LOCAL GOVERNMENT ORDINANCE 1961

(No. 11 of 1961)

PENAMPANG DISTRICT COUNCIL (TAMU) BY-LAWS 1978 (G.N.L 51 of 1978)

In exercise of the powers conferred upon it by section 50 of the Local Government Ordinance 1961, the Rural District Council has made the following by-laws:

Title and commencement.

1. These by-laws may be cited as the District Council (Tamu) By-laws 1978 and shall come into operation on the 1st day of October 1978.

Interpretation.

2. In these By-laws ―

“Council” means the Council;

“tamu” means an open air market established and declared by the Council to be a tamu by notice posted on the Notice Board of the Council, and at the tamu ground.

Licences and licence fees.

3. No person shall sell any commodities not being of Council manufacture in any tamu within the Council’s jurisdiction without a valid licence which may be issued by the Council in its discretion, and the following fees shall be payable ―

(a) Cooked food (noodle soup or fried, cooked rice, 15.00 etc..)

(b) Local products (vegetables, fruits, tobacco, etc..) not being imported … … … … … … … 4.00

(c) Fish, meat mutton, fowls, etc.. … … … … 10.00

(d) Manufactured products (such as clothing, straw hats, basketeries, etc..) … … … … … … 5.00

Temporary sale.

3A. For temporary sale of various commodities in any open space without stall being provided by the Council in any tamu ground within the Council’s jurisdiction is at the discretion of the Council, the fixed daily licence fee shall be two ringgit per day.

Rental of stalls.

4. The rental charges of any stall provided by the Council shall be five ringgit per month each.

Tamu days schedules.

5. The schedule of tamus to be held shall be as follows ―

(i) Tamu … … … … … every Sunday

(ii) Tamu … … … … every Friday and Saturday

(iii) Inobong Tamu … … … … … every Sunday

(iv) Babagon Tamu … … … … every Thursday

(v) Mile 28, Road Tamu … … every 5th, 14th and 25th day of the month

Commencement of tamu.

6. All tamu shall commence at the following schedules ―

(a) Putatan Tamu every Saturday from 2.00 p.m. – 7.00 p.m. and every Sunday from 5.00 a.m. - 11.00 a.m.

(b) Donggongon Tamu every Friday from 2.00 p.m. – 6.00 p.m. and every Saturday from 5.00 a.m. – 11.00 a.m.

(c) Inobong Tamu every Sunday from 5.00 a.m. – 11.00 a.m.

(d) Babagon Tamu every Thursday from 5.00 a.m. – 11.00 a.m.

(e) Mile 28, Tambunan Road Tamu every 5th, 14th and 25th day of the month from 5.00 a.m. – 11.00 a.m.

Tamu Master.

7. The Council may appoint a person to be a Tamu Master who shall be in charge of the keeping of order and the general management of the tamu.

Penalty.

8. Any person or persons who ―

(a) sells or sell any commodity in any tamu without a licence issued under these By-laws; or

(b) takes or attempt to take into any tamu any intoxicating or illicit liquor; or

(c) constructs or extend any tamu stall without the prior approval of the Council; or

(d) has in his possession in any tamu fireworks, firearms, or any offensive weapon; or has in any way contravened the By-laws being not complying with any lawful direction given by the Tamu Master; or

(e) sleeps or lounges in any tamu ground at any time unless permitted in writing by the Council; or

(f) carry out illegal gambling activities in any tamu ground, shall be liable to a fine of not more than one hundred ringgit.

Cancellation of licence.

9. The Council may suspend or cancel a licence if the licensee ―

(a) has not renewed the licence upon its date of expiry; or

(b) has been convicted of any offence under these By-laws.

Repeal.

10. The Kota Kinabalu Rural District Council (Tamu) By-laws 1960 [G.N.S. 151/60.] is hereby repealed.
