Quarles .......................... 442 Conclusion ....................................................................................... 453 Appendix .......................................................................................... 455 Introduction It was 12:30 a.m. in Queens, New York, on September 11, 1980, when a panicked young woman flagged down officers on routine patrol and told them she was just raped.1 She described the assailant to offic- ers, told them he was armed, and that he just retreated into a nearby supermarket.2 Law enforcement apprehended the assailant in the back of the store and handcuffed him following a frisk that revealed an empty shoulder holster.3 An officer asked where the gun was and the suspect responded, “the gun is over there.”4 † Associate Dean & Professor of Law, University of Arkansas-Fayetteville School of Law. Id. 393 Case Western Reserve Law Review·Volume 66·Issue 2·2015 The Unlikely Meeting Between Dzhokhar Tsarnaev and Benjamin Quarles Because the suspect was in custody and responded to interrogation at the time of his incriminating statement, Miranda presumably man- dated exclusion of his response.5 But in a 1984 Supreme Court opinion titled New York v. Quarles,6 the Court held the suspect’s response— “the gun is over there”—admissible at his trial for criminal possession of a weapon by creating “a ‘public safety’ exception” to Miranda.7 Fast forward to 2:49 p.m. on April 15, 2013, when the first of two pressure cooker bombs exploded near the finish line of the Boston Mara- thon.8 A second bomb exploded between twelve to thirteen seconds later 214 yards away.9 Collectively, the explosions killed three people and wounded 264 others.10 At the conclusion of a citywide manhunt that ended at around 8:30 p.m. on April 19,11 law enforcement apprehended a severely wounded Dzhokhar Tsarnaev hiding inside a boat in the city of Watertown.12 His condition initially deteriorated, prompting medical personnel to intubate him to keep him alive.13 5. According to the federal indictment, during the shootout Tamerlan was captured, but died partly as a result of his brother driving over him, and an MBTA police officer was critically injured in the course of Dzhokhar's escape in the SUV[6] (the latter by what may have been friendly fire).[7] Dzhokhar was injured but escaped, and an unprecedented manhunt ensued, with thousands of police searching a 20-block area of Watertown. On the evening of April 19, the heavily wounded Dzhokhar was found unarmed hiding in a boat on a trailer in Watertown just outside the police perimeter, arrested, and taken to a hospital. BOSTON -- Registration for the 2014 Boston Marathon will open on Monday, September 9, 2013 at 10:00 a.m. ET. The B.A.A. will use the same process to register qualified runners as it used in the 2012 and 2013 Marathons, allowing the fastest qualifiers to register first. Registration will be held entirely online at www.baa.org. The qualification window for the 2014 Boston Marathon began last year on September 22, 2012. In addition, in cooperation with the Commonwealth of Massachusetts and the eight cities and towns along the Boston Marathon route, the B.A.A. has set the field size for the 2014 Boston Marathon at 36,000 official entrants. The 118th Boston Marathon will be held on Monday, April 21, 2014 and will mark the 29th consecutive year that the event will have John Hancock Financial Services as its principal sponsor.
