Circular Memo.No.REV01-LANA0LAND(PM)/17/2019, dt.03.12.2019. 3) Form-A(1) filed by the Tahsildar, Savalyapuram through the Revenue Divisional Officer, 4) Form-A(2) State Gazette No W.No. 2, dt.10.01.2020. 5) Form-C approved by the District Collector Guntur dt.21.01.2020 published in District Gazette No.42 dt.22.01.2020. 6) Form-G-III – Agreement with Land Owners. 7) Revised Form-C approved by the District Collector Guntur dt.17.02.2020 published in District Gazette No.503, dt.17.02.2020 8) Connected papers. * * * O R D E R:- The Tahsildar, Savalyapuram Mandal has filed Form-A(1) under Rule-4 of the RFCT LA R&R () Rules, 2018 for the exemption of Chapter-II & III of the Principal Act (I.e., Act No30 of 2013) to an extent of Ac. 1.00 cents in Survey Numbers 188of Vayyakallu H/o Karumanchi Village for providing house sites under “Navaratnalu Pedalandariki Illu” scheme.

In accordance with the provisions contained in Section 10-A of the Act; a notification in Form-A(2) was issued under Rule-4 of the RFCT LA R&R (Andhra Pradesh) Rules, 2018 and exempted the provisions of Chapter-II & III of Principal Act (i.e., Act NO.30 of 2013) and it was published in the State Gazette No W.No.2 , dt.10.01.2020.

Thereon, the Tahsildar, Savalyapuram has filed Form-B, B(1) and B(2) and the Land Acquisition Officer cum Revenue Divisional Officer, Narasaraopet has submitted Form-C Notification after verification of the land with land owners willingness for voluntary acquisition (sale) of land, Combined Sketch, FMB, Copy of Adangal, copy of RSR. After due verification, a Public Notice by way of Notification in Form-C was issued calling for objections to the acquisition if any, and claims from all the persons interested/affected within the 15 days from the date of publication of the said Form-C in the District Gazette No 42 dt.21.01.2020 (which was published on 22-01-2020). The said Notification in Form-C was also got published in (1) Village Secretariat/Ward Secretariat (2) Gram Panchayat Office (3) Tahsildar, Savalyapuram Office and (4) MPDO Office Savalyapuram and also informed the public by beat of Tom-Tom in the village of Vayyakallu H/o Karumanchi in Savalyapuram Mandal. Later negotiations are conducted on Dt.16.02.2020 on fixation of market value. As per RFCT LA RR ACT compensation amount arrived as Rs.9,07,500/- Per Acre. Negotiation Committee offered to pay compensation amount for Rs. 12,00,000/- Per Acre. But, the land owner has demanded for compensation to an amount of Rs. 18,00,000/- and finally expressed his unwillingness to give his land for House Sites. Hence, the Tahsildar, Savalyapuram Mandal has identified alternate patta land and submitted revised form C proposals to an extent of Ac.1.00 in SY.NO 774 of Vayyakallu H/o Karumanchi Village. The same was approved by the District Collector on Dt 17.02.2020 and published in Gazette No.503,Dt.17.02.2020.

Negotiations:-

As per Rule 8 of the RFCT LA R&R (Andhra Pradesh) Rules, 2018 Negotiations Committee constituted with the following Officials to have negotiations with the land owner/owners for finalization of the payment compensation of the land. 1) The District Collector, Guntur 2) The Joint Collector, Guntur 3) The Revenue Divisional Officer, Narasaraopet – Convener of the Committee, 4) Executive Engineer, Panchayat Raj, Narasaraopet 5) Representative of the requisition Department i.e., The Tahsildar, Savalyapuram Mandal.

The Revenue Divisional Officer, Narasaraopet cum Land Acquisition Officer has submitted Market value proposals under Section-26 of the Principal Act (Act 30 of 2013) i.e., Average Sale Price and Basic Value particulars per acre. The Average Sale Price is Rs.3,49,556/- Per Acre. The Basic Value is Rs. 3,63,000/- per acre as per Registration and Stamps Department authenticated letter dt.18-02-2020. The Basic Value is Rs. 3,63,000/-is higher than the Average Sale Price Rs. 3,49,556/. The compensation is comes to Rs. 9,07,500/- per acre including Factor Value 1.25 + 100% Solatium as per RFCT LA R&R Act, 2013 as follows:- Multiplication Land Land Extent of Factor Sl. The land owner has requested to enhance the compensation.

The Negotiation Committee examined the grading of land, the land is abutting to the existing habitation and having Road Connectivity , Anganwadi School are also available and leveling is not required. Basic minimum facilities like Water, Electricity, etc. are available. The land is fit for construction of houses. Hence, this land is proposed under Category A. Hence, the committee have opined that it may just and proper to enhance the land compensation to a tune of Rs 2,92,500/- per acre on the market value arrived as per Act. Accordingly, the Land Compensation per acre is fixed @ Rs 12,00,000/- per acre. The land owner has agreed to receive the land compensation as fixed supra by the Negotiation Committee. The apportionment is fixed based on Revenue Records, Title and enjoyment of land and after preparation of Sub-Division Record. After Completion of the negotiations carried out and settlement reached as narrated supra, with land owners, an agreement in Form-GIII has been entered to that effect by the District Collector/Authorized Officer RFCT LA R&R (Andhra Pradesh) Rules, 2018 (Act No. 22 of 2018) which shall be published in District Gazette forthwith. Further, the “Nil” R&R Award as proposed by the Revenue Divisional Officer, & Land Acquisition Officer is approved.

The Revenue Divisional Officer, Narasaraopet & Land Acquisition Officer is hereby directed to take further action for disbursement of the amount arrived under negotiation to the respective land owner as per procedure by obtaining details of bank accounts and other required documents after due verifying with the concerned Bank Manager whether or not the bank account is in force at the earliest and also complete incorporation of changes in the relevant records.
