since the award of the contract and continued till date.

 Owing to the failure through direct purchase at two villages (Ginigera in Koppal District and Alnawar in Dharwar District), the acquisition is being processed under New LA act. Compensation of Land Acquisition for Koppal under direct purchase is still pending with the Court because of ownership dispute. The case, which is pending with Court has been resolved by District Magistrate that the amount will be deposited to court of Law for further settlement accordingly.  Ginigera in Koppal District Revenue department given Act 2013 section 11 Notification issued under New Land Act.  For Village Ginigera, Joint Measurement Survey that was carried for direct purchase, has now to be done as per New LA Act. Accordingly, letter has been already issued to Assistant Commissioner (Revenue) Koppal to carry out JMS immediately.

5.3 NGO-Assistance to RVNL

5.3.1 NGO contract for Sambalpur-Titlagarh project As stated through previous reports, that Resettlement work for TH is being done directly by state Revenue department. As the contract services of NGO have expired during August 2016. NGO has completed all tasks related to compensation and training for all NTH identified in Sambalpur-Titlagarh during their contract period. Further, two retired persons from state Revenue Department appointed by PIU Sambalpur are assisting the Revenue Department for land acquisition and involuntary resettlement activities and details is as follows:

 Mr. Guru Charan Prasad (Retd. Sub Collector) as Land consultant assisting to RVNL for Private and Government Land acquisition and R&R.  Mr. Raghunath Padhi (Retd. Forest Ranger) as Land consultant assisting to RVNL for Forest Land diversion

5.3.2 NGO contract for Raipur-Titlagarh project

No land acquisition in this section and all NTH have been compensated. The NGO had completed the R&R activities as per the approved Micro plan for NTH. As suggested through the previous reports, the GC social expert recommends closing of this project with respect to R&R.

5.3.3 Assistance for Hospet-Tinaighat project In the similar way of ST project, two consultants have been appointed by RVNL for HT Project from November 2016 under the contract awarded to M/s Shree Manjunatha Enterprises. Extension of the services of these two persons has been approved by CPM till March 2020 and details is as follows:

5.4 General Consultant

A General Consultant (GC) firm has been mobilized for the overall supervision, monitoring and reporting of the investment program. The GC social expert has provided the following input man month for monitoring R&R issues on various subprojects.

ADB mission has visited Hospet-Tinaighat during 11/11/2019 to 13/11/2019 to check the status of Land acquisition and ensure R & R in the project. General consultancy experts have also accompanied ADB mission during their visit.

The purpose of the short mission was to check randomly the compensation process under NTH Interacting with ADB requires familiarity with its procedures and policies of Social safeguards issues. It is also important to regularly monitor the ongoing process of Compensation and settle Resettlement and Rehabilitation process for the affected persons.

5.5 Daund-Gulbarga

No land acquisition in this section and all NTH have been compensated.

The NGO had completed the R&R activities as per the approved Micro plan for NTH. As suggested through the previous reports, the GC social expert recommends closing of this project with respect to R&R.

5.6 Sambalpur-Titlagarh

Social impact assessment (SIA)

A State unit Nabakrushna Choudhury Centre for Development Studies (NCDS), Bhubaneswar has undertaken the Social Impact Assessment (SIA) in the state of Odisha for the project. As social impact assessment (SIA) has been made mandatory in policy provisions of LA Act 2013, Social Impact Assessment (SIA) was under taken in two districts namely Bargarh and Balangir.

The report has been submitted in 2017 to the Government for further processing as per the LA Act. The Revenue department is updating the land records as per section 11(5) of Land Acquisition Act 2013. The revenue department has to update and complete land records before declaration U/S 19. The GC is closely monitoring as no involuntary displacement will take place without completion of R&R. (The R&R package to land losers will be as per the entitlement matrix approved by the R&R administrator of respective districts).

Mitigation Measures: Since the project is a linear project and a small area of land in patches is going to be acquired, the risks and impacts may be less than the average.

Vulnerability Status of the household

As per SIA study, there are total 559 affected households, out of which, 539 households have been covered during the field study. Among the 539 affected households of Balangir district, 80 (14.84%) are headed by women, 9 (1.67%) are headed by physically handicapped persons and the balance 450 (83.49%) households are headed by men. 50 (9.28%) households among them are having BPL cards belonging to 32 villages.

Regarding vulnerability status of the affected households of Bargarh district, there are 128 widows, 97 women headed households, 323 physically handicapped persons, 94 destitute, 103 divorcees and 23 orphans belonging to 26 villages.

All NTHs identified at Khetajpur, Guhratikra and Balangir in Sambalpur–Titlagarh project have been paid full compensation including training programme on income restoration and skill upgradation for affected PAPs during the year 2016. The land is totally free from squatters for laying of new Railway track.

Joint Survey Committee General Manager, East Coast Railway had reviewed the progress of ongoing Sambalpur-Titlagarh doubling project with Rail Vikas Nigam Limited (RVNL). RVNL informed that the progress has been hampered due to non-availability of sufficient width of land for proposed doubling line, whereas Railways appraised that the sufficient railway land is available.

Sambalpur (SBP) District The total private land of Title holders in Sambalpur district required is 4.62 acres (1.869 Ha) in 5 villages. Full possession has been taken for 4.620 acres in 5 villages. The total government land required at Sambalpur district is 21.517 acres in 5 villages. Possession taken so far is 21.487 acres and balance 0.03 acres is pending with Tahasildars.

Bargarh (BRGA) District

Total 22.65 acres (9.25 Ha) of the private land in Bargarh district consisting of 26 villages is proposed to be acquired. 11(1) notification for all 26 villages issued by Government of Odisha on 31/10/2017, 01/11/2017, 02/11/2017, 09/11/2017 and 24/04/2018 for all the 26 villages. Vide 19(1) notification of land acquisition act, the preliminary estimates for all 26 villages have been approved by District collector, Bargarh in series on 28/09/2018, 11/10/2018, 24/10/2018, 29/10/2018 and 30/10/2018. The approved preliminary estimates of all 26 villages was sent to Commerce & Transport Department, Government of Odisha on 05/10/2018, 23/10/2018, 27/10/2018 and 14/11/2018 for approval. On receipt of approval of preliminary estimate of all 26 villages from Commerce and Transport department, Government of Odisha, issued declaration under section 19(1) of land acquisition act for all 26 villages by District Collector, Bargarh. Revenue Department has been paid compensation to THs towards private land acquisition in 10 villages for 11.03 acres and awaiting for details. There is total requirement of 3.985 acres of Government land to be acquired at 26 villages in Bargarh district, only 1.921 acres of alienation/transfer of government land has been made up to the reporting period. Balance transfer of 2.064 acres of land is pending with Tehsildars (local revenue officers at district level).

Balangir District

Total 42.418 (17.166 Ha) acres of private land at 32 villages is to be acquired in Balangir district. 11(1) notification issued by District Collector for all the villages on 24/03/2018. Vide 19(1) notification of land acquisition act, the preliminary estimates have been approved by District Collector, Balangir for all 32 villages and were sent to Commerce & Transport Department, Government of Odisha. The approved preliminary estimates of 32 villages sent to Commerce & Transport Department, Government of Odisha and has been sanctioned for 27 villages Odisha and declared under section 19(1) of land acquisition act by District Collector, Balangir. Revenue Department has been paid compensation to THs towards private land acquisition in 11 villages for 9.24 acres and awaiting for details. Out of total requirement of 11.022 acres of government land in 31 villages, only 7.487 acres have been sanctioned/alienated up to the reporting period. Balance acquisition of 3.535 acres is pending with Tehasildars. Sonepur District

As per the survey details of the Title Holders of Sonepur district, 9.185 acres (3.717 Ha) of Private Land acquisition is required in 8 villages. Total 5.183 acres of private land possession has been taken on 01/06/2017 and 06/06/2017. Handing over of balance land of 4.002 acres is pending with Tehasildar.

Out of 8 villages, the land owners of Sananuapali and Cherupali did not receive payment (seeking higher compensation) and since pending with Revenue department. The District Collected has referred the estimate with revised land acquisition rate for this land of 4.002 acres to State Government of Odisha for sanction in November 2017. However, the State Government of Odisha has declined this proposal for the enhancement of rate of land. At this juncture, the District Collector/Sonepur has instructed SLAO/Sambalpur in June 2018 to handover balance land of 4.002 acres to Railway as per the initially approved compensation rate. There is total requirement of 1.781 acres of Government land to be acquired in 8 villages of Sonepur district, only 1.0571 acres of sanctioned/alienated of government land has been made up to the reporting period. Balance transfer of 0.724 acres of land is pending with Tehsildars (local revenue officers at district level).

Regional Chief Conservator of Forests/Bhawani Patna (RCCF/BWPN) has sent the proposal of diversion of 15.339 acres of forest land of Balangir district to additional Principal Chief Conservative Forest (PCCF), Odisha on 05/05/2018.

Diversion proposal for 6.208Ha (15.339 acres) of reserved forest was filed online on 11/03/2016 and proposal withdrawn on 03/11/2018 due to non-editing option for filing of revenue forest land. Again, online refiling done on 03/12/2018 for 10.420 Ha along with revenue forest land for 4.212 Ha.

Forest Right Act (FRA) certificate for diversion of forest land in Bargarh District is approved by District Collector/Bargarh.

Revenue Forest land:

Pertaining to Revenue forest land acquisition, developments upto the reporting period are as under:

 Plans developed by the consultants have been submitted on 01/05/2018 to Odisha Space Applications Centre (ORSAC) for further process.  ORSAC have demanded for authentication of the submitted plans by Tehsildar. Accordingly, plans authenticated by Tehsildar have been resubmitted to ORSAC.  ORSAC authenticated DGPS survey maps on 04/08/2018 and submitted to DFO/Balalngir for authentication. DFO/Balangir authenticated DGPS survey maps on 30/08/2018.  To file online the diversion proposal of revenue forest land, the edit option could not have obtained. As suggested by DFO/Balangir on 29/10/2018, diversion proposal for 6.208Ha (15.339 acres) of reserved forest was filed online on 11/03/2016 was withdrawn on 03/11/2018 and again, online refiling done on 03/12/2018 for 10.420 Ha, which comprise of 6.208 Ha of Reserve Forest and 4.212 Ha of Revenue Forest.  Nodal Officer of Bhubaneswar approved the proposal on 06/12/2018 and directed to submit the hardcopy of DP to concerned DFO and Collector.

 The signed hard copy of online application for Forest land Diversion Proposal by DYCE (Con)/SBP was submitted to DFO & Collector of Balangir & Sonepur Division on 08/03/2019 and Sambalpur & Bargarh Division on 28/03/2019.  Diversion proposal of forest land site inspection done by DFO/Sonepur, DFO/Balangir, DFO/Bargarh and DFO/Sambalpur on 28/03/2019, 06/04/2019, 14/05/2019 and 22/06/2019 respectively.  Site inspection report has been uploaded online by DFO/Sonepur and DFO/Balangir on 20/07/2019 and forwarded to RCCF/Bhawanipatna.  Site inspection report has been uploaded online by DFO/Sambalpur on 20/07/2019 and DFO/Bargarh on 25/07/2019 and forwarded to RCCF/Bhubaneswar.  Both RCCF Bahwanipatna and Bhubaneswar forwarded to PCCF/BBS.  The diversion proposal put up to State Government for Stage-1 clearance on 18/12/2019.  State Government forwarded the Forest Diversion Proposal to ADG/Forest/Central on 21/01/2020 for Stage-1 Clearance.  Observation raised by ADG/Forest/Central in REC meeting held on 24/02/2020 and compliance under process.

(1) 10.407 acres of Revenue Forest Land diversion is required in 9 villages of Balangir District for the entire Sambalpur – Titlagarh Doubling Railway Project. (2) DGPS Survey completed. DFO/BLGR forwarded the same to ORSAC/BBS for authentication, on: 02/11/2017. (3) SM Consultant reported that ORSAC has issued new format for submission of Survey report. The same has been complied & submitted to ORSAC. Performance of Agency seems to be very poor hence a letter has been issued on 05/02/2018 to expedite the work progress. (4) 4) On 17/04/2018 followed up the issue in ORSAC office along with SM consultant. ORSAC officials observed that there is mismatch of area on 3 nos of plots which require carrying out of DGPS survey again. SM consultant did the job and submitted to ORSAC on 01/05/2018. (5) Again ORSAC asked for authentication of plots by Tehsildars which was complied and submitted on 06/07/2018. (6) ORSAC vide his letter dated 27/07/2018 informed to deposit Rs. 99,120/- for authentication of DGPS survey report. Payment made on: 02/08/2018. (7) ORSAC authenticated DGPS survey maps on 04/08/2018 and sent to DFO, Balangir for authentication and same had been authenticated on 30/08/2018 (8) Revenue Forest land of 04.212 Ha. is required to be filed on line. Due to this edit option was asked from Technical Director FCCID, New Delhi vide letter No. DCE/C/SBP/SBP-TIG Doub/DP/Edit Option/323 dtd.21/08/2018, however edit option could not be obtained. (9) Then suggestion was asked from DFO/BLGR on dt.15/10/2018 and suggested to withdraw the diversion proposal of 6.208 Ha (Reserve Forest) and refile the total area of 10.420 Ha. On dt.29/10/2018. (10) Accordingly withdrawal permission has been requested online on dt.02/11/2018 from forest department and acceptance has been granted on 03/11/2018. During refilling some tahasils are found missed. Regarding this Monitoring Group Delhi have advised to have a mail from concerned nodal officer. (11) Again online refilling done on 03/12/2018 for 10.420Ha (Reserve forest- 6.208Ha+Revenue forest- 4.212Ha) and the proposal approved by Nodal Officer, BBSR on 06/12/2018. (12) The signed copy of the Forest Diversion proposal by Dy. NGO has completed the entire pending task of compensation and entitlement to all the verified APs upto August 2016. There was no land acquisition in any of the subprojects of RT project NGO has completed the entire pending task in August in 2016. No task is pending as per the safeguards policy of ADB. Hence, GC recommends closing of this project with respect to R&R.

The Resettlement work for Title Holders (THs) is being done directly by state Revenue Department with the help of two consultant services hired by RVNL after demobilization of NGO during the year 2016. The total scope of land acquisition has been revised from 31.45 to 30.200 acres owing to stay order obtained from court by one of the TH in Koppal for 1.23 acres leading to redesigning the yard arrangements by RVNL within the available land. The total revised scope of land acquisition of 30.2000 acres comprises of 1.025 acres of land pertaining to Government and 29.175 acres of land pertaining to Private. Acquisition of Government land of 1.025 acres has been completed and possession accomplished. Acquisition of the private land of 29.175 acres has been proposed with 10.450 acres of land through direct purchase and 16.7 acres of land through LA act, based on the willingness of the THs. During the middle of the process of land acquisition through direct purchase, the THs of 2.0250 acres have withdrawn from the process and demanded for acquisition through LA Act. As a result, the scope of land acquisition under Direct Purchase has reduced to 10.450 acres and scope of land acquisition under Land acquisition act has increased to 18.725 acres (16.700 acres under Former LA Act and 2.025 acres under New LA Act).

Land acquisition proposed under direct purchase is of 10.450 acres and possession taken for 4.037 acres. The direct purchase consists of 38 TH at various locations under different District Collectors, viz., Koppal, Gadag, Belgum and Dharwad districts. Out of the proposed direct purchase, 9.925 acres, have been already finalized by Revenue Department at Koppal, Gadag and (Devarayi and Khurdagosh villages) districts and negotiations for the remaining 0.525 acres at Munirabad village of Koppal district have been finalized during reporting period. Out of the finalized acquisitions under direct purchase, compensation has been disbursed to 18 Title Holders of 4.037 acres and in process for the balance 20 Title Holders of 6.413 acres. Disbursement and Registration is in progress for the balance land already finalized by District collectors under direct purchase. Possession of land has been completed at Koppal and Devarayi under direct purchase during this reporting period.

As mentioned, owning to failure through direct purchase, the scope of acquisition under LA Act has been increased from 16.700 acres to 18.725 acres (16.700 acres under Former LA Act and 2.025 acres under New LA Act) with 34 TH at Ginigira in Koppal district and Alnavar in Dharwad district. Notifications 6(1) have been issued for the area of 16.700 acres pertaining to Former LA Act. The land of area 13.30 acres have been finalized and compensation has also been disbursed to 20 out of 25 THs identified. Further, the land of 3.4 acres pertaining to 6 THs is under dispute like ownership, family and updated ownership details. The land acquisition proposed under new LA act due to failure of Direct Purchase, SIA has been completed and submitted to District Collectors / Dharwad / Koppal for the area of 1.025 acres of 2 THs at Alnavar village and for the area of 1.00 acres of 6 THs at Ginigera village respectively.

As stated above, the total revised scope of land acquisition is 30.200 acres after the stay order obtained from court by one of the TH in Koppal for 1.23 acres leading to redesigning the yard arrangements by RVNL within the available land. Out of this revised total scope of land to be acquired, 12.4750 acres was proposed for direct purchase from TH and 16.70 acres was notified under clause 6(1) of old Land Acquisition Act. Subsequent to failure in Direct Purchase during negotiations, 2.0250 acres has been converted to acquire under New Land Acquisition Act. As a result, the scope of Land acquisition under direct purchase has been reduced to 10.4500 acres. The acquisition of 2.025 acres of land, pertaining to 8 Title Holders, thus changed from Direct purchase to New LA act is in process and taking considerable as the process has been initiated from scratch. The total land acquired up to the end of the reporting period is 18.512 acres (61.3 %).

Further, regarding the land acquisition through the New LA Act 2013, SIA of 1.000 acres at Ginigera village has been completed and submitted to District Collectors / Koppal and that of 1.025 acres at Alnavar village has been ruled out by District Collector / Dharwar.

The proposed land acquisition of 16.70 acres has been accomplished with acquisition of 13.45 acres. Under this Old LA act, all the applicable awarded amount of 11,152,300 INR has been deposited to Revenue department for further disbursement. Out of the deposited amount, 8,785,005 INR has already disbursed to 21 Title Holders out of 25 Title holders. The balance 3.250 acres of land pertaining to 4 Title Holders are as detailed in Table 15.

Out of the revised total scope of 10.45 acres proposed through direct purchase, the Revenue department has finalized the process of negotiations with all the 38 THs and also finalized the total sum of compensation as 163,289,455 INR and RVNL has deposited the entire sum of assessed compensation with revenue department. Subsequently, 4.037 acres have been already acquired from 18 Title Holders duly disbursing the compensation of 47,939,917 INR.

From the beginning it was hoped that it would be easy and fast to acquire land by Direct Purchase, but it did not happen because of factors like local dispute in ownership ,identification of true owners and incorrect mutation etc.
