1. Introduction

1.1 MJCA are commissioned by Augean PLC to undertake an assessment of the impact of nuisance dust as a result of the proposal to extend the time and area for landfill disposal of hazardous and potentially low level radioactive wastes and a time extension of the soil treatment facility. The assessment will be included in the Environmental Statement which will be submitted in support of the planning applications.

1.2 The proposed development is located at the East Northants Resource Management Facility which is centred at National Grid reference TF 008 000. The application site covers an area of approximately 32 hectares. The proposed development is described in detail in the Preliminary Environmental Information Report and comprises:

 A time extension of approximately 3 years to complete clay extraction and landfilling of the consented landfill by the end of December 2016 with an associated time extension to the end of December 2016 for the life of the soil treatment and recycling facility and consideration is being given to increase the throughput of the soil treatment and recycling facility to 150,000 tonnes per annum (tpa).

 An extension in the landfill to the west of the current landfill creating additional void which will provide approximately 10 years of life. The proposed extension is within the boundary of the extant planning consent.

 Filling of the void with hazardous waste and potentially low level radioactive waste (LLW).

 The extraction and stockpiling of clay to provide engineering material for use in the construction of an engineered containment system at the site, the exportation of clay for use in engineering the nearby Augean Thornhaugh Landfill Site and for general sale.

 The extension of the life of the soil treatment facility located in the north west of the site to December 2026 and a change in the orientation of the storage area associated with the treatment facility

 The restoration of the site to woodland and grassland by the end of December 2026

1.3 A qualitative assessment has been undertaken of the potential for an impact from dust which may be generated by the proposed development using guidance in 1 MPS2 Annex 1: Dust and guidance published by the Department of the 2 Environment . MPS2 sets out four key stages that should be undertaken in a dust assessment and this approach has been followed for this assessment:

 Establish existing baseline conditions

 Identify site activities that could lead to dust emissions

 Identify site parameters which may increase potential impacts from dust

 Recommend mitigation measures and site design modifications

2. Baseline conditions

2.1 The East Northants RMF is located near the north eastern boundary of Northamptonshire County approximately 2.6 km north of the village of Kings Cliffe. The setting is generally rural with the majority of the land surrounding the site comprising open farmland or woodland. The site occupies approximately 32 hectares.

2.2 To the north and north east of the site are Collyweston Great Wood and an area of woodland known as the Eastern Hornstocks. To the east of the site are Stamford Road, Westhay Cottages and Westhay Farm. Westhay Farm is operated as a haulage yard and a farm with associated agricultural and commercial buildings. To the south of the site are farm buildings and open agricultural land. To the west of the site there is open agricultural land and North Spinney Wood beyond.

2.3 The main sources of dust in this setting are agricultural activities and minor sources from traffic on Stamford Road. The overall dust concentration is low with occasional periods of increase during particular agricultural activity.

2.4 There are a number of sensitive receptors located around the site, the closest of which are located to the east and south of the proposed development. The closest residential properties to the application area are the Westhay Cottages which are located approximately 25m to the east of the application boundary. The agricultural and commercial buildings at Westhay Farm are located approximately 125m east of the application boundary. Westhay Lodge is located approximately 650m south of the application boundary. A further residential property Law’s Lawn is located approximately 1.2km south east of the application area.

2.5 Department of Environment guidance3 categorises farms as being of low dust sensitivity and residential areas as being of medium dust sensitivity.

2.6 A wind rose prepared by ADM Limited for the RAF Wittering weather station located approximately 3km to the north east of the site for the period 2000 to 2009 based on data from the Meteorological Office is presented at Appendix A. The wind data

for the site is summarised in Table 1. Based on the wind rose data wind speeds for approximately 38% of the year are between 0.5 metres per second (m/s) and 4m/s, varying from light air through light breeze and gentle breeze on the Beaufort Scale. A copy of the Beaufort Scale is presented at Appendix B. Wind speeds between 4m/s and 8m/s, classed as gentle breeze and moderate breeze on the Beaufort Scale are recorded for approximately 48% of the year. Wind speeds greater than 8m/s occur for only approximately 13% of the year.

2.7 In the guidance ‘The environmental effects of dust from surface mineral workings’ published by the Department of the Environment together with the guidance in Minerals Policy Statement 2 (MPS2) it is generally accepted that windblown dust does not occur on days when rainfall is in excess of 0.2mm. The Environment Agency has provided rainfall data for the period January 2000 to December 2009 for a rain gauge located at Oundle approximately 16km to the south of the site. The rain gauge data is summarised in Table 2 and shows that the average number of days per month with a rainfall greater than 0.2mm ranges from 10 to 15.

4 2.8 The proposed development site is not located in an Air Quality Management Area .

Dust monitoring

2.9 A dust monitoring action plan is currently in place at the site in accordance with the planning permission and Environmental Permit. Six directional sticky pad DustStudio cylinders are installed at monitoring points 1, 3, 4, 5, 6 and 7 on the eastern, southern and western boundaries as shown on Figure 2 to provide directional nuisance dust monitoring data. Two Frisbee gauges are located adjacent to DustStudio cylinders at monitoring points 1 and 6.

2.10 The DustStudio gauges are changed every seven days and each quarter a report is submitted to the Environment Agency setting out any results which exceed the trigger level set in the Environmental Permit. Samples from the directional sticky pads are assessed for directional Absolute Area Coverage (AAC%) and directional Effective Area Coverage (EAC%) and for an indicative mass deposition rate.

2.11 The two Frisbee gauges are changed on a monthly basis with the deposition mass of dust determined and the results expressed as a rate of deposition in mg/m2 on a weekly average.

2.12 The trigger level set in the Environmental Permit for both the DustStudio cylinders and the Frisbee gauges is 200 mg/m2/day. Table 3 shows the number of individual exceedances of the trigger level with reference to deposited dust concentrations and the indicative mass of dust in suspension. There have been no recorded complaints with reference to dust at the East Northants RMF from 2005 to 2010.

2.13 In December 2009 Augean agreed with the Agency a change in sampling methods and equipment at the East Northants RMF site. From January 2010 the DustStudio locations are no longer being sampled and analysed. Instead an additional four ‘Hanby’ deposited dust gauges have been located at the former DustStudio locations. This will facilitate a direct comparison of the results with the nuisance guidance and Environmental Permit trigger level of 200 mg/m2/day instead of the indicative measurement provided by the DustStudio gauges. In addition a sample can be stored and analysed at a later date should detailed and speciated interpretation be necessary of the components in the dust around the site.

2.14 Qualitative monitoring of point source particulate emissions from the waste stabilisation plant is undertaken in accordance with the Environmental Permit. To date no visible dust has been observed.

3. Dust generation activities

3.1 A review of the current operations and planned operations for the proposed development has been carried out to identify the primary sources of dust generating activities at the site. These are:

 Overburden and clay excavation and handling

 Cell construction primarily clay liner placement and compaction

 Movement of plant and traffic on internal unsurfaced haul roads

 Mud build up on tarmac roads leading to dust generation by traffic

 Placement of dusty waste

 Capping of cells and placement of restoration materials

 Operation of the treatment facility

3.2 The current operational activities and dust control measures will continue to be employed for the proposed landfill extension, clay extraction and operation of the treatment facility.

4. Potential impacts

Time extension of consented landfill to 2016

4.1 Current landfill operations at the site will continue and dust minimisation procedures will remain in use. Monitoring of dust will continue in accordance with the dust monitoring action plan. The nature, containment and method placement of hazardous waste and LLW mean that dust generated from the wastes themselves is unlikely. It is considered that the extension in time of the consented landfill for a further three years will have negligible impact with respect to dust nuisance.

Extension of the landfill void to the west

4.2 Dust comprises particles in the size range 1μm to 70μm in diameter which can become suspended and entrained in air. Large dust particles greater than 30μm are generally deposited within 100m of the source. Particles in the size range 10μm to 30μm may travel between 200m and 500m from the source. Fine particles of less than 10μm may travel 1km from the source5. To result in an impact, dust must be carried from the source to a sensitive receptor which is dependent on wind speed and direction.

4.3 Although dust particles can become airborne at wind speeds as low as 2.9m/s for loose sandy soils, higher wind speeds are necessary to result in significant dust blow. Wind speeds over 5.5m/s may cause wind blow of dust. For the purpose of the assessment it is assumed that significant dust blow will not occur at wind speeds below 4m/s.

4.4 Based on the analysis of wind speed presented in Table 1 for approximately 61% of the year wind speeds are above 4m/s. Based on the data shown in the windrose predominantly west south west and south west winds will be experienced at the proposed development area. Wind from the west south west exceeds 4m/s on 33 days per year and from the south west exceeds 4m/s on 29 days per year. It is generally accepted that wind blow of dust does not occur on days with rainfall on average greater than 0.2mm which ranges in this area from 10 to 15 days per

month (Table 2). Taking into account wind speed and direction together with rainfall the number of days on which there is a risk of dust blow is low.

4.5 Current landfill operations at the site will continue and dust minimisation procedures will remain in use. Monitoring of dust will continue in accordance with the dust monitoring action plan. The nature, containment and method of placement of hazardous waste and LLW mean that dust generated from the wastes themselves is unlikely.

4.6 Notwithstanding that the risk of dust blow is low there is the potential for dust to cause a nuisance to the properties close to the eastern boundary of the site unless mitigation measures are implemented. The mitigation measures are set out in section 5 of this report.

Extraction and stockpiling of clay

4.7 Dust may be generated by the handling of clay. Current controls will continue to be used for the extraction and handling of clay. Monitoring of dust will continue in accordance with the dust monitoring action plan. A water bowser will be used to dampen down the clay and internal hauls roads if the generation of dust is likely or has been observed during extraction and/or handling operations. Current mud and debris minimisation procedures including use of the wheelwash and sweeping of the road will continue to be implemented. It is considered that the risk of nuisance from dust as a result of extraction and stockpiling of clay is negligible.

Time extension of the soil treatment facility

4.8 Dust may be generated by the handling and storage of contaminated soils. The potential for dust generation at the soil treatment plant is low as the processes for soil treatment are enclosed or will be undertaken on damp materials. The potential for dust blow from soils stored in stockpiles on the hardstanding before treatment will be minimised by using a water bowser or sprays as necessary. Current dust minimisation procedures will continue to be used during the lifetime of the soil treatment facility. Monitoring of dust will continue in accordance with the dust monitoring action plan. It is considered that dust emissions can be controlled to a

standard that ensures that the time extension of the soil treatment facility does not cause a significant impact in respect of nuisance.

Restoration

4.9 Dust may be generated by the handling of soils during the restoration works. Soils will be handled in accordance with current site procedures. Soils must be handled only when in a dry and friable condition in order to preserve their structure. Taking into account the wind speed and direction at the site together with rainfall the number of days on which there is potential risk of dust blow from soil handling during restoration works is low. Monitoring of dust will continue during the restoration works in accordance with the dust monitoring action plan. It is considered that dust emissions can be controlled to a standard that ensures that the restoration works do not cause a significant impact in respect of nuisance.

5. Proposed mitigation measures

5.1 The generation of fugitive dust as a result of vehicle movements, landfill engineering works, landfill operations, soil storage and treatment, site restoration works and as a consequence of general operations in the waste reception area and other areas of the site is controlled in accordance with detailed procedures which will continue to be implemented throughout the life of the site. To minimise the potential for dust generation as a result of site traffic during dry weather haul routes are kept damp with water delivered from a bowser or other spray. The running surface of unsurfaced roads are maintained to prevent the formation of ruts and potholes that may trap silt laden water which could cause dust when it dries. The movement of mobile plant and site traffic is restricted to defined haul routes which will be treated. Vehicle speed limits are imposed to reduce the potential for dust to be raised. All site vehicle exhausts are upward pointing to prevent dust being ‘blown’ up from the road surfaces.

5.2 It is a current planning condition that all vehicles transporting materials in connection with the site use the wheel wash when leaving the site to remove mud and dirt from their tyres to prevent mud being carried onto the road. This will minimise the generation of dust as the mud may subsequently dry and turn to dust. This wheel wash system will be subject to regular maintenance to ensure that it is effective. The use of the wheel wash by site vehicles will continue throughout the operational life of the site.

5.3 It is a current planning condition that all vehicles transporting materials in connection with the site are adequately sheeted. Current Augean procedures in use at the site which will continue include the identification of dusty wastes which will involve special handling and will not be tipped in wind speeds exceeding 15mph. Discharge of dusty waste will not commence until the site water bowser is positioned and operational. The delivery vehicle driver will then be instructed to deposit the load. During placement the waste will be sprayed with water to minimise the risk of dust being generated. The waste will then be immediately covered with suitable non dusty cover materials.

5.4 In the event of any visible release of dust outside of the site boundary the release shall be immediately investigated. Operations shall be temporarily halted in affected areas until remedial action has been implemented.

6. Conclusions

6.1 Based on the meteorological conditions at the site the number of days on which the wind blow of dust is likely is small. The nearest sensitive receptor in the direction of the prevailing wind is Westhay Cottages which is 25m from the site. Notwithstanding the small number of days when there is a risk of dust blow, good practice in respect of dust mitigation and management will continue to be used at the site.

6.2 Based on the current dust management measures and the assessment of the probability of dust generation from the proposed development it is concluded that subject to controls it is unlikely that there will be significant dust emissions from operations at the site. It is concluded that dust emissions can be controlled to a standard that ensures that the development does not cause a significant impact in respect of nuisance relating to dust.

Cumulative impacts

6.3 The combined impact of the individual elements of the proposed development on the nuisance caused by dust has been considered. It is considered that due to the current controls in use at the site, the nature of the waste and the meteorological conditions at the site the impact of dust will be negligible.

1 Between the period 3 May 2005 and 26 July 2005 there were 17 individual exceedances. This corresponded with the excavation and construction of Cells 4A and 4B. No other exceedances were observed in 2005.

2 One isolated exceedance was reported on 15th May 2009 in the south western corner of the site. The adjacent agricultural land was being ploughed during this period and this is reflected in the results of most locations on that date.
