APPEAL DETERMINES THAT ARREST DIDN’T VIOLATE DEFENDANT’S RIGHTS Appellate Division, Second Department

In the Appellate Division, Second Department, Trevor Osbourne appealed a judgment by Hon. Joseph Zayas of Queens County Supreme Court, Criminal Term, that convicted him of attempted murder, crimi- nal possession of a weapon and reckless endangerment upon his plea of guilty. According to the record, Osbourne fired several shots at an unidentified person on Feb. 3, 2016. Later, the police traced his whereabouts to a loca- Hon. Joseph Zayas tion in North Carolina. On Eagle file photo March 4, 2016, in a joint opera- tion between New York and North Carolina law enforce- ment officials, police told Osbourne, utilizing a long-range acoustic device speaker, to leave an apartment where he had been found. In addition to issuing directives, the police also played sirens and chirping noises through the speaker. At a suppression hearing, police officers testified that Osbourne left the apartment and was apprehended outside. After the hearing, the Supreme Court, upon crediting the offi- cers’ testimony, denied Osbourne’s motion to suppress his statements to law enforcement officials. In his appeal, Osbourne argued that the use of the speaker had been “a form of nonlethal force” that police utilized to make the arrest and therefore, his statements to law enforcement officials should have been suppressed as the fruit of an unlawful arrest. In response, the justices of the Second Department affirmed the determination of the Supreme Court to deny Osbourne’s motion to suppress his statements to law enforcement officials. They explained that there was no basis to disturb the court’s determinations to credit the police witnesses. They found that, according to the testi- mony of those witnesses, Osbourne’s arrest occurred when the police, without making any threats, directed him to come out of the apartment and he voluntarily exited. Consequently, they determined that the arrest did not vio- late Osbourne’s rights.

VIOLATIONS OF LABOR LAW EQUALS LIABILITY Appellate Division, Second Department

In an attempt to recover damages for personal injuries, Jose Ortega appealed from an order from Kings County Supreme Court, Civil Term that denied his motion for sum- mary judgment on the issue of liability. The complaint said that Ortega was allegedly injured when the front leg of a three-wheeled compressor gave way, causing a portion of his right ring finger to become severed by the bent leg of the compressor. At the time, Ortega was working as a concrete laborer at a property in Queens owned by the defendant, the Roman Catholic Diocese of Brooklyn, New York. At the deposition, Ortega testified that approximately two months before the incident, a locking mechanism that served to sta- bilize the front leg and wheel of the compressor had broken. He added that his employer replaced the broken component with an ordinary screwdriver as a makeshift remedy. Ortega said the accident occurred when the screwdriver popped out of the locking mechanism as he and two coworkers were attempting to push the compressor up a driveway. In the Supreme Court, Ortega moved for summary judg- ment on the issue of liability on the labor law violations and was denied. In the Appellate Division, Second Department, the justices reversed the ruling of the Supreme Court. They explained that the labor law in question imposed a duty upon an owner and general contractor to provide reason- able and adequate protection and safety for workers and to comply with the specific safety rules and regulations set by the Department of Labor. The justices found that Ortega demonstrated his entitlement to judgment as a matter of law by showing that there were violations of the Industrial Code, and that those violations were a proximate cause of his injuries. They went on to note that, contrary to the defendants’ contention, Ortega was not required to also demonstrate his freedom from comparative fault. Therefore, the justices concluded that the Supreme Court should have granted the branch of Ortega’s motion for summary judgment on the issue of liability on the labor law violation claims.
