The Speaker’s Committee is appointed in accordance with the provisions of section 2 of the Political Parties, Elections and Referendums Act 2000 to perform the functions conferred on it by that Act.

Speaker’s Committee Third Report 2011 1 Introduction

1. The Electoral Commission was established by Parliament as a body independent of Government. The Chair of the Electoral Commission and the other Electoral Commissioners are appointed by Her Majesty the Queen, following an Address from the House of Commons. The Speaker’s Committee on the Electoral Commission is required by s3 of the Political Parties, Elections and Referendums Act 2000, as amended by the Political Parties and Elections Act 2009, to oversee the procedure for selecting candidates for appointment to the Electoral Commission. Candidates’ names are put before the House with the agreement of the Speaker.

This report provides information about the procedure followed by the Speaker’s Committee during the selection of a candidate to replace Dr Henrietta Campbell CB as the Electoral Commissioner with a special interest in . Dr Campbell has chosen to step down when her appointment expires on 31 December 2011. We are grateful to her for the contribution she has made.

The selection process

3. In order to assist with identifying possible candidates for the post the Committee in April appointed the following independent Panel:

• Dame Denise Platt DBE (Chair)

• Dr Christine Kennedy OBE (an OCPA independent assessor)

• Mr Gary Streeter MP (representing the Speaker’s Committee)

• Jenny Watson (chair of the Electoral Commission)

Although the post of Electoral Commissioner does not fall to be monitored by the Office of the Commissioner for Public Appointments, the Committee agreed that it was desirable that this appointment should be treated, so far as possible, as though it were subject to such monitoring. Dr Kennedy was invited to be an independent assessor on the panel; she acted in accordance with the principles of the Code for Public Appointments in relation to ‘upper tier’ appointments. She played a full part in the Panel’s work and participated in all elements of the recruitment. The Committee determined that, in view of the current restraints on public expenditure, the vacancy should be advertised primarily in Northern Ireland and the administration of the procedure should be managed by the Electoral Commission without the support of recruitment consultants.

5. The Panel began work in May and its Chair made her report to the Speaker in July. Following advertisement in the Northern Ireland press and on relevant websites,1 five of the 21 applicants were shortlisted for interview by the Panel. The Committee is entirely satisfied that the selection process was rigorous and that the Panel discharged its duties conscientiously and with all due regard to the requirements of thoroughness, fairness and propriety. The Committee is grateful to Dame Denise and her fellow Panel members.

The candidate

6. The unanimous view of the Panel was that Anna Carragher should be the next Commissioner with a special interest in Northern Ireland. Miss Carragher was Controller of BBC Northern Ireland between 2000 and 2006 and has been a member of the Equality Commission for Northern Ireland since 2009. The Panel’s recommendation was endorsed by the Committee on 18 July.

Statutory consultation

7. Section 3(2)(b) of the Political Parties, Elections and Referendums Act 2000, as amended, also requires that the proposal to appoint a member of the Electoral Commission be the subject of consultation with the registered leader of each registered party to which two or more Members of the House of Commons then belong. The Speaker accordingly wrote to the leaders of the qualifying parties on 26 July 2011, providing an opportunity for comment by 22 August 2011. Those leaders who responded were content with the proposed appointment. The responses received are reproduced at Appendix C.

8. The Speaker’s Committee believes that Miss Carragher, whose curriculum vitae is appended to this Report, has both the experience and the personal qualities to be an effective Commissioner. It therefore invites the House to approve the decision of the Panel, endorsed by the Speaker’s Committee, to recommend Miss Carragher for appointment as an Electoral Commissioner for a four-year period, with effect from 1 January 2012.

Appendix A: Role and Person specification

The role and job description

Electoral Commissioners are responsible for:

• Setting the overall strategic direction of the Commission and ensuring delivery of its strategic goals within the statutory framework and with the resources determined by Parliament to ensure public confidence in democracy

• Ensuring efficient and effective use of public funds and that the Commission operates within the limits of its statutory authority to high standards of governance

• Setting the Commission's regulatory priorities and monitoring its regulatory activity in the areas of both party and election finance and electoral administration. This includes oversight of the publication of statutory election reports

• From time to time, taking regulatory decisions on key issues within the Commission’s remit. This may include deciding on the appropriate response to significant breaches of the regulatory framework for political parties and candidates

• Serving as a member of the Audit or Remuneration Committees if required, and participation in informal reference groups from time to time

• Effectively contributing to the Commission’s role as a UK-wide body; understanding the issues faced on a UK-wide level and effectively supporting the work of the devolved governments

• For this role, being known as an ambassador for the Commission in Northern Ireland, participating in stakeholder events and public affairs activities as required

• Performing any other roles or functions which the Commission asks them to discharge personally

Person Specification

Experience—essential

Candidates should be able to demonstrate substantial successful experience of:

• Contributing to the leadership and strategic direction of a complex organisation with multiple stakeholders operating in a political environment. This will include experience in a non-executive role

• Operating in a political environment where decisions taken by the organisation are under constant scrutiny, from the regulated community, and from the media

• Corporate governance, potentially in relation to a regulatory environment including oversight and review of financial and other resource plans, preferably within the context of public sector accounting rules

• Equality and diversity and an understanding of its relevance to the work of the Electoral Commission

Skills & Knowledge—essential

Candidates should be able to demonstrate that they have:

• Highly developed political understanding and awareness including the ability to work closely with colleagues from within political parties and understanding of the Northern Ireland political dynamics

• The ability to scrutinise and challenge from a non-executive perspective, including the ability to comment on issues involving a wide range of conflicting viewpoints

• Excellent interpersonal and communication skills with the ability to win the confidence of colleagues and operate as a team player

• Complete integrity and a commitment to transparency in decision making

Desirable criteria

• Experience gained from civil society (e.g. third or voluntary sector) or from roles which have worked in partnership with civil society organisations would be welcomed from applicants for this role

• Knowledge of key corporate governance issues including those with particular relevance to the work of the Commission

• Excellent analytical ability and in particular the ability to think clearly about regulatory decisions from a principles-based perspective and the ability to apply regulatory frameworks to a political environment

Thank you for your letter of 26 July, regarding the proposed appointment of Miss Anna Carragher as an Electoral Commissioner, replacing Dr Henrietta Campbell CB from January 2012.

I appreciate that the Commission have requested a new Commissioner who would, like Dr Campbell, take a special interest in Northern Ireland. While Northern Ireland politics have a different dynamic, this is an appointment of an Electoral Commissioner who will have a UK-wide remit.

Although I am content for a motion to be made in the House of Commons to the effect that an Address be presented to Her Majesty The Queen seeking the appointment of

Miss Anna Carragher as an Electoral Commissioner, I would like to raise some concerns with you about the recruitment process more generally. I hope that these can be taken into account next time the Panel start the process to recruit the next Commissioner.

In the future, I believe there would be considerable merit in appointing individuals to the Commission who have experience outside the world of the public sector and non- departmental public bodies (NDPB). I note, for example, that this would be Miss Carragher’s third sitting NDPB appointment, after the Human Fertilisation and Embryology Authority and the Equality Commission for Northern Ireland.

The Commission must apply regulation proportionately and with proper awareness of the impact of regulation on small and voluntary sector organisations, like smaller local associations. That is why I think it is particularly important that the Electoral Commission’s Board has sufficient expertise from the private and/or voluntary sectors.

I am content for the current recruitment process involving Miss Carragher to continue, as I have set out above. But I hope that, in future, the thoughts I have raised can be taken into account.
