MINUTES of the THREE-HUNDRED-EIGHTY-FIFTH MEETING of the LEGISLATIVE COUNCIL August 19, 2019 Santa Fe

The three-hundred-eighty-fifth meeting of the Legislative Council was called to order on Monday, August 19, 2019, at 1:40 p.m. in Room 307 of the State Capitol by Senator , Co-Chair.

Approval of Minutes On a motion made, seconded and passed, the minutes of the June 24, 2019 meeting were approved as submitted.

Requests for Use of Chambers Mr. Burciaga said that the New Mexico Speech and Debate Association requested use of State Capitol chambers. He also noted that a request for use of the chambers by the National Hispanic Caucus of State Legislators was approved by the council at its June 24, 2019 meeting.

On a motion made, seconded and passed, the council authorized use of the chambers by the New Mexico Speech and Debate Association.

Interim Committee Requests Mr. Burciaga relayed the following requests on behalf of interim committees:

C one additional meeting day for the Investments and Pensions Oversight Committee, in part to review the recommendations of the Public Employees Retirement Association Solvency Task Force convened by Governor Michelle Lujan Grisham; and C two additional meeting days for the Courts, Corrections and Justice Committee to discuss recommendations made during the governor's New Mexico Domestic Terrorism Summit.

On a motion made, seconded and passed, the council authorized both requests for additional meeting days.

Legislative Council Policies Senator Papen noted that proposed changes to Legislative Council policies had been mailed to all members of the council. Mr. Burciaga explained that work began several years ago on updating council policies to reflect changes made by the council and to clarify language in several areas. He also noted the following changes made to the document mailed to members:

C the number of administrative days allowed for the speaker of the house, senate president pro tempore, majority and minority floor leaders and majority and minority

- 2 - whips to perform tasks associated with their leadership positions was changed from a limited number of days allowed for each leadership position to days to be approved on an as-needed basis; C various session publications were added to the list of documents authorized to be mailed to all members; C language regarding approval of the use of the chambers was changed to better allow for retroactive authorization of requests; C language regarding availability of archived webcasts was clarified to note that such recordings would be available online for five years; and C language regarding reimbursement for attendance at Legislative Council meetings that may be authorized by the speaker and president pro tempore was expanded to include all advisory members of the council.

In response to a question, Mr. Burciaga explained that, as initially contemplated, only voting members of the Legislative Council were eligible for per diem and mileage reimbursement for attendance at council meetings, while all other members of the legislature were considered advisory members of the council. However, he noted, at some point, special advisory members of the council were created and authorized for per diem and mileage reimbursement.

In response to another question, Mr. Burciaga clarified confidentiality and its limited exceptions as it applies to requests made to LCS staff.

On a motion made, seconded and passed, the proposed changes to the policies of the Legislative Council, including the suggested changes noted above, were approved.

Mr. Burciaga introduced several new LCS staff members as follows:

C Eunice Moya, human resources specialist; C Tom Kricka, staff attorney; C Sabina Gaynor, bill drafter; C Joanne Vandestreek, senior librarian; C Tabitha Enriquez, intern; and C Shannon Rodriguez, intern.

Executive Session On a motion made, seconded and passed, the council resolved itself into executive session.

- 3 - Appointments Upon returning from executive session, the council named the following appointments:

C Senator Padilla was appointed to the Fostering Connections Advisory Committee; and C Benny Hodges was appointed by Representative Townsend to serve on the Insurance Nominating Committee.

Staff Reports Mr. Burciaga noted that a memorandum of understanding has been signed with the City of Santa Fe regarding use of the State Capitol Parking Facility. He said that the City of Santa Fe reviewed the memorandum of agreement and approved it, and the Risk Management Division of the General Services Department reviewed the City of Santa Fe's certificate of insurance and determined that it was appropriate. Mr. Burciaga said that the City of Santa Fe has agreed to share in a percentage of the profit realized from operation of the facility.

Mr. Burciaga also noted that programming of key cards for staff and legislator member access to appropriate doors throughout the State Capitol complex is under way.
