A Regular meeting of the Chocolay Township Board was held on Monday, April 3, 2017 at the Chocolay Township Hall, 5010 U S 41 South, Marquette, MI. Supervisor Bohjanen called the Township Board meeting to order at 5:30 p.m.

PLEDGE OF ALLEGIANCE.

TOWNSHIP BOARD. PRESENT: Richard Bohjanen, Max Engle, Ben Zyburt, David Lynch, Judy White, Don Rhein, Mark Maki.

ABSENT: None.

STAFF PRESENT: Steve Lawry, Mary Sanders, Suzanne Sundell, Pat Beck and Lee Gould.

MINUTES –JOINT MEETING March 20, 2017. Rhein moved Zyburt seconded to approve the minutes of the joint meeting of March 20, 2017 as presented. MOTION CARRIED.

AGENDA ADDITIONS/DELETIONS. Lynch moved Maki seconded to approve the agenda as presented. MOTION CARRIED.

PUBLIC COMMENT. Judy White, 370 Lakewood Lane – Spoke on the restructuring of office personnel that is being requested by Manager Lawry. He is requesting that the Deputy Treasurer hours be increased to 40 hours per week and hiring an additional on call person in her absence. She sited state statute on the duties and responsibilities of the Treasurer and Deputy Treasurer position. She also checked with Marquette Township on their Treasurer’s salary and duties of the Treasurer Department. She feels the Board needs to justify additional personnel when the Deputy Treasurer is absent. She feels if the administrative assistant can’t fill in for the Deputy Treasurer, then the Treasurer should.

Mark Maki, 370 Karen Road – At the February ZBA meeting he brought up the fact that there was an illegal sign on M-28 past Shot Point to the Zoning Administrator. It is a large sign (10 x 30), and as far as he knows nothing was done about it. It’s been six weeks since his complaint. Why does it take six weeks to do something? Manager Lawry replied that Dale Throenle updated the Board on that sign in the most recent Board update.

PAYROLL. Lynch moved Rhein seconded that the payroll for March 23, 2017 for $36,540.55 including checks numbered 23791-23829 and 10455-104604 and ACH payments for Federal tax, State tax and MERS are approved for payment. MOTION CARRIED.

TREASURER’S REPORT- FUND WITHDRAWAL AND DEPOSIT REPORT. Treasurer Zyburt reported to the Board that we had one C/D mature in the amount of $250,000. from River Valley Bank and we changed it to North Star Bank, maturing in June of 2019. He also reported that in the past year since he took over as Treasurer our Bond portfolio has had a 100% turn over and with the type of investments made we have increase our interest earnings by $12,412.50.

Engle moved Rhein seconded to accept the Treasurer’s report. MOTION CARRIED.

PRESENTATIONS. FIRE DEPARTMENT UPDATE ON M28 BEACH LIFESAVING EQUIPMENT STATIONS PROJECT. Lee Gould, Assistant Fire Chief presented information to the Board on the Waterfront Safety Project. We have received donations for the project from Northern Michigan University, Marquette General Hospital through the Michigan Sea Grant Program and Michigan State University Extension. These will go toward life preservers, flotation boards, and signage. Rainy Creek Construction is donating all the labor and Lowe’s has committed to donating materials. We are working with Marquette Township, City of Marquette and the Coast Guard on water safety/rescue training. Chocolay DPW is working on permits and the Police Department will be watching for theft once the boards are up.

INTRODUCTION TO DIGITAL TABLETS FOR AGENDA PACKETS. Suzanne Sundell asked the Board if they had any questions on the tablets since they are already using them. She indicated that the tablets are already loaded with some of the major documents such as the Master Plan, Recreation Plan and the 2017 budget. Depending on which browser you use to open in, the look on the tablet will be different. It’s best to just download the packet and then open in Adobe Acrobat Reader. Trustee Maki asked if he could use his own laptop. Clerk Engle said that if you utilize your personal computer for Township business, someone could FOIA your personal information. All Board members signed Charter Township of Chocolay Computer Acceptable Use Policy.

APPOINTMENTS / RESIGNATIONS-RESIGNATION OF TOWNSHIP ASSESSOR BODE. Supervisor Bohjanen informed the Board that Don Bode, Assessor will be retiring as of June 1st. Don did a good job as Township Assessor we will be extremely lucky to find someone as qualified as Don.

Trustee Maki was surprised to see that the County would be interested in taking over our roll. He heard that they did not have the time or staff to take on other Townships. He feels this is a conflict of interest and is not interested in having the County doing our Assessing.

Engle moved Rhein seconded to accept Don Bodes’ letter of resignation. MOTION CARRIED.

CONSIDERATION OF PERSONNEL COMMITTEE AND MANAGER RECOMMENDATIONS ON RESTRUCTURING STAFF POSITIONS. The Board received two memos from the Manager on this item and the minutes of the Personnel Committee meeting.

Trustee Maki asked about the chart in the memo that showed the Community Coordinator at 1248 hours currently. Manager Lawry indicated that it is currently vacant, but budgeted for 1248 hours. Manager

Lawry feels that the Township would be better served if they made the Community Coordinator position full time and the Administrative Assistant a part time position.

Trustee Maki asked if Suzanne Sundell would step into the full time Community Coordinator position. Manager Lawry indicated that she would. She has already taken on many of the duties of this position without additional pay and has proven herself capable. The Personnel Policy allows us to post a position from within if a current employee is interested in it and is qualified.

Trustee Maki thought that the Board already gave full time status to the Deputy Treasurer. Manager Lawry explained that the Board allowed for it in the budget for 2017, but it had to go through the personnel Committee first. Trustee Maki said that we have always had one or two part-time on call personnel. Each department would have their own part-time on call person paid from the respective department.

Trustee Maki has been around here for 42 years and has never seen the Personnel Committee getting involved in recommending staffing. That is a Board duty not a Personnel Committee duty.

Maki moved Lynch seconded to authorize implementation of the Township Manager’s proposal for restructuring the positions of Community Development Director, Administrative Assistant Clerk’s Office, Deputy Treasurer, and On-call Treasurer’s Assistant as outlined in the attached memorandum and to approve filling the Community Development Coordinator position under the terms of Section 2.2.b of the Personnel Policy and Procedures Manual. MOTION CARRIED. (2 Nays – White, Engle)

Trustee White asked Treasurer Zyburt if the Treasurer Department Duties and Procedures had been developed as Manager Lawry requested. Treasurer Zyburt replied that he is currently working on that.

EVALUATION OF ASSESSING SERVICES OPTIONS. Maki moved Lynch seconded to authorize the Manager to advertise for the hiring of a fulltime assessor with MCAO or higher level certification in accordance with the recruitment procedures outlined in the Personnel Policy and Procedures Manual. MOTION CARRIED.

Trustee Maki feels that the Zoning Administrator, Planner and Assessor should all be hired by the Board. He has seen it cause problems by being hired by one or two people. These positions are the face of the Township.

Manager Lawry indicated that in the past we have utilized a screening committee and then brought the final candidate before the Board. We have also had the Board of Review Chair be included in the screening committee.

Supervisor Bohjanen thinks that we may not have a large group to choose from. There are some issues with sending the full application information to the Board, because the packet becomes public information. Personal and private information would have to be redacted. He feels a small committee would be more efficient depending on how many applications we receive. Trustee Maki’s concerns will be taken into consideration.

2017 GENERAL FUND BUDGET AMENDMENT #1 TO ACCOUNT FOR DONATIONS FOR BEACH RESCUE EQUIPMENT BOARDS.

Lynch moved Zyburt seconded that Whereas, a budget was adopted by the Chocolay Township Board to govern the anticipated General Fund receipts within the Township on October 5th, 2016 for fiscal year 2017, and Whereas, as a result of receipt of unanticipated revenue it is necessary to modify the aforesaid budget, Now Therefore, Be It Hereby Resolved, that the aforesaid budget be modified as follows:

AUTHORIZATION TO EXPEND CAPITAL IMPROVEMENT FUNDS FROM THE POLICE TRAINING ACCOUNT FOR TRAINING AT NORTHERN MICHIGAN PUBLIC SAFETY INSTITUTE. Zyburt moved Engle seconded to expend $600. for the NMU Safety Institute for the year 2017. This would be paid from the Capital Improvement Fund Police Training 401.306.957. ROLL CALL. AYES: Maki, White, Rhein, Lynch, Zyburt, Engle, Bohjanen. NAYS: None. MOTION CARRIED.

AUTHORIZATION TO PURCHASE ELECTION EQUIPMENT WITH CAPITAL IMPROVEMENT FUND DOLLARS. White moved Lynch seconded that the Board approve the purchase of an additional tabulator for backup purposes, not to exceed $5,000. from the Capital Improvement Fund Election Department 401.190.977. ROLL CALL. AYES: Maki, White, Rhein, Lynch, Zyburt, Engle, Bohjanen. NAYS: None. MOTION CARRIED.

REQUEST FROM LAKESTATE INDUSTRIES FOR TOWNSHIP TO ACT AS PASS THROUGH AGENCY FOR 2% GAMING FUNDS. Trustee Maki asked if Manager Lawry knew if coffee shop and small retail store were just for training or open to the public. Manager Lawry replied that he understands it will be open to the public as a training facility. He has asked Dale to explore this with Lakestate Industries to make sure this is permissible.

Maki moved Zyburt seconded to authorize a request from Lakestate Industries for $5,000 in funding for its “Building Futures Capital Campaign” to be submitted as a part of the next Township request for 2% gaming funds from the Keweenaw Bay Indian Community, with the Township to act as a pass through agency for

funds received from this source, and to ask Lakestate Industries to sign a Letter of Agreement to provide specified public services in exchange for this funding. MOTION CARRIED.

CONSIDERATION OF ALTERNATE MEETING DATE FOR MAY 2017. Supervisor Bohjanen asked if any other Board member will be unavailable on the regular scheduled Board meeting date of May 8, 2017. Trustee Lynch and Treasurer Zyburt will both be out of town.

Rhein moved Zyburt seconded to reschedule the May 8, 2017 Regular Board meeting to 5:30 pm on Monday May 1, 2017.

For the past three years I have been working for the Dickinson C.Ounty Equalization Department, conducting fieldwork and transferring the data to the updated online system I have used a number of the online services such as the GIS mapping to perform data entry. BACKGROUND: At its meeting of April 3, 2017 the Board reviewed options for completing the property assessment responsibilities of the Township following the resignation of Township Assessor Don Bode. At that meeting I was authorized to advertise to fill a fulltime staff position of Township Assessor. The position was advertised on Township bulletin and message boards, Township website, in the Mining Journal, in the Michigan Works database, and on the Lake Superior Community Partnership and Michigan Township Association employment web pages. It was also sent to the Upper Peninsula Assessors Association, and the Great Lakes Assessors Association covering the east end of the UP and northern Lower Peninsula for publication in their e-mail newsletters. Several local assessors were also informed of the vacancy through word of mouth. Four applications were received in response to the advertising. One of the four applicants lacked the required State certification and was not interviewed. Supervisor Bohjanen, Assessor Bode, and I conducted interviews with the other three candidates. Application materials for the three certified individuals are attached.

FISCAL EFFECTS: Under the most recently adopted wage grid, the salary for this position starts at $42,604 and rises to $48,739 after three years. As a fulltime position, it also qualifies for the full package of fringe benefits offered by the Township. When Mr. Bode was hired he indicated that he had no need of the health insurance benefit offered by the Township and asked for a starting salary of $50,000 based upon nearly 40 years of experience in the assessing field. The Board agreed to waive the adopted wage grid and grant Mr. Bode’s request.

Prior to my employment with the Township, job descriptions for fulltime staff positions were developed and classified and a Personnel Policies and Procedures Manual was developed and adopted by the Board. The job description lists the Assessor position as FLSA Exempt, generally meaning that it is not eligible for overtime compensation for work within the classification performed in excess of 8 hours per day or forty hours per week. Prior to creation of the Manager’s position, personnel administration was performed by the Township Supervisor. Mr. Seppanen, who was Supervisor at the time the above referenced documents were developed, informed me that he authorized compensatory time for previous Assessor Tina Fuller for the weekend work required to complete the valuation of the 20% of Township properties reassessed annually and the associated work with factoring these new assessments into the annual tax roll by the legal deadline. This occurs over the course of 4-6 weeks mid-winter. While the Assessor usually works long work days without added compensation to complete the task, weekend work was also found to be necessary to meet both the 20% quota and the mandated timelines. Compensatory time at the rate of time and one half for the weekend work was granted under the terms of Personnel Manual Section 4.6.b (attached) which allows for such compensation for “special meetings, tasks, projects or functions that have been assigned by a Township Officer which occur at times other than normal working hours.” I was asked to continue this practice and have done so for both Ms. Fuller and Mr. Bode. Overtime pay has not been granted.

RECOMMENDATION: Based upon the application materials supplied and the personal interviews, it is the recommendation of the interview panel that the Board appoint Mr. Mark Maki as Township Assessor, effective June 1, 2017, at a starting salary of $42,604 in accordance with Appendix L of the Personnel Policy and Procedures Manual. It was the panel’s opinion that having previously performed the duties of the position for in excess of 27 years, Mr. Maki is the most qualified candidate for Township Assessor at this time.

SUGGESTED MOTION: ______moved, ______seconded to appoint ______as Chocolay Township Assessor effective June 1, 2017, with compensation as outlined in the Personnel Manual.

ALTERNATIVES: The Board could choose to conduct further interviews and appoint one of the other applicants, re-advertise the position in the hope that other qualified individuals would apply, or choose to issue a request for proposals for contracted assessing services. The other applicants who were interviewed were advised to attend the Board meeting.

4.4 Recording of Hours

Department Heads are required to keep a record of hours worked by temporary, part time and special-projects employees using time sheets developed for this purpose.

Employees seeking overtime pay for time worked must turn in a record of time worked to the Deputy Clerk by 5:00 p.m. on the first business day following the end of the pay period.

Employees seeking compensatory time for time worked must turn in a record of time worked to the Deputy Clerk the day following the day worked.

Any problems concerning the amount of pay or payroll procedures should be directed to the Deputy Clerk.

4.5 Michigan Minimum Wage Law

The Michigan Minimum Wage Law sets minimum wage and overtime compensation for all Township employees, except those who hold positions which are exempt from the overtime provisions of the law. The Supervisor, with Township Board consensus, is responsible for determining the positions which are exempt and nonexempt, based on criteria set by law.

Nonexempt employees will be paid at least the current prescribed minimum hourly wage and will at least meet the minimum compensation requirements for overtime in accordance with the law.

4.6 Overtime, Compensatory and Call-Out Time

a. Nonexempt Employees

All overtime work in excess of 40 hours per week must be authorized by the Personnel Administrator or Department Head. Employees working call-out time will receive a minimum of 2 hours of compensation at overtime schedules.

19 Nonexempt employees who work in excess of 40 hours per week will be compensated at one and one half their hourly rate in either wages or compensatory time off, at the employee's option.

Overtime accumulated for which cash payment is to be made will be reported to the Deputy Clerk not later than 5:00 p.m. of the next regular working day following the end of any payroll period.

Overtime accumulated for which compensatory time is desired will be reported to the Deputy Clerk by 5:00 p.m. of the next regular business day following date of accumulation. Compensatory time will be capped at 80 hours.

Accrued compensatory time for nonexempt and exempt employees must be used prior to commencement of FMLA and non-FMLA leave-of-absence.

b. Exempt Employees

Exempt employees will not be granted additional wages or compensatory time off for hours worked in excess of the standard workday or week.

Employees classified with exempt status will be eligible for overtime compensation according to provisions of this section, when performing work responsibilities on behalf of the Township, which fall within the definition of call-out as defined herein, or when performing non-administrative functions on an overtime basis which are equal to tasks performed by personnel under their direct supervision. Compensatory time may be granted on a pre-approved basis by the Personnel Administrator or Township Officer at time and one-half for special meetings, tasks, projects or functions that have been assigned by a Township Officer which occur at times other than normal working hours.

4.7 Holiday Pay

If an employee is required to work on a designated holiday, the employee shall receive a day's pay plus additional pay at time and one-half for the hours worked.

If working a designated holiday results in an employee working in excess of 40 hours a week, the employee shall receive holiday pay plus overtime pay computed at one and one half the normal rate.

Employees not working a holiday will receive a day's compensation at regular wage rates, should a designated holiday fall upon a scheduled day off.

The Clerk and I attended the Michigan Township’s Association Annual Conference and Expo. The experience was enlightening, though not always uplifting, but the fact that we are not unique in our problems and that there is help available is comforting. I attended conferences on Infrastructure Future, Junk Ordinance Enforcement, Short Term Rentals, Developing Board Consensus, Township and County Road Commission Cooperation, and Bulletproofing Zoning Decisions, as well as General Meeting presentations. I got a few useful ideas to develop for the future. I don’t believe I wasted the cost of attending. XV.A.1

BACKGROUND: The Township recently received the attached request from Dykema Gosset PLLC, attorneys for Alger Delta Cooperative Electric Association requesting a new thirty year franchise agreement to provide electric service within Chocolay Township. A review of the historical files revealed that a similar request was presented to the Township Board in 1998, prior to expiration of the franchise in place since 1969, but the Board postponed taking action on it until some later date and no record of it being taken up for action can be found. Because I had a number of questions regarding how best to deal with the apparent lack of a franchise at present, and felt the ordinance language proposed by the electric utility should undergo a legal review to determine whether it protected the Township to the maximum extent allowed by law, I presented my questions and the draft ordinance to the Township Attorney for a response. With his permission, his answers and suggestions are attached. With regard to the ordinance language itself, Attorney Zappa felt that the Board should be aware that it is free to approve a franchise for any period less than the 30 year maximum allowed by State law. He also suggested adding a clause that requires the utility to submit plans and specifications to the Township for construction or relocation of utility infrastructure located on public property prior to the commencement of such work. His suggested ordinance is attached to his letter and differs only in these two points from the language submitted by Dykema Gosset with their correspondence.

FISCAL EFFECTS: Unless the Township wishes to try to negotiate a franchise fee to be collected through the utility bills, there is no identified direct fiscal effect by granting this franchise. The Utility is pledging to pay the costs of the required publication of the ordinance. Since electric rates on the Alger Delta system remain higher than those charged by the Marquette Board of Light & Power, which serves the remainder of the Township, I am not recommending to the Board that they pursue a franchise fee that would create an even greater disparity. As a rural electric cooperative, Alger Delta serves the more sparsely populated areas of Chocolay Township and other portions of the UP and therefore incurs higher distribution costs per customer than municipal utilities. Past efforts by the Township to encourage adjustments to the service area boundaries of the two utilities in the Lakewood Lane and M28 development areas have been futile.

RECOMMENDATION: Attorney Zappa points out in his letter that adoption of the ordinance does not require a Planning Commission review or a public hearing but it may not be adopted at the same meeting at which it is first introduced. In the interest of keeping the Board’s actions transparent and allowing the public to express their concerns to the Board, it is my recommendation that the Board schedule a public hearing on the draft ordinance language, as amended by Attorney Zappa, for its meeting of June 12, 2017. The Attorney’s version remains open ended on the length of time the franchise would be in place. It is my suggestion that the franchise be timed to expire in the same year as that granted to the Board of Light & Power. MBLP was granted a thirty-year franchise in December 2009 that will expire February 7, 2040.

SUGGESTED MOTION: ______moved, ______seconded to schedule a public hearing and second reading on the adoption of the attached draft of Alger Delta Electric Cooperative Franchise Ordinance #64 containing the provision for Township review of utility construction documents and expiring 2040 at the regular Board meeting of June 12, 2017, to seek approval of the proposed language changes from Alger Delta Cooperative and to publish the proposed ordinance as required by law.

ALTERNATIVES: The Board could choose act on the proposed ordinance without a public hearing, to suggest further changes to the proposed ordinance, to delay the second reading until languages changes are agreed upon with Alger Delta, or to approve the use the language as originally submitted by the Utility’s law firm. It may also wish to further explore options available to it because of the present lack of a franchise for this utility, although that seem to have been precipitated by failure of the 1999 Board to act definitively.

I am writing on behalf of Alger Delta Cooperative Electric Association ("Alger Delta") to ask the Chocolay Township Board of Trustees (the "Township Board") to grant Alger Delta a franchise to conduct business in the Township. As you may know, a franchise provides authorization for Alger Delta to provide electric service to Township residents. Alger Delta cmTently provides electric service to the Township and is now seeking to renew its franchise. I, therefore, write to respectfully ask the Township Board to approve the enclosed new franchise that will take effect when the current franchise expires.

To briefly summarize the franchise, it generally allows Alger Delta to run lines, poles, and other apparatus in the public right-of-way as necessary to provide electric service to Township residents. The franchise allows the Township Board to revoke the franchise at the Township Board's discretion (although hopefully, based on Alger Delta's history serving the township, that would be unlikely). Additionally, the franchise would not be exclusive, which provides flexibility to the Township as well.

Copies of the new franchise are attached as Tab 1. I am enclosing five (5) copies so each Township Board member has a copy. If the proposed franchise is satisfactory, Alger Delta requests that it be placed on the Township Board's agenda for adoption at the next Township Board meeting. If possible, please advise me when the Township Board will consider the proposed franchise.

Enclosed as Tab 2, please find a Franchise Approval Checklist, which is designed to serve as a step-by-step reference for approving and publishing the franchise. Alger Delta will, of course, pay publication fees and would be happy to provide additional information or to answer any questions that the Township Board might have.

The Township of Chocolay ORDAINS:

Section 1. Grant of Electric Franchise. Section 3. Use of Streets and Other Public Places. The Company, its successors and assigns, shall not unnecessarily obstruct the passage of any of the highways, streets, alleys, or other public places within the Township and shall within a reasonable time after making an opening or excavations, repair the same and leave it in as good condition as before the opening or excavation was made. The Company, its successors and assigns shall use due care in exercising the privileges herein contained.

Section 4. Hold Harmless. The Company shall at all times keep and save the Township free and harmless from all loss, costs and expense to which it may be subject by reason of the Company's negligent construction and negligent maintenance of the structures and equipment hereby authorized. If any action is commenced against the Township resulting from the Company's negligent construction and maintenance, the Company shall, upon notice, defend the Township and save it free and harmless from all loss, cost and damage arising out of such negligent construction and maintenance.

Section 5. Force Majeure. The Company shall not be liable for failure to furnish electric service as herein provided, or for any breach of the Company's obligations hereunder, if such failure or breach is caused in any part by acts of God or public enemy, terrorist acts, civil disturbance, labor troubles, strikes, shortages of supply, accidents, breakage or repair of pipeline, machinery or equipment, failure of suppliers to deliver, shortages of materials or labor, governmental laws, rulings or regulations, or any other causes or contingencies not reasonably within the Company's Control.

Section 6. Effective Date; Term of Franchise; Acceptance by the Company. This Franchise shall take effect the day following the date of publication thereof, which publication shall be made within thirty (30) days after the date of its adoption, and shall continue in effect for a period of thirty (30) years thereafter; provided, however, that when this Franchise shall become effective the Township Clerk shall deliver to the Company a certified copy of the Franchise accompanied by written evidence of publication and recording thereof as required by law, and the Company shall, within sixty ( 60) days after receipt of the above documents, file with the Township Clerk its written acceptance of the conditions and provisions hereof.

Section 7. Franchise Revocable. This Franchise shall be subject to revocation during its term at the will of the Township. Any such revocation must be communicated to the Company in writing and such revocation will become effective sixty (60) days following receipt of written notice of revocation.

Section 8. Effect and Interpretation of Franchise. All other franchises, ordinances and resolutions, and parts thereof, which conflict with any of the terms of this Franchise are hereby rescinded. In the case of conflict between this Franchise and any such franchises, ordinances or resolutions, this Franchise shall control. The catch-line headings which precede each section of this Franchise are for convenience in reference only and shall not be taken into consideration in the construction or interpretation of any of the provisions of this Franchise.

Section 9. Successors and Assigns. The words "Alger Delta Cooperative Electric Association" and the "Company," wherever used herein, are intended and shall be held and construed to mean and include both Alger Delta Cooperative Electric Association and its successors and assigns, whether so expressed or not. Dear Mr. Lawry:

I have reviewed the materials you forwarded regarding the Alger-Delta Cooperative Electrical Association Franchise. A 30 year franchise was granted by ordinance in 1969 and approved by the voters in 1970. Although discussions apparently took place in 1998 to renew the franchise that would otherwise lapse by its own terms in 1999, it is my understanding that there is no record of any Board action to either adopt an ordinance or authorize a franchise by contract. In any event, Alger-Delta is now requesting a new 30 year franchise agreement by ordinance.

Article VII, Section 29 of the Michigan Constitution of 1963 requires a public utility to obtain a franchise from the Township before conducting business, and to also obtain consent to use the highways, streets, alleys or other public places for placement of wires, poles or other components of the utility system. Article VII, Section 30 of the Michigan Constitution also limits a franchise to not more than 30 years. Based upon information available at this point, it appears that Alger-Delta may have ben operating in violation of these constitutional provisions for nearly 18 years. Michigan law does not provide a township with any effective means of imposing a penalty, other than possibly refusing to grant a new franchise. This is not usually a viable option, because it would Steve Lawry - Township Ma nag er April 18, 2017 Page2 potentially leave residents without electrical service in the absence of alternate arrangements.

Your first question is whether a franchise should be granted by ordinance or by a contractual agreement. Either is permissible, as long as the terms and provisions are satisfactory. In either circumstances, the franchise must be properly approved by a majority vote of the Township Board. In my experience, ordinances are more commonly utilized to grant utility franchises.

Your second inquiry is whether the Planning Commission must review the franchise ordinance and make a recommendation to the Township Board. This is not necessary because it would not be considered a zoning ordinance. Additionally, while public hearings are necessary any time a zoning ordinance is adopted or amended, no public hearing is required for adoption of a franchise ordinance. Section 20 of the Charter Township Act provides that "except in the case of an ordinance that is declared to be an emergency ordinance, an ordinance shall not be finally passed by the township board at the same meeting at which it is introduced, or before it is published in the form in which it is introduced." MCL 42.20(2). This would not qualify as an emergency ordinance. Consequently, in response to your second question, the franchise ordinance could be introduced at the May 1 meeting, but should not be finally adopted until the next regular meeting after that.

The terms of the ordinance being proposed by Alger-Delta Cooperative are not objectionable. Section 1 provides that the franchise is non-exclusive. This allows other electric utilities to conduct business, or even to expand into areas currently served by Alger-Delta, but potentially subject to Michigan Public Service Commission regulations.

Section 3 grants Alger-Delta the right to use public rights-of-way for its utility lines, but also requires it to repair any excavations, leave any premises in as good condition as before, and to use due care in exercising any privileges granted. This arguably provides Chocolay Township with a legal remedy if Alger-Delta negligently leaves an area within the Township's jurisdiction in a dangerous or unsafe condition. Additionally, Section 4 requires Alger-Delta to defend and hold the Township harmless from claims resulting from Alger-Delta's negligent construction or maintenance of the utility system. These are important provisions to be included.

Section 6 once again proposes a 30 year franchise. This is the maximum length permitted under Michigan law. Unlike the 1969 franchise that was approved by the electorate, Section 7 of the newly proposed franchise provides that it will be revocable, rather than irrevocable. This is of critical importance to Chocolay Township for a number of reasons. First, Article VII, Section 19 of the Michigan Constitution of 1963 prohibits irrevocable franchises unless they are approved by a majority of the voters at a Steve Lawry- Township Manager Apr1118,2017 Page 3

regular or special election. Consequently, the Township Board does not have the authority to grant an irrevocable franchise unless it is approved by the voters. Secondly, and perhaps even more importantly, many unforeseeable changes both in technology as well as in needs of the residents and the Township as a whole may occur within 30 years. I can perceive no benefit to the Township in presenting an irrevocable franchise to the voters. The only time a long term irrevocable franchise is beneficial is when a utility has not yet installed its transmission system, and wants a firm assurance of a long term commitment before undertaking a substantial investment to expand service to a new area, not previously served. The provision making the franchise agreement revocable is beneficial to the Township.

Termination of even a revocable franchise agreement can occasionally pose legal questions or issues, depending upon the reasons or circumstances surrounding the attempted revocation. The ideal length of a franchise is difficult to predict because of the inherent unknown nature of future developments. On the one hand, a franchise of some reasonable duration helps assure that the utility will invest in maintenance and upgrades necessary to insure reliable, high quality service. A short term franchise may not accomplish this. On the other hand, contingencies and rapid pace of change may justify consideration of a franchise shorter than 30 years. 10 or 20 years franchises are not unusual. The length of the franchise is within the discretion of the Township Board, but ultimately must also be accepted by Alger-Delta.

Additionally, the Township Board may wish to consider a provision along the following lines:

The Company shall submit any plans and specifications to the Township for review and approval prior to commencement of construction of new or relocated transmission and distribution lines, poles, cables, conduits, appliances, or appurtenances in the highways, streets, alleys, or other public places within the Township.

This would allow Chocolay Township to provide input on routing, suggest alternatives to tearing up new pavement, and to help prevent conflict with anticipated new projects or improvements within the public rights-of-way or properties.

You also inquired about the possibility of charging a franchise fee. For example, in the telecommunications industry, a municipality may charge up to five percent of the gross revenue generated by the utility within the township. Charter Communications pays this type of fee to Chocolay Township. Telecommunication fees are governed by a different statute, however. While the statutes governing electric utility franchises do not expressly authorize franchise fees, they are also not directly prohibited. Most electrical utilities will not agree to pay a franchise fee unless one is expressly required or Steve Lawry - Township Manager April 18, 2017 Page4 authorized by statute. The arrangement between the Marquette Board of Light and Power, Chocolay Township, and several other townships within Marquette County is somewhat of a unique situation. While there may be no harm in inquiring, I would be somewhat surprised if Alger-Delta would accept a franchise fee provision.

I have enclosed a modified ordinance containing these possible revisions, depending upon the preference of the Township Board. I have left the duration of the franchise blank. The Township may enter any duration it feels appropriate, not longer than 30 years.

The Township of Chocolay ORDAINS:

Section 1. Grant of Electric Franchise. Section 3. Use of Streets and Other Public Places. The Company, its successors and assigns, shall not unnecessarily obstruct the passage of any of the highways, streets, alleys, or other public places within the Township and shall within a reasonable time after making an opening or excavations, repair the same and leave it in as good condition as before the opening or excavation was made. The Company, its successors and assigns shall use due care in exercising the privileges herein contained.

Section 4. Hold Harmless. The Company shall at all times keep and save the Township free and harmless from all loss, costs and expense to which it may be subject by reason of the Company's negligent construction and negligent maintenance of the structures and equipment hereby authorized. If any action is commenced against the Township resulting from the Company's negligent construction and maintenance, the Company shall, upon notice, defend the Township and save it free and harmless from all loss, cost and damage arising out of such negligent construction and maintenance.

To: Chocolay Township Board From: Steve Lawry, Manager Date: April 11, 2017 Subject: 2017 Capital Improvement Fund Budget Amendment #2 to Reflect Receipt of Additional Insurance Settlement on Damaged Police Vehicle

BACKGROUND: On February 9th the Township’s 2016 Ford Explorer Police Patrol Vehicle was damaged in a traffic accident on US 41 South. Upon inspection, the insurance adjuster employed by the Michigan Municipal Risk Management Authority insurance pool, through which the Township maintains its fleet insurance, determined that the vehicle was totaled and did not warrant repair. Based upon the 58,000 miles shown on the vehicle’s odometer, the car was depreciated to an actual cash value of $20,000. This value was exclusive of the add-on police equipment, such as lights, cameras, cages, radar, push bar, etc. and the insurance company also paid Fox Motors directly to remove these items and present them back to the Township for re-installation on a replacement vehicle.

We also asked our local MMRMA representative to investigate whether or not we were paid a fair price for the vehicle in comparison with other similar claims. Chief Jennings and I met with our local MMRMA representative on this matter. After all the calculations were examined, the reviewer found some issues that he was able to interpret differently when drawing from the tables. In doing this, MMRMA came up with an amount that was $2,483 more than the original cash value.

FISCAL EFFECTS: The Board has already authorized purchase of a replacement patrol vehicle from the Police Department portion of the Capital Improvement Fund. In March the Board did 2017 Capital Improvement Fund Budget Amendment #1 to reflect receipt of the original amount of $19,750. This budget adjustment will authorize placement of the additional insurance settlement payment into the account used for the purchase of Police Department vehicles.

RECOMMENDATION: It is recommended that the Board assign the additional proceeds from the insurance settlement to the Police Vehicles Account within the Capital Improvement Fund to assist with the purchase of a replacement vehicle.

BACKGROUND: While preparing to post the vacancy in the Township Assessor position, the job description for the position was reviewed. It was noted that the requirements for State certification contained within the document referenced the State’s former classification system of Level I through Level IV certification. This system has been replaced by designations of Michigan Certified Assessing Officer (MCAO), Michigan Advanced Assessing Officer (MAAO), and Michigan Master Assessing Officer (MMAO). The need for a change in the language of the job description to reflect this was referred to the Township Personnel Committee. At the same time several other small clarifying changes were suggested, including listing each of the property classifications that must be assessed within the Township, adding a reference to poverty and disabled veteran exemption record maintenance, and adding experience with municipal tax roll preparation and proficiency with the current tax software packages to the list of preferred qualifications. Please see the attached proposed version of the job description with intended deletions highlighted in red and additions in yellow.

The Personnel Committee reviewed and approved the suggested changes on April 17, as reflected by their attached minutes.

POSITION SUMMARY:

This Performance Resolution is required by the Michigan Department of Transportation for purposes of issuing to a municipal utility an ''Individual Permit for Use of State Highway WRightay'', of or an ''Annual Application and Permit for Miscellaneous Operations within State Highway Right of Way''.

RESOLVED WHEREAS, the (city, village, township, etc.) hereinafter referred to as the ''GOVERNMENTAL AGENCY,'' periodically applies to the Michigan Department of Transportation, hereinafter referred to as the "DEPARTMENT," for permits, referred to as ''PERMIT,'' to construct, operate, use and/or maintain utilities or other facilities, or to conduct other activities, on, over, and under State Highway Right of Way at various locations within and adjacent to its corporate limits;

NOW THEREFORE, in consideration of the DEPARTMENT granting such PERMIT, the GOVERNMENTAL AGENCY agrees that:

1. Each party to this Agreement shall remain responsible for any claims arising out of their own acts and/or omissions during the performance of this Agreement, as provided by law. This Agreement is not intended to increase either party's liability for, or immunity from, tort claims, nor shall it be interpreted, as giving either party hereto a right of indemnification, either by Agreement or at law, for claims arising out of the performance of this Agreement.

2. If any of the work performed for the GOVERNMENTAL AGENCY is performed by a contractor, the GOVERNEMENTAL AGENCY shall require its contractor to hold harmless, indemnify and defend in litigation, the State of Michigan, the DEPARTMENT and their agents and employee’s, against any claims for damages to public or private property and for injuries to person arising out of the performance of the work, except for claims that result from the sole negligence or willful acts of the DEPARTMENT, until the contractor achieves final acceptance of the GOVERNMENTAL AGENCY. Failure of the GOVERNMENTAL AGENCY to require its contractor to indemnify the DEPARTMENT, as set forth above, shall be considered a breach of its duties to the DEPARTMENT.

3. Any work performed for the GOVERNMENTAL AGENCY by a contractor or subcontractor will be solely as a contractor for the GOVERNMENTAL AGENCY and not as a contractor or agent of the DEPARTMENT. The DEPARTMENT shall not be subject to any obligations or liabilities by vendors and contractors of the GOVERNMENTAL AGENCY, or their subcontractors or any other person not a party to the PERMIT without the DEPARTMENT’S specific prior written consent and notwithstanding the issuance of the PERMIT. Any claims by any contractor or subcontractor will be the sole responsibility of the GOVERNMENTAL AGENCY.

4. The GOVERNMENTAL AGENCY shall take no unlawful action or conduct, which arises either directly or indirectly out of its obligations, responsibilities, and duties under the PERMIT which results in claims being asserted against or judgment being imposed against the State of Michigan, the Michigan Transportation Commission, the DEPARTMENT, and all officers, agents and employees thereof and those contracting governmental bodies performing permit activities for the DEPARTMENT and all officers, agents, and employees thereof, pursuant to a maintenance contract. In the event that the same occurs, for the purposes of the PERMIT, it will be considered as a breach of the PERMIT thereby giving the State of Michigan, the DEPARTMENT, and/or the Michigan Transportation Commission a right to seek and obtain any necessary relief or remedy, including, but not by way of limitation, a judgment for money damages. 5. The GOVERNMENTAL AGENCY will, by its own volition and/or request by the DEPARTMENT, promptly restore and/or correct physical or operating damages to any State Highway Right of Way resulting from the installation construction, operation and/or maintenance of the GOVERNMENTAL AGENCY'S facilities according to a PERMIT issued by the DEPARTMENT.

6. With respect to any activities authorized by a PERMIT, when the GOVERNMENTAL AGENCY requires insurance on its own or its contractor's behalf it shall also require that such policy include as named insured the State of Michigan, the Transportation Commission, the DEPARTMENT, and all officers, agents, and employees thereof and those governmental bodies performing permit activities for the DEPARTMENT and all officers, agents, and employees thereof, pursuant to a maintenance contract.

7. The incorporation by the DEPARTMENT of this resolution as part of a PERMIT does not prevent the DEPARTMENT from requiring additional performance security or insurance before issuance of a PERMIT.

8. This resolution shall continue in force from this date until cancelled by the GOVERNMENTAL AGENCY or the DEPARTMENT with no less than thirty (30) days prior written notice provided to the other party. It will not be cancelled or otherwise terminated by the GOVERNMENTAL AGENCY with regard to any PERMIT which has already been issued or activity which has already been undertaken.

Dear Constituent Municipality:

As you are probably aware, there has been some issue recently with whether Marquette County should be a constituent municipality of the Marquette County Solid ·waste Management Authority (the "Authority").

The County has never been a direct user of the Authority Landfill and simply provides its solid waste through one of the 22 constituent municipalities (19 townships and 3 cities). When the Landfill was being developed, the County agreed to provide funding to upgrade County Road NP (leading from Co Rd 480 to the Landfill) and to upgrade the bridge on County Road NP. There was a written agreement that the County's only responsibility and liability was for the County Road NP upgrades and the agreement expressly states:

- the road upgrades are the County's only obligation - the County is not a user of the Landfill - the County does not pledge its full faith and credit - the County is not responsible for any system costs, or any other costs other than the road upgrades

The County fulfilled all of its obligations in the late 19801s and under the agreement the County no longer has any obligations or liabilities of any kind.

Consequently from the beginning of the Landfill in the late l 980's, tmtil about two years ago, the County was not recognized as a constituent municipality by the Authority, the County Plan, or any filings with the State of Michigan. At that time, the Authority was addressing ambiguities and inconsistencies within the Intergovernmental Agreement and other plan documents and discovered that the County Board Chai1verson in 1988 (Timothy Lowe) appeared to have been a signatory to the Intergovernmental Agreement. To address this inconsistency, the Authority asked the County if they wished to be a Constituent Municipality and they ans\verecl in the negative. The Authority proceeded to remove the County from being a Constituent Municipality. Some of the Constituent Municipalities requested that the County be re-instated as a Constituent Municipality. The County indicated that it does not matter if they are re-instated as a Constituent Municipality, as long as they have no obligations, responsibilities, or liabilities, as was the case under the agreement to fund the road upgrades. In order to allow the County to become a Constituent Municipality (with no obligations, responsibilities, or liabilities) it requires unanimous resolutions from all of the 22 current Constituent Municipalities (19 townships and 3 cities).

As a secondary matter, there is also an inconsistency with the statute as to whether the other Constituent Municipalities were properly admitted into the Authority. The statute states:

Any municipality which did not join in the incorporation of an authority may become a constituent paii thereof by amendment to the articles of incorporation adopted by the legislative body of such municipality and by the legislative body of each municipality of which such authority is composed. Any such amendment shall be indorsed, published, and certified printed copies filed, in the same manner as the original articles of incorporation, except that the printed copies shall be certified and filed by the recording secretary of the authority. MCL 124.286 (Public Act 233 of 1955).

[T]he articles of incmvoration shall be published at least once in a newspaper designated in the articles and having general circulation within the teITitory encompassed by the authority. One printed copy of the articles of incorporation certified as a true copy by the person or persons designated for the certification, with the date and place of the publication, shall be filed with the secretary of state and the clerk of the county within which the territory or the major portion of the territory is located. . MCL 124.282 (Public Act 233 of 1955).

Marquette City and Sands Township are the original incorporators of the Marquette County Solid Waste Management Authority. There is no documentation that an amendment to the articles of incorporation was properly executed, in accordance with the statute. An Interlocal agreement (in our case the Intergovernmental Agreement) does not supersede or displace the statutory requirements.

Therefore, please consider ratification of the following proposed amendment to the Authority's Articles of Incorporation:

The Authority was never informed that there was going to be any discussion and/or action by the Marquette County Board regarding this issue, nor was there any MSCWMA issue listed on the County Meeting Agenda. If the Authority was aware of this, we would have been represented at the meeting.

Per the written request from the County of Marquette, and upon receiving a copy of the Draft minutes, on (03/20/2017) The Authority is proceeding with the required amendment to allow the County of Marquette to become a Constituent Municipality.

Article II; INCORPATING MUNICIPALITIES: Section 2.

Only "municipalities" as defined in Section 1 (d) of Act 233, and located in Marquette County, shall be eligible to be members of the Authority (hereinafter identified as "Constituent Municipalities") .The admission o:: new Constituent Municipalities shall be effected by amendment to the Articles adopted by the legislative bodies of each existing and new Constituent Municipality. In recognition of the action of the Marquette County Board of Commissioners on March 07 1 2017 and receiving, by email, the written request including a copy of the meetings draft minutes from County Administrator, Mr. Scott Erbisch, where said Board voted to be a constituent municipality of the Marquette County Solid Waste Management Authority, under the same terms and conditions as they were a constituent municipality in the past, which are as follows:

Additionally, the Treasurer requested the Township determine if the Land Bank Authority should acquire the properties for the purpose of demolition.

After holding interviews for the sergeant position within the police department on April 24, 2017, the interview committee unanimously recommended, and I concur, that Anthony Carrick is promoted to that position.

As it is the responsibility of the Township Board to determine the final salary for a job position at the time of promotion, I recommend that effective 05/01/2017, and in accordance with the township’s personnel policy, that Anthony be elevated to pay grade 4, step 3 of Appendix L, Chocolay Township Pay Grid, with an annual salary of $51,176. This would be an increase of $2,437 annually over his present salary.

Public Comment

Francis Ward, owner of 6448 US 41 South – he has a potential buyer for the property, and they would like to put in a daycare center. Frank pointed out that the permitted principle uses for Commercial property which are listed in the Zoning Ordinance. He feels a daycare center would have substantially less traffic that the permitted uses, so he does not understand why daycare center would not be listed in the permitted uses. Page 1 of 4

Staff Introduction Throenle indicated the reason that the only reason Mr. Ward is listed on the application is that he is the property owner, and there has not been a sale as of yet. The property in question is the old Root 41 restaurant, and the property has been vacant for several months. The property is being sold, along with the property behind it. The daycare will be contained in the existing structure, with the only addition being a fenced in area in the same location. There is more than adequate parking to support a daycare. Notice had been sent to surrounding landowners, and no comments have been received. The daycare would run Monday through Friday, 6:00 AM to 6:00 PM. The noise factor would be minimal.

Commissioner Discussion White asked who the potential owners of the daycare are. Throenle indicated they were in the audience – David and Sue Ridolphi. White asked about the licensing for the daycare. Sue indicated that they have already met with licensing and the Fire Marshall, and a business plan is in place. Sue is a teacher and will be there until school starts, at which time she already has a Director and Lead Caregiver hired. David is a contractor, and will be the one that will be doing the modifications inside. Milton asked what the daycare capacity would be. Sue indicated that it could go as high as 60 – 75 children, but this would depend on the age of the children. They will also be providing latchkey services, if needed, for both morning and afternoon. Mahaney asked about an outdoor play area. Sue indicated this will be enclosed in the back – at this point there is nothing commercialized planned. They would like to have a little race track in back to ride three wheelers, a couple of swings, and a few “diggers”. Sue indicated that anything permanent has to be installed by a professional and inspected by a professional – at this point, they are just planning on keeping it natural. David indicated this will be a 75’ x 75’ area (approximately). Meister indicated he felt it was pretty straight forward – a daycare meets the general characteristics of the permitted uses in that district. Mr. Ward asked for an explanation of a “Conditional Use” permit. Throenle stated it applies to uses that are outside the permitted uses, and based on that the Planning Commission needs to approve the use of the property, along with any “conditions” they would place on the permit. Throenle indicated that the Conditional Use permit goes along with the property. Ward asked about any additions that may be put on the property – would there be a need to come back to the Planning Commission for those. Throenle indicated that they would still need to come back to the Planning Commission for a Site Plan Review. David indicated that there is a modification he would like to make right away – there are two furnaces in the back, and he would like to add a storage area to the back of the building and move the mechanical equipment into that area – 16’ x 40’. This would be storage for the outside equipment. White indicated he would still need to Page 2 of 4

get a permit from the County. Mahaney stated it seemed like a good reuse of the building. White agreed it would be a good asset to the area. Meister moved, Kangas seconded, that after public comment and staff review and analysis in consideration of Conditional Use application CU 17 01, and the understanding that the proposed use is compliant with all terms of “Section 16.2, Conditional Use Permits Basis of Determination and General Standards” and the intent of the Zoning Ordinance, the Planning Commission approved Conditional Use Permit 17 01, with the addition of allowing an addition of up to 16’ x 40’ on the west end of the building.

B. Planning Commission Priorities Throenle indicated this is just a matter of taking what was given by the Township Board, and incorporating them in the Planning Commission Priorities for 2017 – 2018. Throenle indicated that based on the Board’s recommendations, Priority 1 should include the Asset Management Plan, Mixed-Used Corridor, Short Term Rentals, and Zoning Ordinance review and where the conflicts exist (with possible review of two ordinances per meeting). Meister asked about the four-season transit facility. Throenle indicated that this was something that the former Planning Director (Kelly Drake Woodward) had seen as a need for the Township. Mahaney also stated this was one of the comments that was seen as a priority in the Master Plan. It was agreed that this should stay on the list. Meister indicated that the issue with this was that there was no money to build it – may need to look at grant money that is available. Mahaney feels that this is needed in the Township. Steve Lawry (Township Manager) addressed the issue of grant money. There had been grant money available in approximately 2010. Lawry and Planning Director Jennifer Thum met with Al-Tran, Marq-Tran and the director of MDOT. Marq-Tran did have a grant for bus-stops that they were not using. MDOT urged them to spend on this or return to MDOT. Marq-Tran did not choose to do this, so the grant money expired and went back to MDOT. Lawry stated that at the time, based on the ridership, Chocolay Township was not considered a priority. He felt that this would be the case until such time that the Board membership changes. We could go ahead and apply for grant money without involving MarqTran, but we would still need to involve them as the service provider, so it is best to try to involve them at the beginning. It was suggested that this be dropped to Priority 2. A better way to approach is to get the right people on the Authority Board to support this idea. Milton asked if the four-seasons would need water and sewer. Lawry indicated it would. Throenle asked that since there were no Priority 3 items, could Priority 4 be moved Page 3 of 4

to Priority 3. Kangas indicated that on the Priority 1 list, we are showing the Asset Management Plan for roadways. He asked that the sewer system and possible water system be included in this item. 3. Operations Report for February 2017

a. Permit compliance: The plant is in full compliance. b. Land Applications/Solids Disposal: Done for the year. c. Digester Update: All feed is now going to digester 1. Digester 2 is now turned off and is slowly being pumped down. Digester 3 is being heated and working well. d. Process Control: Neil stated that the plant is operating very well. Side streams have been impacting the bio~p. The RAS pump is now rebuilt and back in service. The new pump is installed in the vactor pad wet well. e. Storm: The plant experienced a three-hour power outage during the wind storm. No major issues occurred from the power outage. f. Biosolids: The Biosolids storage is filling up fast. g. Digester Gas Piping Failure: Curt spoke with Donohue and they will provide technical drawings and technical specifications for replacement of the internal piping in Digester 2. The drawings and specifications will be suitable for Curt/Mark to receive quotes from local mechanical contractors to complete the work.

1. Review Minutes from January Meeting

2. Agency Update a. Negaunee Township i. The Wellhead Protection committee will be placing signs on US-41 and CR 492. Signs on US-41 must be placed outside of the right of way as is outlined in the guide. ii. The Township is also conducting a road study. b. Marquette Township i. The DDA will be meeting to discuss enhancement items that could be added to the 2019 and 2021 MDOT projects. That may include Brickyard Road and Commerce Street intersection lighting improvements. ii. The Township will be completing the final 6 miles of road improvements this summer. c. Marquette County – i. The County is working on a complete overhaul of the County master plan. The planning department will be meeting with municipality to identify top issues beginning sometime in April. d. MDOT/Permits i. Alger Delta will be upgrading utility poles on M-28 in vicinity of Casino. ii. Fraco will be submitting a new site plan for the showroom, they are looking to send water down the ROW. e. Chocolay Township i. The Casino developments are still pending rezoning of the property where the motel will be located. Steve will bring up the turn lane recommendations at a design meeting with the Tribe in March. ii. Dark Signals – a power outage on February 12 resulted in the US-41/M-28 signal being out. Chocolay Township police ended up directing traffic for 5 hours. Steve would like to see if there is any way to get a backup power source for the signal. Action Item: Joel will explore options for backup power at the signal.

iii. M-28 Passing on Right- Steve asked again for signs to be placed on M-28 to inform motorist that there is no passing on the right. They have been getting complaints at the Township Board meetings from residents. 3. Construction Update i. Speed Limit Increases – MDOT and MSP are reviewing sections of road for potential speed increases. In the first year the State is looking to increase the speed on 900 miles of roadway. ii. M-94 Chocolay River Bridge project will begin work in March. The contractor is Zenith Tech. iii. 2017 US-41 Negaunee reconstruct. With this project a left turn phase will be added to the Teal Lake Avenue signal. City of Negaunee is also adding some watermain work to the project. MDOT will also work to close some of the access drives on US-41 in the City of Negaunee with this project. iv. 2017 Carpool Lot – US-41 Negaunee west of Teal Lake Avenue. v. 2017 M-553 (Glasses Curve) Realignment – utility relocation work has already started. This project will bid in January and Lindbergs is the contractor. vi. Future Projects – 1. 2018 Traffic Signal Upgrades 2. 2019 Marquette Township Boulevard Construction 3. 2021 US-41 resurfacing in Marquette City & Township 4. Site Plan Review- John Deere - Negaunee Township – The new John Deere Dealer is located in the old KAMAN building in Negaunee Township. The building will serve as a dealer and service location for John Deere, with a proposed addition on the rear of the building to accommodate a service facility. The group reviewed the site plan and made the following recommendations: 1. Close the western dirt drive into the building. 2. Owner needs to submit a change of use permit for the building. 3. Plant salt tolerant grasses in first ten feet of ROW.

Meeting Minutes March 14, 2017 – Annual Law Enforcement Meeting

Bidding has not taken place to date. Staging to be similar to 2016 Ishpeming Roundabout project. Median will be grass. M-94 Bridge Placement. Washed out culverts will not be replaced with culverts. A new bridge will be constructed. o US-41 through Negaunee milling, paving with curb replacements. New lighting being placed. o Carpool lot proposed along Water Street. No direct access to US-41. o 2018-2021 Construction Information o 2018 Signal at Grove and M-553 o 2018 Pedestrian signal at US-41 and M-553 o 2019 US-41 Boulevard Construction (Wal-Mart to Brickyard Road). Roundabouts planned at US-41/HQ and US-41/Brickyard. o 2021 US-41 from Wright Street through Front Street- Resurfacing and some curb replacements.

Open Forum

o Marquette County Sheriff o Any plans for US-41 at Lakeshore Drive in Ishpeming? o Left Turn phase being added as well as Dilemma Zone Detection. o Attempt to acquire funding for roundabout unsuccessful. The Carp River Bridge modifications make this an expensive project. o Jubilee parking lot being used as a through route to access Lakeshore Drive.

o Chocolay Township Police o Scott inquired about the possibility of a Roundabout at US-41/M28 Intersection. There are no plans for a roundabout at this location. This was looked at prior to the last reconstruct at that intersection. A signalized intersection was recommended as it was working well. Also, it is not on the high crash list.

o Another power outage in Chocolay Township presented an issue with the US-41/M- 28 signal. Can we do anything to the intersection to make it safer in a power outage? o MDOT doesn’t have many signals statewide with backup power. A few Freeway Diverging Diamonds in the LP have them. o Joel obtained prices. The signal does have the capability to add backup power. o MDOT will likely not fund. o May be possible if funded by Chocolay Township. o Peter Van Steen suggested applying for a Hazard Mitigation Grant. The project would first have to be listed in the counties Hazard Mitigation Plan. May have a better chance of getting a Grant if others in the county were included. o Don Larson made a point that it’s not obvious at this intersection as to who has the right of way as they are both major highways.

o No Passing on Shoulder signs for M-28 again requested. MDOT has determined they will not be placed. A Public Service Announcement was done by MSP officer Stacy Rasanen to help make the public aware of this law.

o Requested update on Speed Limit increases. o 900 non-freeway miles statewide will increase from 55 MPH to 65 MPH. o Currently in the process of selecting areas. MSP will decide if these areas meet the 85th Percentile rule. Areas are to be finalized by November of 2017. o Certain segments may be increased by Memorial Day. o Will encompass corridors as opposed to small sections. o Truck speeds increasing on Freeway routes.

o Negaunee Township o Nick asked if there were resources available to address access spacing due to increased speed limits. o Design Standards will evolve and correction will be made as new projects are designed. o John Deere show room opened near Guindon Moving and Storage. No improvements planned for existing approach. Will remove west gravel driveway. o Nick will ask RG Design to contact MDOT to acquire permit.

o Ishpeming Township o Mark Sloan asked about construction mandates regarding maintenance strips. There are no mandates at this time. Mark is in favor of the maintenance strips.

o MDOT o Local agencies and law enforcement are encouraged to comment if they feel design standards of any kind can be improved.

o The left turn signal to north at US-41 and CR HQ will always get the call to change. It is no longer activated by vehicles in the turn lane. Although it will remain green for a longer period of time if there are more vehicles turning.

MARQUETTE COUNTY TOWNSHIP ASSOCIATION MINUTES: MARCH 22, 2017

The meeting was called to order at 7:00 p.m. at the Negaunee Township Hall by President Nankervis. The Pledge of Allegiance was said. Twelve townships were represented.

Roll Call: Nankervis, Engle, Manninen and Johnson were present. Thornton and LaRue were absent.

Motion Johnson, second Engle to approve the agenda as presented. Motion carried.

Motion Johnson, second Walch to approve the minutes of the February 22, 2017 meeting. Motion carried.

Motion Engle, second Johnson to approve the Treasurer's Report. Motion carried.

Committee Report: Central Dispatch has finished their updates.

Public Comment: Darlene Walch stated that the Marquette County Commissioners had voted to re-instate Marquette County as a constituent municipality of the Marquette County Solid Waste Management Authority. She also encouraged all townships to attend the next meeting of the MCSWMA on April 19, 2017 at 4:00 p.m.

Old Business: 1. There are 16 people signed up to ride the bus to Lansing for the MTA Convention. 2. There didn't seem to be enough interest in having a banquet on a Saturday night so that plan has been cancelled.
