PUBLIC NOTICE NOTICE OF FINAL HEARING STATE OF MINNESOTA ) ) SS COUNTIES OF CLAY-WILKIN ) RE: Project No. 78, Clay/Wilkin Judicial Ditch No. 1-Improvement NOTICE IS HEREBY GIVEN that the Final Hearing for the above referenced project, as required per Minnesota Statutes Annotated (M.S.A.) 103E.325, 103E.335, and any other applicable statutes, will be held by the Board of Managers, Buffalo-Red River Watershed District, on Monday, January 7, 2019, at 7:00 PM, in the Buffalo-Red River Watershed District Office, 1303 4th AVE NE, Barnesville, MN. The Petition for this project was filed on June 1, 2018. Jurisdiction of the ditch system resides with the Buffalo-Red River Watershed District. The Preliminary Hearing was held on August 30, 2018. The Engineer’s Detailed Survey Report and the Viewers’ Report are on file at the office of the Buffalo-Red River Watershed District, 1303 4th AVE NE, Barnesville, Minnesota, and are open to public inspection during regular business hours. An open house to meet with the Viewers will be held on Thursday, January 3, 2019, between the hours of 2:00 PM and 4:00 PM at the Buffalo-Red River Watershed District office. The proposed improvement for Clay/Wilkin Judicial Ditch No. 1 commences at the outlet with Wolverton Creek/Comstock Coulee in Section 27, Holy Cross Township, and proceeds due easterly along the quarter line of Sections 27, 26, 25, and the W½ of Section 30, Alliance Township. The total length of the said project is approximately 3.04 miles. The proposed improvement involves work on the channel grade line, cross-sections, and structures in the referenced area. The channel improvements are designed to convey runoff produced from the 10-year rainfall event. A rural ditch section, which will be trapezoidal in shape, with a 20-foot bottom width and 5H:1V sideslopes, will be installed. Centerline drainage structures along the project alignment were evaluated for their elevation and capacity, and where necessary, will be adjusted in elevation to meet the design standards. Field inlets will be adjusted/installed as needed. Total proposed benefits for Project No. 78 as found by the Viewers are $3,503,851. Benefits include lands draining to the improvement area, as well as protected areas north of the ditch, which have been affected in the past with historic overtopping of Clay/ Wilkin Judicial Ditch No. 1. The project includes the acquisition of additional right-of-way, which will require 46.9 acres of permanent right-of way and 36.4 acres of temporary right-of-way. This right-of- way is needed to improve the ditch, and includes the required by law, one-rod grassed buffer strips for the entire ditch system. The project’s estimated cost is $2,181,272, which includes $245,420 for right-of-way. Financing for the project, if constructed, could come from a bond sale, spread over a 7-year to 15-year period (to be determined at hearing). Exhibit 1 is a description of the property affected, benefited, or damaged within the Clay/Wilkin Judicial Ditch No. 1. The names of owners thereof and the municipal and other corporations affected thereby as shown by the Engineer’s and Viewers’ Reports are attached as Exhibit 2.
