Call to The regular meeting of the Sussex County Council was held Order on Tuesday, June 8, 1976 at 10:00 A. M. with the following members present:

The meeting was opened with the repeating of the Lord's Prayer and the Pledge of Allegiance to the flag.

M 318 76 A Motion was made by Mr. Hill, seconded by Mr. Workman, to Minutes approve the minutes of the previous meeting as presented. Approved Motion Adopted by Voice Vote.

M 319 76 A Motion was made by Mr. Workman, seconded by Mr. Benson, Employment that Robert Lynch be employed as Custodian, replacing Joseph Hearn, at a salary of $5,628.00 per year, effective June 9, 1976. Motion Adopted; 4 Yea, 1 Absent.

M 321 76 A Motion was made by Mr. Benson, seconded by Mr. Cole, that Borrowing Mr. Carey, Finance Director, be authorized to borrow for of Monies water and sewer expenses $1,115,000.00 for a period of ap­ proximately six months, and this money be prepaid if funds are available prior to the due date. Tax Mr. Conaway, County Administrator, reported to the Council Collections that tax collections are $7,000.00 over the anticipated revenue.

Workshop The Council agreed that Mr. Conaway, County Administrator, Sessions on will speak in Pennsylvania at workshop sessions on Economit Economic Development on June 18, 1976 and June 28, 1976, and expenses Development will be paid by the State of Pennsylvania.

Beach Mr. Conaway, County Administrator, reported to the Council Passes that during the past week 585 beach passes were issued to re­ sidents and 24 to non-residents.

State Mr. Conaway, County Administrator, reported to the Council Parks that as it is not the state policy for bicyclists or pedes­ trians to be charged to go into the State Parks, steps are being taken to correct this misunderstanding.

Dumpsters The Council agreed that Mr. Conaway, County Administrator, should get costs on putting dumpsters in areas where there is a problem of trash being dumped outside of "Pitch-In" barrels in lieu of trash being taken to the landfills.

EOC The Council agreed that October 2, 1976 will be the Ground­ breaking for the new Emergency Operations Center, and that Mr. W. Ellingsworth should proceed with the preparing of the invitations.

Nanticoke Mr. Conaway, County Administrator, submitted to the Council River copies of a memo from Mr. McKee, Civil Engineer, regarding Dredging the schedule for the Nanticoke River Dredgirig Project.

S.C. Aging Mr. Conaway, County Administrator, submitted to the Council Advisory copies of the minutes of the Sussex County Aging Advisory Council Council meeting held on May 10, 1976.

Indian Mr. Conaway, County Administrator, submitted to the Council River copies of a letter from the Indian River Senior Center, Inc. Senior regarding the efforts of the Council to ke~p DAST going in Center special areas for the balance of this fiscal year.

Nanticoke Mr. Conaway, County Administrator, submitted to the Council River copies of a memo from Mr. McKee, Civil Engineer, regarding Dredging the bid proposals received by the Corps of Engineers for the Nanticoke River Dredging project.

R 016 76 Mr. Conaway, County Administrator, read the following proposed resolution:

SEEKING THE CONTINUATION OF THE MISPILLION RIVER DREDGING PROJECT AS AN ACTIVE PROJECT BY THE U. S. CORPS OF ENGINEERS, PHILADELPHIA DISTRICT

WHEREAS, the Mispillion River is a major commercial and recreational river in Sussex County; and

WHEREAS, the City of Milford is developing park land on the banks of the Mispillion that will lead to increased re­ creational use of this River; and

WHEREAS, commercial interests in the Milford area are developing a ship building industry along the banks of the Mispillion River; and

R 016 76 WHEREAS, local interests including the City of Milford Cont. are extremely interested in reactivating this project and following through with the necessary procedures to see the work accomplished; and

WHEREAS, the City of Milford is spending $200,000.00 a year to see that its sewage is not dumped into the Mispillion River thus increasing its potential for recreational develop­ ment; and

WHEREAS, the economic potential of the river has increased dramatically because of the advent of offshore drilling;

NOW, THEREFORE,

BE IT RESOLVED by the Sussex County Council that the dredging of the Mispillion River be continued as an active project by the U. S. Corps of Engineers, Philadelphia Dis­ trict; and

BE IT FURTHER RESOLVED that the Sussex County Council is prepared to develop the same type of program to accomplish the dredging of the Mispillion River that has proven success­ ful in the dredging of the Nanticoke River in Sussex; and

BE IT FURTHER RESOLVED by the Sussex County Council that a certified copy of this Resolution be sent to U. S. Senator William V. Roth, Jr.; U. s. Senator Joseph R. Eiden, Jr.; U. S. Representative Pierre S. du Pont IV, Delaware Senator Thurman Adams, Jr., Delaware Representative Lewis B. Harrington; and Milford Mayor Herman S. McNatt.

CONGRATULATING THE MILFORD HIGH SCHOOL TEAM, THE "1976 STATE HIGH SCHOOL SOFTBALL CHAMPIONS

WHEREAS, three Henlopen Conference Girls' Softball Teams were entered in the 1976 Delaware State High School Softball Championship; and

R 017 76 WHEREAS, the Milford High School Girls' Softball Team Cont. has won the 1976 State High School Championship in softball; and

WHEREAS, Dorcell Smith played an outstanding game as Short Stop and at the plate; and

WHEREAS, Shirley Washington was the winning for Milford; and

WHEREAS, Beverly Breeding has done an outstanding job as Coach of the Milford High School Softball Team,

NOW, THEREFORE,

BE IT RESOLVED by the Sussex County Council that con­ gratulations are in order for the Milford High School Soft­ ball Team, the 1976 State High School Softball Champions; and

BE IT FURTHER RESOLVED that a certified copy of this Resolution be sent to DanMcGinniss, Principal of Milford High School; Beverly Breeding, Coach of the Team; Dorcell Smith, team member; and Shirley Washington, team member.

M 325 76 A Motion was made by Mr. Hill, seconded by Mr. Workman, that Delmarva $2,574.00 be granted to the Delmarva Advisory Council and Advisory these funds are to be from Revenue Sharing funds. Motion Council Adopted; 5 Yea.

208 Program The Council agreed that the Coastal Sussex County E.P.A. Waste Treatment Planning Program can begin negotiations with Engineering Sciences, Inc. for the following tasks:

Task 2333 - Analyze Existing Industrial Discharges Task 2334 - Analyze Municipal Treatment Systems Task 2335 - Analyze Municipal Collector Systems Task 2336 - Analyze Existing Private Treatment Systems Task 2337 - Analyze Existing Residuals Disposal Programs Task 2353 - Identify Existing Service Areas Task 2354 - Identify Capacity Excesses or Deficiencies in Present Systems Task 2356 - Delineate Future Service Areas Task 2357 - Analyze Residuals Disposal Alternatives Task 2358 - Future Residuals Production Analysis.

Land Use Mr. Conaway, County Administrator, reported to the Council on the status of legislation on Land Use in Delaware.

M 326 76 A Motion was made by Mr. Hill, seconded by Mr. Cole, that NA Co Joseph Toner be endorsed as a member of the Board of Direct­ ors of the National Association of Counties. Motion Adopted; 5 Yea.

CETA Mr. Conaway, County Administrator, reported to the Council that there will be a meeting on June 10, 1976 of the Compre­ hensive Employment Training Act Planning Council regarding CETA funding and monies that are being cut back in the Public Service Employment program. The Council agreed that Mr. Conaway should voice the opinion of the Council that a part of the training funds from CETA Title I will be used to continue public service employment through June 30, 1977.

Water Mr. Henry, County Engineer, reported to the Council on the Franchises meeting he attended on June 2, 1976 regarding the bill that has been introduced in the House of Representatives regard­ ing the changing of authority to grant water franchises from the Public Service Commission to the Department of Natural Resources and Environmental Control.

Dewey Beach The Council agreed that the letter written by Mr. Henry, Water & County Engineer, to Miriam Howard, Mayor of Rehoboth Beach, Sewer dated June 8, 1976, regarding Dewey Beach Water and Sewer District, Water Supply, should be delivered.

Dewey Beach Mr. Henry, County Engineer, reported to the Council that Water & the State Highway Department has approved the restored State Sewer maintained streets under the Dewey Beach Water and Sewer District, Sussex County Contract No. C-10-55-1.

Dewey Beach Mr. Henry, County Engineer, reported to the Council that Water & George, Miles and Buhr have recommended the acceptance of Sewer all pipeline work as having been completed and inspected under the Dewey Beach Water and Sewer District, Sussex County Contract No. C-10-55-1.

M 328 76 A Motion was made by Mr. Hill, seconded by Mr. Benson, to Rail Spur approve amending the contract for the Sussex County Indus­ trial Airpark Rail Spur, EDA 01-11-01212, to extend the completion date to June 30, 1976. Motion Adopted; 5 Yea.
