3.1. To ensure conservation and protection of shellfish stocks coastwide through the application of scientific management principles.

3.2. To ensure the optimal use of shellfish stocks in order to meet social and economic objectives of Canada.

3.3. To develop fishing plans consistent with principles of conservation, through a consultative process with users of the resource.

3.4. To preserve, enhance, restore and protect critical aquatic habitat for shellfish production.

3.5. To optimize the quality of shellfish harvested.

4. HISTORY OF THE RED SEA URCHIN FISHERY

The red sea urchin dive fishery began in the 1970's and has grown rapidly since 1982. The fishery and landings have been stabilized somewhat by quotas in the South Coast. Initial quotas were based on surveys, but quotas in recent years and in 1995 are largely arbitrary until more is known about the stock.

In the South Coast, the fishery is limited primarily to the period of traditional peak market demand, avoiding mid-year months. Area quotas have been set to limit fishery growth until stock and biological data are collected and evaluated.

In the North Coast, an experimental management program was initiated in 1988 which incorporated minimum and maximum size limits as well as rotational areas. The maximum size limit was removed in 1993. Area quotas have also been set in the North to limit fishery growth until stock and biological data are collected and evaluated.

Total landings (preliminary) in 1993 reached 6,148 t valued at $4.9 million. In 1993, 103 vessels recorded landings.

In 1991, the red sea urchin licences were limited to 102 (the 103 vessels with landings in 1993 are due to licence transfers so that more than one vessel had landings on one licence). The numbers of eligible licences has climbed to 109 through appeals.

In 1994, the red sea urchin fishers instituted a voluntary individual quota system. The coast was divided into two licence areas, north and south, of which fishers were required to elect one. The quota in each area was divided equally between the fishers. Landings were validated by a company employed by the Harvesters Association.

5. ENFORCEMENT PLAN

The Department of Fisheries and Oceans has recently reorganized into sector management which has resulted in the creation of an enforcement sector called Conservation and Protection. The Conservation and Protection Sector has the responsibility to enforce the Fisheries Act and associated regulations, to address conservation, health and safety issues and to maintain proper management and control of the various fisheries. Priorities in enforcement activities are discussed with users in the Sectoral Committee meetings and will be addressed during the 1995 season.

Users of the resource have a responsibility to report violations. Any suspected or actual fisheries, wildlife or pollution violations can be quickly and discretely reported to the

appropriate Enforcement Officer by using the toll free Observe, Record and Repon hotline. This toll free number is available 24 hours a day. Confidentiality is assured.

6. ABORIGINAL FISHERIFS STRATEGY

The Department of Fisheries and Oceans recognizes the importance of fish, including invertebrates, to the aboriginal peoples of . Through the Aboriginal Fisheries Strategy, the Department seeks to negotiate, with aboriginal organizations, allocations for food, social and ceremonial purposes. Subject to conservation, these allocations will have priority over allocations for commercial and recreational user groups.

The Department will consult with aboriginal organizations to determine what these allocations should be. In some cases, instead of negotiating allocations, an area may be closed to certain fishing except fishing by an aboriginal organization. These closures may be for the season or for specified times. Whenever possible, the appropriate annual fishing plan will identify such closures. Communal licences will be issued to the aboriginal organization for the fishing.

7. SPORT FISHING PLAN

The recreational harvest of shellfish is regulated by the British Columbia Sport Fishing Regulations made under the Fisheries Act. The regulations are summarized annually in the British Columbia Tidal Waters Sport Fishing Guide which lists closed times, bag limits, size limits (where applicable) and closed areas. If necessary, public notices are posted to document closures or changes from the Guide. Closures may be implemented in order to conserve vulnerable stocks, protect the public from consumption of contaminated shellfish or to meet Aboriginal food, social and ceremonial needs. For some species, areas have been closed to commercial harvest or open times for commercial harvest have been delayed to provide an opportunity for the recreational community.

The primary consultative body for the recreational fishing community is the Sport Fishing Advisory Board (SFAB). The SFAB has representatives from all parts of this community including the BC Wildlife Federation and the Sport Fishing Institute of Be. Within the SFAB, a shellfish committee has been established for the south coast region.

8. COMMERCIAL FISHING PLAN

8.1. MANAGEMENT CHANGES IN 1995

8.1.1. South Coast Quota

Landings reported to date indicate that there was a 120,000 lb overage in Area 12B in 1994. This has been deducted from the 1995 quota. Esperanza Inlet (Area 25A) will be closed in 1995 as there appears to be no product available. The Area 26-1 portion of the Exploratory area has been removed; the quota is unchanged. Adjustments in quotas have been made to Areas 12C and 12B as portions of this area will be used as a study area (see 8.2.4.2). Any portion of the deducted quota (80,000 lb) harvested by commercial fishers (under permit by DFO) will be used as part of the PUHA Research Fund. All other quotas have been returned to former levels for 1995. If, at the end of the 1994 season, more overages have occurred, additional adjustments will be made to area quotas for 1995.

8.1.2. North Coast Quota

The total North Coast quota will be limited to 12 million pounds in 1995. A revised schedule of openings and quotas has been established in consultation with fishers and industry.

8.2. QUOTAS, OPEN TIMES AND SEASONAL CLOSURES

8.2.1. North Coast

In 1995, the red sea urchin harvest in North Coast Areas 1-10 will be limited to 12 million lb, apportioned between a number of management areas (see the table on page 8). A schedule of openings has been established to disperse the fishery throughout most of the year in order to meet market demands. All weights referred to in the table below are those taken at the first point of landing. Fishers and processors should ensure that scales are available at landing ports. Fishery managers will solicit the cooperation of industry participants in monitoring landings on a timely basis. Note that, as in the South Coast, adjustments may be made in the subsequent year for quota overages incurring in 1995. In order to ensure efficient use of patrol resources openings will be suspended if fishing is not initiated within a reasonable period from the opening date.

This plan has been fonnulated under the assumption that voluntary individual quotas will be retained for 1995 and that a charter patrolman, paid for by the urchin fishers, will be on the grounds for validation for the months of January to April and October to December, inclusive. Fishing multiple areas, as proposed in the plan below, is not possible without charter patrol for validation of catch on the grounds.

8.2.4.1. Moser Point (Area 24E): This study area has been created to study the effects of modification of minimum size limits and the effects of different harvesting strategies. The area is fished by permit to contol harvest strategies.

That portion of Subarea 24-8 in the vicinity of Moser Point on Vargas Is. described as: "inside of or northerly of a line from the most southwesterly Point of Echachis Is., thence northwesterly to Wilf RIc., thence northwesterly 312 degrees True for .45 nautical miles to an unnamed island in the La Croix Group designated on Chart 3649 as having a height of land of 20 feet, thence due north to the shore of Vargas Is.; thence following along the shore of Vargas Is. in a northeasterly direction to the unnamed point immediately south of the Yarksis Indian Reserve, thence southeasterly across Father Charles Channel to the northernmost point on Wickaninnish Is.; thence along the western shoreline of Wickaninnish Is. to the southernmost point; thence in a straight line to the northwestern point of Echachis Is.; thence southerly along the western shoreline of Echachis Is. to the point of commencement. 8.3.16. In Area 28:

8.3.16.1. Porteau Cove: That portion of Subarea 28-4, east of a line drawn from a white fishing boundary sign located on the south shore of Porteau Cove to a white fishing boundary sign located on the north shore of Porteau Cove. (park Closure)

8.3.16.2. Whytecliff park: That portion of Subarea 28-2 bounded by a line commencing from the most southerly point of Whytecliff Park; thence in a straight line to a point located 100 m east of the most southeasterly point of Whyte Is.; thence following the southern shoreline of Whyte Is. at a distance of 100 m to a point lying 100 m from the most southwesterly point of Whyte Is.; thence in a straight line to a point lying 100 m west of Whytecliff Point; thence following the shoreline at a distance of 100 m in a northerly direction to a point 100 m north of Lookout Point; thence following the shoreline at a distance of 100m in an easterly direction to a point 100 m perpendicular to the most northerly point of Whytecliff Park; thence to the most northerly point of Whytecliff Park on the mainland.

8.4. LICENSING

8.4.1. Licence category: All vessels used for diving must have a "Z-C" Red Urchin licence.

8.4.2. Species: The species licenced to be harvested is red sea urchins, Strongylocentrotus jranciscanus.

8.4.3. Gear: All diving and fishing operations must take place from a "Z-C" licenced vessel. Vessels used to hold or pack Red Urchins must be inspected and licenced.

8.4.4. Area Licences: Licence holders must select only one of the following two fishing locations listed below.

8.4.4.1. North Coast - Areas 1 to 10 and adjacent offshore areas. 8.4.4.2. South Coast - Areas 11 to 29 and adjacent offshore areas.

8.S. SIZE LIMITS

By regulation, the minimum size limit for red sea urchins is 100 mm for all Pacific Fishery Waters (see Fig. 11).

8.6. NOTIFICATION PROCEDURES PRIOR TO COMMENCEMENT AND ~ATIONOFAFffimNGTRIP

The vessel master shall notify D&D Pacific Consulting (1-800-775-5505) of the following information at least 24 hours prior to fishing: Vessel name and CFV; vessel masters' name; species to be fished; Subareas (as described in the Pacific Fishery Management Area Regulations) to be fished, and time and date that fishing will commence.

If he is unable to arrive at his declared fishing area within 24 hours of the stated time, or moves to a new Area or Subarea, he shall advise D&D Consulting (1-800-775-5505) of his failure to arrive in the Management Subarea or his move to a new Area or Subarea.

8.7. CATCH REPORTING

8.7.1. All catch must either be validated by D&D Pacific Consulting or hailed to D&D Pacific Consulting at 1-800-775-5505. If hailing, the vessel master is responsible for hailing that vessel's catch each Thursday for all days fished during the previous seven (7) days with the following information:

(a) Vessel master's name and CFV #. (b) Species fished (i.e. red sea urchins). (c) Number of days fished. (d) Subareas fished (as described in the Pacific Fisbery Management Area Regulations). (e) Amount caught (this can be by dock weight, or by cages with an average weight per cage).

8.8. CATCH AND FISHING DATA

8.8.1. Harvest Log Data

8.8.1.1. The vessel master must provide and maintain an accurate and true log of daily harvest operations in the logbook authorized for 1995 by the Department of Fisheries and Oceans. DFO authorized logbooks for 1995 are available from I. O. Thomas and Assoc., (604) 291-6340. This log must be accompanied by a chart record of locations fished.

8.8.1.2. The harvest log mllst he completed hy midnight of the day fished and kept aboard the licenced vessel when Red Sea Urchins are heing harvested or when Red Sea Urchins are on board. Logbooks must be produced for examination by a fishery officer or guardian.

8.8.1.3. The licence holder registered with the Commercial Licence Unit is responsible to ensure that the vessel master has completed and submitted a copy of the log data. DFO can only release log data to the registered licence holder, and only upon written request.

8.8.1.4. One copy of the harvest log and chart record must be forwarded each month to:

THE DEPARTMENT WISHES TO REMIND FISHERS THAT IT IS A CONDmON OF THEIR LICENCE THAT LOGS MUST BE TURNED IN AT THE END OF EACH MONTH FISHED. TO DELAY SUBMISSION OF LOGS BEYOND THAT PERIOD IS A VIOLATION OF A CONDmON OF LICENCE.

8.8.2. Fish Slip Requirements

It is a condition of this licence that an accurate written report shall be furnished on a fish slip of all shellfish caught under the authority of this licence. A report must be made even if the shellfish landed are used for bait, personal consumption,

or otherwise disposed. The written report shall be posted not later than seven (7) days after the offloading and sent to:

8.9. OTHER RESTRICTIONS AND GENERAL INFORMATION

8.9.1. Export Requirements: Prior to the export of red sea urchins to any other Province, Territory or Country from British Columbia, which have not gone through a federally registered processing plant, an oral report of the following information must be made by telephoning 666-0583 (DFO - Vancouver):

(a) Total weight of the red sea urchins to be exported. (b) Area of catch. (c) Export destination. (d) Location and expected time of export.

licence conditions regarding harvest logs and ilSh slips must be complied with, even for red sea urchins exported from British Columbia which have not gone through a federally registered processing plant.

8.9.2. All divers shall be in possession of a Workers' Compensation Board Seafood Harvesting Diving Certificate.

"I I', CONDITIONS OF 1995 RED SEA URCHIN LICENCE Pursuant to sUbsection 22(1) of the Fishery (General) Regulations, and for the proper management and control of the red sea urchin fishery, the following conditions are specified for this 1995 commercial fishing licence: 1. Species of fish permitted to be taken: Red Sea Urchins.

2. Fishing gear permitted to be used: Diving gear. Handpicking by divers only. suction devices are not permitted to be used. 3. Information that the master of the vessel shall report to the Department of Fisheries and Oceans: (1) Before and After a Fishing Trip: The vessel master shall notify D&D Pacific Consulting (1- 800-775-5505) at least 24 hours prior to fishing and within 24 hours of terminating fishing in an area, of the following information: (a) vessel master's name, vessel name and CFV #; (b) species to be fished (i.e. red sea urchins); (c) Subareas fished (as described in the Pacific Fishery Management Area Regulations); and (d) time and date that fishing will begin or end.

(2) Non-arrival on Fishing Grounds: If the vessel is unable to arrive in the declared fishing area within 24 hours of the stated time, the vessel master shall so advise D&D Pacific Consulting (1-800-775- 5505).

(3) Moving to a New Fishing Area:

The vessel master shall notify D&D Pacific Consulting (1- 800-775-5505) 24 hours prior to moving to a new Area or Subarea.

(4) All catch must either be validated by D&D Pacific Consulting or hailed to D&D Pacific Consulting at 1-800- 775-5505. If hailing, the vessel master is responsible for hailing that vessel's catch each Thursday for all days fished during the previous seven days with the following information:

This log must be completed and submitted in both hard copy and electronic copy. Logbooks, meeting DFO requirements, are available from outside suppliers who, for a small fee, will provide both the logbook and the keypunch service, thus complying with the requirements for a hal:d and an electronic copy. This log must be accompanied by a chart record of locations fished. The hard copy of the log and the chart record must be forwarded each month to: Department of Fisheries and Oceans Shellfish Data Program Pacific Biological Station Hammond Bay Road Nanaimo BC V9R 5K6 Tel: 756-7022 or 756-7202 Fax: 756-7~38 As an alternative to the above, you may provide a log in the same form and providing the same particulars as shown in the fishing log sample attached hereto (see Appendix I). You must also provide an electronic copy, which must be an ASCII file and DOS compatible on a 3 ~/2 " or 5" disk. Disks will remain the property of the Department of Fisheries and Oceans. Both the hard copy and the electronic copy of the harvest log must be forwarded each month to the above address. (b) The information shall be recorded in the harvest log no later than midnight for each day fished and the logbook kept aboard the licenced vessel when sea urchins are being harvested or when sea urchins are on board. Logbooks must be produced for examination on demand of a fishery officer or fishery guardian.
