Article I NAME AND CONCEPT NAME The name of this organization is WUNH-FM.

CONCEPT

WUNH-FM is a service organization, providing the University and surrounding communities with non-commercial, alternative . We strive for diversity in programming, playing artists and entire genres of music underrepresented in mainstream media. We maintain a high level of professionalism in our broadcasts, and are committed to providing the most up-to- date university information, news, and sports to the community. We provide the opportunity for interested members of the community to participate in all aspects of radio station operation through on-the-job training.

Article II MEMBERSHIP

Section 1. Membership in radio station WUNH is open to all individuals with preference to full-time, undergraduate students enrolled at the University of who have participated in the activities of WUNH and have completed all the requirements of the on-air training program. WUNH membership of non full-time UNH undergraduate students must not exceed 25% of total WUNH membership. All members of WUNH must have two signed copies of the Signed Membership Agreement, one each with the General Manager, and with UNH Police Chief.

Section 2. Membership may be granted by a 2/3 Executive Board vote.

Section 3. Only members and Executive Board members are entitled to vote at WUNH general meetings. Non-members may participate in the activities of the radio station. S.A.F. paying members are to be given priority over non-S.A.F. paying members except in general elections. All members may hold office.

Section 4. Non-S.A.F. paying individuals are eligible for elected positions but they must be elected in accordance with Student Senate guidelines. These prohibit reimbursement of non- students in S.A.F. funded organizations. Exceptions may be granted by the Student Senate in cases where the need is justified.

Section 5. Non-Executive Board members who do not fulfill their responsibilities may be removed from membership by a 2/3 consenting vote of Executive Board members. Executive Board members may be removed from office by a 2/3 consenting vote of the Board of Governors.

Section 6. To be eligible as an on-air operator an individual must pass the Engineering Clearance test. An operator is anyone signed on to the log as an operator or operating transmitting equipment for a remote broadcast. Any person not cleared by the Engineering Department can neither sign as an operator nor operate any piece of equipment in the on-air signal chain, which shall consist of all audio, audio processing, transmitting, receiving and control equipment but specifically set aside at that time for productions or rehearsal. News and Sports reporters are required to pass the engineering clearance test and be at the level of board op. Former station members wishing to do a show or shows will be required to notify the Engineering Department before going on-air and abide by all current operating policies.

Section 7. Whatever month an operator is initially cleared, s/he will be required to re-pass the Engineering Clearance Test each year prior to the end of that month. Any information needed to pass the Clearance Test will be provided by the Engineering Department but the department will not be required to notify operators individually of their up-coming annual re- clearance. A list of the people who need to be re-cleared will be posted at the beginning of each semester. Members due for re-clearance must make an appointment to take the test prior to the end of the month of their annual re-clearance. Failure to comply with these policies will result in the revocation of operating privileges at WUNH.

The Engineering Department reserves the right to change the Clearance Test to reflect changes in policies and physical plant of the station, but the Test will always be available upon request.

Article III DEFINITION OF NON-MEMBER STATUS

Section 1. Non member Definitions: 1. Trainee: A trainee at WUNH is any person currently enrolled in the WUNH On-Air Training Program as outlined by the Chief Announcer. 2. Staff: A staff member at WUNH is any person involved with the radio station who has not completed the WUNH On-Air Training Program.

Section 2. Although not eligible to vote at General Meetings, both Trainees and Staffers are responsible for attending said meetings.

Article IV. EXECUTIVE AND GOVERNING BOARDS

Section 1. The Executive Board of WUNH-FM a. The Executive Board consists of the General Manager (chairperson), Program Director, Chief Announcer, Business Manager, Technical Director, Music Director, Promotions Director, and News Director. All other officers are required to be at meetings, but are not permitted to vote. b. The Executive Board is responsible for the efficient operation and control of the radio station and all related activities. c. The Executive Board has authority over all the WUNH members, and if it deems such action necessary, may remove any non-executive officer from his/her position by a 2/3 majority vote. d. The Executive Board members, with the exception of the General Manager are elected for one calendar year by a meeting of the general membership. e. Executive Board members must attend Executive Board meetings and any other meetings scheduled by the General Manager not to exceed one per week. Absence from one of these meetings must be preceded by a written notice. f. All Executive Board meetings will be run by Roberts Rules which may be waived at the General Managers discretion.

Section 2. The Board of Governors a. The Board of Governors consists of all members of the Executive Board of WUNH and the Chief Engineer of WUNH-FM; plus the following who are elected by the Executive Board and the Board of Governors when necessary: - a representative from the Theater or Communication Department, - a representative from the Electrical Engineering Department, - a representative from the faculty community, - a representative from the University System, and - two Members-at-large selected from the community. One of these elected representatives must also be elected a Faculty Advisor by the Executive Board. b. The Board of Governors is the direct representative of the Board of Trustees of the University System of New Hampshire and is responsible for advising WUNH on matters of policy and general operation to the satisfaction of the requirements of the FCC and the Board of Trustees, who holds the license of WUNH. c. The Board of Governors supervises the finances of WUNH by approving the annual budget proposed by the Executive Board and reviewing the administration of the budget throughout the year. d. The Board of Governors has authority over individual officers, and for specified cause, may remove any officer from his/her position by a 2/3 majority vote. e. The General Manager shall convene a Board of Governors' Meeting: 1. at least once each semester; 2. at the request of any Board of Governor member; 3. to act as an appeal board for any Executive Board decision; 4. for budget approval before WUNH goes to SAFC for annual budgetary proceedings.

ARTICLE V. OFFICERS

Section 1. Definitions of Positions a. The responsibilities of all officers are described in the appendix to the Constitution of WUNH-FM; these responsibilities may be amended at any time by the Executive Board. b. Through modification of the appendix to the Constitution, additional personnel positions may be added as deemed necessary by the Executive Board. The Executive Board may also eliminate any position that it no longer deems necessary. c. Officers will be compensated according to the current budget of WUNH-FM. Changes can be made by an Executive Board decision. The General Manager may withhold compensation of any officer pending executive action to take place within 72 hours.

Section 2. Filling Positions: a. A recommendation to the Board of Governors for the position of General Manager of WUNH is made by a majority vote of the general membership. The Board of Governors approves the candidate by a majority vote at the February meeting. b. All other officers of WUNH are elected by the general membership during the February meeting. Letters of intent may be submitted to the General Manager or made from the floor at the General Meetings. Assistants are appointed by their respective department heads.

Section 3. Terms of Office: a. During the period of February 1 to May 1 the General Manager elect , the Business Manager elect , the Program Director elect, and the Music Director elect will undergo a period of training and serve assistants until May 1 at which time they will assume full office and serve for a one year period. b. All other officers will take office for terms of one year beginning on May 1.

Section 4. Vacancies: a. In the event of a vacancy in a position of General Manager, the Executive Board convenes within 72 hours to choose a replacement to serve until the next meeting of the Board of Governors. The Board of Governors meets within 30 days of the Executive Board's meeting to select a General Manager who will serve out the remainder of the term. b. A vacancy in any elected office is filled by appointment of the Executive Board to serve until the next General Meeting, which will be held within 30 days after the departure of the officer, at which time a replacement is elected to serve the remainder of the term.

ARTICLE VI. MEETING PROCEDURES

Section 1. A quorum for any Executive Board meeting or Board of Governors meeting exists when 2/3 or more of the current members of the respective Board are present, and attempts have been made to inform all members of the meeting. A quorum at General Meetings exists when 1/3 or more of the membership of WUNH are present, and notice of the meeting has been posted for at least two full weeks prior to the meeting date.

Section 2. All decisions of the Executive Board, Board of Governors, or General Membership are made of those present, except where otherwise specified in the Constitution.

Section 3. Attendance at General Meetings is mandatory for all members and staff except when excused by the General Manager. Failure to provide the General Manager with an excuse prior to the meeting will result in a penalty at the discretion of the executive board by a 2/3 vote. Penalties include, but are not limited to: loss of show, on-air privileges, and/or station privileges

Section 4. General Meetings may be held once each month during the regular UNH school year and as designated by the Executive Board. Special additional meetings may be called by the General Manager. The General Manager must call for a General Meeting when called upon to do so by a petition signed by at least ten percent of the membership. Further, the issue defined by the petition must be on the agenda of the said meeting.

Section 5. The General Manager will assure that the responsibility of taking notes at all meetings is fulfilled. Section 6. Meetings will be conducted in accordance with Robert's Rules of Order which may be waived at the General Manager's discretion.

ARTICLE VII. AMENDMENTS

Amendments to this Constitution may be made at any meeting of the general membership by a two-thirds vote of those present, provided that the proposed amendment has been approved by the Board of Governors and is submitted to the general membership for consideration at least two weeks prior to the meeting.

APPENDIX TO THE CONSTITUTION OF WUNH-FM

Section 1 OFFICER RESPONSIBILITIES

A. GENERAL MANAGER 1. Acts as chief executive officer of WUNH and is responsible for its overall administration and operation. 2. Is responsible for any business concerning the University administration, FCC and the Board of Trustees. 3. Supervises, together with the Business Manager, all financial dealings of the radio station. Has authority over all expenditures. 4. Is the official representative of the radio station at the University and non-University functions. 5. Has authority over all departments of the station. Acts as voting chairperson of the Executive and Governing Boards. Is responsible for scheduling weekly Officer meetings and Executive Board meetings. 6. Responsible for the annual budget and financial audits of the station together with the business manager. 7. Responsible for, with the News Director, the editorial stand of the station. 8. Calls General Meetings in accordance with Constitutional procedures. 9. Is responsible for the administration of Federal Communications Commission rules and regulations including Public files and license renewals unless otherwise specified. 10. Responsible for maintaining the speaker level of the hall speakers, in the MUB hallway, outside the lobby door of WUNH. This level must adhere to the MUB Policy G.1.

B. BUSINESS MANAGER 1. Responsible for the processing of all invoices and debts acquired by the radio station through the S.A.F.O. business office. 2. Responsible for the processing and depositing of all revenue to WUNH's accounts. 3. Together with the General Manager is responsible for the approval of all purchase contracts for services and related expense items, including travel expenses and other expenditure cases. 4. Keeps accurate and up-to-date records of WUNH income and expenses as well as assures their agreement with S.A.F.O. books. 5. Along with General Manager, is responsible for the fiscal responsibility of the radio station during audits and budget transfers. 6. Must attend all meetings of SAFC as WUNH's voting representative unless an alternate is appointed by the General Manager at the request of the Business Manager. 7. Assures WUNH's compliance with SAFC and Student Senate guidelines. 8. Maintains station business supplies.

C. PROGRAM DIRECTOR 1. Has authority over the complete on-air sound relative to production quality, news presentation and the general execution of studio and remote broadcasts. 2. Is responsible, with the News Director, for the news presentation and the public affairs programming. Also supervises the activities to the Music Director, Chief Announcer, Production Manager, and Sports Director. 3. Is responsible for the scheduling of programs and announcers for programs each semester as well as program content including musical formats. 4. Sees that the FCC required logs (program, transmitter, discrepancy reports and cross references) are maintained and stored properly. 5. Responsible for obtaining all programming materials necessary from outside sources. 6. Has final approval of audition tapes for all program announcers. 7. Administers the programming budget with the approval of the General Manager and the Business Manager. 8. Will assist the General Manager in the administration of the FCC rules and regulations including ascertainment surveys, EBS tests and any on-air notification requirements. Will assure that all programming is in compliance with FCC standards and regulations. 9. Is responsible for the overall organization and administration of the annual fund-raising marathon.

D. CHIEF ANNOUNCER 1. Supervises the Training Program under written guidelines posted at the beginning of each semester and is responsible for trainee activity in the station. 2. Has authority over the approval of audition tapes of prospective announcers. 3. Is responsible for the scheduling of replacement announcers for air-shifts. 4. Makes air-checks and recommendations to Program Director Relative to announcers' performance. 5. Is responsible for keeping accurate files of current on-air membership and trainees regarding programming clearances, etc..

E. MUSIC DIRECTOR 1. Is responsible for the procurement of records and maintaining relations/record service with record companies and their distributors. 2. Composes and distributes the station playlist. 3. Is responsible for the maintenance of album files; handles and administers new records as they arrive. 4. Administers the Music Department budget with the approval of the GM and BM. F. PRODUCTION MANAGER 1. Responsible for the quality production of all promotional announcements and taped programs aired on WUNH. 2. Responsible for scheduling studios and production facilities to ensure the most effective use of available studio time in accordance with studio priorities: a. Repairs on equipment b. On-air broadcasting (including remote set-ups) c. Station production d. Trainee tapes e. Personal production (non-broadcast) f. Sudden impulses 3. Supervises and administers all recording done by WUNH. Also supervises and delegates individual production responsibilities including script assignment, production supplies and submissions to the Program Director. 4. Administers the Production budget with the approval of the GM and BM.

G. TECHNICAL DIRECTOR 1. Responsible for coordination of engineering functions in all areas including technical planning and maintenance of studio, transmitter and related equipment in conjunction with the Chief Operator. 2. Reports any discrepancies relative to technical FCC standards to the Chief Operator. 3. Supervises and assists the student engineering staff in assuring proper studio operation. 4. Assures efficient scheduling and supervision of equipment including sign-out lists. 5. Administers engineering budget with the approval of the GM and BM. 6. Can suspend operating privileges of any member not complying with Article II, Section 5 of the WUNH Constitution.

H. NEWS DIRECTOR 1. Responsible for the overall quality of news broadcasts on WUNH, for the scheduling and training of news announcers and, in conjunction with the Sports Director, the scheduling of Sports announcers. 2. Maintains an inventory of news department equipment and supplies. 3. Responsible for maintaining Teletype service, supplies and maintenance. 4. Administer the news budget, with the approval of the GM and BM.

I. SPORTS DIRECTOR 1. Responsible, along with the Program Director and the GM for determining which University sports events should be covered live and actual coverage of the agreed upon games. 2. Schedules personnel to announce live games, and to write and read sports for local newscasts, subject to the approval of the News and Program Directors. 3. Responsible for any stories or scores for University sports, including follow up stories covered by UNH. 4. Regarding sports broadcasts, acts as liaisons between WUNH and University officials, telephone companies and lodging facilities to assure professional, quality broadcasting. 5. Administers the Sports budget with the approval of the GM and BM. J. PROMOTIONS DIRECTOR 1. Responsible for the placement of ads promoting the stations activities in area newspapers and places of business. 2. Responsible for the sale of non-broadcast advertising, program funding and promotions (advertising space for Program Guide, etc..) and for the Program Guide itself. 3. Obtains promotional material with the Executive Board's approval. 4. In addition: a. Is responsible to the General Manager. b. Must be familiar with FCC rules pertaining to underwriting. c. Responsible for acquiring underwriting financing. d. Responsible for promotions in our listening area, increasing station visibility. e Must understand the operations and philosophy of the station. f. Responsible with the Business Manager for billing and procuring funds. g. Maintains records and reports to the Executive Board. h. Is compensated 10% of all income generated by his/her sales, upon collection.

K. PUBLIC RELATIONS DIRECTOR 1. Responsible for attending weekly student programming council meetings. 2. Responsible for attempting to put WUNH related information in the student newspaper on a bi-weekly basis. 3. In addition, a. Must organize WUNH showing at the following events: i: student activity fair ii: freshman orientation iii: memorial union building spring festival iv: fall registration b. Must conduct dormitory visitations.

L. MARATHON CORDINATOR 1. Responsible for setting date of marathon 2. Responsible with Public Relations Director for effectively promoting marathon. 3. Coordinating with DJ’s to ensure all premiums are ready and paid for. 4. Responsible for coordinating all marathon efforts during the chosen week, including: Making sure additional phone lines are installed, arranging tables and chairs for lobby, finding people to answer phones, etc. 5. Responsible for coordinating: group sessions to mail out premiums, mailing of reminders, 6. Responsible, along with Business Manager and General Manager, for administration of Marathon budget.

M. EVENTS CORDINATOR 1. Responsible for coordinating all events, concerts, etc. 2. Administers Events budget along with Business Manager and General Manager.

Section II. DESCRIPTION OF ASSISTANTS' RESPONSIBILITIES

A. ASSISTANT PROGRAM DIRECTOR 1. Serves as PD elect in training from January 1 to May 1. 2. Assists the Program Director as requested. B. ASSISTANT MUSIC DIRECTOR 1. Assists the MD in compiling playlists 2. Assists the MD with record responsibilities. 3. Assists the MD with record procurement, replacements and company relations.

C. ASSISTANT TECHNICAL DIRECTOR 1. Assists the Technical Director as requested. 2. Maintains inventory of all equipment related to broadcast use; orders spare parts as needed, with the approval of the BM.

D. ASSISTANT NEWS DIRECTOR 1. Supervises news reporters and editors, responsible for the quality of news copy and production. 2. Responsible for assigning reporters to cover stories of off-campus or local interest.

E. ASSISTANT GENERAL MANAGER 1. Serves as GM elect in training from January 1 to May 1. 2. Assists the General Manager as requested.

F. ASSISTANT BUSINESS MANAGER 1. Serves as BM elect in training from January 1 to May 1. 2. Assists the BM as requested.

Section III. PAID STAFF RESPONSIBILITIES

A. CHIEF OPERATOR 1. Is responsible for the overall maintenance, repair, and planning of the radio station's facilities. 2. Assures compliance with all FCC rules and regulations including weekly remote meter calibrations. 3. Supervises the Engineering staff and instructs them in proper technical procedures. 4. Is hired and retained by the Executive Board and must be reaffirmed each year by the new Executive Board.

B. PROFESSIONAL ENGINEER 1. Regularly clean and maintain studio equipment including styli and audio levels for proper operation of the audio chain. 2. Instruct station members and student engineers in the proper care and use of equipment. 3. Helps coordinate outside productions including remotes. 4. Assists the Chief Operator in doing required proofs of performance. 5. Perform Chief Operator's duties in his/her absence.

C. SECRETARY 1. Receives and types schedules and announcements with the Program Director's approval. 2. Maintains station files and business supplies in conjunction with the BM. 3. Types, compiles, files, and mails all WUNH correspondence. 4. In general, assures the smooth flow of information within the station and from the station to outside sources. 5. Is responsible for keeping minutes of all General Meetings and Board of Governor's meetings. 6. Is hired by and is directly responsible to the General Manager, who has authority to designate all duties of the secretary.

Section IV. OFFICER RESPONSIBILITIES 1. In addition to outlined position requirements, all current officers of WUNH-FM are required to attend Officer's Meetings as scheduled. 2. In official representation of WUNH all officers are expected to conduct themselves in manners deemed appropriate by the Executive Board. 3. All officers are required to post office hours within two weeks of the start of a given semester/summer period.

Section V. NON-PAID STAFF RESPONSIBILITIES 1. All non-paid staffers are immediately responsible to their department heads and ultimately responsible to the Executive Board. Non-paid staff is understood to include but is not limited to volunteers in news, sports and engineering departments.

Section VI. DEFINITION OF CLEARANCE LEVELS 1. Drive Time: This allows a member to have a show between 6:00 am and 9:00 am, and 3:00 pm and 6:00 pm weekdays in addition to all other times. 2. Non-Drive time: Every time that is not drive time (6am to 9am and 3pm to 6pm). 3. 10-2: 10:00 pm to 2:00 am anyday. 4. 2-6: 2:00 am to 6:00 am anyday. 5. Specialty: Clearance must be granted by Chief Announcer and/or Program Director. 6. Board op: This position is entry level and is required for all other members who are not a DJ. The Board op is allowed to operate the board but is not allowed to talk unless as a guest on another persons’ show who is cleared. Board op status may be obtained by simply competing the engineering test, or displaying equivalent ability to the engineering staff. News, and Sports reporters are required to be at this level. 7. Not cleared: This person has not completed any form of on-air training and is not permitted to operate any equipment in the WUNH-FM facility, including remote broadcasts. 8. When a fill schedule is up, you can do a show that is up one clearance level. 9. Board ops may not talk on air unsupervised. News and sports people must have board op abilities.

Section VII. BY-LAWS

A. ALCOHOL/DRUG POLICY 1. Alcoholic beverages/illegal substances are not to be present in any of the WUNH facilities (UNH policy). 2. An illegal substance is understood as defined in the University of New Hampshire Rights, Rules, and Responsibilities. 3. If a member is found violating this regulation, his/her membership and operating privileges will automatically be terminated as outlined in subpart D. ON-AIR POLICIES AND STATION ETIQUETTE. 4. Announcers and Engineers under the influence of such substances as to be incapable of fulfilling their on-air responsibilities will also face disciplinary action as outlined in subpart D. ON-AIR POLICIES AND STATION ETIQUETTE.

B. GUEST POLICY 1. The DJ who is signed on the log is allowed to have two guest present with them on air at any time unless told different by exec. Both guests are required to be signed into the Guest Sign-In Sheet found in the Program Log. 2. At all times, DJ's are required to have advanced written permission for any other guests over their two allowed.

C. FCC PROCEEDURE 1. All DJ’s are responsible for knowing all applicable FCC laws and policies pertaining to non-commercial educational FM broadcasts as outlined in CFR 47 and other pertaining documents.

D. ALCOHOL/DRUG POLICY Volunteer and student members and their guests are governed at all times by existing UNH policy concerning alcohol and illegal substances (outlined in the University of New Hampshire Rights, Rules, and Responsibilities).

B. ON-AIR POLICIES AND STATION ETIQUETTE 1. Instant suspension/permanent expulsion. A member of the radio station will be instantly suspended/permanently expelled at the executive board’s discretion by 2/3 executive board vote for one or more of the following: a. Speaking an obscenity (as defined by the FCC manual) over the air, regardless of time and intent. b. Violating the alcohol and drug policy as described in subpart A. c. Violating UNH sexual harassment policy while representing the station. d. Defacing station, whether physically, or morally while on the air in accordance with CFR 73.1920, UNH policies and rules, and the WUNH-FM membership agreement. e. Stealing or removing any WUNH-FM asset without prior written/oral approval from the General Manager. A member of the Technical Department has the ability to sign out equipment that has previously been designated as equipment for loan. f. Stealing or removing personal property without approval of owning party.

2. Three Strike policy: A show/DJ may receive a strike for one or more of the following. Strikes remain on the books for one calendar year, with a one strike reduction at the end of each year. All infractions not covered by policy 1 fall under this category. a. Consequences i. First infraction (minor): WARNING* ii. Meeting with GM and PD iii. Second infraction (minor): SUSPENSION (for 2 months)*. vi. Third infraction (minor): EXPULSION (permanent)* * Must pass Exec board by a 2/3 vote. This means that if the action is not deemed an infraction by the exec board vote, no strike is issued. b. Examples of infractions under this policy: i. Playing an obscenity (off a record, CD, etc.) ii. Exceeding the guest limit without permission iii. Incorrect procedure regarding underwriting (i.e. saying prices, pitching products) iv. Missing a show without following missed show policy.

3. All Djs are bound by the Disciplinary Agreement, to be signed upon official membership to the station.

Section VIII. SPEAKERS 1. The speakers in the hallway of the MUB, outside the lobby door of WUNH must adhere to the rules of the MUB Policy section G.1

The following actions will result in one strike. Three accumulated strikes within a calendar year will result in a suspension with the length to be determined by the executive board. Four accumulated strikes within a calendar year will result in a 2 month suspension, with clearance dropped to 2-6pm at the return of the suspension. playing an obscenity (off of a cd or record) Exceeding the guest limit as described in WUNH consitition section VII subpart B without permission Incorrect procedure regarding underwriting. (advertising products on air, saying inappropriate things over the air other than obcsenities) Missing a show without following the missed show policy Missing a general meeting without being excused.

Strike removal: One strike is removed at the end of each calendar year.

2) One strike can be removed for every 4 hours filled

After returning from a 2 month suspension, the DJ will be carefully monitored and any additional strikes accumulated before the end of the calendar year may result in further suspension/expulsion at the executive board’s discretion.
