0309/20 CHAIR’S ANNOUNCEMENTS Chair gave an update of the low-key ceremony and laying of the Council’s wreath on Armistice Day, 11th November 2020. Chair confirmed she had contacted Dermot Murphy, from the Office of Sarah Dines MP For Derbyshire Dales. As agreed by Council, she had highlighted planning and public transport as being the main concerns for Crich Parish. Chair advised that she had not stood for election as Trustee to the Glebe Field Centre, nor as a Member of the Management Committee, at the recent AGM. Cllr Thorpe had also resigned from her position as Council Representative on the Trustee Board. The Clerk had been contacted by the new Trustee Chair in relation to the vacancy for Parish Councillor Trustee representation. The Clerk had requested more information of what the role would entail and the envisaged time commitment involved. She would circulate the response when received. The vacancy would appear on the Agenda for 4th January 2021. Resolved: A vote of thanks be recorded for Cllr Lane and Cllr Thorpe, for the roles they had carried out as Glebe Field Centre Trustees. Cllr Lane was also thanked for serving on the Management Committee of the Glebe Field Centre. Appreciation was expressed for all their work over the years on behalf of the Council.

MINUTES 0310/20 Resolved: To approve the Minutes of the Parish Council Meeting held on Monday 2nd November 2020.

PLANNING 0311/20 a) Planning Authority applications Delegated decision making: Cllr Collison Lead, consultation with all Members. Cllr Collison abstained from discussion relating to Planning Application AVA/2020/1102 - Land Off Top Lane, Whatstandwell, and the associated notice of planning application from residents. This application was presented by Cllr Smith. After Council had agreed the response to be submitted, Cllr Collison re-joined the Meeting. Resolved: That the Parish Council representations on planning applications comments made at the meeting be submitted to AVBC.

Cllr Walsh said he had been unable to look into past planning decisions and provide a report of how they compared to the objections made by Council, as AVBC’s planning portal did not contain those representations, they were removed once a decision had been made. Resolved: The Clerk to contact AVBC Planning Department to enquire why representations were removed from the AVBC’s on-line planning portal records.

0312/20 b) Notice of planning application Letter from four residents - land adj. 22 Hindersitch Lane, Whatstandwell – planning application, circulated 16th November 2020, and with Agenda. Resolved: The content of the letter was noted.

FINANCE 0313/20 a) Payments Resolved: That payments of the attached accounts in the sum £6,624.30 be formally approved.

0314/20 b) Receipts Resolved: That receipts of the attached accounts in the sum £3,026.46 be formally approved.

0315/20 c) Notice of conclusion of Audit 2020 Resolved: Audit Return for year ended 31st March 2020, sections 1-3 and notice formally accepted.

REPORTS

RECREATION GROUND 0316/20 a) The Place Project Cllr Yorke had nothing new to report.

0317/20 b) Recreation Ground Working Party – Signage Review Working Party had not yet met or agreed a Lead. Resolved: Cllr Yorke to organise the first video conference meeting.

0318/20 c) Boules pitch Cllr Collison advised there was nothing further to report since the last on-site meeting with the group of residents. Resolved: This Item to be removed from the Agenda until Council receive a proposal paper from the group.

0319/20 d) Unauthorised football practice Cllr Walsh had visited the Recreation Ground again, but had not witnessed any activity. Resolved: This Item to be removed from the Agenda, though the use of the Recreation Ground continue to be monitored.

0320/20 CRAG WORKING PARTY Cllr James said he had nothing currently to report, but an update would be provided at January’s Meeting.

BURIAL GROUND 0321/20 a) Working Party Reviews x 3 Cllr Walsh gave an overview of recent findings and said it was hoped that the new fees could be introduced from January 2021. The Rules and Regulations were a work in progress, which would hopefully be approved later in 2021.

0322/20 Crich Burial Ground – Fees Proposed scale of new Burial Ground fees, circulated with Agenda. Council did not feel that it had sufficient information to make an informed decision. Resolved: The Working Party was asked to produce a report explaining how they had arrived at the recommended fees, how those fees compared with other local Parish Burial Grounds, and any other relevant information to help with decision making.

0323/20 Crich Burial Ground - Exclusive Right of Burial The Working Party’s recommendation of not adopting an Exclusive Right of Burial option was deferred until Council was in a position to make a decision about new fees.

0324/20 Crich Burial Ground - Rules and Regulations The Clerk had cross-referenced the first Working Party draft with the existing Rules and Regulations, as well as the list of ‘problems’ that had been encountered that needed to be included. She had provided comments and queries for the Working Party to consider.

0325/20 b) Repair and extension of access road The Clerk had not been able to progress this Item further, as available time had been spent working on the new website and the Burial Ground reviews.

WINTER SERVICES/CHRISTMAS 0326/20 a) Large Christmas tree The large tree and new lights have been installed, with no incidents regarding parked vehicles this year. The new barriers and pavement signs appeared to be working well, and also looked much better. All those involved in facilitating the installation were thanked for their efforts, which had resulted in positive feedback.

0327/20 b) Small Christmas trees Cllr Yorke reported that the trees had arrived on schedule and were being stored in the Glebe basement. They had all been trimmed to fit the wall brackets, and he had organised delivery of the new lights. However, further work needed to be carried out with regard to extending the electrical leads, and it was hoped everything would be installed on Thursday 10th December. All businesses, excluding one, were participating this year, with the Infant School requesting two trees. Cllr Yorke and those involved in facilitating the installation of the small Christmas trees were thanked for all their work.

0328/20 c) Christmas Lights Working Party Review Cllr Yorke said this was now completed as the new lights for the large and small Christmas trees had been purchased.

0329/20 d) Winter Service Winter Service Report and Grit Bin Status Report from Cllr Baugh, circulated with Agenda. It was noted that relevant actions had been carried out with regard to topping- up bins/sorting out water logged bins. Resolved: Clerk to organise a top-up of the grit salt store held in the Glebe basement.

0330/20 DECISIONS MADE UNDER DELEGATED POWERS Resolved: Monthly report of decisions made under delegated powers, circulated with Agenda, was accepted.

0331/20 FUNCTIONS AND SERVICES STATUS Resolved: Monthly report of functions and services status, circulated with Agenda, was accepted.

MATTERS FOR DECISION

ACCESSIBILITY 0332/20 a) Website upgrade The pre-upgrade meeting with 2Commuune, Cllr Collison and the Clerk took place on 10th November 2020. The new website is up and running. Follow-up website work has been carried out and will continue to take place when time permits. The Council were pleased with the appearance of the new website.

0333/20 b) Training In order that the Council continue to receive support from 2Commune it is necessary for the person responsible for the management and maintenance of the Council’s website to attend a two hour on-line training session at a cost of £150 + VAT. This was not known to be necessary prior to the upgrade of the Council’s website. Resolved: The Clerk to undertake 2Commune’s on-line training session at a cost of £150 + VAT, at a time convenient to her.

TREE SURVEY 0334/20 a) Tree survey five areas As agreed by Council the tree survey work for the five areas of Council land identified was carried out by the selected Consultant, report circulated with Agenda. Notes on results: Area 1 – Crich Recreation Ground, and Area 5 – Parish Quarry, were queried by the Clerk, clarification provided by Consultant, report circulated with Agenda.

Concern was expressed regarding the brevity of the report, and that it did not contain all of the information that had been expected. It also appeared the Jubilee Ground had not been fully inspected. However, it was agreed that it did satisfy the need it had been intended for, and Council now had a report saying that currently no H&S tree work was necessary. The next inspections should be carried out in two years’ time.

Resolved: The Clerk to look into the content of the report, why it was not as expected, and report to Council on findings. The Clerk to look into the Jubilee Ground inspection omission and advise Council of findings, and how it might be resolved. Cllr Baugh volunteered to join future tree inspection visit/s to answer any questions from Contractor engaged. The Clerk to circulate the maps used to identify the five areas of Council land to Members. The Clerk to work with Cllr Baugh to produce a file note detailing what Council require for the next inspection report which is due to be undertaken October/November 2022.

0335/20 b) Trees on ‘common land’ in Wheatcroft The Clerk had e-mailed the map identifying the two possible areas of land to Cllr Walsh on 3rd November 2020. Cllr Walsh had spoken to the Records Office in Matlock, but it was not currently open for public inspection of documents due to Covid restrictions. He would contact them again if the situation changed.

0336/20 ACTIVE CRICH FOR EVERYONE (ACE) – YOUTH CLUB E-mail request, circulated with Agenda. Cllr Smith provided additional information from her conversation with the Chair of Crich Patients’ Participation Group (PPG), which was the body planning to discuss this item at their meeting in January 2021.

Resolved: Cllr Smith to contact the Chair of the Crich PPG to advise Council Chair was happy to have a conversation regarding a previous Youth Club that had been held in the Glebe Field Centre, and her experience of running it. The discussion to take place prior to the planned Crich PPG meeting in January 2021. The Clerk to advise the author of the e-mail that arrangements are being put in place for Council Chair to speak to the Chair of Crich PPG regarding this matter.

0337/20 CORRESPONDENCE Resolved: November’s list of correspondence and information circulated as received, circulated with Agenda, was noted.

PLANNING APPLICATIONS

Agreed and submitted under delegated powers as closing date for response expires before next Parish Council Meeting. To be reported at next meeting. Ref: AVA/2020/0978 Proposal: Proposal for a new two storey dwelling with adjacent car parking and shed. Location: 3 Taylors Yard Market Place Crich Matlock Derbyshire DE4 5DD Response: Objection. Reasons: 1: Whilst the principle of development of the site is welcomed and supported, and it is appreciated the proposals attempt to reflect the mixed use and palette of materials in the surroundings, it is considered the design and choice of materials, particularly sheet metal cladding, are inappropriate in a prominent location adjacent to a principal entrance to the Crich Recreation Ground. 2: The design and materials proposed, in particular use of sheet metal cladding, are such that the proposal will harm, and fail to enhance, the significance of the designated Crich Conservation Area.

Proposed additional comment to be submitted to AVBC, Agent and Mr & Mrs Gray: “It is noted that planning Application AVA/2020/0978 includes a proposal to re-align the boundary wall adjoining Crich Recreation Ground. The proposed alignment is in part within the Recreation Ground. The necessary notice required as part of the planning application process has not been served on the Parish Council (acting on behalf of the Trustees). A copy of this comment has been sent to the applicants/agent as the proposed re-alignment of part of the boundary wall into the Crich Recreation Ground would require the necessary land ownership issues to be resolved. At this time it is unclear whether or not the Trustees would consent to the re-alignment of the wall in part into the Recreation Ground ,and it is most unlikely they would, in any case, wish to incur costs associated with the proposal. The applicants may consider the proposal would be more straightforward if it was amended to merely repair the wall on its existing alignment.”

Ref: AVA/2020/1014 Proposal: Erection of 2 no detached family dwellings on land opposite Cliff Inn public house. Location: Land Opposite The Cliff Inn Town End Crich Matlock Derbyshire Response: The Parish Council OBJECTS to the proposal as it conflicts with the Crich Parish Neighbourhood Development Plan in the following respects: 1. The proposal is to construct two dwellings in an area of open countryside that is outside the settlement development boundary for Crich, contrary to Policy NP2 which states that such land will be treated as open countryside, which will be protected for the sake of its intrinsic character and beauty. 2. The proposals are in conflict with Policy NP1 and Policy NP2 in that they make no attempt to demonstrate they will meet local housing development needs within Crich. 3. The proposals are in conflict with Policy NP5 as it is not demonstrated the proposed housing mix responds to local needs. 4. The proposals are in conflict with Policy NP4 in that they do not conserve or enhance the landscape character and setting of Crich. 5. The proposals are in conflict with Policy NP2 and Policy NP3 in that the proposed intrusions into open countryside are in areas of valued landscape (Paragraph 170 NPPF), defined as important Green Gap between Crich and Whatstandwell, which is also defined as a Special Landscape Area in Borough Council policy. 6. The proposal is contrary to Policy NP3 in that it has significant adverse visual impact on an identified important view corridor. 7. The proposals are in conflict with Policy NP4 in that the design of the properties and their proposed layout does not reflect the character of local traditional development. 8. The proposals are in conflict with Policy NP2 and Policy NP9 as avoidance of harm to important habitat is not demonstrated. 9. The proposals are in conflict with Policy NP2 and Policy NP11 as the scale of harm to the significance of important heritage assets arising from the proposed development is inappropriate. The proposal will harm the Outstanding Universal Value of the Derwent Valley Mills World Heritage Site. The proposal will also harm the significance being located within the setting of the Cliff Inn heritage asset.

Ref: AVA/2020/1102 Proposal: Outline Permission sought for 2no. residential dwellings Location: Land Off Top Lane Top Lane Whatstandwell Matlock Derbyshire Response: The Parish Council OBJECTS to the proposal as it conflicts with the Crich Parish Neighbourhood Development Plan in the following respects: 1. The proposals are in conflict with Policy NP2 parts 1a) 1b) and 3a) in that the layout is not compatible with local character; would cause loss or damage to an open space which is important to the character of the area; and would not achieve a direct relationship between the front of buildings and the street edge. 2. The proposals are in conflict with Policy NP5 as it is not demonstrated the proposed housing mix responds to local needs. 3. The proposals are in conflict with Policy NP9 as avoidance of harm to important habitat is not demonstrated. 4. The proposals are in conflict with Policy NP11 as they will harm the loose-grain character of the Whatstandwell Conservation Area where open areas are a particular feature. The proposals will also harm the Outstanding Universal Value of the Derwent Valley Mills World Heritage Site. 5. It is unacceptable to make an application in outline only. Policy NP11 states proposals will only be supported within a Conservation Area where the proposals are of high design quality and meets stated criteria. The proposal is described off Top Lane. There is concern that vertical alignments of the visibility splays on Hindersitch Lane will be inadequate particularly given the dogleg nature of the horizontal alignment and the fact that satnavs direct traffic along this route to the Tramway Village making summertime traffic flows significant.
