Probation Into the Millennium: the Changing Features of Community Justice PROBATION INTO THE MILLENNIUM: THE CHANGING FEATURES OF COMMUNITY JUSTICE A thesis submitted to Middlesex University in partial fulfilment of the requirementsfor the degreeof Doctor of Philosophy Anthony Harvey Goodman School of Social Science Middlesex University September2000 ABSTRACT This thesis briefly examines the changing nature of punishment in England and the origins of the probation service. From its religious roots probation became a professional organisation, probation and social work shared the same qualification. The 1960's was the golden age of the treatment ideal, casework techniqueswere employed to work with offenders on their problems, which were seenas being located in their life experience. The service expandedtaking responsibility for prison welfare and offering support to prisonerson discharge. Optimism in the ability to reduce reoffending waned in the 1970's, although probation officers had almost total autonomy. Seniors offered supervision and carried small caseloads themselves. In 1984 the Home Office set priorities for the service and with the threat of `cash limiting' made it clear that management had to co-operate. Reports from the Audit Commission and the National Audit Office continued the drive for stronger management as well questioning the relevance of social work. The Criminal Justice Act 1991 introduced the notion of `just deserts'. My interviews with informants highlight thesetensions and pressures.The 1992 and 1995 versions of National Standardsfor the supervision of offenders changedthe nature of probation to one of administering punishmentand this is consideredin depth. The service has becomestratified, with low morale as officers adjust to a risk focused, more punitive and highly regulated organisation. Notions of actuarialjustice, casemanagement replacing individual casework, and the use of set unchangeableprogrammes with offendersare evaluated.Links with social work endedin 1995 and the changeof governmenthas not affected moves to turn probation into a correctional agency. Probation remains a political issue and its future is located within contemporary thought on the changingnature of community control, particularly of minority groups where probation historically held a commitment to anti-discriminatory practice. The reflection of the informants is that the old ethos of `advise, assist and befriend' is evolving into one of `control and monitor'. 2 ACKNOWLEDGEMENTS This thesis is dedicatedto the memories of the late Pearl Goodman and Frank Zadik.     Rights, Responsibilities and Religion in a mid-Victorian convict prison Dr David J. Cox∗ Abstract This article investigates the rights and responsibilities of both a prison governor and a prison chaplain in a Victorian Convict Prison. Major Hickey and Reverend Francis served respectively as Governor and Chaplain of HMP Dartmoor in the early 1870s and developed a mutual feeling of irreconcilable resentment following a clash of personalities and ideas regarding the management and punishment of male convicts in one of the most notorious of all Victorian English convict prisons. It details the causes and repercussions of the ensuing argument that led to Reverend Francis resigning his post and complaining directly to the Director of Convict Prisons about both his treatment and that of the convicts under his spiritual care. The paper relates this personal argument to the wider philosophical debates over late-Victorian penal policies that were becoming known to a larger audience thanks to both the publication of numerous prison enquiry reports and the published autobiographies of a number of erudite and well-educated middle-class convicts which proliferated during the period in question. BACKGROUND Convict prisons were the punishment of choice for those found guilty of serious indictable offences following the gradual ending of transportation to Australia from the early 1850s.
