ECOLOGICAL SURVEY OF LAND OFF CLOTHALL ROAD AND LAND SOUTH OF CLOTHALL COMMON, BALDOCK, HERTFORDS HIRE

1 INTRODUCTION 1.1 ESL(EcologicalServices)LtdhasbeencommissionedbyVincentandGorbingonbehalfof Hertfordshire County Council to carry out an ecological survey of land off Clothall Road, Baldock,Hertfordshire.ThesiteisoneofanumberintheBaldockareaownedbytheCounty Council and will be promoted for residential development as part of the emerging Local DevelopmentFramework.Reportsonthesurveysofthreeothersitesinthevicinityaregiven inESL2008ac. 1.2 Thisreportdescribesthemethodsusedandprovidesthefindingsofthesurveytogetherwith recommendations for further work where appropriate. English names of higher plants are usedthroughoutthetextwithafullspecieslistincludingscientificnamesaccordingtoStace (1997)giveninAppendix1.HabitatmapsaregivenasFigures1a,1band1cwithpotential ecological constraints shown as Figures 2a, 2b and 2c. Photographs are included where appropriateinthetext. 1.3 Prior to the site visit a risk assessment was undertaken by the Project Manager using all availableinformationonthesite,indicatingworkingmethodsbelievedtobenecessaryforsite safety.Thisriskassessmentwasupdatedbythefieldworkersonarrivalatthesiteandbefore commencingthesurvey. 2 SURVEY METHODS 2.1 DATA SEARCH

2.1.1 TheNaturalwebsitewasconsultedforthelocationsofinternationallyprotectedsites within5kmofthesiteandforlocationsofSitesofSpecialScientificInterest(SSSIs),National NatureReserves(NNRs)andLocalNatureReserves(LNRs)withina2kmradiusofthesite. Thesitewasaccessedon30April2008. 2.1.2 The Hertfordshire Biological Records Centre (HBRC) was asked to provide records of protected,BiodiversityActionPlan(BAP)andotherimportantspeciesforHertfordshirewithin a2kmradiusofcentralgridreferenceTL251338,whichisapproximatelythecentreofthe sitessurveyed.Theywerealsoaskedtoprovideinformationonnonstatutorysiteswithinthe samearea.TheNBNgatewaywasconsultedforanyadditionalrecordsofprotectedspecies withintheareaofsearch.Thiswebsitewasaccessedon30April2008. 1 ESL (Ecological Services) Ltd, 1 Otago House, Allenby Business Village, Crofton Road, Lincoln, LN3 4NL Ecological Survey of land off Clothall Road and land South of Clothall Common, Baldock, Hertfordshire Vincent & Gorbing

2.1.3 TheUKandHertfordshireBAPwebsiteswereconsultedtoidentifythespeciesandhabitats includedintheseplans.Thesesiteswereaccessedon30April2008.

2.2 FIELD SURVEY

2.2.1 Awalkoverofthesitewascarriedouton28April2008bytwoexperiencedecologistsandthe followingsurveyswerecompleted. Habitats, Plant Communities and Plant Species

2.2.2 All habitats and plant communities on the site were mapped and characterised. All hedgerows were assessed against the criteria for importance set out in the Hedgerow Regulations(1997).Noteswerealsomadeonlandadjacenttothesite. Amphibians and Reptiles

2.2.3 Duringthewalkoverasearchwasmadeforanywaterbodiesonthesiteandadjacentland. Allhabitatswereassessedfortheirpotentialforusebyreptiles,lookingparticularlyformore openvegetationthatwouldprovidesuitableareasforbasking,closetoareasofmoredense vegetationwhichwouldprovideprotectionfrompredators.Directobservationwascarriedout inthese areas; this involveswalkingslowly andquietly throughsuch habitats watchingand listeningforanimals(HGBI,1998). 2.2.4 Allbricks,largestones,woodenboardsandothersuitablerefugeswereliftedwherepossible tocheckforthepresenceofamphibiansorreptilesshelteringunderneath.Eachrefugewas carefullyreplacedafterinspectionusingtheoriginalfootprint. Mammals

2.2.5 Anassessmentwasmadeoftreesonandadjacenttothesitefortheirpotentialtosupport roosting bats. Suitable features include disused woodpecker holes, rot holes, cracks and splitsintrunksandlimbs,delaminatingbarkandivycladding.Buildingsonthesitewerealso assessedfortheirsuitability. 2.2.6 All ditches adjacent to the site were assessed for their suitability for water voles. Ideal waterbodies for this species have permanent still or very slow flowing water with steep, densely vegetated banks suitable for burrowing. Heavily shaded waterways or those with sparsevegetationarelessfavoured(StrachanandMoorhouse,2006).

2.2.7 Asearchwasmadeforsignsofusebybadgers.Suchsignsincludesetts,latrinesanddung pits,pathways,footprints,hairsandfeedingsignssuchassnuffleholesandscratchedtrees. 2.2.8 Sightingsandsignsofothermammalspecieswerealsorecorded. Birds

2.2.9 All birds seen and heard on and immediately adjacent to the site were recorded. An assessment was made of the habitats on site for their potential to support breeding birds listedonSchedule1oftheWildlifeandCountrysideAct(1981andasamended).

3 RESULTS 3.1 DATA SEARCH

3.1.1 No Internationally protected sites were identified within 5km of the site boundary and no nationallyprotectedsiteswereidentifiedwithin2kmofthesiteboundary. 3.1.2 The HBRC provided details of one Local Nature Reserve, Ivel Springs, which is located approximately1.5kmnorthwestofthesite.ThissiteisalsoaCountyWildlifeSitewithrelic patchesofwatercressbeds,reedmarshanddampwoodland.Avarietyofimportantplants, amphibians,reptiles,birdsandmammalsincludingwatervoleareknowntobepresent. 3.1.3 Afurther11CountyWildlifeSiteshavebeenidentifiedwithin2kmofthesite,theclosestbeing WestonHillsandWallingtonRoadVergebyClothallCommon.WestonHillsabutsthesiteto thesouthwestandisancientchalkdownland.Atypicalchalkfloraispresentwithhawthorn scrub,adisusedchalkpitandmaturebeechplantation.Orchidshavebeenrecordedandthe siteis alsoimportantforboth invertebrates and vertebrates.WallingtonRoad Vergehas a diversechalkandarableweedflora,includingtallbroomrape,cowslipandpoppyspecies. 3.1.4 Protected species records provided by HBRC include grass snake, common lizard, slow worm, bats, water voles, badgers and a dormouse record. Two records of common lizard alongtheWallingtonRoadVergearetheclosesttothissite.Anumberofrecordshavealso beenprovidedforbatsandbadgers,locatedmainlytothesouthwestofthesite,buttheexact locations are not known due to the sensitivity of the information. The only record for a HertfordshireBAPspeciesisforcornflowerrecordedattheBaldockAllotmentsin1998. 3.1.5 Detailsofallsitesandrecordsdescribedabove,andtheNBNgatewayrecords,aregivenin ESL2008d.

3.2 HABITATS AND PLANT COMMUNITIES

3.2.1 Thesiteisdividedintothreesectionsandeachoftheseisdescribedseparatelybelow. Site 1A

3.2.2 ThissiteislocatedsouthwestofClothallRoadandhashorseandcattlegrazedpasturewith arablesetaside/leygrasslandandanumberofbuildings.Thenortheasternboundaryofthe site is marked by various buildings and a grownout hawthorndominated hedge. Other speciespresentincludeblackthorn,elderanddogrosewithgroundfloracomprisingivy,garlic mustard,commonnettleandbramble.BeyondthehedgeistheoldClothallRoad. 3.2.3 Thenorthwesternboundaryismarkedbyamixtureofbrickwallsandfencesborderingthe adjacenthousesandgardens.Barbedwirefencingispresentinsomeareaswithanarrow strip of ruderal vegetation, including common nettle, along the boundary line. The fencing continues along the irregular southwestern boundary, beyond which is a caravan park. Thereisapatchofscrubalongtheboundaryasitturnsabruptlynortheast,containingelder, cherrylaurel,hawthornandornamentalspecies,withivy,commonnettle,cleaversandgarlic mustard.Theboundaryeventuallybecomesagrownouthedgewithmaturetrees,including sycamore, and following two further bends the hedge, consisting of elder, ash, dogrose, hawthorn, elm, blackthorn and sycamore continues to the southeastern corner of the site, beyondwhichisafootpathandarableland.Afenceformsthesoutheasternboundary,atthe topoftheA505embankment.Beyondthefencetheembankmentslopesdowntotheroad.

present include daisy, creeping bent, common mouseear, Yorkshirefog and bulbous buttercup. Horsegrazed pasture is present immediately south of Cambrai Farm and the swardhereisparticularlyshort.A2mwidestripofroughgrasslanddividingthehorseand cattlegrazedfieldscomprisescommonnettle,falseoatgrass,cock’sfoot,creepingbent,cow parsleyandcommonragwortwithdogrosealsopresent. 3.2.5 Arablesetasideislocatedinthecentralandsoutheasternsectionsofthesite.Thecentral sectionisdominatedbycommoncouchandfalseoatgrasswithbarrenbrome,Yorkshirefog, perennial ryegrass, spear thistle, dandelion, common nettle, common ragwort, red fescue, hogweed,ivy,reddeadnettleandcommonmouseear.Theswardisfairlyuniformbutwitha grazedstripalongtheboundarywiththegrazedareas.Someareashaveafinerswardwith moreabundantredfescue.Towardsthenortheasternboundaryofthisareathereisafenced paddockofroughgrasslandwithcreepingbuttercup,whitedeadnettle,cowparsley,broad leaveddock,dandelion,redfescue,cock’sfoot,andpatchesofcommonnettleandcreeping thistle.Asmallcattlegrazedareaisalsopresentherewithaveryshortswardofperennial ryegrass,cowparsley,cock’sfootandcreepingthistle.

Photograph 2 Viewsouthoversetasideinsoutheasternpartofsite1A 3.2.6 Thesetasideinthesoutheasternpartofthesiteisverysimilartothecentralareabutwith moreruderalspeciesincludingcommonnettle,cow parsleyandcleavers(Photograph2)in parts.Activeanthillsarealsopresent.Anareaofnewlyplantedtreesinthesoutheastern cornerofthesiteincludesholly,beech,hazelandhawthornoveraverysparsegroundfloraof hogweed and moss. The ground slopes up towards the southeastern boundary and the sward appears to be finer with more red fescue, great lettuce, creeping thistle, cock’sfoot, dandelion,whiteclover,whitedeadnettle,commonmouseearandcommonnettle.

3.2.7 A number of buildings are present along the northeastern boundary. Cambrai Farm comprises the farm house with a number of other buildings including open barns used for storage,astableblockandpigsty.Thestableisofwoodenconstruction with timberwalls andaslatetiledroof.Thepigstyisconstructedofwoodensheetsandconcreteblockswitha singlepitchedroof. Amound nearthe pigsty is vegetated withspeciesincludingcommon nettle,cowparsley,cleavers,commonmallow,broadleaveddockandivyleavedspeedwell. The other buildings are located towards the eastern corner of the site and again comprise houseswithassociatedbarnandstableareas,similarintypetothoseatCambraiFarm. Site 1B

3.2.8 Thissiteis part ofan extensivearablefieldtothesouth ofClothall Common.Itisroughly triangular,withthenorthernboundaryformedbyWallingtonRoadandashortsectionofpost andrailfenceintheextremenortheast.Beyondtheroadarehousesandgardensandthe roughgrasslandofClothallCommon.Adryditchextendsnorthalongthewesternedgeofthe common. The south eastern boundary is marked by the carriageway of the A505. The boundaryinthesouthwestbetweenthissiteandSite1Cisunmarked.

Photograph 3 ViewsouthwestalongsoutheasternboundaryofSite1B 3.2.9 Alongside Wallington Road in the southwest is a narrow piece of closely mown amenity grassland with species including perennial ryegrass, daisy, annual meadowgrass, ribwort plantainanddandelion.Betweenthisandthearablefieldisanarrowstripofroughgrassland extendingthefulllengthofthenorthernboundarywithspeciesincludingperennialryegrass, cock’sfoot,commonnettle,whitedeadnettleandcowparsley. 3.2.10 TheembankmentslopingupfromtheA505hasbeenseededwithadiversewildflowermix. Species include kidney vetch, salad burnet, oxeye daisy, common bird’sfoot trefoil, lady’s

bedstraw,greaterknapweedandcommonfumitorywithgrassesincludingsweetvernalgrass, annualmeadowgrass,redfescue,cock’sfootandcreepingbent(Photograph3). Site 1C

3.2.11 ThissiteliesimmediatelysouthwestofSite1Bandmostofitispartofthesamearablefield, whichisdividednorthsouthbyapublicfootpath(Photograph4).Inthenorthwesternpartof the site are allotments, beyond which is Wallington Road. The roadside verge of amenity grasslandisstillpresenthere,withasmallareaofplantedsilverbirchtreesintheextreme westerncornerofthesite.ThesoutheasternboundaryisformedbytheA505aswithSite 1Bandtheroadsideembankmenthasthesamevegetation.Thesouthwesternboundaryis formedbythenewClothallRoad,beyondwhichisSite1A.Crashbarriersarepresentalong much of the length of this boundary. Recently planted shrubs along the field side of this boundarycomprisehawthorn,hazel,dogrose,blackthornandguelderrose.Thegroundflora includescock’sfoot,creepingbent,creepingandspearthistles,curleddock,commonnettle, commonragwort,groundsel,bristlyoxtongue,Canadianfleabane,Yorkshirefoganddaisy.A post and rail fence is present further northwest, with a barn in an area of hardstanding. Beyondthisisfurthermownvergeandrecentlyseededgrasslandalongthevergeadjacentto theallotments.

A soil bank with wasteland type vegetation of cleavers, dandelion, common mallow, black horehound and greater burdock is present in the southeast and a muckhillandstorageareaarepresenttothenortheast.

3.3 AMPHIBIANS AND REPTILES

3.3.1 Nopondsor wetditchesarepresent onthesiteandnone werefoundonadjacentlandso thereisnopotentialforamphibianstobreedonthesite. 3.3.2 Noreptileswereseenduringthesurvey.However,suitablehabitatispresentonthesitefor these species. The embankment along the A505 provides suitable habitat for reptiles and recordsofcommonlizardsareknownfromtheeasterncornerofSite1B.Site1Bisalsovery closetoClothallCommonwhich itselfprovidessuitablehabitatforthesespecies.Theset asidegrasslandonSite1Aiscurrentlyalsosuitableforreptilesbutsincethisislikelytobea relatively recent occurrence it is considered less likely that reptiles will have colonised this area.Therearehoweverrecordsofslowwormandcommonlizardsouthwestofthesite. 3.4 MAMMALS

3.4.1 Fourtreeswereidentifiedashavingpotentialtosupportroostingbats.Thelocationsofthese areshownonFigure2aandfurtherdetailsaregiveninTable1below. T4 TL2538833046 Matureashwithdenseivycoverandsome deadbranches. 3.4.2 In addition, some of the buildings at Cambrai Farm and at the other houses along the old ClothallRoadonSite1A,areconsideredtohavepotentialforroostingbats.Thehouseholder atCambraiFarmreportedbatstobeintheroofofthehouseandtohaveseenthemflying around the garden. The barn on the opposite side of Clothall Road on Site 1C is not consideredsuitableforroostingbats. 3.4.3 TheonlyditchpresentisthedryditchadjacenttoClothallCommonnearSite1Bbutthiswas dryatthetimeofsurveyandtherewasnoindicationthatiteverregularlyholdswater.There isthereforenosuitablehabitatforwatervoles. 3.4.4 Nosignsofbadgerswererecordedonthesites.Othermammalspeciesrecordedwererabbit andbrownhare,bothonSite1A.BrownhareisaUKBAPspeciesandisalsomentionedin thefarmlandhabitatactionplanoftheHertfordshireBAP.

3.5 BIRDS

3.5.1 Intotal,18birdspecieswererecordedonorimmediatelyadjacenttothethreesectionsofthe sites.Allofthesearecommonandwidespreadlocallyandnationally.TheUKBAPspecies skylarkandcommonstarling,bothofwhichhavesufferedarapidandsevere(>50%)decline inbreedingnumbersoverthelast25years,wererecordedinallthreesectionsofthesite. 3.5.2 Allofthehabitatsonsitehavethepotentialtosupportnestingbirds,includingBAPspecies. Some of the buildings on Site 1A also have potential for use by barn owls, a specially protectedspeciesundertheWildlifeandCountrysideAct1981(andasamended).

4 DISCUSSION AND RECOMMENDATIONS 4.1 All habitats and plant communities recorded on and adjacent to the site are common and widespreadinalocalandnationalcontext.Noneofthehedgessurveyedmeetthecriteriafor importance set out in the Hedgerow Regulations (1997). All plant species recorded are similarlycommonandwidespread. 4.2 From the results of the desk study and field survey, the presence of suitable habitat for reptilesandoftreesandbuildingswithpotentialtosupportroostingbatsandbreedingbirds will all need to be considered in any application to develop these sites. A summary of the statutoryprotectionforthesespeciesisgiveninAppendix2. 4.3 Bats are highly mobile creatures and can occupy a number of different roost sites and the smallestofnichesthatarenotalways possibletosurvey accurately. Shouldany worksbe proposed to the trees or buildings identified as having some potential for use by bats, it is recommendedthatamoredetailedinspectionbecarriedoutbyalicensedbatecologist.If thisidentifiessignsofuse,itmaybenecessarytocarryoutanemergencewatchonthetrees (EnglishNature,2004).Thisshouldbecarriedoutduringthesummermonthsforaperiodof upto2hoursaftersunset.Batfeedingtransectsusingelectronicdetectorsshouldalsobe carriedoutonthesevisits. 4.4 ItisrecommendedthattheroadembankmentalongthesoutheasternboundariesofSites1B and C be surveyed for the presence of reptiles as per HGBI Guidelines 1998. This would require a combination of direct observation techniques and the placing and inspection of artificial cover objects or tins. A minimum of seven survey visits are required to determine presence/absence, but a further 13 visits may be required to determine likely population estimates.TheoptimalsurveyperiodisbetweenmidMarchandearlyOctober,ideallyduring MaytoJune,orSeptemberwhentheairtemperatureislowbutthereissufficientsunlight.

4.5 In order to avoid damaging or destroying bird nests, site clearance should be undertaken outsidethebreedingseason,whichtypicallyrunsfromthebeginningofMarchtotheendof August.Ifthisisnotpossiblethenacheckmustbemadefornestsbyasuitablyexperienced individualpriortoanyclearanceworks.Anyneststhoughttobeactiveshouldbeidentified and protected until the eggs have hatched and young have fledged. RELEVANT LEGISLATION STATEMENTS 1 Reptiles

1.1 Allfourofthemorewidespreadspeciesofnativereptiles,thatiscommonlizard Lacerta vivipara ,grasssnake Natrix natrix,slowworm Anguis fragilis andadder Vipera berus ,are givenpartialprotectionundertheWildlifeandCountrysideAct(1981andasamended)which prohibitstheintentionalkilling,injuringortakingofanyofthesespecies.Thereisnoprovision intheActforlicensingworkswhichcouldgiverisetoanoffence,butitdoesprovidea defencewheretheotherwiseunlawfulactcanbeshowntobetheincidentalresultofalawful operationandcouldnotreasonablyhavebeenavoided.Permitteddevelopmentora developmentwhichhasreceivedplanningpermissionisclearlyalawfulactivitybutthelaw thusrequiresthatareasonableeffortbemadetoavoidkillingorinjuringprotectedanimalsin thecourseofimplementingthispermission.

1.2 ThehabitatsofrarereptilespeciesarealsoprotectedunderthisAct,butthoseofthecommon specieslistedabovearenot,andtheseanimalsarealsonotprotectedfromdisturbancewhilst occupyingtheirhabitat.

2 Bats 2.1 InEngland,ScotlandandWales,allspeciesofbatsarefullyprotectedundertheWildlifeand Countryside Act 1981 and as amended, including by the Countryside and Rights of Way (CRoW) Act 2000. They are also protected by European legislation, being included on Schedule 2 of the Conservation (Natural Habitats, &c.) Regulations 1994. Taken together, thislegislationmakesitillegal, inter alia to: • intentionallyorrecklesslykill,injureorcaptureabat • deliberatelydisturbabatwhenitisoccupyingaroost • damage,destroyorobstructaccesstoabatroost 2.2 Abatroostisdefinedasbeinganystructureorplacethatisusedforshelterorprotection,and since it may be in use only occasionally or at specific times of year, a roost retains such designationwhetherthebatsarepresentornot. 3 Birds 3.1 The Wildlife and Countryside Act (1981 and as amended) protects all wild birds and their nestsandeggs.UnderthisActitisanoffenceto:

However, certain rare breeding birds, listed on Schedule 1 of the Act (e.g. barn owls), are also protected against disturbancewhilstbuildinganestoronornearanestcontainingeggsoryoung.
